南方医科大学外国留学生安全责任协议书.doc

南方医科大学外国留学生安全责任协议书为维护外国留学生（以下简称留学生）和甲方的合法权益，提高留学生的安全意识，明确留学生人身伤害事故发生时甲方与留学生双方的责任，由南方医科大学（甲方）与留学生（乙方）签订安全责任协议书。一、 甲方的责任甲方应加强对乙方的安全教育和校园管理工作，维护乙方的人身安全。因下列因素造成乙方人身伤害的，甲方承担相应的责任。 （一）甲方的校舍、场地和其他公共设施，以及甲方提供给乙方使用的学习、教学和生活设施设备不符合中国国家标准，或者有明显不安全因素的；（二）甲方的安全保卫、消防、设施设备等存在安全隐患，而未及时采取措施的；（三）甲方组织乙方参加教学活动或者其他校外活动未对乙方进行相应的安全教育，并在可预见的范围内未采取必要的安全措施的；（四）甲方违反有关规定，组织乙方从事不宜乙方参加的活动的；（五）甲方教师或者其他工作人员在履行职责过程中违反工作要求、操作规范或者其他有关规定的；（六）甲方有未依法履行职责的其他情形的。二、 乙方的责任乙方在校学习期间，受中国法律保护和约束。乙方应当遵守中国的法律和甲方的规章制度，尊重中国和别国的风俗习惯，提高安全和自我保护意识，增强自我防范能力。因下列情况造成伤害的，乙方应承但责任。.（一）违反中国的法律、法令以及甲方的规章制度而引起的法律、经济和人身安全责任的；（二）不假外出或擅自离校的；（三）参加甲方组织的外出考察、实习、游览和参观活动，未按甲方的要求活动或自行安排活动的；（四）参加甲方组织的教学和训练，未按照有关要求操作或违反实验操作规则的；（五）在本国驻华使、领馆住宿的；（六）自己要求在甲方留学生公寓外住宿的；（七）自行从事旅行、游览等活动的；（八）有特异体质或者特殊疾病，未向甲方汇报的；（九）私用电器的；（十）自杀、自伤或其他自身原因造成的；（十一）未经甲方同意，乙方个人或学生社团组织擅自外出活动的；（十二）放假期间甲方要求离校而滞留学校发生的；（十三）自行参加对抗性或者具有风险性的活动发生的。三、其他责任 （一）乙方乘坐交通工具时，安全责任由承运方依据相关保险条例承担；（二）乙方遭受意外伤害时，属保险理赔范围之内的，甲方应当协助乙方进行索赔。属保险理赔范围之外的，甲方应当按照中国有关法律、法令和甲方的有关规定协助其驻华代表机构妥善处理善后事宜；（三）乙方来华陪读的配偶和子女的安全由其本人负责。乙方应当自费为本人和陪读的配偶和子女购买保险（至少购买意外伤害险和医疗保险）；（四）地震、雷击、台风、洪水和其他不可抗力因素造成乙方人身伤害及财产损害，甲方已经履行了相应职责，甲方不承担责任；（五）乙方在校期间，因他人过失或者故意引起人身伤害和财产损害的，由侵害人承担相应责任；（六）乙方因过失或者故意造成他人人身伤害或者财产损害的，由乙方承担相应责任。四、附则 （一）本协议如与中国有关的法律、法规相违背，以中国的法律、法规为准。（二）本协议解释权在南方医科大学国际教育学院。（三）本协议采用中英文版本，两种版本具有同等效力。 （四）本协议一式两份，甲方及乙方各执一份。（五）本协议自签订之日起开始生效。甲方：南方医科大学国际教育学院（盖章） 乙方：学生（签名）Party A: (School of International Education of Southern Medical University) Party B:( full name capitalized )（代表签名） Signature:年 月 日 (date): Appendix 1:Agreement on Security Liabilities between Southern Medical University and its International Students To protect the lawful rights and interests of both parties, namely, the international students (Party B hereafter) and Southern Medical University (Party A hereafter), to enhance students awareness of security, and to confirm the liabilities of both parties in case of accidents that may cause students physical injury, Party A and Party B hereby sign this agreement for security liabilities.1. Liabilities of Party AParty A should lay stress upon safety education and campus management so as to safeguard Party B. In the following circumstances, if anything has caused damages against Party Bs personal security , Party A must bear the relevant liabilities: （1）When the schoolhouses, grounds, living and teaching equipments as well as other public facilities supplied by Party A do not meet national standards or are clearly bound up with risky elements. （2）When hidden dangers exist in security, fire control, equipments and facilities owned and managed by Party A and proper measures are not taken in time.（3）When Party A organizes Party B to attend teaching activities or some other off-campus activities, without relevant safety education and without taking necessary safety measures in the foreseeable scope. （4）When Party A breaches the relevant regulations by organizing Party B to attend the activities that are not suitable for Party B.（5）When in the course of performance, the teachers or other workers of Party A carry out their duties by violating working requirements, operating standards or other relevant regulations.（6）When in some other circumstances that Party A fails to perform its duties in accordance with the law. 2. Liabilities of Party BWhen studying in the University, Party B is protected but restricted by the laws of China. Party B shall abide by the laws of China and the regulations of the University, respect the customs of China and other countries, develop awareness of security and self-protection and strengthen the abilities of self-guard as well. In the following circumstances, Party B should bear liabilities for any injuries incurred.（1）When the legal, economic and personal safety liabilities that are resulted from Party Bs violation of the laws of China and Party As regulations. （2）When Party B leaves the University arbitrarily or without asking for leave. （3）When attending the activities organized by Party A, such as observation, clinical practice, visiting and sight-seeing, Party B does not follow the requirements of Party A or Party B makes an arrangement of the activities by himself or herself.（4）When attending teaching and training activities organized by Party A, Party B does not operate in accordance with the relevant requirements or violates the laboratory operating rules.（5）When Party B resides at his or her countrys embassy or consulate in China. （6）When Party B requests to live outside the international students dormitory. （7）When Party B undertakes the activities like travel and sight-seeing by himself or herself. （8）When Party B has some special physical constitution or suffers from some special disease, but keeps it confidential from Party A. （9）When Party B uses electric appliances in private. （10）When Party B commits suicide or injures himself or herself or when such harms are done by Party B himself or herself. （11）When without permission from Party A, Party B himself or herself as an individual or in group like the students association organizes the outdoor activities arbitrarily.（12）When on vocation, Party A requires his or her leave of the university, but Party B insists a stay on the campus. （13）When Party B engages himself or herself in the adventurous or antagonistic activities. 3Other Liabilities（1）When Party B is on board the transportation vehicles, the carrier shall bear the security liabilities in accordance with relevant insurance ordinances. （2）When accidental injuries happen to Party B and are within the scope of insurance compensation, Party A shall help Party B to claim compensation. If they fall outside the scope of insurance compensation, Party A shall help Party Bs foreign institutions in China to deal properly with the aftermath in accordance with the laws of China and the regulations of Party A.（3）When his or her spouse and children keep his or her company in China, Party B shall be responsible for their safety. Party B shall pay for his or her spouses and childrens insurance at their own expenses. At least the two kinds of insurance for accidents and medical care should be purchased. （4）When Party B is injured physically and suffer a property loss caused by factors of force majeure such as earthquake, lightning strike, typhoon, flood and so on, if Party A has performed its duties, Party A shall not bear the liabilities. （5）When on campus, Party B is endangered with physical injuries and property damages either by fault or on purpose, the trespasser shall bear the relevant liabilities. （6）When Party B has caused physical injuries and property damages ei
