XXXXX有限公司培训协议Agreement on training甲方：XXXX有限公司乙方：Party A:Party B:地址：XXXXXX姓名：性别：Address:Name:Gender电话： 身份证号码：Telephone:Number of ID card:地址： Address:基于乙方愿意接受甲方资助参加专业培训，甲乙双方就培训后乙方履行相应服务期事宜，经协商一致达成如下协议：Based on the fact that Party B intends to accept the funds granted by Party A to attend the professional training, the parties hereby reaches the agreements as follows on Party Bs obligations related to post training service period.1. 甲方同意出资安排乙方赴 上海 参加 EOL 编程软件培训-Labview 视觉 培训，培训期限预计自2014 年 3月 24 日至2014 年 3 月 30 日，具体时间以乙方根据培训计划安排到达培训地之日起至完成培训任务离开培训地止。乙方完全理解并同意，甲方可以适当延长或缩短培训期限，但应及时告知乙方。1. Party A agrees to offer funds to party B to attend the training on EOL 编程软件培训-Labview 视觉_ that will be held in _上海_. According to estimation, the training period will commence on _24_date_3_month_2014_year and end on_30_date_3_month_2014_year. The specific training period shall start from the date on which Party B plans to arrive the destination for training according to schedule and end on the date on which Party B leaves the same place after fulfillment of the task of receiving training. Party B fully understands and agrees that Party A shall have the rights to properly extend or shorten the training period subject to the condition that Party A shall inform Party B of the same intention in a timely manner.2. 乙方同意按照本协议附件 2014年年度 培训计划，完成培训内容并达到培训目标。2. Party B agrees to complete all of the contents designed for this training and achieves training target according to the terms and conditions specified in the appendix of this agreement , which is Plan of Training on _2014_.3甲方同意支付乙方参加培训费用预计人民币贰万三仟捌佰伍拾元整，包括学费和资料费；3. Party A agrees to pay Party B the estimated training expenses, total amount of which is RMB _23,850_Yuan only, includes tuition fee and documents fee.乙方按本协议约定完成培训或因其他情形结束培训时，均应按甲方指定的时间和方式结算培训费用。Where Party B completes this training according to the terms specified in this agreement or terminates the same under other circumstances, Party B shall settle the training expenses with Party A within the time period and according to the procedures specified by Party A.4培训期间，乙方原享受的标准工资待遇维持不变。4. During the training period, Party B shall have the rights to enjoy the same standard salary as usual.5培训期间，乙方应每月向甲方提交一份培训情况小结，同时，甲方可以指定专人或部门对乙方接受培训的情况和表现进行必要的指导和监督。5. During the training period, Party B shall submit a brief summary to Party A on the training status by each month. At the same time, Party A shall have the rights to designate a specific personnel or department to conduct necessary supervision and monitoring on the status and performance of Party Bs receipt of training.6培训期间，发生下列情形之一的，甲方可以中止、延长培训期限或变更培训内容，并对乙方作出相应安排：6. During the training period, Party A shall have the rights to terminate, extend the training period or change the content of training and make related arrangement for Party B subjectTo any of the following circumstances:a）甲、乙双方协商一致；a) Both parties hereto reach agreements based on consultancy.b）培训公司/机构/场所由于不可抗力的影响不能按原计划实施培训；b) Due to force majeure, the training company / institution / site fails to implement training according to original schedule.c）甲方业务状况发生变化或经费上的原因无法继续履行培训计划；c) Due to the change of business situation or financial conditions, Party A fails to continue obligation to fulfill the plan of training.d）乙方在培训期间因生病、负伤或其他原因而致不能或不宜继续接受培训；d) During training period, Party B fails to or become ineligible to continue training due to illness, injury or other reasons.e）由于培训公司/机构/场所的其他原因；e) Because of other reasons caused by the training company / institution / site.f）由于国家法律和政策上的原因。f) Because of the reasons related to government laws or policies.乙方无论因何种理由需中止、延长培训期限或变更培训内容，应提前30天向甲方提出书面申请。未向甲方申请或未经甲方批准而擅自变更培训时间、内容或未能完成培训或不能达到培训目标的，甲方有权要求乙方全额赔偿甲方已支出的培训费用及甲方因此而遭受的其它实际损失。Party B shall give Party A 30 days advance written notice of intention to terminate, extend the training period or change the content of the training subject to all of the conditions. Where Party B change the training time, content of training without Party As approval, fails to fulfill the obligation of receipt of training or achieve the training target, Party A shall have the rights to request Party B to compensate for all of the training expenses paid by Party A and any other actual losses of Party A resulting there from. 7乙方保证其在培训期间，严格遵守国家和培训所在地的法律、法规及培训公司/机构的规章制度，并进一步承诺，由于其本人有故意不当行为或重大过失而发生法律上请求、诉讼、政府调查等，乙方应避免甲方和培训机构遭受损失并免除其相应的责任，若造成甲方及培训机构损失的，由乙方承担赔偿责任。7. During training period, Party B shall ensure strict observance of the local laws and regulations of the training place and the rules and regulations of the training company/ institution, and shall make further commitment that Party B shall avoid to cause any loss to Party A and the training institution and shall exempt the same from the corresponding legal responsibilities result from appeal, litigation and government investigation caused by Party Bs malfeasance or gross negligence. Where Party B causes any loss to Party A and the training institution, Party B shall bear the compensation responsibility.8乙方同意，在完成培训后须根据本协议第二条的规定向甲方递交一份书面培训总结（及相关研究成果、学术论文或报告），并在培训期满后返回甲方报到并按甲方规定办理有关手续。8. Party B agrees to submit to Party A a written summarization of the training according to terms specified in article two of this agreement after Party B complete the training(and relevant research result, academic theses or report), and shall return to Party A to report for duty from and since the date on which Party Bs training period expires.9.乙方承诺，完成或结束培训后按甲方规定的日期返回甲方工作，并应在甲方至少服务 贰 年（自返回甲方报到之日起计算，该期限简称“服务期”）。同时进一步同意，本协议签订时，乙方若正在履行其他协议约定的服务期，且培训结束回甲方工作时仍在继续履行的，本协议规定的服务期履行起始日将延迟至正在履行的服务期限届满时起生效。9. Party B promises that Party B shall return to work for Party A on the date specified by Party A after Party B complete or terminate the training, and the service period of Party B shall be no less than _2_years (the period shall be calculated from the date on which Party B report for duty; this will be called Service Period). At the same time Party B further agrees that where Party B is in the middle of the service period prescribed by other agreements when signing this agreement and is obliged to continue the same after termination of this training period and returning to work for Party A , the start date of the service period specified by this agreement shall be extended to the date on which current service period expires.10本协议约定的服务期限若超过甲、乙双方签订的劳动合同期限，当劳动合同履行期满时，甲方若要求乙方续签劳动合同期限不超过服务期限，或者等同与服务期限的，乙方应当续签；但甲方不提出续签劳动合同的，本协议即行终止，乙方无须继续履行本协议约定的义务。10. Where the service period agreed herein exceeds the labor contract period signed between Party A and Party B; Party A shall have the rights to request Party B to renew the labor contract subject to the condition that the renewed labor contract shall not exceed the service period and Party B shall meet Party As request; However, this agreement expires when Party A has no intention to renew the labor contract and Party B has no obligation to continue this agreement.11甲方履行了本协议约定的出资义务，乙方有下列情形之一的，应承担违约赔责任：11. Where Party A fulfills the duty of contribution specified in this agreement, Party B shall be liable to the compensation caused by breach of this agreement subject to any of the following conditions: a）本协议生效后，擅自中止或不配合甲方办理培训手续，或因过失被停止办理培训手续的；a) When this agreement comes into force, Party B terminates the agreement without Party As approval or is unwilling to cooperate Party A to handle the procedures of training, or be forced to cease the training procedures due to negligence.b）本人原因不完成培训或在培训期间违反培训纪律被终止培训的；b) Party B fails to fulfill the training due to Party Bs own account or being forced to terminate this training result from breach of training disciplines.c）培训期间未经甲方同意，擅自离开培训机构的；c) Party B leaves training institution during training period without Party As approval.d）培训期间辞职或过失被甲方解除劳动合同的；d) Party B resigns during training period or Party B is forced to terminate the contract by Party A due to Party Bs negligence.e）培训期满后，不按时离开培训地返回甲方，或未按甲方规定的日期上班的；e) Party B fails to leave the place of training and return to Party A in a timely manner; orfails to register for duty on the date specified by Party A after training period expires. f）在服务期限内辞职或过失被甲方解除劳动合同的；f) Party B resigns during service period or Party B is forced to terminate the labor contract by Party A due to Party Bs negligence.g）在服务期限内故意不完成或不按要求完成甲方安排的工作任务，或者因患一般疾病累计或连续请病休假超过医疗期被解除劳动合同，或者不服从合理的工作安排被解除劳动合同的；g) During the service period, Party B is forced to terminate the contract due to the fact that Party B intentionally fails to complete the tasks assigned by Party A or fails to complete the same according to Party As requirement, Party Bs accumulative or successive sick leave days exceed the medical treatment period due to normal disease, or Party B is not willing to observe the reasonable tasks assigned by Party A. h）在服务期限内，原劳动合同履行完毕，甲方提出按不低于原条件待遇续签劳动合同，乙方不同意的。h) During the service period, Party A requests to renew the labor contract with Party B subject to the condition that the treatment of Party B specified in the renewed contract will not be less than that in the original one after expiration of the original labor contract and Party B does not agree.12乙方有本协议第十一条所列情形之一的，甲方有权要求乙方按以下标准向甲方支付违约金：12. Where Party Bs activity conforms to any of the items specified in article 11, Party A is entitled to claim the penalty from Party B according to the standard specified as follows: 违约金=培训费用 - 培训费用应履行服务期实际已履行服务期Penalty = training expense training expense due service period x actual fulfilled service period 其中：服务期以工作日核计。Remark: Service period will be calculated according to working days.13乙方完全理解本协议内容及其本人应承担的义务，并同意接受和履行。本协议经甲、乙双方签署后即生效。本协议生效后，与劳动合同同具法律效力，但本协议约定内容若与劳动合同内容不一致的，以本协议约定内容为准。13. Party B fully understands the contents specified in this agreement and the obligations which shall be fulfilled by Party B, and Party B agrees to accept and fulfill the same.
