2025标准办公室装修合同范本OfficeDecorationContractContractNo.:ThisContractforOfficeDecorationisenteredintoon(the"ContractDate")byandbetweenthefollowingtwoparties(collectivelyreferredtoasthe"Parties"):PartyA:TheEmployerName:Address:ContactPerson:Position:PartyB:TheContractorName:Address:ContactPerson:Position:ThePartiesagreeasfollows:1.GeneralProvisions1.1InterpretationInthisContract,thetermsdefinedinthesingularshallincludethepluralandviceversawherethecontextsorequires.TermsnotdefinedhereinshallhavethemeaningsasgivenbytherelevantlawsandregulationsofthePeople'sRepublicofChina.1.2ScopeofApplicationThisContractshallgovernthedecorationoftheofficespacelocatedat(the"ProjectSite")forthepurposeofofficeuse.Thespecificscopeofworkisdetailedintheattached"DecorationWorkDescription"(Attachment1).1.3LawGoverningtheContractThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina,includingbutnotlimitedtothe"ConstructionLawofthePeople'sRepublicofChina,"the"ContractLawofthePeople'sRepublicofChina,"andthe"RegulationsontheAdministrationofUrbanandRuralConstructionEngineering."2.ProjectDescription2.1ProjectOverviewTheprojectinvolvesthedecorationofanofficespacewithanareaofsquaremeterslocatedat,includingbutnotlimitedtodemolition,renovation,flooring,partitioning,electricalwork,plumbing,andpainting.2.2ProjectScheduleThedecorationworkshallcommenceonandbecompletedby,withinatotal工期ofdays.Theexactcommencementdatemaybeadjustedbymutualagreementinwriting.3.PriceandPayment3.1ContractPriceThetotalcontractpriceforthedecorationworkis（RMB）,whichincludesalllabor,materials,andmanagementfeesrequiredtocompletetheprojectinaccordancewiththeagreedscopeandstandards.3.2PaymentScheduleThepaymentshallbemadeinthefollowinginstallments:a.%ofthecontractprice,amountingtoRMB,uponcommencementofthework.b.%ofthecontractprice,amountingtoRMB,uponcompletionoftheelectricalandplumbingworks.c.Theremaining%ofthecontractprice,amountingtoRMB,uponfinalacceptanceoftheproject.3.3AdvancePaymentAnadvancepaymentof%ofthecontractprice,amountingtoRMB,shallbepaidbyforthepurchaseofmaterialsandsupplies.Thisamountshallberecoveredfromthefinalpaymentuponcompletionoftheproject.3.4RetentionDepositAretentiondepositof%ofthecontractprice,amountingtoRMB,shallbedeductedfromthefinalpaymenttoensurethequalityandintegrityofthework.Theretentiondepositshallbereleasedwithindaysaftertheexpirationofthewarrantyperiod.4.MaterialsandEquipment4.1MaterialsSuppliedbytheContractorTheContractorshallprovideallmaterialsrequiredforthedecorationwork,includingbutnotlimitedtopaint,flooring,tiles,partitions,electricalfixtures,andplumbingfixtures.ThequalityofthematerialsshallcomplywiththerelevantnationalstandardsandshallbeinspectedandapprovedbytheEmployerpriortouse.4.2MaterialsSuppliedbytheEmployerTheEmployershallprovideanymaterialsorequipmentspecificallyrequiredfortheprojectasagreedinthecontract.TheEmployershallensurethetimelydeliveryofsuchmaterialstotheProjectSite.4.3WarrantyofMaterialsTheContractorshallprovideawarrantyforthematerialssuppliedbyit,coveringdefectsarisingfrommanufacturingdefectsorimproperstorage,foraperiodofyearsfromthedateofacceptanceoftheproject.5.RightsandResponsibilities5.1ResponsibilitiesoftheEmployera.TheEmployershallprovidetheContractorwithnecessaryaccesstotheProjectSiteandensurethatallnecessaryapprovalsandpermitsareobtainedbeforethecommencementofwork.b.TheEmployershalltimelyreviewandapprovealldesigndrawingsandconstructionplanssubmittedbytheContractor.c.TheEmployershallpaythecontractpriceinaccordancewiththeagreedschedule.5.2ResponsibilitiesoftheContractora.TheContractorshallstrictlycomplywiththerelevantlaws,regulations,andsafetystandardsduringtheconstructionprocess.b.TheContractorshallensurethequalityoftheworkbyusingqualifiedmaterialsandemployingskilledworkers.c.TheContractorshallcompletetheworkinaccordancewiththeagreedscheduleandnotifytheEmployerofanyanticipateddelays.5.3LiabilityforDamagesAnydamagecausedtotheProjectSiteorthird-partypropertyduringtheconstructionprocessshallbebornebytheContractor.6.InspectionandAcceptance6.1IntermediateInspectionTheContractorshallnotifytheEmployerofthecompletionofeachmajorphaseofwork(e.g.,demolition,electrical,plumbing,painting),andtheEmployershallconductaninspectionwithindays.AnydefectsfoundshallberectifiedbytheContractoratnoadditionalcost.6.2FinalAcceptanceTheContractorshallissueanoticeofcompletiondayspriortothescheduledcompletiondate.TheEmployershallinspectandaccepttheworkwithindaysafterreceivingthenotice.6.3DefectsandRepairsAnydefectsfoundduringtheinspectionshallberepairedbytheContractorfreeofchargewithindaysaftertheEmployer'snotification.7.Warranty7.1WarrantyPeriodTheContractorshallprovideawarrantyforthecompletedworkforaperiodofyearsfromthedateoffinalacceptance.Thewarrantyshallcoveranydefectsarisingfrom施工defectsormaterials.7.2ExclusionsfromWarrantyThewarrantyshallnotapplytodefectscausedbyimproperuse,modification,ornaturalwearandtearbytheEmployeroritsemployees.8.QualityAssurance8.1InspectionandTestingTheContractorshallconductregularinspectionsandtestsduringtheconstructionprocesstoensurecompliancewiththeagreedstandards.AllinspectionreportsshallbesubmittedtotheEmployerforreview.8.2RectificationofDefectsIfanydefectsarefoundduringtheinspection,theContractorshallpromptlyrectifythematnoadditionalcost.9.LiabilityforBreachofContract9.1LiquidatedDamagesIncaseofabreachofcontract,thePartyindefaultshallpayliquidateddamagestotheotherParty.Theamountofliquidateddamagesshallbe%ofthecontractpriceforeachdayofdelay,uptoamaximumofRMB.9.2TerminationofContractIftheContractorfailstocompletetheworkwithintheagreedschedulebymorethandays,theEmployershallhavetherighttoterminatethecontractandclaimcompensationforlosses.10.ChangeOrders10.1ModificationoftheWorkAnychangestothescopeofworkordesignshallberequestedinwritingbyeitherPartywiththeconsentoftheother.Thecostandscheduleimpactsofsuchchangesshallbeagreeduponinwriting.10.2AdditionalWorkAnyadditionalworkrequestedbytheEmployerduringtheconstructionprocessshallbesubjecttoasupplementaryagreementandadditionalpayment.11.DisputeResolution11.1NegotiationIntheeventofadispute,thePartiesshallfirstattempttoresolvethematterthroughfriendlynegotiations.11.2LitigationIfnegotiationsfail,eitherPartymayinitiatelegalproceedingsinthe人民法院(People'sCourt)inaccordancewiththerelevantlaws.12.TerminationofContract12.1TerminationbyMutualConsentThisContractmaybeterminatedbymutualconsentinwritingatanytime.12.2TerminationbytheEmployerTheEmployermayterminatethisContractwithoutcausebygivingdays'writtennotice,providedthattheContractoriscompensatedforanylossesincurred.12.3TerminationbytheContractorTheContractormayterminatethisContractonlyiftheEmployerfailstofulfillitsobligationsunderthisContract.13.MiscellaneousProvisions13.1ForceMajeureNeitherPartyshallbeliableforanyfailuretoperformitsobligationsunderthisContractduetoforcemajeure.TheaffectedPartyshallpromptlynotifytheotherPartyoftheoccurrenceofforcemajeureandmakereasonableeffortstomitigateitseffects.13.2AssignmentofContractNoPartyshallassignthisContractoranyofitsrightsorobligationswithoutthepriorwrittenconsentoftheotherParty.13.3EntireAgreementThisContractconstitutes
