房屋租赁合同(中英双文规范版)ResidentialLeaseAgreement(StandardChinese-EnglishVersion)出租方(甲方):Landlord(PartyA):姓名/公司名称:Name/CompanyName:地址:Address:联系方式:ContactInformation:承租方(乙方):Tenant(PartyB):姓名/公司名称:Name/CompanyName:地址:Address:联系方式:ContactInformation:第一条租赁房屋描述Clause1:DescriptionoftheLeasedPremises甲方同意将位于________(详细地址)的房屋(以下简称"该房屋")出租给乙方使用。该房屋建筑面积为______平方米,户型为______室______厅______卫。PartyAherebyagreestoleasetoPartyBthepremiseslocatedat________(fulladdress),hereinafterreferredtoas"thePremises".ThePremiseshasaconstructionareaof______squaremetersandconsistsof______bedrooms,______livingrooms,and______bathrooms.第二条租赁期限Clause2:LeaseTerm本合同租赁期限自______年____月____日起至______年____月____日止,共计____个月。租赁期限届满前,乙方如有意续租,应提前______天书面通知甲方,双方另行协商续租事宜并签订新的租赁合同。TheleasetermofthisAgreementshallcommenceon______andendon______,totaling______months.IfPartyBintendstorenewtheleaseuponexpiration,itshallnotifyPartyAinwritingatleast______dayspriortotheexpirationdate.Thetwopartiesshallnegotiatethetermsofrenewalandexecuteanewleaseagreement.第三条租金及支付方式Clause3:RentandPaymentMethod该房屋每月租金为人民币______元(大写:____________________)。ThemonthlyrentforthePremisesshallbeRMB______(inwords:____________________).租金支付方式为:按______(月/季/半年)支付。乙方应在每个支付周期开始前______天内,将租金支付至甲方指定的银行账户。甲方银行账户信息如下:Therentshallbepaidona______(monthly/quarterly/semi-annual)basis.PartyBshallpaytherenttoPartyA'sdesignatedbankaccount______dayspriortothestartofeachpaymentperiod.ThebankaccountdetailsofPartyAareasfollows:开户银行:____________________BankName:____________________账户名称:____________________AccountHolder:____________________账号:____________________AccountNumber:____________________若乙方逾期支付租金,每逾期一日,应按未支付金额的______%向甲方支付违约金。逾期超过______天的,甲方有权解除本合同,并要求乙方承担违约责任。IntheeventthatPartyBfailstopaytherentontime,itshallpayPartyAalatefeeof______%oftheoverdueamountforeachdayofdelay.Ifthedelayexceeds______days,PartyAshallhavetherighttoterminatethisAgreementandrequirePartyBtoassumeliabilityforbreachofcontract.第四条押金Clause4:SecurityDeposit乙方应在本合同签订之日起______天内,向甲方支付押金人民币______元(大写:____________________)。该押金作为乙方履行本合同各项义务的担保。PartyBshallpayPartyAasecuritydepositofRMB______(inwords:____________________)within______daysaftertheexecutionofthisAgreement.ThesecuritydepositshallserveascollateralforPartyB'sperformanceofallobligationsunderthisAgreement.租赁期限届满或本合同提前终止后,在乙方结清所有应付款项(包括但不限于租金、水电费、物业费等)并将该房屋完好交还甲方后的______天内,甲方应将押金无息退还乙方。若乙方存在违约行为或造成房屋损坏,甲方有权从押金中扣除相应费用,不足部分乙方应另行补足。UponexpirationoftheleasetermorearlyterminationofthisAgreement,PartyAshallrefundthesecuritydeposittoPartyBwithoutinterestwithin______daysafterPartyBhassettledallpayableamounts(includingbutnotlimitedtorent,utilities,propertymanagementfees,etc.)andreturnedthePremisestoPartyAingoodcondition.IfPartyBhascommittedanybreachofcontractorcauseddamagetothePremises,PartyAhastherighttodeductthecorrespondingexpensesfromthesecuritydeposit.PartyBshallmakeupanyshortfall.第五条房屋用途Clause5:PermittedUse乙方租赁该房屋仅作为______(居住/办公/商业等)使用,乙方保证在租赁期限内不改变房屋用途,不利用该房屋从事任何违法违规活动。PartyBshallusethePremisessolelyfor______(residential/office/commercial,etc.)purposes.PartyBwarrantsthatitwillnotchangetheuseofthePremisesduringtheleasetermandwillnotengageinanyillegalorirregularactivitiesonthePremises.若乙方违反本条规定,甲方有权立即解除本合同,并要求乙方承担违约责任,同时乙方应赔偿甲方因此遭受的一切损失。IfPartyBbreachesthisclause,PartyAshallhavetherighttoterminatethisAgreementimmediatelyandrequirePartyBtoassumeliabilityforbreachofcontract.PartyBshallalsocompensatePartyAforalllossesincurredasaresultthereof.第六条房屋维修与保养Clause6:RepairandMaintenance租赁期限内,甲方应负责该房屋的主体结构、公共设施设备的正常维修和保养,确保房屋及其附属设施处于安全和适用状态。但因乙方使用不当或故意造成的损坏除外。Duringtheleaseterm,PartyAshallberesponsibleforthenormalrepairandmaintenanceofthemainstructureofthePremisesandpublicfacilitiestoensurethatthePremisesanditsappurtenancesareinasafeandusablecondition,exceptfordamagescausedbyimproperuseorintentionalactsofPartyB.乙方应合理使用并爱护该房屋及其附属设施。如发现房屋及其附属设施有损坏或故障时,应及时通知甲方维修。乙方因使用不当或故意造成房屋及其附属设施损坏的,应负责修复或承担赔偿责任。PartyBshallusethePremisesanditsappurtenancesreasonablyandwithcare.IfPartyBdiscoversanydamageormalfunctiontothePremisesoritsappurtenances,itshallpromptlynotifyPartyAforrepair.PartyBshallberesponsibleforrepairingorcompensatingforanydamagetothePremisesoritsappurtenancescausedbyitsimproperuseorintentionalacts.对于乙方的维修通知,甲方应在接到通知后的______天内进行维修。如甲方未及时维修,乙方可自行维修,费用由甲方承担。但紧急情况(如漏水、漏电等)下,乙方有权立即进行维修,费用由甲方承担。PartyAshallcarryoutrepairswithin______daysafterreceivingPartyB'srepairnotice.IfPartyAfailstorepairinatimelymanner,PartyBmayarrangeforrepairsonitsown,andtheexpensesshallbebornebyPartyA.However,incaseofemergencies(suchaswaterleakage,electricleakage,etc.),PartyBhastherighttocarryoutrepairsimmediately,andtheexpensesshallbebornebyPartyA.第七条物业管理与费用承担Clause7:PropertyManagementandExpenseResponsibility乙方应遵守该房屋所在小区的物业管理规定,按时足额缴纳物业管理费、水电费、燃气费、有线电视费、网络费等因使用该房屋而产生的各项费用。PartyBshallabidebythepropertymanagementregulationsofthecommunitywherethePremisesislocatedandpayontimeandinfullthepropertymanagementfees,utilities(includingwater,electricity,gas,etc.),cableTVfees,internetfees,andotherexpensesincurredfromtheuseofthePremises.上述费用的缴纳方式和时间按照相关部门或物业公司的规定执行。乙方应保存好缴费凭证,并在甲方要求时提供相关证明。Thepaymentmethodsanddeadlinesfortheaboveexpensesshallbeinaccordancewiththeregulationsoftherelevantauthoritiesorpropertymanagementcompany.PartyBshallkeepthepaymentvouchersandproviderelevantcertificatesuponPartyA'srequest.第八条违约责任Clause8:LiabilityforBreachofContract若甲方违反本合同约定,提前收回该房屋或妨碍乙方正常使用该房屋的,应退还乙方已支付但尚未使用的租金和押金,并按照相当于______个月租金的标准向乙方支付违约金。若违约金不足以弥补乙方损失的,甲方还应承担赔偿责任。IfPartyAbreachesthisAgreementbytakingbackthePremisesinadvanceorinterferingwithPartyB'snormaluseofthePremises,PartyAshallrefundtherentandsecuritydepositpaidbyPartyBbutnotyetused,andpayPartyBapenaltyequivalentto______months'rent.IfthepenaltyisinsufficienttocompensateforPartyB'slosses,PartyAshallalsobeartheliabilityforcompensation.若乙方违反本合同约定,逾期支付租金或其他费用、擅自改变房屋用途、损坏房屋及其附属设施等,甲方有权要求乙方限期改正,并按照相当于______个月租金的标准向甲方支付违约金。若乙方在甲方规定的期限内未改正的,甲方有权解除本合同,并要求乙方承担违约责任。IfPartyBbreachesthisAgreementbyfailingtopayrentorotherexpensesontime,changingtheuseofthePremiseswithoutauthorization,damagingthePremisesoritsappurtenances,etc.,PartyAshallhavetherighttorequirePartyBtocorrectthebreachwithinaspecifiedtimelimitandpayPartyAapenaltyequivalentto______months'rent.IfPartyBfailstocorrectthebreachwithinthetimelimitspecifiedbyPartyA,PartyAshallhavetherighttoterminatethisAgreementandrequirePartyBtoassumeliabilityforbreachofcontract.第九条合同解除Clause9:TerminationoftheAgreement经甲乙双方协商一致,可以解除本合同。ThisAgreementmaybeterminatedbymutualagreementofPartyAandPartyB.有下列情形之一的,甲方有权单方解除本合同:PartyAshallhavetherighttoterminatethisAgreementunilaterallyunderanyofthefollowingcircumstances:乙方逾期支付租金超过______天的;PartyBfailstopaytherentformorethan______days;乙方擅自将该房屋转租、转借他人或擅自与他人互换使用的;PartyBsubletsthePremises,transferstheleasetoathirdparty,orexchangesthePremiseswithotherswithoutauthorization;乙方损坏房屋主体结构或造成其他严重损坏,经甲方要求仍未修复的;PartyBdamagesthemainstructureofthePremisesorcausesotherseriousdamageandfailstorepairitafterbeingrequestedbyPartyA;乙方利用该房屋从事违法违规活动的。PartyBusesthePremisestoengageinillegalorirregularactivities.有下列情形之一的,乙方有权单方解除本合同:PartyBshallhavetherighttoterminatethisAgreementunilaterallyunderanyofthefollowingcircumstances:甲方未按照本合同约定交付该房屋,经乙方催告后______天内仍未交付的;PartyAfailstodeliverthePremisesasagreedinthisAgreementandstillfailstodeliveritwithin______daysafterbeingurgedbyPartyB;甲方严重干扰乙方对该房屋的正常使用,经乙方催告后______天内仍未改正的;PartyAseriouslyinterfereswithPartyB'snormaluseofthePremisesandfailstocorrectitwithin______daysafterbeingurgedbyPartyB;该房屋因不可抗力或政府行为导致无法继续使用的。ThePremisesbecomesunavailableforcontinueduseduetoforcemajeureorgovernmentactions.任何一方依据本条规定单方解除本合同的,应书面通知对方。本合同自通知送达对方之日起解除。AnypartyterminatingthisAgreementunilaterallyinaccordancewiththisclauseshallnotifytheotherpartyinwriting.ThisAgreementshallbeterminatedonthedatethenoticeisservedontheotherparty.第十条争议解决Clause10:DisputeResolution本合同在履行过程中如发生争议,由甲乙双方协商解决;协商不成的,任何一方均有权向该房屋所在地有管辖权的人民法院提起诉讼。AnydisputesarisingfromtheperformanceofthisA
