PAGE小区物业项目承包合同甲方（委托方）：名称：法定代表人：地址：联系方式：乙方（受托方）：名称：法定代表人：地址：联系方式：鉴于甲方为[小区名称]的业主或相关权益人，拥有该小区物业项目的管理权利；乙方具备专业的物业管理资质和经验，双方经友好协商，依据《中华人民共和国民法典》及相关法律法规，就甲方将小区物业项目承包给乙方事宜达成如下协议：一、合同标的1.1甲方将位于[小区详细地址]的物业项目（以下简称“本项目”）承包给乙方进行管理和服务。本项目包括但不限于小区内的房屋建筑及其附属设施设备、绿化、环境卫生、公共秩序维护、车辆停放管理等相关物业服务内容。二、承包期限2.1本合同承包期限自年月日起至年月日止。合同期满前，双方如无异议，则本合同自动延续[延续期限]年。三、双方权利与义务（一）甲方权利与义务3.1权利3.1.1有权对乙方的物业服务质量进行监督检查，提出意见和建议。3.1.2有权知晓乙方关于本项目物业服务费用的收支情况。3.1.3法律、法规规定的其他相关权利。3.2义务3.2.1向乙方提供本项目物业的相关资料，包括但不限于房屋建筑图纸、设施设备清单等。3.2.2协助乙方处理本项目物业管理中与业主或使用人的纠纷。3.2.3按照本合同约定向乙方支付物业服务费用。3.2.4配合乙方做好本项目的物业管理工作，不得干涉乙方的正常管理服务活动。（二）乙方权利与义务3.3权利3.3.1按照本合同约定收取物业服务费用。3.3.2根据本项目实际情况制定物业服务方案，并有权要求甲方协助实施。3.3.3对违反本项目物业管理规定的行为进行制止和处理。3.3.4法律、法规规定的其他相关权利。3.4义务3.4.1按照国家及地方相关物业管理规范和本合同约定，提供优质、高效的物业服务。3.4.2建立健全本项目物业管理档案资料，妥善保管相关文件、记录等。3.4.3定期对本项目的设施设备进行维护保养，确保其正常运行。3.4.4加强本项目的环境卫生管理，保持小区整洁卫生。3.4.Diligentandresponsibleforthemaintenanceofpublicorderinthecommunity,andtakenecessarysafetymeasurestopreventsecurityincidents.3.4.6合理安排本项目的车辆停放管理，确保车辆停放有序。3.4.7在本项目显著位置公示物业服务内容、标准、收费项目及标准等信息。3.4.8定期向甲方汇报本项目物业服务情况。3.4.9根据甲方或业主的合理要求，及时改进物业服务工作。3.4.10遵守法律法规及本合同约定，不得损害甲方及业主的合法权益。四、物业服务内容与标准（一）房屋建筑及附属设施设备管理4.Afterreceivingthepropertyproject,PartyBshallpromptlyinspectthehousingbuildingsandtheirancillaryfacilitiesandequipmentwithinthecommunity,establishadetailedinventoryandfile,andrecordthestatusofeachfacilityandequipment.4.1.2Regularlyconductmaintenanceandinspectionofhousingbuildingsandancillaryfacilitiesandequipment,includingbutnotlimitedtoroofs,walls,floors,doors,windows,elevators,watersupplyanddrainagesystems,electricalsystems,etc.,andtimelyrepairanyproblemsfound.4.1.3Ensurethattheancillaryfacilitiesandequipmentsuchasfireprotectionfacilities,securitymonitoringsystems,andelevatorsareinnormaloperationatalltimes,andcooperatewithrelevantdepartmentstocompleteregularinspectionsandmaintenancework.（二）绿化管理4.2.1Maintainthelawns,flowerbeds,andtreeswithinthecommunity,regularlywater,fertilize,prune,andpreventpestsanddiseases.4.2.2Ensurethatthegreeningrateofthecommunitymeetstherelevantstandards,andcontinuouslyimprovethegreeningenvironment.（三）环境卫生管理4.3.1Cleanthepublicareasofthecommunityeveryday,includingroads,sidewalks,stairwells,elevators,etc.,andremovegarbageanddebrisinatimelymanner.4.3.2Setupsufficientgarbagebinsinthecommunity,andensurethattheyareregularlyemptiedandcleaned.4.3.3Strengthenthemanagementofthesanitationofpublictoilets,andkeepthemcleanandodorfree.（四）公共秩序维护4.4.1Establishapublicordermaintenancesystem,arrangesecuritypersonneltopatrolthecommunityregularly,andensurethesafetyofthecommunity24hoursaday.4.4.2Strengthenthemanagementofaccesscontrol,andchecktheentryandexitofpersonnelandvehiclestopreventunauthorizedentry.4.4.3Cooperatewithrelevantdepartmentstodealwithemergenciesandsecurityincidentsinatimelymanner.（五）车辆停放管理4.5.1Reasonablyplanthevehicleparkingspacesinthecommunity,andensurethattheparkingorderisgood.4.5.2Chargevehicleparkingfeesinaccordancewiththerelevantregulationsandthestandardsannouncedinthecommunity,andissueinvoicesinatimelymanner.4.5.3Providenecessaryguidanceandassistanceforvehicleownerstoparktheirvehicles.（六）其他服务4.6.1ProvideservicessuchaspropertymanagementconsultationandcommunityculturalactivitiesaccordingtotheneedsofPartyAandtheactualsituationofthecommunity.4.6.2Cooperatewithrelevantdepartmentstocarryoutworksuchaspropertyinspectionandrectificationinthecommunity.五、物业服务费用及支付方式（一）物业服务费用标准5.1.1本项目物业服务费用标准为每月每平方米[X]元，总建筑面积为[具体面积]平方米，每月物业服务费用总额为[X]元。5.1.2物业服务费用标准如有调整，需经双方协商一致，并提前[通知期限]通知对方。（二）支付方式5.2.1甲方应在每月的[支付日期]前，将当月的物业服务费用支付至乙方指定的银行账户。5.2.2乙方应在收到甲方支付的物业服务费用后[发票开具期限]内，向甲方开具合法有效的发票。六、违约责任（一）甲方违约责任6.1.1IfPartyAfailstopaythepropertyservicefeesinaccordancewiththecontractagreement,itshallpaytheoverduefeesandpayliquidateddamagesatarateof[defaultrate]%oftheoverdueamountforeachoverdueday.6.1.2IfPartyAviolatesotherobligationsstipulatedinthiscontract,causinglossestoPartyB,PartyAshallbearcorrespondingcompensationresponsibilities.（二）乙方违约责任6.2.1IfPartyBfailstoprovidepropertyservicesinaccordancewiththecontractagreementandtherelevantstandards,itshalltakemeasurestoimprovewithinatimelimit.Ifthesituationremainsunchangedaftertheexpirationofthetimelimit,PartyBshallrefundpartofthepropertyservicefeestoPartyAinaccordancewiththeproportionoftheunfulfilledservicecontent,andpayliquidateddamagesatarateof[defaultrate]%ofthetotalpropertyservicefeesforthatyear.6.2.2IfPartyBviolatesotherobligationsstipulatedinthiscontract,causinglossestoPartyA,PartyBshallbearcorrespondingcompensationresponsibilities.七、合同变更与解除7.1.1经双方协商一致，可以书面形式变更或解除本合同。7.1.2Incaseofforcemajeureorotherunforeseeableandirresistiblereasonsthatmakeitimpossibletocontinuetoperformthiscontract,thepartiesmaydiscussanddecidewhethertomodifyorterminatethiscontract.7.1.3Ifonepartyfailstoperformitsobligationsunderthiscontractforalongtime,causingtheotherpartytosufferseriouslosses,theotherpartyhastherighttoterminatethiscontrac
