REFERENCETOPARTIIINDEXTENDERAGREEMENTEDITORIALAMENDMENTSIN1988FURTHERAMENDMENTSIN1992 PARTI-GENERALCONDITIONSDefinitionsandInterpretationDefinitions1.1IntheContract(ashereinafterdefined)thefollowingwordsandexpressionsshallrequires:Conditionsandthelegalsuccessorsintitletosuchperson,butnot(exceptwiththeconsentoftheContractor)anyassigneeofsuchperson.(ii)”Contractor”meansthepersonwhosetenderhasbeenacceptedbytheEmployerandthelegalsuccessorsintitletosuchperson,butnot(exceptwiththeconsentoftheEmployer)anyassigneeofsuchperson.(iii)”Subcontractor”meansanypersonnamedintheContractasaSubcontractorforapartoftheWorksoranypersontowhomapartoftheWorkshasbeensubcontractedwiththeconsentoftheEngineerandthelegalsuccessorsintitletosuchperson,butnotanyassigneeofanysuchperson.(iv)”Engineer”meansthepersonappointedbytheEmployertoactasEngineerforthepurposesoftheContractandnamedassuchinPartIIoftheseConditions.(v)”Engineer’sRepresentative”meansapersonappointedfromtimetotimebytheEngineerunderSub-Clause2.2(b) (i)”Contract”meanstheseConditions(PartsIandII),theSpecification,theDrawings,theBillofQuantities,theTender,theLetterofAcceptance,theContractAgreement(ifcompleted)andsuchfurtherdocumentsasmaybeexpresslyincorporatedintheLetterofAcceptanceorContractAgreement(ifcompleted).(ii)”Specification”meansthespecificationoftheWorksincludedintheContractandanymodificationthereoforadditiontheretomadeunderClause51orsubmittedbytheContractorandapprovedbytheEngineer.(iii)”Drawings”meansalldrawings,calculationsandtechnicalinformationofalikenatureprovidedbytheEngineertotheContractorundertheContractandalldrawings,calculations,samples,patterns,models,operationandmaintenancemanualsandothertechnicalinformationofalikenaturesubmittedbytheContractorandapprovedbytheEngineer.(iv)”BillofQuantities”meansthepricedandcompletedbillofquantitiesformingpartoftheTender.(v)”Tender”meanstheContractor’spricedoffertotheEmployerfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectsthereininaccordancewiththeprovisionsoftheContract,asacceptedbytheLetterofAcceptance.(vi)”LetterofAcceptance”meanstheformalacceptancebytheEmployeroftheTender.(vii)”ContractAgreement”Cmeansthecontractagreement(ifany)referredtoinSub-Clause9.1.(viii)”AppendixtoTender”meanstheappendixcomprisedintheformofTenderannexedtotheseConditions.(c) (i)”CommencementDate”meansthedateuponwhichtheContractorreceivesthenoticetocommenceissuedbytheEngineerpursuanttoClause41.(ii)”TimeforCompletion”meansthetimeforcompletingtheexecutionofandpassingtheTestsonCompletionoftheWorksoranySectionorpartthereofasstatedintheContract(orasextendedunderClause44)calculatedfromtheCommencementDate.(d) (i)”TestsonCompletion”meansthetestsspecifiedintheContractorotherwiseagreedbytheEngineerandtheContractorwhicharetobemadebytheContractorbeforetheWorksoranySectionorpartthereofaretakenoverbytheEmployer. (ii)”Taking-OverCertificate”meansacertificateissuedpursuanttoClause48.(e) (i)”ContractPrice”meansthesumstatedintheLetterofAcceptanceaspayabletotheContractorfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectsthereininaccordancewiththeprovisionsoftheContract.(ii)”RetentionMoney”meanstheaggregateofallmoniesretainedbytheEmployerpursuanttoSubClause60.2(a)(iii)”InterimPaymentCertificate”meansanycertificateofpaymentissuedbytheEngineerotherthantheFinalPaymentCertificate(iv)”FinalPaymentCertificate”meansthecertificateofpaymentissuedbytheEngineerpursuanttoSubClause60.8.(f) (i)”Works”meansthePermanentWorksandtheTemporaryWorksoreitherofthemasappropriate.(ii)”PermanentWorks”meansthepermanentworkstobeexecuted(includingPlant)inaccordancewiththeContract.(iii)”TemporaryWorks”meansalltemporaryworksofeverykind(otherthanContractor’Equipment)requiredinorabouttheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein.(iv)”Plant”meansmachinery,apparatusandthelikeintendedtoformorformingpartofthePermanentWorks.(v)”Contractor’sEquipment”meansallappliancesandthingsofwhatsoevernature(otherthanTemporaryWorks)requiredfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein,butdoesnotincludePlant,materialsorotherthingsintendedtoformorformingpartofthePermanentWorks.(vi)”asaSection.(vii)”Site”meanstheplacesprovidedbytheEmployerwheretheWorksaretobeexecutedandanyotherplacesasmaybespecificallydesignatedintheContractasformingpartoftheSite.(g) (i)”cost”meansallexpenditureproperlyincurredortobeincurred,whetheronorofftheSite,includingoverheadandotherchargesproperlyallocabletheretobutdoesnotincludeanyallowanceforprofit.(ii)”day”meanscalendarday.(iii)”foreigncurrency”meansacurrencyofacountryotherthanthatinwhichtheWorksaretobelocated.(iv)”writing”meansanyhand-written,type-written,orprintedcommunication,includingtelex,cableandfacsimiletransmission.HeadingsandMarginalNotes1.2TheheadingsandmarginalnotesintheseConditionsshallnotbedeemedpartthereoforbetakenintoconsiderationintheinterpretationorconstructionthereoforoftheContract.Interpretation1.3Wordsimportingpersonsorpartiesshallincludefirmsandcorporationsandanyorganisationhavinglegalcapacity.SingularandPlural1.4Wordsimportingthesingularonlyalsoincludethepluralandviceversawherethecontextrequires.Notices,Consents,ApprovalsCertificatesandDeterminations1.5WhereverintheContractprovisionismadeforthegivingorissueofanynotice,consent,approval,certificateordeterminationbyanyperson,unlessotherwisespecifiedsuchnotice,consent,approval,certificateordeterminationshallbeinwritingandthewords”notify”,”certify”or”determine”shallbeconstruedaccordingly.Anysuchconsent,approval,certificateordeterminationshallnotunreasonablybewithheldordelayed.EngineerandEngineer’sRepresentativeEngineer’sDutiesandAuthority2.1(a) TheEngineershallcarryoutthedutiesspecifiedintheContract.(b) TheEngineermayexercisetheauthorityspecifiedinornecessarilytobeimpliedfromtheContract,provided,however,thatiftheEngineerisrequired,under,thetermsofhisappointmentbytheEmployer,toobtainthespecificapprovaloftheEmployerbeforeexercisinganysuchauthority,particularsofsuchrequirementsshallbesetoutinPartIIoftheseConditions.ProvidedfurtherthatanyrequisiteapprovalshallbedeemedtohavebeengivenbytheEmployerforanysuchauthorityexercisedbytheEngineer.(c) ExceptasexpresslystatedintheContract,theEngineershallhavenoauthoritytorelievetheContractorofanyofhisobligationsundertheContract.Engineer’sRepresentative2.2TheEngineer’sRepresentativeshallbeappointedbyandberesponsibletotheEngineerandshallcarryoutsuchdutiesandexercisesuchauthorityasmaybedelegatedtohimbytheEngineerunderSub-Clause2.3.Engineer’sAuthoritytoDelegate2.3TheEngineermayfromtimetotimedelegatetotheEngineer’sRepresentativeanyofthedutiesandauthoritiesvestedintheEngineerandhemayatanytimerevokesuchdelegation.AnysuchdelegationorrevocationshallbeinwritingandshallnottakeeffectuntilacopythereofhasbeendeliveredtotheEmployerandtheContractor.AnycommunicationgivenbytheEngineer’sRepresentativetotheContractorinaccordancewithsuchdelegationshallhavethesameeffectasthoughithadbeengivenbytheEngineer.Providedthat:(a) anyfailureoftheEngineer’sRepresentativetodisapproveanywork,materialsorPlantshallnotprejudicetheauthorityoftheEngineertodisapprovesuchwork,materialsorPlantandtogiveinstructionsfortherectificationthereof,and(b) iftheContractorquestionsanycommunicationoftheEngineer’sRepresentativehemayreferthemattertotheEngineerwhoshallconfirm,reverseorvarythecontentsofsuchcommunication.AppointmentofAssistants2.4TheEngineerortheEngineer’sRepresentativemayappointanynumberofpersonstoassisttheEngineer'sRepresentativeinthecarryingoutofhisdutiesunderSub-Clause2.2.HeshallnotifytotheContractorthenames,dutiesandscopeofauthorityofsuchpersons.SuchassistantsshallhavenoauthoritytoissueanyinstructionstotheContractorsaveinsofarassuchinstructionsmaybenecessarytoenablethemtocarryouttheirdutiesandtosecuretheiracceptanceofmaterials,PlantorworkmanshipasbeinginaccordancewiththeContract,andanyinstructionsgivenbyanyofthemforthosepurposesshallbedeemedtohavebeengivenbytheEngineer'sRepresentative.InstructionsinWriting2.5InstructionsgivenbytheEngineershallbeinwriting,providedthatifforanyreasontheEngineerconsidersitnecessarytogiveanysuchinstructionorally,theContractorshallcomplywithsuchinstruction.ConfirmationinwritingofsuchoralinstructiongivenbytheEngineer,whetherbeforeorafterthecarryingoutoftheinstruction,shallbedeemedtobeaninstructionwithinthemeaningofthisSubClause.ProvidedfurtherthatiftheContractor,within7days,confirmsinwritingtotheEngineeranyoralinstructionoftheEngineerandsuchconfirmationisnotcontradictedinwritingwithin7daysbytheEngineer,itshallbedeemedtobeaninstructionoftheEngineer.TheprovisionsofthisSub-ClauseshallequallyapplytoinstructionsgivenbytheEngineer'sRepresentativeandanyassistantsoftheEngineerortheEngineer’sRepresentativeappointedpursuanttoSub-Clause2.4.EngineertoActImpartially2.6Wherever,undertheContract,theEngineerisrequiredtoexercisehisdiscretionby:(a) givinghisdecision,opinionorconsent,(b) expressinghissatisfactionorapproval,(c) determiningvalue,or(d) otherwisetakingactionwhichmayaffecttherightsandobligationsoftheEmployerortheContractorheshallexercisesuchdiscretionimpartiallywithinthetermsoftheContractandhavingregardtoallthecircumstances.Anysuchdecision,opinion,consent,expressionofsatisfaction,orapproval,determinationofvalueoractionmaybeopenedup,reviewedorrevisedasprovidedinClause67.AssignmentandSubcontractingAssignmentofContract3.1TheContractorshallnot,withoutthepriorconsentoftheEmployer(whichconsent,notwithstandingtheprovisionsofSub-Clause1.5,shallbeatthesolediscretionoftheEmployer),assigntheContractoranypartthereof,oranybenefitorinterestthereinorthereunder,otherwisethanby(a) achargeinfavouroftheContractor’sbankersofanymoniesdueortobecomedueundertheContract,or(b) assignmenttotheContractor’sinsurers(incaseswheretheinsurershavedischargedtheContractor'slossorliability)oftheContractor'srighttoobtainreliefagainstanyotherpartyliableSubcontracting4.1TheContractorshallnotsubcontractthewholeoftheWorks.ExceptwhereotherwiseprovidedbytheContract,theContractorshallnotsubcontractanypartoftheWorkswithoutthepriorconsentoftheEngineer.AnysuchconsentshallnotrelievetheContractorfromanyliabilityorobligationundertheContractandheshallberesponsiblefortheacts,defaultsandneglectsofanySubcontractor,hisagents,servantsorworkmenasfullyasiftheyweretheacts,defaultsorneglectsoftheContractor,hisagents,servantsorworkmen.ProvidedthattheContractorshallnotberequiredtoobtainsuchconsentfor:(a) theprovisionoflabour,intheContract,or(c) thesubcontractingofanypartoftheWorksforwhichtheSubcontractorisnamedintheContract.AssignmentofSubcontractors’Obligations4.2IntheeventofaSubcontractorhavingundertakentowardstheContractorinrespectoftheworkexecuted,orthegoods,materials,PlantorservicessuppliedbysuchSubcontractor,anycontinuingobligationextendingforaperiodexceedingthatoftheDefectsLiabilityPeriodundertheContract,theContractorshallatanytime,aftertheexpirationofsuchPeriod,assigntotheEmployer,attheEmployer’srequestandcost,thebenefitofsuchobligationfortheunexpireddurationthereof.ContractDocumentsLanguage/sandLaw5.1ThereisstatedinPartIIoftheseConditions:((b) thecountryorstatethelawofwhichshallapplytotheContractandaccordingtowhichtheContractshallbeconstrued.Ifthesaiddocumentsarewritteninmorethanonelanguage,thelanguageaccordingtowhichtheContractshallbeconstruedandinterpretedisalsostatedinPartIIoftheseConditions,beingthereindesignatedthe”RulingLanguage”.PriorityofContractDocuments5.2TheseveraldocumentsformingtheContractaretobetakenasmutuallyexplanatoryofoneanother,butincaseofambiguitiesordiscrepanciesthesameshallbeexplainedandadjustedbytheEngineerwhoshallthereuponissuetotheContractorinstructionsthereonandinsuchevent,unlessotherwiseprovidedintheContract,thepriorityofthedocumentsformingtheContractshallbeasfollows:(1) TheContractAgreement(ifcompleted);(2) TheLetterofAcceptance;(3) TheTender;(4) PartIIoftheseConditions;(5) PartIoftheseConditions;and(6) AnyotherdocumentformingpartoftheContract.CustodyandSupplyofDrawingsandDocuments6.1shallbeoftheContract,theDrawings,SpecificationandotherdocumentsprovidedbytheorcommunicatedtoathirdpartybytheContractor.UponissueoftheDefectsLiabilityotherdocumentsprovidedundertheContract.andotherdocumentssubmittedbytheContractorandapprovedbytheEngineerinaccordancewithClause7,togetherwithareproduciblecopyofanymaterialwhichcannotbereproducedtoanequalstandardbyphotocopying.InadditiontheContractorshallsupplysuchfurthercopiesofsuchDrawings,SpecificationandotherdocumentsastheEngineermayrequestinwritingfortheuseoftheEmployer,whoshallpaythecostthereof.OneCopyofDrawingstobeKeptonSite6.2OnecopyoftheDrawings,providedtoorsuppliedbytheContractorasaforesaid,shallbekeptbytheContractorontheSiteandthesameshallatallreasonabletimesbeavailableforinspectionandusebytheEngineerandbyanyotherpersonauthorisedbytheEngineerinwriting.DisruptionofProgress6.3TheContractorshallgivenoticetotheEngineer,withacopytotheEmployer,wheneverplanningorexecutionoftheWorksislikelytobedelayedordisruptedunlessanyfurtherdrawingorinstructionisissuedbytheEngineerwithinareasonabletime.Thenoticeshallincludedetailsofthedrawingorinstructionrequiredandofwhyandbywhenitisrequiredandofanydelayordisruptionlikelytobesufferedifitislate.DelaysandCostofDelayofDrawings6.4If,byreasonofanyfailureorinabilityoftheEngineertoissue,withinatimereasonableinallthecircumstances,anydrawingorinstructionforwhichnoticehasbeengivenbytheContractorinaccordancewithSubClause63,theContractorsuffersdelayand/orincurscoststhentheEngineershall,afterdueconsultationwiththeEmployerandtheContractor,determine:and(b) theamountofsuchcosts,whichshallbeaddedtotheContractPrice,andshallnotifytheContractoraccordingly,withacopytotheEmployer.FailurebyContractortoSubmitDrawings6.5IfthefailureorinabilityoftheEngineertoissueanydrawingsorinstructionsiscausedinwholeorinpartbythefailureoftheContractortosubmitDrawings,SpecificationorotherdocumentswhichheisrequiredtosubmitundertheContract,theEngineershalltakesuchfailure.bytheContractorintoaccountwhenmakinghisdeterminationpursuanttoSub-Clause6.4.SupplementaryDrawingsandInstructions7.1TheEngineershallhaveauthoritytoissuetotheContractor,fromtimetotime,suchsupplementaryDrawingsandinstructionsasshallbenecessaryforthepurposeoftheproperandadequateexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein.TheContractorshallcarryoutandbeboundbythesame.PermanentWorksDesignedbyContractor7.2WheretheContractexpresslyprovidesthatpartofthePermanentWorksshallbedesignedbytheContractor,heshallsubmittotheEngineer,forapproval:(a) suchdrawings,specifications,calculationsandotherinformationasshallbenecessarytosatisfytheEngineerastothesuitabilityandadequacyofthatdesign,and(b) operationandmaintenancemanualstogetherwithdrawingsofthePermanentWorksascompleted,insufficientdetailtoenabletheEmployertooperate,maintain,dismantle,reassembleandadjustthePermanentWorksincorporatingthatdesign.TheWorksshallnotbeconsideredtobecompletedforthepurposesoftakingoverinaccordancewithClause48untilsuchoperationandmaintenancemanuals,togetherwithdrawingsoncompletion,havebeensubmittedtoandapprovedbytheEngineerResponsibilityUnaffectedbyApproval7.3ApprovalbytheEngineer,inaccordancewithSub-Clause7.2,shallnotrelievetheContractorofanyofhisresponsibilitiesundertheContract.GeneralObligationsContractor’sGeneralResponsibilities8.1TheContractorshall,withduecareanddiligence,design(totheextentprovidedforbytheContract),executeandcompletetheWorksandremedyanydefectsthereininaccordancewiththeprovisionsoftheContract.TheContractorshallprovideallsuperintendence,labour,materials,Plant,Contractor’sEquipmentandallotherthings,whetherofatemporaryorpermanentnature,requiredinandforsuchdesign,execution,completionandremedyingofanydefects,sofarasthenecessityforprovidingthesameisspecifiedinorisreasonablytobeinferredfromtheContract.TheContractorshallgivepromptnoticetotheEngineer,withacopytotheSiteOperationsandMethodsofConstruction8.2TheContractorshalltakefullresponsibilityfortheadequacy,stabilityandsafetyofallSiteoperationsandmethodsofconstruction.ProvidedthattheContractorshallnotberesponsible(exceptasstatedhereunderorasmaybeotherwise(agreed)forthedesignorspecificationofPermanentWorks,orforthedesignorspecificationofanyTemporaryWorksnotpreparedbytheContractor.WheretheContractexpresslyprovidesthatpartofthePermanentWorksshallbedesignedbytheContractor,heshallbefullyresponsibleforthatpartofsuchWorks,notwithstandinganyapprovalbytheEngineer.ContractAgreement9.1TheContractorshall,ifcalleduponsotodo,enterintoandexecutetheContractAgreement,tobepreparedandcompletedatthecostoftheEmployer,intheformannexedtotheseConditionswithsuchmodificationasmaybenecessary.PerformanceSecurity10.1IftheContractrequirestheContractortoobtainsecurityforhisproperperformanceoftheContract,heshallobtainandprovidetotheEmployersuchsecuritywithin28daysafterthereceiptoftheLetterofAcceptance,inthesumstatedintheAppendixtheEngineerofsodoing.SuchsecurityshallbeintheformannexedtotheseConditionsorinsuchotherformasmaybeagreedbetweentheEmployerandthetheEmployer.ThecostofcomplyingwiththerequirementsofthisClauseshallbebornebytheContractor,unlesstheContractotherwiseprovides.PeriodofValidityofPerformanceSecurity10.2TheperformancesecurityshallbevaliduntiltheContractorhasexecutedandcompletedtheWorksandremediedanydefectsthereininaccordancewiththeContract.NoclaimshallbemadeagainstsuchsecurityaftertheissueoftheDefectsLiabilityCertificateinaccordancewithSub-Clause62.1andsuchsecurityshallbereturnedtotheContractorwithin14daysoftheissueofthesaidDefectsLiabilityCertificate.ClaimsunderPerformanceSecurity10.3PriortomakingaclaimundertheperformancesecuritytheEmployershall,ineverycase,notifytheContractorstatingthenatureofthedefaultinrespectofwhichtheclaimistobemade.InspectionofSite11.1TheEmployershallhavemadeavailabletotheContractor,beforethesubmissionbytheContractoroftheTender,suchdataonhydrologicalandsub-surfaceconditionsashavebeenobtainedbyoronbehalfoftheEmployerfrominvestigationsundertakenrelevanttotheWorksbuttheContractorshallberesponsibleforhisowninterpretationthereof.TheContractorshallbedeemedtohaveinspectedandexaminedtheSiteanditssurroundingsandinformationavailableinconnectiontherewithandtohavesatisfiedhimself(sofarasispracticable,havingregardtoconsiderationsofcostandtime)beforesubmittinghisTender,asto:(a) theformandnaturethereof,includingthesubsurfaceconditions,(b) thehydrologicalandclimaticconditions,(c) theextentandnatureofworkandmaterialsnecessaryfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein,and(d) themeansofaccesstotheSiteandtheaccommodationhemayrequire,and,ingeneral,shallbedeemedtohaveobtainedallnecessaryinformation,subjectasabovementioned,astorisks,contingenciesandallothercircumstanceswhichmayinfluenceoraffecthisTender.TheContractorshallbedeemedtohavebasedhisTenderonthedatamadeavailablebytheEmployerandonhisowninspectionandexamination,allasaforementionedSufficiencyofTender12.1TheContractorshallbedeemedtohavesatisfiedhimselfastothecorrectnessandsufficiencyoftheTenderandoftheratesandpricesstatedintheBillofQuantities,allofwhichshall,exceptinsofarasitisotherwiseprovidedintheContract,coverallhisobligationsundertheContract(includingthoseinrespectofthesupplyofgoods,materials,PlantorservicesorofcontingenciesforwhichthereisaProvisionalSum)andallmattersandthingsnecessaryfortheproperexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein.NotForeseeablePhysicalObstructionsorConditions12.2If,however,duringtheexecutionoftheWorkstheContractorencountersphysicalobstructionsorphysicalconditions,otherthanclimaticconditionsontheSite,whichobstructionsorconditionswere,inhisopinion,notforeseeablebyanexperiencedcontractor,theContractorshallforthwithgivenoticethereoftotheEngineer,withacopytotheEmployer.Onreceiptofsuchnotice,theEngineershall,ifinhisopinionsuchobstructionsorconditionscouldnothavebeenreasonablyforeseenbyanexperiencedcontractor,afterdueconsultationwiththeEmployerandtheContractor,determine(a)anyextensionoftimetowhichtheContractorisentitledunderClause44,and(b)theamountofanycostswhichmayhavebeenincurredbytheContractorbyreasonofsuchobstructionsorconditionshavingbeenencountered,whichshallbeaddedtotheContractPrice,andshallnotifytheContractoraccordingly,withacopytotheEmployer.SuchdeterminationshalltakeaccountofanyinstructionwhichtheEngineermayissuetotheContractorinconnectiontherewith,andanyproperandreasonablemeasuresacceptabletotheEngineerwhichtheContractormaytakeintheabsenceofspecificinstructionsfromtheEngineer.WorktobeinAccordancewithContract13.1Unlessitislegallyorphysicallyimpossible,theContractorshallexecuteandcompletetheWorksandremedyanydefectsthereininstrictaccordancewiththeContracttothesatisfactionoftheEngineer.TheContractorshallcomplywithandadherestrictlytotheEngineer’sinstructionsonanymatter,whethermentionedintheContractornot,touchingorconcerningtheWorks.TheContractorshalltakeinstructionsonlyfromtheEngineer(orhisdelegate).ProgrammetobeSubmitted14.1TheContractorshall,withinthetimestatedinPartIIoftheseConditionsafterthedateoftheLetterofAcceptance,submittotheEngineerforhisconsentaprogramme,insuchformanddetailastheEngineershallreasonablyprescribe,fortheexecutionoftheWorks.TheContractorshall,wheneverrequiredbytheEngineer,alsoprovideinwritingforhisinformationageneraldescriptionofthearrangementsandmethodswhichtheContractorproposestoadoptfortheexecutionoftheWorks.RevisedProgramme14.2IfatanytimeitshouldappeartotheEngineerthattheactualprogressoftheWorksdoesnotconformtotheprogrammetowhichconsenthasbeengivenunderSub-Clause14.1,theContractorshallproduce,attherequestoftheEngineer,arevisedprogrammeshowingthemodificationstosuchprogrammenecessarytoensurecompletionoftheWorkswithintheTimeforCompletion.CashFlowEstimatetobeSubmitted14.3TheContractorshall,withinthetimestatedinPartIIoftheseConditionsafterthedateoftheLetterofAcceptance,providetotheEngineerforhisinformationadetailedcashflowestimate.inquarterlyperiods,ofallpaymentstowhichtheContractorwillbeentitledundertheContractandtheContractorshallsubsequentlysupplyrevisedcashflowestimatesatquarterlyintervals,ifrequiredtodosobytheEngineer.ContractornotRelievedofDutiesorResponsibilities14.4ThesubmissiontoandconsentbytheEngineerofsuchprogrammesortheprovisionofsuchgeneraldescriptionsorcashflowestimatesshallnotrelievetheContractorofanyofhisdutiesorresponsibilitiesundertheContract.Contractor’sSuperintendence15.1TheContractorshallprovideallnecessarysuperintendenceduringtheexecutionoftheWorksandaslongthereafterastheEngineermayconsidernecessaryfortheproperfulfillingoftheContractor'sobligationsundertheContract.TheContractor,oracompetentandauthorisedrepresentativeapprovedofbytheEngineer,whichapprovalmayatanytimebewithdrawn,shallgivehiswholetimetothesuperintendenceoftheWorks.Suchauthorisedrepresentativeshallreceive,onbehalfoftheContractor,instructionsfromtheEngineer.IfapprovaloftherepresentativeiswithdrawnbytheEngineer,theContractorshall,assoonasispracticable,havingregardtotherequirementofreplacinghimashereinaftermentioned,afterreceivingnoticeofsuchwithdrawal,removetherepresentativefromtheWorksandshallnotthereafteremployhimagainon
