Conntracttor'sRepreesentaative&ConnstrucctionManagger17.2.1 IIftheeConttractoor'sRRepressentattiveissnotnameddinttheCoontracct,thhenwiithinfourtteen((14)ddaysooftheeEffeectiveeDatee,theeConttractoorshaallapppointttheContrractorr'sReepreseentatiiveanndshaallreequesttVINAACOMINNinwwritinngtoapproovethheperrsonssoapppointeed.IffVINAACOMINNmakeesnoobjecctiontothheapppointmmentwwithinnfourrteen(14)days,,theContrractorr'sReepreseentatiiveshhallbbedeeemedttohavvebeeenappprovedd.IfVINACCOMINobjecctstootheappoiintmenntwitthinffourteeen(114)daaysgiivingtherreasonntherreforee,theentheeConttractoorshaallapppointtareeplaceementwithiinfouurteenn(14))dayssofssuchoobjecttion. TheConttractoor'sRRepressentattivesshallrepreesentandaactfoortheeConttractooratallttimesdurinngtheecurrrencyofthheConntracttandshalllgiveetotthePrrojecttManaageraallthheConntracttor’snottices,,insttructiions,inforrmatioonanddallotherrcommmunicaationssinrrelatiiontooperfformannceofftheContrract.Allnotiices,instrructioons,iinformmationnandalloothercommuunicattionsgivennbyVVINACOOMINoortheeProjjectMManageertotheCContraactorunderrtheContrractsshallbegiiventtotheeConttractoor'sRRepressentattiveooritssabseence,itsddeputyy,excceptaasherreinootherwwisepprovidded.TheConttractoorshaallnootrevvokettheapppointtmentofthheConntracttor'sRepreesentaativewithooutVIINACOMMIN’spriiorwrrittennconssent,whichhshalllnottbeuunreassonabllywitthheldd.IfVINACCOMINconseentsttheretto,thheConntracttorshhallaappoinntsommeothherpeersonasthheConntracttor'sRepreesentaativepursuuantttotheeproccedureesetoutiinGC17.2..1aboove. TheConttractoor'sRRepressentattivemmay,ssubjeccttotheaapprovvaloffVINAACOMINNwhicchshaallnootbeunreaasonabblywiithhelld,attanytimedeleggatettoanyyperssonannyoftheppowerss,funnctionnsanddauthhoritiiesveestedinhiimorher.Anyssuchddelegaationmaybberevvokedatannytimme.AnnysucchdellegatiionorrrevoocatioonshaallbeesubjjectttoappriornoticcesiggnedbbyConntracttor'sRepreesentaativeandaanynooticeofdeelegattionoorrevvocatiionshhallsspeciffytheepoweers,ffunctiionsaandauuthoriitiesthereebydeelegattedorrrevooked.NosuuchdeelegattionoorrevvocatiionshhallttakeeeffecttunleessanndunttilacopythereeofhaasbeeendellivereedtoVINACCOMINandtthePrrojecttManaager.Anyactorexxercissebyanyppersonnofppowerss,funnctionnsanddauthhoritiiessoodeleegateddtohhimorrherinacccordaancewwithtthisGGCshaallbeedeemmedtoobeaanacttoreexerciisebyytheContrractorr'sReepreseentatiive. FromtheecommmencemmentoofinsstallaationofthheMaoKhheCoaal-firredThhermallPoweerPlaantatttheSiteuntillProvvisionnalAccceptaanceoofUniit,thheConntracttor'sRepreesentaativeshalllappoointaasuittablepersoonasthecconstrructioonmannager(hereeinaftterreeferreedtoas“theCConstrructioonMannager”).ThheConnstrucctionManaggershhallssupervviseaallwoorkdooneatttheSitebythheConntracttoranndshaallbeepressentaattheeSiteethrooughouutnorrmalwworkinnghouursexxceptwhenonleeave,sickorabbsentforrreasonnsconnnecteedwitththeepropperpeerformmanceofthheConntractt.WheeneverrtheConsttructiionMaanagerrisaabsenttfrommtheSite,,asuuitablleperrsonsshallbeapppointtedtooactasdeeputy.. VINACOMIINmayybynnoticeetottheCoontracctoroobjectttoaanyreepreseentatiivesoorperrsoneemployyedbyytheContrractorrinttheexxecutiionofftheContrractwwhoshhall,inthhereaasonabbleoppinionnofVVINACOOMIN,miscoonductthimorheerselfforbbeinccompettentoorneggligenntorcommiitasseriouusbreeachooftheeSiteereguulatioonsprrovideedundderGCC22.44hereeof.VVINACOOMINsshallproviideevvidencceofthessamewwhereuuponttheCoontracctorsshallremovvesucchperrsonffromttheMaoKhheCoaal-firredThhermallPoweerPlaant.17.2.6
