EHS COMMON PROCEDUREProcedure No: EHS-P-07Revision: 01Page 8 of 8Title: Legal and Other Requirements Identifying and Compliance Evaluating Procedure 法律法规和其他要求识别及合规性评价程序Revision HistoryRev.Change contentPrepared ByReviewed ByApproved By01New releaseKaron XiongHelena ZouHong ChenSandvik Mining and Construction (China) Ltd.山特维克矿山工程机械(中国)有限公司1 适用范围Scope本规程适用公司内法律法规及其他要求的收集、识别、落实的管理。The Regulations are applicable to collection, identification and implementation of legal other requirements. 2 目的 Purpose及时获取、识别、落实与公司经营、服务活动中与危险源相关的法律、法规及其他要求,并跟踪其变化。Obtain, identify and fulfill legal and other requirements related to hazards among operation and service of organization and follow up.3 职责Responsibility3.1 管理者代表负责审核合规性评价表及合规性评价报告Managements representative take the responsibility of auditing the form and report of evaluation of conformity.3.2 EHS主管负责相应法规及其他要求的信息管理并EHS officers take the responsibility of managing legal requirements and other requirements andA. 收集、识别相应的法律法规和标准;Collect, identify the relevant laws of standardsB. 识别各部门传递的其他要求;Identify requirements submitted from other departmentC. 编制相应的合规性评价表并组织评价实施及编制汇总报告。Compile the relevant form of evaluation of conformity, organize to implement and compile the report of evaluation of conformity3.3 各部门负责收集相应的其他要求,配合EHS主管开展法规信息的落实和评价。Each department collect related other requirements and assist the EHS officer to carry out and evaluate legal requirements.4 术语或定义Terms and Definitions4.1 法律法规:泛指由人大、政府、政府组成部门发布的具有规范性的文件(包括有关环境标准、职业健康安全标准)。Legal requirements: normative document released by peoples congress councile, government, or government branches (Including related Environmental standards and occupational healthy and safety standards)4.2 其他要求:指由有关政府管理机构、上级部门发布的有关职业健康和安全的通知、要求以及主要客户提出有职业健康和安全的要求以及与有关单位签订的环保、安全协议、合同等。Other requirements:the notification and requirements about OH&S issued by government and superior department as well as the proper requirements from main customers and agreements on environmental protection and safety with related organization.5 流程 Flow 5.1 法规信息管理流程见下图Flow about management of legal requirements sees below.文件及记录控制 危险源识别评价 文件及记录控制 EHS工程师 5.2 获取的范围Scope A. 国家环境、职业健康和安全的法律、法规和有关标准和技术规范;National legal requirements on environment, occupational health and safety, related standards and technical specifications.B. 地方的环境、职业健康和安全的法律、法规和有关标准和技术规范;Local legal requirements on environment, occupational health and safety, related standards and technical specifications.C. 相关方要求,如集团要求,来自行业协会、重大客户等的要求。Requirements from interested parties, such as group,industrial institute, important customer, etc.5.3 获取的途径和方法Approaches and methods5.3.1 可通过以下渠道获取有关法律、法规及其他要求的信息(不局限于):Could acquire information about legal requirements and other requirements through below channel but not limited to:A. 政府及上级部门如:环保局、安监局等;Government or superior department: environmental protection bureau, National Safety Production Supervising Bureau, etc.B. 政府网站:Government internetl 上海市政府Shanghai municipal government:/l 中国法律法规检索系统Chinese Legal Requirements Search System:99/home/begin.cbsl 国家安监局National Safety Production Supervising Bureaul 国家环保局 National environmental protection bureau5.3.2 获取与沟通方式Obtaining means of communicationA. 可通过公司局域网、电话、E-mail等方式 Local area internet, telephone, E-mail, etc.B. 会议、通知等形式。Meeting, notice, etc.5.4 法规及其他要求信息管理Management of communication about legal requirements5.4.1 获取Obtaining EHS主管每月到相关网站上浏览有关法规信息,发现有新的或修改的法律法规信息应及时进行收集。Every month the EHS officer shall follow up any changes of national laws and rules and collect them. 各有关部门在与上级部门、政府、客户沟通过程中发现有关新的法律法规信息或其他有关环境/职业健康和安全的要求信息应及时进行收集。During the process of communicate with superior department, government and customers, each related department shall collect related legal requirements and other requirements on EHS.5.4.2 识别Identification 各相关部门在获取有关信息后应及时传递给EHS主管,让其进行适用性识别Each related department shall report information to EHS officer who then identify them in time. EHS主管对自己收集的或其他相关部门传递的法规及其他要求信息进行适用行识别。EHS officer identify the conformity of legal requirements collected himself or by other departments. 适用性识别可以通过阅读或组织相关人员进行讨论分析等方法进行。Identification of conformity could be carried out through reading or organize related people to discuss and analyze. 判断原则 Principles of identificationA. 与公司环境因素/危险源有关的法规及其他要求;Legal requirements and other requirements related to organizations environmental aspects and hazardsB. 与公司环境/职业健康和安全管理活动有关的法规及其他要求。Legal requirements and other requirements related to the management of activities related to organizations EHS.5.5 EHS主管对经识别适用公司的法规及其他要求登录于法规及其他要求信息识别表。并登录于适用法规及其他要求信息一览表。EHS officer record applicable legal and other requirements on the identification form of legal and other requirements as well as the list of applicable legal and other requirements.5.5.1 EHS主管负责将有关获取适用的法规及其他要求信息在公司网络上发布或将书面的资料装订保存。涉及电子文件或书面的资料管理按文件及记录控制程序要求实施。EHS officer should publicize the legal requirements and other information on the net of company or stitch and save the written data. The management of Electronic document or written data should be assessed according to Document and record control procedure.5.5.2 传递和落实 Pass and fulfill 对法律、法规及其他要求的变化可能会对公司管理及服务产生重大影响时,EHS主管应将变化情况上报管理者代表,并向相关部门进行书面通报。As to those changes of legal requirements and other requirements could bring severe influence to the management and service of organization, EHS officer should report the change to management representative and inform related departments through written means. EHS主管将法规及其他要求信息识别表通过网络、资料发放、会议等形式通知所涉及的相关部门,并应在需要时及时告知来访者与合同方。EHS officer should inform the identification form of legal and other requirements to related departments through internet of company, data distribution or conference, etc. EHS主管根据所识别的法规及其他要求的内容,及时调整环境因素/危险源控制策划结果,具体参见危险源识别、评价、策划程序、环境因素识别评价程序。EHS officer should adjust the control planning of hazards in time according to content of the legal and other requirements identified. For details refer to the Identification, evaluation and plan of hazards procedure, Identification and evaluation of environmental aspects procedure 各相关部门在获取信息后可通过网络或向EHS主管获取具体有关信息。需要复制书面资料,EHS主管应按文件及记录控制程序要求对所发放的资料进行有效性控制。Each related department could obtain details about the legal and other requirements through internet or ask the EHS officer. If there is need to copy with written information, EHS officer should effectively control as the requirements of document and record control procedure. 各相关部门根据法规及其他要求的内容对本部门所涉及的岗位人员进行传达和培训。涉及培训的按培训管理程序要求进行。Each related department train the employees of its department as the legal requirements and other requirements. 各相关部门根据法规及其他要求的内容结合本部门实际管理现状根据需要编制修定有关管理制度。涉及制度的编制修改按文件及记录控制程序要求实施。Each related department compile and modify relevant regulations according to legal and other requirements considering the management status of its department. 各有关部门应根据所涉及的法规及其他要求的变化及时调整需要监测和测量的项目和内容。监测和测量内容参见监测和测量程序。Every related department adjust the item and content which need monitoring and measurement in time, according to the content of legal and other requirements. The content of monitoring and measurement refer to Monitoring and Measurement Procedure. 5.6 合规性评价Evaluation of conformity 5.6.1 EHS主管每年的固定时间,根据所收集、识别的法规及其他要求内容结合公司的实际情况进行评价,得出合规性评价报告。EHS officer should collect and analyze the information in the companyc in fixed time every year according to the content of legal and other requirements ,and fill in the report of evaluation of conformity at this year.5.6.2 形成的本年度的合规性评价报告经管理者代表审核后,EHS主管以文件形式将其发放给各部门。并作为管理评审的输入内容之一。The report of evaluation of conformity at this year is released to each department by the EHS officer after being verified by the MR and as the input of management review.5.7 信息管理 Information Management 5.7.1 EHS主管每年年初应将适用法规及其他要求信息一览表进行更新一次,并进行发放。EHS officer shall renew the list of applicable legal and other requirements at the beginning of every year and release.5.7.2 对所获取的、适用公司
