The rights and obligations of each side are as follows: 第一条 劳动合同期限Article 1 Labour Contract Time Period1.1 本合同期限类型为期限劳动合同。1.1 This contract is for a(n) unlimited / limited time period. 1.2 合同期限自年月日至年月日止。1.2 Contract term is from_ Year_Month_Day to_Year_Month_Day. 1.3 自合同生效之日起个月为试用期。1.3 _ month(s) will serve as the probationary period from the day this contract goes into effect. 第二条 工作岗位、工作职责Article 2 Work Position and Duty 2.1 甲方安排乙方到_部门,担任_职位,乙方必须按甲方确定的职务说明书的工作内容,按时、按质、按量完成甲方分配的工作(生产)任务;2.1 Party A arranges for Party B to work in_department, serving as_position_. Party B, according to the Party A-approved stipulations for the particular post as stated in the work manual, must complete assignments for Party A on time and according to certain quality and quantity standards;2.2甲方根据生产经营的需要以及依据乙方的能力(专业、技能、健康)和工作表现,可在协商一致的基础上调整或重新分配乙方的工作职位,如乙方同意被分派到一个不同的职位,则甲方有权根据该职位的要求和该职位的市场情况重新审定和调整乙方的报酬。2.2 According to the needs of production and management of Party A, and according to the ability (specialty, skill, health) and work performance of Party B, Party A can adjust the working position of Party B, or reassign Party B to other positions on a consensual basis. If Party B agrees to be assigned to a different position, Party A, according to the duties of this position and market conditions, has the right to authorize and adjust the remuneration of Party B. 第三条 工作时间Article 3 Working Time3.1 甲方实行每周正常的工作时间40小时(用餐、休息时间除外),特殊岗位需实行不定时工作制或综合计时制的,双方将另行签订补充协议。3.1 Party A will implement an ordinary work week of 40 hours (excluding meals and rest periods). For special positions that require an indefinite period of time or a certain accumulated amount of time, both sides will sign a separate supplementary agreement. 3.2甲方因工作需要,如需延长工作时间的,应按国家有关规定执行。3.2 Due to the needs of work, Party A shall comply with all relevant state regulations in carrying out an extension of the work period. 3.3甲方应按国家有关规定支付乙方加班费。3.3 Party A shall pay Party B overtime according to the pertinent regulations of the state. 第四条 劳动保护和劳动条件 Article 4 Labour Protection and Working Conditions 4.1甲方应按中华人民共和国劳动法规定,必须为乙方提供符合国家规定、安全卫生的工作环境,保证乙方在人身安全及人体不受危害的环境条件下工作;甲方根据乙方的岗位实际情况,按照国家及甲方的规定向乙方提供必要的劳动防护用品。4.1 Party A shall, according to The Labour Law of the Peoples Republic of China, conform to the state regulations in providing for Party B a safe and healthy working environment, and guarantees that Party B works under conditions where personal security and the human body are not endangered; according to the working conditions of Party B, and according to the regulations of the State and Party A, Party A shall provide to Party B any necessary protective articles. 4.2甲方负责对乙方进行职业道德、业务技术、劳动安全卫生及各种规章制度的教育和培训。包括但不限于人事手册在内的甲方各类的培训材料及培训内容均可作为对乙方工作表现的考核标准4.2 Party A is responsible for carrying out education and training regarding professional ethics, business technology, labour safety and hygiene and other various regulations. Party Bs work performance will be assessed according to Party As various trainings and related materials including, but not limited to, the Personnel Manual.第五条 劳动报酬Article 5 Labour Remuneration 5.1乙方的税前工资为每月人民币_ 元,试用期税前工资每月人民币_ 元。乙方的奖金、津贴由甲方按国家规定支付。5.1 The monthly pretax salary of Party B will be RMB_, pretax monthly salary during the probationary period will be RMB_. Bonuses and subsidies for Party B shall be paid by Party A according to national regulations. 5.2甲方遇生产(工作)不景气时,支付乙方的收入不低于本市规定的最低工资标准。5.2 If Party As production (work) demand becomes depressed, the income which Party A pays to Party B must not be lower than the minimum wage stipulated by local city standards.5.3甲方按本公司规定的工资形式和考核办法确定乙方的劳动所得,甲方按月支付乙方工资,乙方必须按国家规定缴纳个人所得税,月薪制工资发放时间为每月 _ 日,并以银行卡转帐的方式向乙方支付。5.3 Party A shall, according to the companys rules on wage distribution and according to a defined method of assessment, determine Party Bs labor income. Party A pays Party Bs salary monthly, Party B must according to national regulations pay individual income tax. The monthly salary will be paid to Party B on _ of each month by way of bank card.5.4甲方可根据乙方的工作业绩及表现和甲方的经营状况对乙方的工作岗位进行调整,人力资源部门事先会做书面通知,乙方对此表示同意。5.4 According to the achievement and performance of Party B and the managing requirements of Party A, Party A may adjust Party Bs position. The Human Resources department shall notify Party B in writing, and Party B may express their consent for an adjustment to occur. 5.5甲方实行新的工资制度或乙方的岗位变动时,乙方的工资待遇按甲方规定予以调整,人力资源部门事先会做书面通知,乙方对此表示同意。5.5 When Party A implements a new wage system or Party Bs position is changed, the salary of Party B will be adjusted according to Party As regulations, and the Human Resource Department shall in writing notify Party B in advance and Party Bs consent is required.第六条 休息休假Article 6 Rest and Holidays 6.1 乙方有权享用下列法定节假日。元旦 1 天春节 3 天清明节1 天国际劳动节天端午节天中秋节天国庆节 3 天具体时间根据政府公告为准。6.1 Party B is entitled to the following legal festivals or holidays:New Years Day - One daySpring Festival - 3 days Qing Ming Day - One dayInternational Labour Day - One day Dragon Boat Festival - One day Mid-autumn Festival - One day National Day - 3 days The specific times for these holidays and festivals will be announced by the government, and duly followed. 第七条劳动保险、福利待遇 Article 7 Labor Insurance and Welfare 7.1甲方按照国家劳动保险条例的规定为乙方缴纳相应的保险,具体的实施方案参照人事手册。7.1 Party A shall pay the corresponding insurance for Party B according to the provisions of the national labor insurance regulations. The Personnel Manual should be consulted for specifics. 7.2 乙方享有国家规定的法定节假日、公休假日等待遇按甲方依法制定的人事手册中的有关规定执行。7.2 The remuneration paid to Party B during national and official holidays will be carried out under the terms specified in the Personnel Manual legally drafted by Party A. 7.3 甲方向乙方支付政府及甲方规定的福利费用。7.3 Party A shall pay welfare expenses to Party B according to national regulations and Party As rules. 7.4 女职工按照国家规定享有女工保护的有关待遇。7.4 Female employees shall, according to national regulations, enjoy relevant protective treatment. 第八条劳动纪律Article 8 Labour Discipline 8.1合同期内,甲乙双方均须严格遵守执行国家有关法律、法规和政策、乙方应严格遵守甲方依法制定的人事手册及各项规章制度,严格遵守劳动安全卫生、生产工艺、操作规程和工作规范;爱护甲方的财产,遵守职业道德;积极参加甲方组织的培训,维护甲方的声誉和利益。甲方制定的各项企业规章制度通过张贴和公开培训的方式公示,同时员工也可以到部门主管或人力资源部查询。8.1 Within the contractual period, both parties shall strictly observe and adhere to all relevant national laws, regulations, and policies. Party B shall strictly observe the stipulations contained in the Personnel Manual and various rules and regulations Party A makes in accordance with the law, and strictly observe labour safety and hygiene, production technology, operational procedure and working norms; protect the property of Party A, observe professional ethics; participate in the training that Party A organized, safeguard the reputation and interests of Party A. Party A will announce its own regulations by way of posting or public trainings, or by inquiring with the department head or at the Human Resources Department.8.2 乙方违反劳动纪律,甲方可依据公司规章制度给予纪律处分,直至解除劳动合同。8.2 If Party B violates the labour discipline rules, Party A may mete out disciplinary punishment according to company rules and regulations, up to cancelling the labour contract. 8.3 乙方应遵守甲方规定的工作程序、保密规定等制度,恪尽职守,不得存有任何有损甲方经营利益的行为。8.3 Party B should abide by Party As working rules and regulations regarding working procedures and secrecy. Party B shall scrupulously abide by the duties of their post, and not engage in any behavior that would be harmful in any way to Party A.8.4 因乙方违反劳动纪律和其他任何形式的过错行为,导致甲方包含物质、声誉等经济利益损失,乙方应对甲方进行经济赔偿,赔偿方式包括工资扣除等其他甲方认可的方式。甲乙双方应就保密以及竞业限制事宜另行签署保密与竞业限制协议。8.4 If Party B violates the rules of labour discipline or engages in other faulty behaviors, causing Party A to suffer economic loss including material and reputational damage, Party B shall compensate Party A. Compensation shall take the form of wage deduction or any other means approved by Party A. Both sides shall sign a confidentiality and non-competition agreement separately.第九条劳动合同终止、解除的条件 Article 9 Conditions that Terminate or Cancel the Labour Contract. 9.1 下列情形之一的,甲方可以不提前通知乙方解除合同,辞退乙方:(1)试用期间被证明不符合录用条件的;(2)严重违反劳动纪律或者甲方规章制度的;(3)严重失职、营私舞弊,对甲方利益造成重大损害的;(4)被依法追究刑事责任或者劳动教养的。(5)法律、法规规定的其他情形。9.1 Party A may cancel the labour contract with Party B without prior notification for any of the following reasons: ( 1) During the probationary period, there is proof of non-conformity with job requirements; ( 2) Serious violation of labour disciplinary rules or Party As rules and regulations; ( 3) Serious neglect of ones duty or engage in fraud causing great harm to Party As interests; ( 4) Guilty of a crime or sentenced to re-education-through-labor in accordance with the law; ( 5) Other situations or provisions of the law and regulation. 9.2 符合下列情形之一的,甲方可以解除劳动合同,但应提前30天以书面形式通知乙方:9.2 Under any of the following situations, Party A may cancel the labour contract, but must give 30 days advance notice to Party B in writing: (1)乙方患病或者非因工负伤,医疗期满后不能从事原工作,也不能从事甲方另行安排的工作的;(2)乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;(3)劳动合同订立时所依据的客观情况发生重大变化,致使原劳动合同无法履行,经甲乙双方协商不能就变更劳动合同达成协议的;(4)甲方的经营或技术状况发生重大变化,人员确有多余或本合同约定的乙方岗位消失而无法安排的 (1) Due to illness or non-work-related injury, and after a period of medical treatment, Party B can neither be engaged in the original work for which they were hired, nor other work arrangements made by Party A for Party B;(2)Party B is found to be not competent at the work, and after training and adjusting of the work position, Party Bs competency is still found to be lacking;(3) Upon the entering into this labor contract, an objectively drastic change in circumstances occurs, such that the original labour contract cannot be fulfilled, and both parties cannot agree on a modification of the terms;(4) A significant change takes place in the management or technological circumstances of Party A, such that there becomes a number of personnel who are superfluous to the workings of the company, or that different positions in the company disappear but cannot be rearranged by the company. 9.3 符合下列情形之一的,乙方可以解除劳动合同:9.3 Under the following situations, Party B can cancel the labour contract: (1) 甲方不按本合同约定,向乙方支付劳动报酬、社会保险费或提供劳动条件的;(2) 甲方以暴力威胁或非法限制人身自由的手段强迫乙方劳动的;(3) 法律、行政法规规定的其他情形。 乙方在试用期内解除劳动合同,应当提前三天以书面形式通知甲方。 (1) Party A does not abide by the terms of this contract to pay labour remuneration, social insurance premium or provide working conditions to Party B; (2) Party A forces Party B to work through the use of threats of violence and limitations on personal freedom; (3) Other situations that are stipulated by law or administrative regulation. If Party B cancels the labour contract within the probationary period, they should give three days advance notice to Party A in writing. 9.4 符合下列情形之一的,甲方不得根据上述第9.2条终止或解除劳动合同:9.4 Under any of the following situations, Party A may not terminate or cancel the labour contract according to the above-mentioned article 9.2 : (1)乙方患病或非因工负伤在规定的医疗期内的;(2)乙方因工负伤或患职业病在规定的医疗期间的;(3)乙方在孕期、产期和哺乳期内的;(4)法律、法规规定的其他情形。(1)Party B becomes ill or injured due to a non-work-related incident, and is undergoing stipulated medical treatment; (2)Party B suffers a work-related injury or occupational disease, and is undergoing stipulated medical treatment;(3)Party B is pregnant, has just given birth, or nursing; (4)Other situations stipulated by law or regulation. 9.5 甲乙双方协商一致,可以解除劳动合同。9.5 If Both sides are in agreement, the labour contract may be cancelled. 9.6 本合同期满,由于生产、工作需要,经甲乙双方协商一致,可续订合同。9.6 At the expiration of this contract, because of production or labour need, both sides may arrive at a consensus to renew the contract.第十条 教育培训Article 10 Education and Training 10.1在乙方被聘用期间,甲方负责对乙方进行职业道德、业务技术、安全生产及各种规章制度的在职培训。10.1 At the time of Party Bs employment, Party A is responsible for carrying out on-the-job training for professional ethics, business technology, security and various rules and regulations. 10.2如果在合同期间,由甲方出资培训(含境内、外实行进修),甲方将与乙方另行签订培训协议。培训协议期限与本劳动合同期限不一致时,员工须优先履行培训协议期限。10.2 If during the contract term Party A has paid for training (whether domestically or internationally), Party A and Party B will sign a separate Training Agreement. If the time terms of the training agreement and this labour contract are not in accordance, Party B will give priority to the time limit of the training agreement. 10.3如果乙方在合同期内受过甲方出资培训,乙方在培训期间及规定的服务期间因乙方责任或个人原因或非其他甲方原因解除劳动合同的,须按双方签订的培训协议赔偿有关的培训费用。 10.3 If Party B has accepted any training paid by Party A during the term of this contract, and if Party B cancels the labour contract during the training period and the stipulated serving period due to Partys Bs responsibilities or personal reasons or other reasons not caused by Party A, Party B shall, according to the Training Agreement signed by both parties, compensate Party A for the related training fees.第十一条违约责任Article 11 Liability for Breach of Contract11.1甲乙双方任何一方违反本合同及人事手册,给对方造成经济损失或损害的,都须承担经济赔偿责任,具体赔偿金额按国家和本市有关规定,根据违约方的责任大小确定及给对方造成的经济损失的程度确定。11.1 If either party violates terms of this labour contract and the Personnel Manual, causing economic loss or harm to the other side, the violating side shall be liable for economic compensation. The specific amount of compensation will be calculated according to the relevant regulations of the country and local city, according to the degree of responsibility of the delinquent party, and to the degree of the economic losses confirmed and caused to the other side.11.2 对于本合同第九条第一款解除劳动关系的情形,甲方不向乙方支付任何补偿,乙方如对甲方造成损失的,应当依法承担赔偿责任。11.2 With regard to the cancellation provisions of this contract in Section 9, Part 1, Party A does not pay any compensation to Party B. If Party B caused loss or damage to Party A, Party B shall be liable for compensation in accordance with the law. 第十二条劳动争议的处理Article 12 Resolution of Labour Dispute12.1甲乙双方因履行本合同发生的争议,应协商解决;协商不成,当事人任何一方可向甲方注册地或经营地的劳动争议仲裁委员会申请仲裁。对裁决不服的,可在接到裁决书后法定期限内,向人民法院提起诉讼。12.1 If in the implementation of this agreement a dispute arises between Party A and B, there shall be a negotiated settlement; If resolution through negotiation cannot occur, either party can apply to the labour dispute arbitration commission which is located in the registered place or operational place of Party A for arbitration. If either party does not accept the arbitration award, they may within a legal time limit bring a suit with an appropriate peoples court.第十三条其他13.1本合同一式两份,甲乙双方各持一份,在甲乙双方签字后生效,合同履行完毕时失效,两份具有同等法律效力;13.1 This contract is done in duplicate, and both sides each will hold one copy, which comes into force after both copies are signed by both parties.
