英汉法律术语翻译中的对应异差及其等效补偿策略.pdf

摘要 在诸多法律翻译所出现的问题中 法律术语误译是本文的核心内容 尽管最 近几年这方面已经取得了卓越的成果 越来越多的研究论文和不断改善的翻译作 品就是最好的印证 但目前英汉法律术语翻译因多方面原因仍不尽人意 许多理 论和实践性问题还有待解决 所以 在这方面进行全面深入的研究显得非常紧迫 也非常的有必要 这也是本篇作者一直致力于法律术语的英汉翻译研究的原因 本文开篇先研究了法律术语的词源和特征 研究表明英语法律术语主要来源 于拉丁语和法语外来词 随着西方法律系统的发展而完善而出现的法律新词 基 于古英语和中世纪英语的古语词 而汉语法律术语大部分来自于 般汉字 然而 在语言特点上 他们都具有语体正式性 词义单一性 反义性和语用行事性等特 征 随后 本文探析了英汉法律术语翻译中的对应异差 主要包含欠对等 伪对 等和部分对等三方面内容 这在很大程度上是因为中西方不同的法律系统 文化 和上下文背景 不同的法律系统和文化已经形成具有自己特点的历史 哲学或思 想观念 操作机制和推理方式以满足特定国家的需求 从而产生不同的法律术语 表达和法律行为程序 而这些术语 表达和行为程序的翻译产生对应异常也就在 所难免 在认识到其根本原因的基础上解决这些翻译异差 本文提出基于功能等效的 法律术语翻译补偿策略 这基于主流补偿理论框架 例如奈达的动态对等 旨在 追求源语与目标语之间的超语言交际效果 诺德的目的法则旨在高度关注目标文 本的预期交际目的 强调决定翻译过程的最主要因素正是整体翻译行为的目的 莫纳 贝克的表述 其综合了语言学学术思想和方法以及文化研究 哈维和希金 斯对翻译补偿的分类以及其在翻译和语用学领域的研究 基于这些补偿理论 作者进一步提出了具体的补偿策略以获得功能对等 a 直译 加尾注或脚注 由于一种法律系统的法律概念和事实可能或部分等同于 另一法律系统的法律概念和事实 同时
