Unless otherwise specified in the Contract Documents, the Work includes all labor necessary to provide such construction, supervision, and direction, all materials and equipment incorporated or to be incorporated in the construction, and all other obligations assumed by the Contractor under this Contract. The Work encompasses activities and items described below, in Exhibit , and assigned to the Contractor in other parts of these Contract Documents.1.2.1基本工程任务Basic Work Tasks.当业主颁发授权指示承包商为项目的全部或任何部分实施工程时,且在该等授权的限度内,承包商应着手完成以下任务:When and to the extent that authorization is issued by the Owner directing the Contractor to proceed with the Work for all or any part of the Project, the Contractor shall proceed to complete the following tasks:1.2.1.1就完成工程所需的材料、供给品、机器、设备及其租金、设备维修及服务的分包合同(包括采购订单),制作招标文件或建议书,获得并且评估投标书和/或议定的建议书。承包商应负责对拟议投标人的经验和其他资质进行详细调查。Preparing requests for bids or proposals and obtaining and evaluating the bids and/or negotiated proposals for Subcontracts, including purchase orders, for materials, supplies, machinery, equipment, rentals thereof, repairs to equipment, and services needed to complete the Work. Detailed investigations of the experience and other qualifications of proposed bidders are the responsibility of the Contractor.1.2.1.2拟定并授予因中标和/或承诺接受建议书而成立的分包合同。分包合同应以承包商的名义签署。该等分包合同应受限于业主事先的批准以及通用条件第6.4款的规定。Assembling and awarding the Subcontracts resulting from the acceptance of bids and/or proposals. The execution of the Subcontracts shall be in the name of the Contractor. Such Subcontracts shall be subject to the prior approval of the Owner and to the provisions of Paragraph 6.4 of the General Conditions. 1.2.1.3为有效监督、指挥并协调其分包商的人员,以便根据本合同的所有要求完成工程,提供符合本行业良好惯例标准的人员、技术和良好判断力。Furnishing the staff and the skill and good judgment, consistent with standards of good practice in the industry, for the purpose of effectively supervising, directing, and coordinating the forces of his Subcontractors in order to complete the Work in accordance with all requirements of this Contract.1.2.1.4依靠分包商的力量,以及就未分配给分包商的工程部分,依靠承包商自有的力量,共同完成所有施工工程。Furnishing all construction Work using the forces of the Subcontractors and using the Contractors own forces for those portions of the Work not assigned to Subcontractors.1.2.1.5根据下文第4.2款规定的要求,制订并定期更新项目的施工进度表,并协调分包商(包括供应商)的活动以确保对进度表的遵守。Establishing and periodically updating a Construction Schedule for the Project, as required under Paragraph 4.2, below, and coordinating the activities of the Subcontractors (including suppliers) to assure adherence to the Schedule.1.2.1.6获得、核实、评估并向业主提供来自各分包商(包括材料供应商)的成本和价格明细,该等明细应包含由其提供的工程,包括变更指令工程。Obtaining, verifying, evaluating, and furnishing to the Owner a cost and price breakdown from each Subcontractor (including material suppliers) which covers the Work, including Change Order Work, to be furnished by him.1.2.1.7获得、核实并向业主传达所有就分包商(包括材料供应商)提供的工程而提出的额外补偿的请求、变更指令以及请求支付工程款的申请。Obtaining, verifying, and transmitting to the Owner all claims for extra compensation, Change Orders, and Applications for Payment for Work furnished by Subcontractors, including material suppliers.1.2.1.8获得、为审查是否符合合同的要求而审阅以及向业主传达工程所需的所有提交文件,包括但不限于,保险证明、保函(若有)、施工图、产品数据、样本、保证、运营和维护指示、检验证书以及政府批文。Obtaining, reviewing for compliance with Contract requirements, and transmitting to the Owner all submittals required for the Work, including but not limited to, insurance certificates, bonds (if any), Shop Drawings, Product Data, Samples, guarantees, operation and maintenance instructions, certificates of inspection, and government approvals.1.2.1.9对于工程实施检验和其他检查,以确保其自身实施的工程和分包商的工程完全达到合同文件的全部要求,并及时向业主报告任何重大的不符之处。Conducting inspections and other investigations of the Work to assure that his own Work and the Work of the Subcontractors achieve full compliance with all of the requirements of these Contract Documents, and promptly reporting any significant deviations to the Owner.1.2.1.10制作、更新并按月向业主提交一份现金流的估算、一份所预计的成本的摘要,且若业主及当业主要求时,按业主要求的内容和格式,提交一份详细的预算成本的估算和一份详细的成本状态报告。Preparing, updating, and submitting to the Owner on a monthly basis, a cash flow estimate and a summary of anticipated costs and, if and when requested by the Owner, a detailed budget cost estimate and detailed cost status reports, and in such detail and form as the Owner may require.1.2.1.11维持项目记录和账目。Maintaining Project records and accounts.1.2.1.12为项目安全、健康、环境保护和劳动关系建立符合适用的国家和地方法律、法规和规章的方案。Establishing programs for Project safety, health, environmental protection and labor relations, all in compliance with applicable state and local laws, regulations and rules.1.2.1.13迅速纠正根据通用条件第15.4款而制作的缺陷和未完成工程清单中所列的所有项目。Expediting the correction of all items on the punch list of defective and uncompleted Work prepared in accordance with Paragraph 15.4 of the General Conditions.1.2.1.14为业主制作一套可复制的显示所有在施工过程中做出的变更的竣工图纸,该等图纸的制作应基于承包商和其分包商可获得的标注的照片、图纸以及其他数据。Preparing for the Owner a set of reproducible as-built drawings (Record Drawings) showing those changes made during the construction process, which drawings shall be based on the marked-up prints, drawings, and other data available to the Contractor and his Subcontractors.1.2.2选定的替代项目Selected Alternatives.以下替代项目已被选定,特此列为工程的一部分:_The following alternatives have been selected and are hereby included as part of the Work:_1.3工程的变更CHANGES IN THE WORK.业主可根据通用条件第10条要求对工程进行变更。该等变更包括了根据通用条件第11条执行的合同价格的变更和/或根据通用条件第12条执行的合同时间的变更。The Owner may order changes in the Work in accordance with Article 10 of the General Conditions. NOTICES.3.1与合同文件相关的所有通知应以书面方式做出,并且,在发送致业主的情形下,若以面呈或以电报或快件或普通邮件的方式发送给业主代表至上述第2.1款提供的地址,则该等通知应已充分。All notices pertaining to the Contract Documents shall be made in writing and, if to the Owner, shall be sufficient if delivered personally or sent by telex, telegram, or express or regular mail to the Owners Representative at the address noted in Paragraph 2.1, above.3.2对于所有须递交给承包商的通知,若是以面呈或以电报或快件或普通邮件的方式发送给承包商的项目经理至上述第2.3款提供的地址,则该等通知应已充分。All notices to be delivered to the Contractor shall be sufficient if delivered personally or sent by telex, telegram, or express or regular mail to the Contractors Project Manager at the address noted in Paragraph 2.3, above.第四条合同时间 ARTICLE 4. CONTRACT TIME.4.1所有列于本第4条和其他列于合同文件中的时间限制对于本合同来说均是至关重要的。承包方应在接到中标通知书的*日内在业主的配合下取得施工许可, 并在取得该许可的*日内开始工程。其应以足够的人力令工程迅速推进,并且在_前达到实质竣工,能令项目设施已具备为业主所占有和使用的条件(“合同时间”)。而且,承包商应于_前达到本合同所要求的最终竣工。All time limits stated in this Article 4 and elsewhere in the Contract Documents are of the essence of the Contract. The Contractor shall obtain the construction permit within * days after he receives bid-winning notice with the cooperation of the Owner and begin the Work within * days after receipt of the construction permit. He shall carry the Work forward expeditiously with adequate forces and shall achieve Substantial Completion by having the Project facility ready for occupancy and use by the Owner by , the Contract Time. Further, the Contractor shall achieve Final Completion as required by the Contract by . 4.2承包商应根据业主的要求制作、解释并不时地更新并修改施工进度表以及适当的分进度表。进度表和分进度表应通过能使工程在合同时间内完成的建设和行政活动,来显示完整的工程顺序。承包商承认施工进度表是本合同的一项重要条件,且若工程未按施工进度表进行,业主将会遭受重大的损失。The Contractor shall prepare, explain, and, from time to time, update and revise a Construction Schedule, with appropriate subschedules, in accordance with the requirements of the Owner. The Schedule and subschedules shall show the complete sequence of the Work by construction and administrative activity which shall lead to completion of the Work within the Contract Time. The Contractor recognizes that the Construction Schedule is an essential condition of the Contract and that the Owner would suffer substantial damages if the Work is not provided in accordance with the Construction Schedule.4.3在承包商开始工程后直到最终竣工,业主将对照施工进度表定期地确定工程的实际进度。若承包商因任何原因(除因通用条件第12.1款项下的允许的迟延外)致使实际进度落后于施工进度表,其应立刻采取,并促使其分包商采取为补救迟延的进度而必须采取的行动。该等行动可包括同时操作、额外增添的设备、额外增添的人力、额外增加的班次、加班及其他措施。承包商为符合或努力符合施工进度表的目的而采取的任何加速行动不应使之得到任何补偿或合同价格的增加,除非是仅由于通用条件第12.1款下描述的允许的迟延,或是由于工程的变更(在工程变更的情况下,合同价格的任何适当的增加应包含在变更指令中),而必须要采取该等行动和增加额外的成本。After commencement of the Work by the Contractor, and until its Final Completion, the Owner will periodically determine the actual progress of the Work against the Construction Schedule. If the Contractor should fall behind the Construction Schedule for any reason except excusable delay under Paragraph 12.1 of the General Conditions, he shall immediately take, and cause his Subcontractors to take, such actions as may be necessary to remedy lack of progress. These actions may include concurrent operations, additional equipment, additional manpower, additional shifts, overtime, and other measures. No compensation or increase in the Contract Price shall be allowed the Contractor for any expediting actions undertaken by him in order to meet, or in an attempt to meet, the Construction Schedule unless such actions and extra costs are necessary only because of an excusable delay of the type described under Paragraph 12.1 of the General Conditions, or because of a change in the Work, in which case any appropriate increase in Contract Price shall be covered by a Change Order.4.4业主有权要求承包商在施工进度表中所示的日期前完成工程或其任何一部分,或即使承包商的延迟请求已根据通用条件第12条的规定被批准,仍然要求承包商按照施工进度表完成工程。业主根据本第4.4款要求的对工程进度的任何加速应限于承包商能合理达到的限度内,并且应使承包商有权获得一项变更指令,以涵盖任何其所承担的因该等加速工作所引起的额外成本。The Owner shall have the right to require the Contractor to complete the Work or any part thereof before the date set forth in the construction Schedule, or to require the Contractor to complete the Work according to the Construction Schedule even though his claim for a delay has been approved under Article 12 of the General Conditions. Any acceleration in the progress of the Work required by the Owner under this Paragraph 4.4 shall be limited to that reasonably attainable by the Contractor and shall entitle the Contractor to a Change Order to cover any additional costs incurred by him as a result of the acceleration.4.5若在任何时间,无论基于何种理由(通用条件第12.1款项下允许的迟延除外),承包商未能保持必要的工程进度,该等变更应如业主所批准的指令,以承包商自己的资源、努力和人力做出。业主的上述行动或业主未采取行动不应免除承包商在本合同项下的任何责任。业主应有权指令承包商在和从业主认为为确保在合同时间内完工而必需的尽可能多的不同点或部分同时实施工程。未能遵守任何该等工程指令应构成对本合同的违约,并可使承包商支付通用条件第12.4款规定的违约金。If at any time, the necessary progress of the Work is not being maintained by the Contractor for reasons other than excusable delay under Paragraph 12.1 of the General Conditions, such changes shall be made in the Contractors resources, effort, and forces, as the Owner may approve of order. Such action by the Owner or the Owners failure to act shall not relieve the Contractor of any responsibility under the Contract. The Owner shall have the right to order the Contractor to prosecute the Work simultaneously at and from as many different points or parts as the Owner may deem necessary to assure completion within the Contract Time. Failure to comply with any such Work Order shall constitute a breach of this Contract and may expose the Contractor to liquidated damages as specified in Paragraph 12.4 of the General Conditions.4.6在与业主间的所有纠纷或异议持续期间,承包商仍应按施工进度表继续实施工程。The Contractor shall carry on the Work in conformance with the Construction Schedule during all disputes or disagreements with the Owner.4.7所有保证工程完工的进度宽裕时间应归业主(支配)。All schedule float shall accrue to the Owner.第五条合同和变更指令价格 ARTICLE 5.
