江苏省工资支付条例Provisions on Wage Payment of Jiangsu Providence(2004年10月22日江苏省第十届人民代表大会常务委员会第十二次会议通过)Provisions on Wage Payment of Jiangsu Providence, examined and approved at the 12th Executive Meeting of the Standing Committee of the NPC of Jiangsu Province on Oct. 22nd, 2004第一章 总则Chapter IGeneral Provisions第一条 为了保护劳动者取得劳动报酬的权利,规范用人单位的工资支付行为,加强对用人单位工资支付行为的监督管理,根据中华人民共和国劳动法和有关法律、行政法规,结合本省实际,制定本条例。 Article 1The present Provisions are formulated in accordance with Labor Law of the Peoples Republic of China, other relevant laws and regulations and practical conditions of the province in order to defend the right of employees to receive remuneration for their work according to law, to regulate and to enforce the supervision on the employing units of their acts of wage payment. 第二条 在本省行政区域内的企业、个体工商户、民办非企业单位(以下统称用人单位)和与之形成劳动关系的劳动者,适用本条例。 Article 2 These Provisions shall apply to the enterprises, privately-owned business and private non-enterprise units(hereinafter referred to as employing units)within the administrative areas of the province as well as the employees who have formed a labor relationship therewith, and supervision and management of wage payment of the employing units by related departments. 国家机关、事业单位、社会团体和与之形成劳动合同关系的劳动者,依照本条例执行。公务员和参照公务员管理的人员工资支付以及国家另有规定的除外。 civil service system 公务员制度These regulations shall be complied with in implementation by government offices, institutions, social organizations and the employees who have formed a labor relationship with these employing units. Public servant, personnel referring the payment terms as public servant or other regulations should be excluded.第三条 县级以上地方人民政府 根据本地区社会经济发展和劳动力供求状况等,定期制定和发布工资水平宏观调控指导政策。 To practice macroeconomic control by stipulating and publishing the instructive police on wage level by the peoples government at or above the county level in accordance with the local social-economic development and market supply of labor. 用人单位应当按照政府工资分配的宏观调控指导政策的要求,结合劳动力市场价格和本单位经济效益,合理确定本单位的工资水平。 用人单位应当建立正常的工资增长机制,根据本单位的经济效益增长情况、当地政府发布的工资指导线、工资指导价位和本地区、行业的职工平均工资水平等,逐步增加劳动者的工资。 第四条 工资分配应当遵循按劳分配的原则,实行同工同酬;工资支付应当遵循诚实信用的原则,按时以货币形式足额支付。 Article 4Wages shall be paid according to the principle of “distribution according to work” and “equal pay for equal work”; and wages shall be paid on time and in full pursuant to the principle of good faith.第五条 县级以上地方人民政府 劳动和社会保障行政部门(以下简称劳动保障行政部门)负责对本行政区域内的工资支付行为进行指导和监督检查。 Article 5The administrative departments of labor security of the peoples government at or above the county level (hereinafter referred to as departments of labor security)shall be responsible for supervision and management of the implementation of these regulations.县级以上地方人民政府人事、经贸、建设、工商管理、人民银行等部门在各自职责范围内,依法对本行政区域内的工资支付行为进行管理和监督。 The administrative departments of human resource, trade & economic, construction, industrial & commercial administration, and Peoples bank at or above the county level shall,within their respective authorities, help the departments of labor security to have the wage payment of employing units well supervised and administered.工会、妇联等组织依法维护劳动者获得劳动报酬的权利。Trade unions and Womens Federation at all level shall safeguard the legitimate rights of the employees in receiving remuneration for their work according to law.第二章 一般规定Chapter IIGeneral Provisions on Wage Payment第六条 用人单位(个体工商户除外)应当就工资分配、工资支付等事项依法制定规章制度。制定规章制度应当听取本单位职工代表大会(职工大会)或者工会组织的意见,并及时在本单位公布,告知本单位全体劳动者。对职工代表大会(职工大会)或者工会组织提出的合理意见,用人单位应当采纳。 Workers Congress in the Corporation第七条 工资分配制度应当包括以下内容: Article 7A wage payment system shall include the following content: (一) 各岗位的工资分配办法;Wage distribution methods for each position(二) 工资正常增长分配办法; Wage increase distribution methods(三) 奖金分配办法; (四) 津贴、补贴分配办法;、(五) 患病、休假等特殊情况下的工资分配办法。第八条 工资支付制度应当明确以下内容:Article 8A wage payment system shall include the following items: (一) 工资支付项目、标准、形式; Forms, items and standards of wage payment;(二) 工资支付周期和日期; Term and date of wage payment;(三) 加班加点工资计算标准;Method of wage payment for overtime;(四) 假期工资支付标准;Method of wage payment for holidays;(五) 依法代扣工资的情形及标准。Withholding, remitting and deduction of wages;第九条 用人单位与职工一方就职工年度工资调整水平和调整部分的分配办法等签订集体合同或者工资专项集体合同,应当采取集体协商的方式。第十条 用人单位与劳动者应当在劳动合同中约定与其岗位相对应的工资分配及支付办法等事项,双方的约定不得违反本单位工资分配和支付制度、集体合同或者工资专项集体合同。第十一条 实行计件工资制的,用人单位确定、调整劳动定额或者计件报酬标准应当遵循科学合理的原则;确 定、调整的劳动定额应当使本单位同岗位百分之九十以上劳动者在法定工作时间内能够完成。Article 11The employing units practicing piecework system shall follow scientific and rational principle in determining and adjusting labor quotas or unit piece. The standard for determining and adjusting labor quotas shall be the amount of work that over 90 percent employees in the same position of the units can finish within legal working hours. Such employing units shall not refuse to execute the minimum wage standards on the pretext of adopting piecework system, and shall not reduce the wage level in disguised forms by raising the labor ratio or lowering the unit piece.第十二条 劳动者提供了正常劳动,用人单位应当按照劳动合同约定的工资标准支付劳动者工资。劳动合同约定的工资标准不得低于当地最低工资标准。 Article 12An employing unit shall pay its employees in accordance with the labor contract for their normal work during legal working hours or working hours agreed in the labor contract. The wage level should not be lower than the local minimum wage standards.劳动者有下列特殊情形之一,但提供了正常劳动的,用人单位支付给劳动者的工资不得低于当地最低工资标准,其中非全日制劳动者的工资不得低于当地小时最低工资标准:(一) 在试用期内的; During probation period; (二) 因用人单位实行预付部分工资、分批支付工资的; (三) 违反用人单位依法制定的规章制度,被用人单位扣除当月部分工资的; (四) 给用人单位造成经济损失,用人单位按照劳动合同的约定以及依法制定的规章制度的规定需要从工资中扣除赔偿费的;(五) 因用人单位生产经营困难不能按工资标准支付工资,经用人单位与本单位工会或者职工代表协商一致后降低工资标准的。 前款第(三)项规定的情形,用人单位扣除劳动者当月工资的部分并不得超过劳动者当月应发工资的百分之二十;第(四)项规定的情形,用人单位和劳动者在经济损失发生后另有约定的除外。 当地最低工资标准由设区的市人民政府根据省人民政府公布的最低工资标准确定;最低工资标准每两年至少调整一次。 劳动合同履行地与用人单位所在地的当地最低工资标准不一致的,适用当地最低工资标准时应当遵循有利于劳动者的原则。第十三条 用人单位应当自劳动者实际履行劳动义务之日起计算劳动者工资。工资支付周期最长不得超过一个月。确定工资支付周期应当遵守下列规定:Article 13An employing unit shall pay wages to its employees at least once each month. An employing unit shall comply with the following prescriptions in determining the term for wage payment:(一) 实行月、周、日、小时工资制的,工资支付周期可以按月、周、日、小时确定;Monthly, weekly, daily and hourly wages shall be paid as per the term agreed between the two parties;(二) 实行年薪制或者按考核周期支付工资的,应当每月预付部分工资,年终或者考核周期期满后结算并付清; If an employing unit has a yearly salary system or it pays wages according to an assessment term, the unit shall pay part of wages in advance every month, and pay off at the end of each year or upon expiry of the evaluation period.(三) 实行计件工资制或者其他相类似工资支付形式的,工资支付周期可以按计件完成情况约定; As for wages paid on the basis of piecework or wages paid upon completion of certain tasks, the payment term can be agreed upon in accordance with the pieces of work or tasks completed. (四) 以完成一定工作任务计发工资的,在工作任务完成后结算并付清。结算周期超过一个月的,用人单位应当每月预付工资;However, in case the payment term exceeds one month, the wages shall be paid in part in advance each month; (五) 建筑施工企业经与劳动者协商后实行分批支付工资的,应当每月预付部分工资,每半年至少结算一次并付清,第二年一月份上旬前结算并付清上年度全年工资余额。While in case the payment term exceeds one year, the wages shall be settled and paid off at least once in every six months.第十四条 用人单位应当在与劳动者约定的日期支付工资;没有约定工资支付日期的,按照用人单位规定的日期支付工资。工资支付日期如遇法定节假日或者休息日,应当在此之前的工作日提前支付。Article 14 An employing unit shall pay wages to its employees on the agreed date; if there is no agreement on the date for wage payment; the payment shall be made on the date set by the unit. If a date of wage payment happens to be a legal holiday or a non-business day, the payment shall be made in a preceding business day.第十五条 用人单位应当以货币形式支付劳动者工资,不得以实物、有价证券等形式替代,不得规定劳动者在指定地点、场合消费,也不得规定劳动者的消费方式。Article 15 An employing unit shall pay wages by cash, and not in kind or portfolio. An employing unit shall pay wages to employees themselves. Where the employees cannot take their wages in person for some reason, they may entrust other people to take the wages instead. 第十六条 用人单位可以与银行签订代为支付工资协议,在银行设立工资专用账户,并在本单位工资支付日前将劳动者工资足额纳入工资专用账户,由银行在协议约定的时间内代为支付劳动者工资。Article 16An employing unit can entrust a bank with wage payment and the wages shall be deposited in full into employees personal accounts on the date agreed for wage payment. 第十七条 用人单位应当书面记录支付劳动者工资的应发项目及数额、实发数额、支付日期、支付周期、依法扣除项目及数额、领取者姓名等内容。Article 17An employing unit shall formulate a wage payment table for paying wages according to the wage payment terms. A wage payment table shall have records of the name of the unit to make payments, date of wage payment, names of employees, working hours, items and amount payable and deductible, signature of the employees (or persons entrusted to collect the payment), voucher of wage payment of banks, and others. 用人单位应当建立劳动考勤制度,书面记录劳动者的出勤情况,每月与劳动者核对并由劳动者签字。用人单位保存劳动考勤记录不得少于二年。 A wage payment table shall be kept at least for 2 years for future reference.用人单位不得伪造、变造、隐匿、销毁工资支付记录及劳动者出勤记录。第十八条 用人单位应当将工资支付给劳动者本人,并同时提供本人的工资清单。劳动者实际取得的工资与工资清单以及用人单位的工资支付记录应当一致。劳动者有权查询和核对本人的工资。 Article 18When paying employees wages, an employing unit shall provide its employees with pay lists. The contents of pay lists shall be identical with those of wage payment tables. The employees have the right to enquire about and check their pay lists. 第十九条 用人单位与劳动者依法解除或者终止劳动关系的,应当在劳动关系解除或者终止之日起两个工作日内一次性付清劳动者工资。双方另有约定的除外。 Article 19When a labor contract between an employing unit and an employee is canceled or terminated according to law, the wages shall be computed to the date of the termination and paid in full within 2 working days from the date of cancellation or termination of the labor relationship; if the two parties have otherwise agreed, such agreement shall be complied with. 劳动者死亡的,用人单位应当按照满一个工资支付周期支付其工资。第三章 特殊规定Chapter IIISpecial Provisions on Wage Payment第二十条 用人单位安排劳动者加班加点,应当按照下列标准支付劳动者加班加点的工资:Article 18 Where an employing unit arranges its employees to work beyond the statutory standard working hours, it shall pay them overtime wages according to the following rates:(一) 工作日延长劳动时间的,按照不低于本人工资的百分之一百五十支付加点工资;To pay employees no less than 150 percent of their hourly wage in case of overtime beyond normal working hours;(二) 在休息日劳动又不能在六个月之内安排同等时间补休的,按照不低于本人工资的百分之二百支付加班工资; To pay the employees no less than 200 percent of their daily or hourly wage in case of overtime on a non-business day;(三) 在法定休假日劳动的,按照不低于本人工资的百分之三百支付加班工资。 To pay the employees no less than 300 percent of their daily or hourly wage in case of overtime on legal holidays.前款第(一)项、第(三)项的加班加点工资支付周期自加班加点当日起最长不得超过一个月;第(二)项的加班工资支付周期自加班当日起最长不得超过六个月,但劳动合同履行期限不足六个月的,应当在劳动合同剩余时间内支付完毕。第二十一条 实行计件工资制的,劳动者在完成计件定额任务后,用人单位安排其在法定工作时间以外加班加点的,应当根据本条例第二十条的规定,分别按照不低于其本人法定工作时间计件单价的百分之一百五十、百分之二百、百分之三百支付加班加点工资。Article 21In case employees who are paid on the basis of piecework are arranged to work beyond the legal working hours after they have fulfilled their quotas, the employing unit shall pay them overtime wage no less than 150 percent, 200 percent or 300 percent of the normal piece rate respectively as stipulated as per the preceding clause.第二十二条 经劳动保障行政部门批准实行综合计算工时工作制的,劳动者在综合计算周期内总的工作时间超过总法定工作时间的部分,视为延长工作时间,用人单位应当依照本条例第二十条第一款第(一)项的规定支付劳动者加点工资。劳动者在法定休假日劳动的,用人单位应当依照本条例第二十条第一款第(三)项的规定支付劳动者加班工资。Article 22 Where the work system of comprehensive calculation of working hours approved by the administrative department of labor security is practiced, the part of comprehensively calculated working hours in excess of the legal working hours shall be taken as overtime working and the overtime pay shall be paid according to Article 20.1.1 of these Provisions. The employing unit shall pay employees for their overtime working as per Article 20.1.3 of these Provisions if the employees are arranged to work on legal holidays. 第二十三条 实行轮班工作制的,劳动者在法定休假日遇轮班的,用人单位应当执行本条例第二十条第一款第(三)项的规定。Article 23Where a rotating shift system is practiced, the employing unit shall pay overtime wages to employees as per Article 20.1.3 of these Provisions if their shifts fall on legal holidays. 第二十四条 妇女节、青年节等国家规定部分公民节日放假期间,用人单位安排劳动者休息、参加节日活动的,应当视同其正常劳动支付工资。节日与休息日为同一天,用人单位安排劳动者加班的,应当执行本条例第二十条第一款第(二)项的规定。第二十五条 经劳动保障行政部门批准实行不定时工作制的,不执行本条例第二十条的规定。 Article 25In case of practicing work system of non-schedule working hours, the employing unit is allowed to not follow Article 20 of these Provisions. 第二十六条 劳动者有下列情形之一的,用人单位可以不予支付其期间的工资:(一) 在事假期间的;(二) 无正当理由未提供劳动的; (三) 由于劳动者本人的原因中止劳动合同的。第二十七条 劳动者患病或者非因工负伤停止劳动,且在国家规定医疗期内的,用人单位应当按照工资分配制度的规定以及劳动合同、集体合同的约定或者国家有关规定,向劳动者支付病假工资或者疾病救济费。病假工资、疾病救济费不得低于当地最低工资标准的百分之八十。国家另有规定的,从其规定。Article 25 If an employee suffers from a work-related injury or occupational disease and has to stop working for medical treatment,the wages paid to the employee for the period of medical treatment shall follow concerned regulations of the country and of Jiangxi Province. If an employee is ill or injured for a reason not related to work and has to stop working for medical treatment, an employing unit shall, within the period of medical treatment, pay the employee the wages for sick or injury leave as per the labor contract and collective contract. The wages for sick or injury leave, after social insurance premiums or other expenses payable as prescribed have been deducted, shall not be less than 80% of the local minimum wage standard.第二十八条 对依法被列为甲类传染病或者采取甲类传染病控制措施的疑似病人或者其密切接触者,经隔离观察排除是病人或者疑似病人的,其隔离观察期间,用人单位应当视同劳动者提供正常劳动并支付其工资。Article 28 For suspect patients and people in close contact with them who have been confined as a measure to prevent spread of infectious diseases, during the confinement period, the employing unit shall regard them as providing normal work and pay them wages. 第二十九条 劳动者依法享有的法定节假日以及年休假、探亲假、婚丧假、晚婚晚育假、节育手术假、女职工孕期产前检查、产假、哺乳期内的哺乳时间、男方护理假、工伤职工停工留薪期等期间,用人单位应当视同劳动者提供正常劳动并支付其工资。Article 29 When an employee enjoys an annual leave, a home leave, a marriage leave, a funeral leave, maternity leave, or a leave for birth control surgery etc., according to law, an employing unit shall pay the employee the vacation wage which should be his or her own standard wage. When an employee takes a leave for private affairs, an employing unit may not pay wages to the employee but shall not deduct wages for the attendance period. 第三十条 劳动者因依法参加下列社会活动占用工作时间的,用人单位应当视同劳动者提供正常劳动并支付其工资:Article 23 When an employee participates in the following activities during legal working hours, an employing unit shall regard him as providing normal labor and pay wages: (一) 行使选举权或者被选举权; Exercising the right to vote and stand for election;(二) 人大代表、政协委员依法履行职责; Performing duties according to law as a deputy to the NPC or a CPPCC committee member;(三) 当选代表,出席政府、党派以及工会、青年团、妇联等召开的会议; Attending the meetings convened by organizations such as governments, parties, labor unions, Communist Youth League and Womens Federation as an elected representative or member;(四) 出任人民法院陪审员; Participating in trials as a peoples juror or taking part in the activities of litigation and arbitration as a witness;(五) 出席劳动模范、先进工作者大会; Attending conferences as model workers and advanced workers;(六) 基层工会非专职工作人员履行职责;不脱产工会基层委员会委员依法参加工会活动;Participating in the activities of a trade union as a member of a grassroots committee of the trade union who is not released from production; (七) 担任集体协商代表期间,参加集体协商、签订集体合同; Participating in collective negotiation and signing collective contract during his or her term as a collective negotiation representative;(八) 参加兵役登记等应征事宜和预备役人员参加军事训练; Participating in (九) 法律、法规、规章规定的其他社会活动。Attending other social activities according to law. 第三十一条 用人单位非因劳动者原因停工、停产、歇业,在劳动者一个工资支付周期内的,应当视同劳动者提供正常劳动支付其工资。超过一个工资支付周期的,可以根据劳动者提供的劳动,按照双方新约定的标准支付工资;用人单位没有安排劳动者工作的,应当按照不低于当地最低工资标准的百分之八十支付劳动者生活费。国家另有规定的,从其规定。Article 21 An employing unit shall pay its employees as per the wage standards agreed in the labor contract if its production or operation has been suspended for less than one wage payment term for a reason which is not employees own fault. If such suspension exceeds one wage payment term during which the employing unit arranges work for the employees, wages shall be paid as agreed between the two parties and shall not be less than the local minimum wage standard; if such suspension exceeds one wage payment term during which no work is arranged for the employees, the employing unit shall follow concerned regulations of the country for settlement. Article 22 In case the employing unit goes bankrupt or is terminated or dissolved, it shall give priority to paying wages due to its employees with the liquidated assets in accordance with legal liquidation procedures.第三十二条 用人单位依照本条例第二十七条、第三十一条的规定,按照当地最低工资标准的百分之八十支付给劳动者病假工资、疾病救济费和生活费的,必须同时承担应当由劳动者个人缴纳的社会保险费和住房公积金。Article 25 If an employee suffers from a work-related injury or occupational disease and has to stop working for medical treatment,the wages paid to the employee for the period of medical treatment shall follow concerned regulations of the country and of Jiangxi Province. If an employee is ill or injured for a reason not related to work and has to stop working for medical treatment, an employing unit shall, within the period of medical treatment, pay the employee the wages for sick or injury leave as per the labor contract and collective contract. The wages for sick or injury leave, after social insurance premiums or other expenses payable as prescribed have been deducted, shall not be less than 80% of the local minimum wage standard.第三十三条 劳动者依法被取保候审、判处管制、适用缓刑或者被假释、监外执行期间,劳动合同未解除且劳动者继续在原单位正常劳动的,用人单位应当按照劳动合同的约定以及本单位的规章制度支付其工资。Article 27 If an employees right to freedom of the person has been restricted by judicial organs because the employee is suspected of violating law and the employee doesnt work during the period, the employing unit may not pay wages to the employee.If an employee is sentenced to public s
