Labor Contract Management Procedure(try out)劳动合同管理办法(试行)1.0 PURPOSE(目的)The purpose of the procedure is to establish the relation between company and staff, nail down the rights and obligations of both sides and make the management of the labor contract regularly.为确立公司与员工之间的劳动关系,明确劳动关系双方的权利和义务,并使劳动合同的管理有所依循,特制定本办法。2.0 SCOPE(范围)It is applicable for all the signing, visa, renewing and terminating of labor contract of domestic staff. 公司全体境内员工劳动合同签订、签证、续签及终止作业均适用。3.0 REFERENCE DOCUMENTS(参考文件)Document NumberDocument TitleExit Management Procedure 员工离职管理办法4.0 RESPONSIBILITY(职责)Made by Human Resources and Administration Department according to the Labor Law of the Peoples Republic of China and approved by director and manager.由公司人力资源及行政部依据中华人民共和国劳动法制订,总经理/董事长核决。5.0 SAFETY(安全)N/A 6.0 DEFINITIONS (定义)Definitions & TermsDescriptionDepartment (人事单位) Human Resources and Administration Department 人力资源及行政部7.0 PROCEDURE(程序)7.1 Labor contract signing 劳动合同签订7.1.1 Signing the labor contract with staff by company. 以公司为单位与员工签订劳动合同。7.1.2 New employee signs the labor contract with the company on the same day of registering. 新进员工于报到当日办理签订劳动合同手续。7.1.3 Contract shall be signed in the principle of equality, unconstraint and following the principle of consensus. The most important is that it shall not violate the national laws and regulations. 公司与员工签订劳动合同应遵循平等自愿、协商一致的原则,双方签订的劳动合同不得违反国家法律、行政法规的规定。7.1.4 Ways to sign the labor contract :劳动合同签订方式:The unified contract is used as the labor contract. As for the visa and number of the labor contract, they are operated according to the regulations of the personnel department of Government of Shanghai. 公司使用统一的劳动合同)文本,是否需要签证及签订份数依上海市政府劳动人事部门之规定操作。7.2 Term of the labor contract :劳动合同期限7.2.1 To regard a concrete job or a job of period of time as term: 以完成一项具体的工作或一个阶段的工作期限:A. Generally, the term of this kind of contract is under one year; 此类合同期限一般在一年以下;B. It is applicable for casual labors. 此类合同期限适用临时工劳动合同的签订。7.2.2 Fixed term:固定期限A. Generally, the fixed term contract is one year. 此类合同期限一般为一年.B. It is applicable for formal staff whose probationary period is 3 months.此类合同期限适用于编制内的正式员工,适用期三个月。7.3 Labor contract renewing :劳动合同的续签:7.3.1 Once the fixed term contract expires, it will be renewed according to the original contract term and the same time limit automatically if both sides have not notified each other about the termination.固定期限合同到期,双方均无解约统治视为双方同意按原合同条款及相同期限自动续约。7.3.2 Human Resources and Administration Department is responsible for filling in the Cognizance Form for Renewing the Labor Contract one and a half months before the labor contract expires, and submits it to the manager of the employing department for confirming. 人力资源及行政部在员工劳动合同到期前一个半月填写劳动合同续签认定表送用人单位权责主管进行续签合同认定。7.3.3 Direct manager of employing department shall write down the explanation and submit it to the manager for approving, once it confirmed that the employee will not renew the labor contract with the company. Then the Human Resource and Administration Department shall fill in the Labor Contract Termination Notice, and notify the employee one month prior to the termination of the labor contract and handle the leaving procedure one day prior to the expiry of the contract according to Exit Management Procedure. 经认定不再续签之员工,用人单位直属主管填写说明,呈权责主管核准后,由人力资源及行政部填写终止劳动合同通知书,于合同到期前一个月通知员工本人,于合同到期前一日依公司员工离职管理办法办理离职手续。7.4 Labor contract terminating 劳动合同的终止Labor contract will be terminated at once if the term of the labor contract expires or the appointed condition appears. 劳动合同期满或者当事人约定的劳动合同终止条件出现,劳动合同即行终止。7.5 Labor contract canceling: 劳动合同的解除7.5.1 The company need not notify the staff about the dismissal if the staff has one of the following situations: 员工有下列情形之一的,公司无须预告本人,解除劳动合同(辞退):A. Examined that is not qualified to be employed in probationary period; 在适用期经考核被证明不符合录用条件;B. Fail to turn the organization affiliation within fixed time; 在规定期限内未能调转人事关系;C. Removed form the rolls because of violating the labor discipline or rules and regulations of LOA; 因严重违反劳动纪律或企业规章制度被除名;D. Badly investigated the criminal responsibility or the reeducation through labor; 被依法追究刑事责任或劳动教养的。7.5.2 LOA will notify the staff about the dismissal in written form 30 days in advance if the staff has one of the following situations: 员工有下列情形之一的,公司应提前三十日以书面形式通知员工,解除劳动合同(辞退):A. Due to illness or injury not caused in working time that he or she can not be engaged in the original work or the work transferred by company after legal medical treatment expires. 员工患病或非因公负伤,法定医疗期满后,不能从事原工作,也不能从事由用人单位另行安排的工作;B. Employee who is not competent to the work or can not competent to the work after training or transferring to another post; 员工不能胜任工作,经过培训或调整工作岗位,仍不能胜任工作;C. The objective situation that the labor contract relies on changes so that the original contract is unable to fulfill. In such situation, he or she can be dismissed if both sides can not reach the agreement. (劳动合同订立时所依据的客观情况发生重大变化,致使原劳动合同无法履行,经协商不能变更劳动合同达成协议。)7.5.3 If the company needs to reduce the staff because of awful business or bankrupt, it shall notify the Labor Union or the staff 30 days in advance and get the opinions and suggestions. Then it shall be reported to the personnel department of the local government before reducing the staff and canceling the labor contract. (用人单位生产经营状况发生严重困难或濒临破产进行法定整顿,确需裁减人员时,应提前三十日向工会或全体员工说明情况听取意见,并经向当地政府劳动人事部门报告后,可以裁减人员,解除劳动合同。)7.5.4 Employee can cancel the labor contract with the company at any time when one of the following situations appears(resign)(有下列情形之一的,员工可以随时向所在公司提出解除劳动合同(辞职):A. In probationary period. (在试用期内。)B. Employee is forced to work by threatening with violence or limit the freedom illegally. (员工所在单位以暴力威胁或非法限定人身自由的手段强迫劳动。)C. Company does not pay the staff remuneration or offer the working condition according to the agreement of the labor contract. (员工所在单位未按照劳动合同约定支付劳动报酬或提供劳动条件。)7.5.5 Except for 7.5.4, employee who wants to cancel the labor contract (resign) with the company shall notify 30 days in advance by written form. (除7.5.4 外员工解除劳动合同(辞职)应提前三十日以书面形式通知所在公司。)7.5.6 The labor contract also can be cancelled if the staff and the company make an agreement. (经员工和所在公司协商一致,也可以解除劳动合同。)7.5.7 Procedure of canceling the labor contract (解除劳动合同的手续): According to relevant regulations of Exit Management Procedure (依公司员工离职管理办法相关规定办理。)7.6 Economic compensation about canceling the labor contract (解除劳动合同的经济补偿):7.6.1 Canceling the labor contract according to the regulation 7.5.2, 7.5.3 and 7.5.4 B/C, company must offer the economic compensation. As for the special regulation of the local government, it shall be handled according to the local rules and regulations. (依本规定7.5.2、7.5.3和7.5.4 B/C 项解除劳动合同的,公司应给予经济补偿。地方政府有特殊规定的,按当地之地方性法规办理。)7.6.2 The economic compensation is dependent on the labor law of the local government. (经济补偿的标准按当地劳动法规的规定办理。)7.7 Situations about the labor contract can not be cancelled (不得解除劳动合同的规定):If the employee has following situations, LOA can not cancel the labor contract with him or her (员工有下列情形,其所在公司不得解除劳动合同):7.7.1 Employee who has job injury and is identified losing or partly losing the labor capacity by the Labor Identification Committee. (因工负伤并经劳动鉴定委员会鉴定被确认丧失或部分丧失劳动能力。)7.7.2 Being ill or injuring not caused during working time within the fixed medical treatment period. (患病或非因公负伤在规定的医疗期内。)7.7.3 Female employee who is in the period of pregnancy, confinement or lactation. (女员工在孕期、产期或哺乳期内。)7.7.4 Employee who has served in LOA for 10 years, or within 3 years of legal retirement age. (在本单位工作满十年、距法定退休年龄三年以内的。)7.7.5 Other laws, rules and regulations stipulated by government. (法律、国家行政法规规定的其他情形。)7.8 Disposal of the labor disputes (劳动争议的处理):7.8.1 The written application shall be put forward and submitted to the Labor Arbitration Commission for interceding and arbitrating in 60 days from the day of the labor dispute taking place. (公司与员工自劳动争议发生之日起六十日内向当地政府劳动仲裁委员会提出书面申请,进行调解和仲裁。)7.8.2 Employee has one of the following situations while canceling the labor contract, LOA has the right to demand for economic compensation. As for those who refuse, LOA can apply for the arbitration to the Labor Arbitration Commission, and freeze up his or her social insurance fund and organizational affiliation before the end of the arbitration. (解除劳动合同时,员工有下列情形之一的,其所在公司有权要求赔偿经济损失。对拒不赔偿损失的,公司可以向当地劳动争议仲裁委员会申请仲裁,并在仲裁结案前请求冻结该员工的社会保险基金和人事关系。)A.
