中国海事仲裁委员会(以下简称仲裁委员会)以仲裁的方式,独立、公正地解决海事争议,以保护当事人的正当权益,促进航运事业和对外经济贸易的发展。第二条 仲裁委员会根据当事人在争议发生之前或者在争议发生之后达成的将争议提交仲裁委员会仲裁的仲裁协议和一方当事人的书面申请,受理下列海事争议案件:(一)关于海上船舶互相救助、海上船舶和内河船舶互相救助的报酬的争议;(二)关于海上船舶碰撞、海上船舶和内河船舶碰撞或者海上船舶损坏港口建筑物或设备所发生的争议;(三)关于海上船舶租赁、代理、拖航、打捞、买卖、修理、建造业务以及根据运输合同、提单或者其他运输文件办理的海上运输业务和海上保险所发生的争议;(四)关于海洋环境污染损害的争议;(五)双方当事人协议要求仲裁的其他海事争议。仲裁协议系指当事人在合同中订立的仲裁条款,或者以其他方式达成的书面仲裁协议。仲裁委员会有权就仲裁协议的有效性和仲裁案件的管辖权作出决定。第二节 组 织第三条 仲裁委员会由主席一人、副主席若干人和委员若干人组成。主席履行本仲裁规则赋予的职责,副主席受主席委托可以履行主席的职责。仲裁委员会设秘书处,负责处理仲裁委员会的日常事务。第四条 仲裁委员会设立仲裁员名册,仲裁员由中国国际贸易促进委员会从具有有关专业知识和实际经验的中外人士中聘任。第五条 仲裁委员会设在北京。根据仲裁业务发展的需要,仲裁委员会可以在中国境内其他地方设立仲裁委员会分会。第二章 仲裁程序第一节 仲裁申请、答辩和反诉第六条 申诉人必须按照下列要求向仲裁委员会提出仲裁申请:(一)向仲裁委员会提交仲裁申请书。仲裁申请书应当写明:1、申诉人和被诉人的名称、地址;2、申诉人所依据的仲裁协议;3、申诉人的要求及所依据的事实和证据。仲裁请申书应当由申诉人及/或申诉人授权的代理人签名。(二)向仲裁委员会提交仲裁申请书时,应当附具申诉人要求所依据的事实的证明文件。(三)在仲裁委员会仲裁员名册中指定一名仲裁员,或者委托仲裁委员会主席指定。(四)按照本仲裁规则所附的仲裁费用表的规定预缴仲裁费。第七条 仲裁委员会收到仲裁申请书及其附件后,经过审查认为申诉人申请仲裁的手续完备,应即将申诉人的仲裁申请书及其附件,连同仲裁委员会的仲裁规则和仲裁员名册各一份,寄送给被诉人。第八条 被诉人应当在收到仲裁申请书之日起二十天内在仲裁委员会仲裁员名册中指定一名仲裁员,或者委托仲裁委员会主席指定,并应在收到仲裁申请书之日起四十五天内向仲裁委员会提交答辩书及有关证明文件。第九条 被诉人对仲裁委员会已经受理的案件,如有反诉,应当在第八条规定的提交答辩书的期限内提出。被诉人应当在反诉书中写明其要求及所依据的事实和证据,并附具有关的证明文件。被诉人提出反诉时,应当按照本仲裁规则所附的仲裁费用表的规定预缴仲裁费。第十条 仲裁委员会认为必要时,可以要求被诉人预缴一部分仲裁费。第十一条 当事人向仲裁委员会提交仲裁申请书、答辩书、反诉书和有关证明材料以及其他文书,应当按照对方当事人和组成仲裁庭的仲裁员人数,备具副本。第十二条 当事人可以委托代理人向仲裁委员会办理有关仲裁事项。代理人可以由中国或者外国的公民充任。接受委托的代理人应当向仲裁委员会提交授权委托书。第十三条 仲裁委员会可以根据当事人的申请和中国法律的规定,提请被诉人财产所在地或者仲裁机构所在地的中国法院作出关于保全措施的裁定。第二节 仲裁庭的组成第十四条 双方当事人各自在仲裁委员会仲裁员名册中指定或者委托仲裁委员会主席指定一名仲裁员后,仲裁委员会主席应即在仲裁委员会仲裁员名册中指定第三名仲裁员为首席仲裁员,组成仲裁庭,共同审理案件。第十五条 双方当事人可以在仲裁委员会仲裁员名册中共同指定或者委托仲裁委员会主席指定一名仲裁员为独任仲裁员,成立仲裁庭,单独审理案件。如果双方当事人约定由一名独任仲裁员审理案件,但在被诉人收到仲裁申请书或者在约定由一名独任仲裁员审理案件之日起二十天内就独任仲裁员人选达不成一致意见时,则由仲裁委员会主席指定。第十六条 如果被诉人未按照本仲裁规则第八条的规定指定或者委托仲裁委员会主席指定仲裁员,仲裁委员会主席有权为被诉人指定一名仲裁员。第十七条 仲裁案件有两个或者两个以上申诉人及/或被诉人时,申诉人之间及/或被诉人之间应当经过协商,在仲裁委员会仲裁员名册中各自共同指定一名仲裁员。如果申诉人之间未能在提交仲裁申请书时共同指定及/或被诉人之间未能在收到仲裁申请书之日起二十天内共同指定仲裁员,则由仲裁委员会主席指定。第十八条 被指定的仲裁员,如果与案件有利害关系,应当自行向仲裁委员会请求回避。当事人有权向仲裁委员会提出书面申请,要求该仲裁员回避。第十九条 当事人要求仲裁员回避,应当在案件第一次开庭审理之前提出。如果要求回避原由的发生或者得知是在第一次开庭审理以后,可以在其后到最后一次开庭审理终结以前提出。第二十条 仲裁员回避的决定,由仲裁委员会主席作出。第二十一条 仲裁员因回避或者其他原因不能履行其职责时,应当按照原指定仲裁员的程序,重新指定。第三节 审 理第二十二条 仲裁庭应当开庭审理案件。但经双方当事人申请或者征得双方当事人同意,也可以不开庭审理,只依据书面文件进行审理并作出裁决。第二十三条 仲裁庭开庭审理的日期,由仲裁庭商仲裁委员会秘书处决定,并于开庭前三十天通知双方当事人。当事人有正当理由的,可以请求延期,但必须在开庭前十二天向仲裁委员会秘书处提出请求,除非发生不能预见的特殊情况;延期请求由仲裁委员会秘书处转告仲裁庭,然后由仲裁庭商仲裁委员会秘书处作出决定。第二十四条 仲裁委员会受理的案件,应当在仲裁委员会所在地进行审理;经仲裁委员会主席批准,也可以在其他地点进行审理。第二十五条 仲裁庭开庭审理案件,不公开进行。如果双方当事人要求公开审理,则由仲裁庭作出决定。第二十六条 当事人应当对其申诉或者答辩所依据的事实提出证据。仲裁庭认为必要时,可以自行调查,收集证据。第二十七条 证据由仲裁庭审定。第二十八条 仲裁庭可以就案件中的专门问题请专家咨询或者指定鉴定人进行鉴定。专家和鉴定人可以是中国或者外国的机构或公民。第二十九条 仲裁庭开庭时,如果一方当事人或其代理人不出席,仲裁庭可以进行缺席审理和作出缺席裁决。第三十条 仲裁庭开庭时,由仲裁委员会秘书处作出庭审笔录及/或录音。仲裁庭认为必要时,可以令当事人及/或其代理人、证人及/或其他有关人员在笔录上签字。第三十一条 仲裁委员会受理的案件,如果双方当事人自行达成和解,申诉人应当及时申请撤销案件。案件的撤销,发生在仲裁庭组成以前的,由仲裁委员会主席作出决定;发生在仲裁庭组成以后的,由仲裁庭作出决定。当事人就已经撤销的案件再次向仲裁委员会提出仲裁申请的,由仲裁委员会主席作出受理或者不受理的决定。第四节 裁 决第三十二条 仲裁庭应当在案件审理终结之日起四十五天内作出仲裁裁决书。第三十三条 由三名仲裁员组成仲裁庭审理的案件,裁决依多数仲裁员的意见决定,少数仲裁员的意见可以作成记录附卷。第三十四条 仲裁庭对其作出的仲裁裁决除按第三十七条规定作出的裁决书外,应当说明裁决所依据的理由。仲裁裁决书应当由仲裁庭全体或者多数仲裁员署名,并写明作出裁决书的日期和地点。第三十五条 仲裁庭认为必要或者当事人提出经仲裁庭同意,可以在仲裁过程中的任何时候,就案件的任何问题作出中间裁决或者部分裁决。第三十六条 仲裁裁决是终局的,任何一方当事人均不得向法院起诉,也不得向其他机构提出变更仲裁裁决的请求。第三十七条 仲裁委员会和仲裁庭可以对其受理的案件进行调解。经调解达成和解协议的案件,仲裁庭应当根据双方当事人和解协议的内容,作出裁决书。第三十八条 当事人应当依照裁决书规定的期限自动履行裁决;裁决书未规定期限的,应当立即履行。一方当事人不履行的,另一方当事人可以根据中国法律的规定,向中国法院申请执行,或根据一九五八年承认及执行外国仲裁裁决公约或者中国缔结或参加的其他国际条约,向外国有管辖权的法院申请执行。第三章 附 则第三十九条 仲裁委员会以中文为正式语文。在仲裁庭开庭时,如果当事人或其代理人、证人不懂中文,仲裁委员会秘书处可以提供译员,也可由当事人自行提供。对当事人提交的各种文书和证明材料,仲裁委员会秘书处认为必要时,可以要求当事人提供相应的中文或其他语文的译本。第四十条 仲裁委员会向当事人发送的任何通讯,如经当面递交收讯人或投递至收讯人的营业地点、惯常住所或通讯地址,或者经合理查询不能找到上述任一地点而以挂号信或能提供作过投递企图的记录的其他任何手段投递给收讯人最后一个为人所知的营业地点、惯常住所或通讯地址,即应视为已经送达。第四十一条 仲裁委员会除按照本仲裁规则所附的仲裁费用表向当事人收取仲裁费用外,可以向当事人收取其他实际开支,包括仲裁员办理案件的报酬、旅差费和食宿费,以及仲裁庭聘请专家、鉴定人和翻译等费用。仲裁委员会对双方当事人自行达成和解协议申请撤销的案件,可以收取一定的费用和实际开支费用。第四十二条 本仲裁规则适用于仲裁委员会分会受理的争议案件。在仲裁委员会分会进行仲裁时,本仲裁规则规定由仲裁委员会主席和仲裁委员会秘书处履行的职责,由仲裁委员会分会主席和仲裁委员会分会秘书处履行。第四十三条 本仲裁规则自一九八九年一月一日起施行。仲裁费用表争议金额(人民币) 仲裁费用(人民币)100,000元以下 争议金额的6%,最低不少于2,000元100,000元至500,000元 the FirstNational Congress of the China Council for the Promotion of InternationalTrade China Chamber of International Commerce)Whole documentChapter I General ProvisionsSection 1 JurisdictionArticle 1The China Maritime Arbitration Commission (hereinafter referred to as theArbitration Commission) independently and impartially settles maritimedisputes by means of arbitration so as to protect the justified rights andinterests of the parties and promote shipping industry and foreigneconomic and trade development.Article 2Upon receiving written application of one of the disputing parties and inaccordance with written agreement concluded between the parties, prior orsubsequent to the occurrence of dispute, to refer their dispute to theArbitration Commission for arbitration, the Arbitration Commission takescognizance of:(1) disputes regarding remuneration for salvage services rendered by sea-going vessels to each other or by a sea-going vessel to a river craft andvice versa;(2) disputes arising from collisions between sea-going vessels or betweensea-going vessels and river craft or from damages caused by sea-goingvessels to harbour structures or installations;(3) disputes arising from chartering, agency, towage, raising, sale,repairing and building of or in respect of sea-going vessel, carriage bysea in virtue of contracts of affreightment, bills of lading or othershipping documents, and marine insurance;(4) disputes regarding pollution damages to marine environment;(5) other maritime disputes submitted for arbitration by agreement betweenthe parties. An arbitration agreement means the arbitration clausestipulated by the parties in their contract, or agreements in writingconcluded in other forms to submit disputes for arbitration.The Arbitration Commission has power to decide on the validity ofarbitration agreement and the jurisdiction over arbitration cases.Section 2 OrganizationArticle 3The Arbitration Commission is composed of Chairman, Vice-Chairmen andCommission members.The Chairman performs functions and duties given by these Rules and anyVice-Chairman, if authorized by the Chairman, may perform the functionsand duties of the Chairman. Under the Arbitration Commission, aSecretariat is established to handle the day-to-day work of theArbitration Commission.Article 4The Arbitration Commission maintains a panel of arbitrators. Thearbitrators are selected and appointed by the China Council for thePromotion of International Trade (China Chamber of International Commerce)from among Chinese and foreign persons with relevant expertise andpractical experience.Article 5The Arbitration Commission is located in Beijing. The ArbitrationCommission may, according to the requirement of development of arbitrationbusiness, establish sub-commissions in other places within the territoryof China.Chapter II Arbitration ProceedingsSection 1 Application for Arbitration, Defence and CounterclaimsArticle 6The Claimant must submit his Application for Arbitration to theArbitration Commission in accordance with the following requirements:(1) an Application for Arbitration in writing must be submitted to theArbitration Commission. The following must be specified in the Applicationfor Arbitration:(a) the name and address of the Claimant and those of the Respondent;(b) the arbitration agreement relied upon by the Claimant;(c) the Claimants claim and the facts and evidence on which his claim isbased. The Application for Arbitration shall be signed by the Claimantand/or the attorney authorized by the Claimant.(2) when submitting an Application for Arbitration to the ArbitrationCommission, relevant documentary evidence on which the Claimants claim isbased shall accompany the Application for Arbitration.(3) the Claimant shall appoint an arbitrator from among the Panel ofArbitrators of the Arbitration Commission or authorize the Chairman of theArbitration Commission to make an appointment on his behalf.(4) the Claimant shall pay an arbitration fee in advance to theArbitration Commission according to the Arbitration Fee Schedule attachedto these Rules.Article 7After receipt of the Application for Arbitration and its attachments andwhen the Arbitration Commission, after examination, deems that theClaimant has completed the formalities required for arbitration, theArbitration Commission shall immediately mail to the Respondent one copyeach of the Claimants Application for Arbitration and its attachments aswell as the Arbitration Rules and the Panel of Arbitrators of theArbitration Commission.Article 8The Respondent shall, within 20 days after receipt of the Application forArbitration, appoint an arbitrator from among the Panel of Arbitrators ofthe Arbitration Commission, or authorize the Chairman of the ArbitrationCommission to make an appointment on his behalf, and shall, within 45 daysafter receipt of the Application for Arbitration, submit his defence andrelevant documentary evidence to the Arbitration Commission.Article 9The Respondent shall file with the Arbitration Commission his counter-claim, if any, in connection with the case taken cognizance of by theArbitration Commission, within the time limit as specified in Article 8for the submission of his defence. The Respondent must state, in hiscounter-claim, his claim and the facts and evidence on which his claim isbased and attach relevant documentary evidence to his counter-claim. Whenfiling a counter-claim, the Respondent must pay an arbitration fee inadvance according to the Arbitration Fee Schedule attached to theseArbitration Rules.Article 10The Arbitration Commission has discretion to ask the Respondent to pay inadvance a part of arbitration fees when it deems it necessary.Article 11When submitting an Application for Arbitration, defence, counter-claim,relevant documentary evidence and other documents to the ArbitrationCommission, the parties shall provide duplicate copies as many as thenumber of the other party/parties and the arbitrators, of whom thearbitration tribunal is composed.Article 12The parties may authorize attorneys to confer with the ArbitrationCommission on matters relating to arbitration. Such attorneys may becitizens of China or foreign citizens. The authorized attorney mustproduce a Power of Attorney to the Arbitration Commission.Article 13The Arbitration Commission may, pursuant to the request of the parties andin accordance with the Chinese law, apply to the Chinese court in theplace where the property of the Respondent(s) is or in the place where thearbitration institution is located for a decision in respect of takingpreservative measures.Section 2 Composition of Arbitration TribunalArticle 14After each of the two parties has chosen one arbitrator from among thePanel of Arbitrators of the Arbitration Commission or the Chairman of theArbitration Commission has made such an appointment under theauthorization by the party/parties, the Chairman of the ArbitrationCommission shall appoint a third arbitrator from among the Panel ofArbitrators of the Arbitration Commission as the presiding arbitrator toform an arbitration tribunal to hear the case.Article 15Both parties may jointly appoint or authorize the Chairman of theArbitration Commission to appoint one arbitrator from among the Panel ofArbitrators of the Arbitration Commission as a sole arbitrator to form anarbitration tribunal to hear the case alone. If both parties have agreedon the appointment of a sole arbitrator to hear their case alone butfailed to agree on the choice of such a sole arbitrator within 20 days asfrom the date on which the Respondent receives the Application forArbitration or as from the date on which both parties reach an agreementto have their case heard by a sole arbitrator, the Chairman of theArbitration Commission shall appoint the sole arbitrator.Article 16If the Respondent fails to appoint and fails to authorize the Chairman ofthe Arbitration Commission to appoint an arbitrator according to Article 8of these Rules, the Chairman of the Arbitration Commission has the powerto appoint an arbitrator for the Respondent.Article 17When there are two or more Claimants and/or Respondents in an arbitrationcase, the Claimants side and/or the Respondents side shall each, throughconsultation, appoint one arbitrator from among the Panel of Arbitratorsof the Arbitration Commission. If the Claimants side fails to make suchappointment at the time when the Claimants submit their Application forArbitration and/or Respondents side is unable to appoint one arbitratorwithin 20 days as from the date on which the last Respondent receives theApplication for Arbitration, the appointment shall be made by the Chairmanof the Arbitration Commission.Article 18Any appointed arbitrator having personal interest in the case shallhimself request the Arbitration Commission for withdrawal from his officeand the parties have the right to make a request in writing to theArbitration Commission for a withdrawal of the arbitrator from his office.Article 19A party who intends to challenge an arbitrator must put forward hischallenge before the first oral hearing of the case. If the grounds forchallenge come out or become aware of after the first oral hearing, thechallenge may be raised before the conclusion of the last hearing.Article 20The Chairman of the Arbitration Commission shall decide on the challenge.Article 21If an arbitrator cannot perform his duty due to withdrawal or otherreasons, a substituted arbitrator shall be appointed in accordance withthe procedure pursuant to which the original arbitrator was appointed.Section 3 HearingArticle 22The arbitration tribunal shall hold oral hearings to hear the case.However, at the request of the parties or with their consent, oralhearings may be omitted and the arbitration tribunal may examine the caseand make an award on the basis of documents only.Article 23The date of oral hearing shall be decided by the arbitration tribunal inconsultation with the Secretariat of the Arbitration Commission and thenotice of hearing shall be communicated to the parties 30 days before thedate of hearing. A party having justified reasons may request forpostponement of the date of hearing. But his request must be communicatedto the Secretariat of the Arbitration Commission 12 days before the dateof hearing unless unforeseeable special circumstances occur. TheSecretariat shall inform the arbitration tribunal of his request and thearbitration tribunal shall decide thereon, in consultation with theSecretariat.Article 24The cases taken cognizance of by the Arbitration Commission shall be heardin the place where the Arbitration Commission is located and may, with theapproval of the Chairman of the Commission, be heard in other places.Article 25The arbitration tribunal shall not hear cases in open sessions. If bothparties request hearings in open sessions, the arbitration tribunal shalldecide thereon.Article 26The parties shall give evidence for the facts on which their claim ordefence is based. The arbitration tribunal may, if it deems it necessary,make investigation and collect evidence on its own initiative.Article 27The evidence shall be examined and approved by the arbitration tribunal.Article 28The arbitration tribunal may consult experts or appoint appraisers for theclarification of special questions relating to the cases. Such experts andappraisers may be Chinese or foreign organizations or citizens.Article 29Should one of the parties or his attorney fail to appear at the hearing,the arbitration tribunal may proceed with the hearing and make an award bydefault.Article 30During hearings, the Secretariat of the Arbitration Commission shall takerecords in writing and/or tape-recordings and the arbitration tribunalmay, if it deems it necessary, order the parties and/or their attorneys,witnesses and/or other persons involved to sign the records taken.Article 31If both parties reach a settlement by themselves of a case under thecognizance of the Arbitration Commission, the Claimant shall timelyrequest for withdrawal of the case. Dismissal of the case shall bedecided by the Chairman of the Arbitration Commission before anarbitration tribunal is formed and by the arbitration tribunal after thearbitration tribunal is set up.If the party or the parties refer the dismissed cas
