2、出租人(甲方) :Lessor (Party A)承租方(乙方):Lessee (Party B):根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例) 的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租 甲方可依 出租(出租)的 商品房(房屋/商品房)事宜,订立本合同。In accorda nee with the Laws of Con tract of the People s Republic of Chi na and theTenancy Regulati ons of the Shan ghai Mun icipality (here in
3、after referred to as“ theProvisions ” ),Party A and Party B, having reached an agreement based on the prin ciplesof equality, willi ngn ess and mutual ben efit, hereby en ter into thisCon tract on matters in relati onto the Leaseof the Property byParty A to Party B.一、出租房屋情况Con diti on of the Lease o
4、r Pre-Lease Property1- 1甲方 出租 (出租)给乙方的房屋座落在本市_ (区/县)路号(弄/新村)_ (号/幢)_室(部位)(以下简称该房屋)。该房屋 实 测(【出租】实测)建筑面积为 平方米,房屋用途住宅 ,房屋结构为 钢混。甲方已向乙方出示:Party A shall lease Party B the Property situated at,(here in after referred to as “ the Property ” ).The total gross area of the Lease Property shall be quare meters

6、 the Property (Certificate No.).1-2甲方作为该房屋的房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋(已/未)设定抵押。Party A bei ng the Owner of the Propertyand Party B havedeveloped a lessor/lessee relati on ship.Before the sig ning of this Con tract,Party A has already in formed Party B that the Property
7、 subject to amortgage.1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状 况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、 乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向 乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The area and the use of the public or com mon part of the Property; the existing fixtures, facilities, condition of equipment and

9、on of the Property at the time of hand over of the Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Con tract.租赁用途Purpose of the Property2- 1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市有关房屋使用和物业管理的规定。Party B warrants to Party A that the Property shall be used
10、for Residential purposeand follows the regulationsof the State and thisMuni cipality in relati on to the use and man ageme nt of Property.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前, 不擅自改变上款约定的使用用途。Party B guara ntee that duri ng the lease term, it shall not alter the purpose of the Property without Part
11、y A s prior written consent as well as the approval from the releva nt gover nmen tal departme nt.三、交付日期和租赁期限Delivery Date and Lease Term3-1甲乙双方约定,甲方于 【出租】房屋租赁期自年月日向乙方交付该房屋。 _年月 _ 日起至年月日止。Party A and Party B have agreed that Party A shall hand over the Property to Party B before .Lease The lease ter
12、m of the Property shall be fromun til3- 2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租房屋的,则应于租赁期届满前2个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。Upon expiry of the lease term, Party A shall have the right to repossess the Property in its en tirety and Party B shall deliver it up accord in gly. 13、e, it shall submit such intent in writing to Party A two mon ths prior to the expiry of the lease and sig n a new leasecon tract with the consent of Party A.四、租金、支付方式和期限Rent, Method of Payme nt and Term4- 1甲、乙双方约定,【出租】月租金人民币()(大写:)。该房屋租金 (年)内不变。自第 (年)起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定。Party A and P

15、月 日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按日租金的%支付违约金。Party B shall pay the rent by the of each mon th. Late payme nt byParty B shall be subject to a pen alty of% of the mon thly rent per day.4- 3乙方支付租金的方式如下:The rent shall be paid by Party B as follows:五、保证金和其他费用Deposit and Other Fees and Charges5- 1甲、乙双方约定,甲方交付该
16、房屋时,乙方应向甲方支付房屋租赁保证金,保证金 为贰个月的租金,即(人民币贰万贰仟元整 )。甲方收取保证金后应向乙方开具收款 凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用 夕卜,剩余部分一周内无息归还乙方。Party A and Party B have agreed that at the time of the hand over of theProperty by Party A, Party B shall pay to Party A a rental deposit of theProperty, the deposit shall be Two

18、y B after settingoff the fees and expensesborne by Party B under theCon tract without in terest withi n one week.5- 2租赁期间,使用该房屋所发生的水、电、煤气、通讯费用及ADSL安装费由乙方(甲方/乙方)承担。其他物业管理费、卫星电视收视费和现场的家庭会所卡两人,均由 甲方 (甲方/乙方)承担。Duri ng the lease term, the water, electricity, gas, com muni cati on of theProperty ,ADSL usa

20、y the above fees andcharges, the computation or amortization,method and time of payment:Accord ing to the dema nd no tes, if delay ing payme nt,Party B should beresp on sible for the pen alty.六、房屋使用要求和维修责任Stan dard Required for Use of Property and Resp on sibility of Property Maintenance and Repair6
21、- 1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。During the lease term, if Party B discovers any damages or defects of theProperty andfacilitiesattached, it shall notify Party A immediatelyforrepair. PartyA shallcarry out the repair within days afterreceivingno tific
22、ati on fromParty B.Any delay in repair may be repaired by PartyBon Party A sbehalf andthe expenses incurred shall be borne by Party A.6- 2租赁期间,乙方应合理使用并爱护该房屋其附属设施。因乙方使用不当或不合理使 用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒不维修, 甲方可代为维修,费用由乙方承担。During the lease term, Party B shall reas on ably use and take good car
23、e ofthe Property and the facilities attached. Party B shall be responsibletorepair immediately the damages caused to the Property and/or facilities due to improper and un reas on able use by Party B.If Party B refuses torepair, Party A may repair on its behalf and the expe nses in curred shall be bo
24、rne by Party B.6- 3租赁期间,甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。甲方对 该房屋进行检查、养护,应提前 日通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。During the lease term, Party A shall guarantee the normal usable and safecon diti on of the Property and facilities attached.Party A shall no tify PartyB days in adva nee before carry ing out
25、exam in ati on and maintenanceworks. Party B shall ren der cooperati onduri ng the exam in ati onandmaintenance. Party A shall reduce the effect caused to Party B in using the Property.6-4乙方需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定须向 有关部门审批的,则还应由甲方(甲方/甲方委托乙方)报请有关部门批准后,方可进行。乙方增设的附属设施的设备归属及其维修责任由甲、乙双方另行书面约定。Ex
26、cept for Appe ndix3 of this Con tract,before carry ingout any extrarenovationor addition of facilities attached and equipment. Party B shallobtai n the writte n consent of Party A and submit the same to the releva nt authority for exam in ati on and approval in accorda nce with the regulati ons.The
27、works could only be carried out upon completion of the procedure of approval with the releva nt authority byParty A .The resp on sibility ofthe maintenance of the added facilities by Party B shall be agreed by Party A and Party B in separate writte n agreeme nt.七、房屋返还时的状态Con diti on of Property at D
28、elivery Back7- 1除甲方同意乙方续租外,乙方应在本合同的租期届满后的日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按 向甲方支付该房屋占用期间的使用费。Except for the ren ewal of lease agreed by Party A, Party B shall deliver up the Property withi n after the expirati on of lease term of this Con tract.Latedelivery of the Property without the consent of Party
29、 A shall be subject to acharge for adverse possessi on of the Property attime of rent per day.7- 2乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互 结清各自应当承担的费用。The Property at the time of delivery up by Party B shall be of a condition after n ormal use. The delivery up shall be exam ined and authorized by Party
30、A and the fee and charges respon sible by the parties shall be cleared at the time of delivery up.八、转租、转让和交换Sublease, Assignment and Exchange8- 1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方 的书面同意,方同将该房屋部分或全部转租给他人。但同一间居住房屋,不得分割转 租。Un less otherwise agreed in the suppleme ntary clauses of this Con tract, Part
31、y B shall obtain the written approval from Party A before it could sublease part or all of the Property to a third party during the lease term.Party B shall not sublease part of the Property or sublease to two lessees or more tha n two lessees at the same time.8- 2乙方转租该房屋,应按规定与接受转租方订立书面的转租合同。并按规定向该房
32、屋 所在区、县房地产交易中心或农场系统受理处办理登记备案。When Party B subleases the Property, it shall enter into a sublease con tract with the lessee in writi ng in accorda nee with the regulati ons. The sublease con tract shall be registered and filed with the Real Estate Trade Man ageme nt Departme nt or the Mini stry of Ag
33、ricultural Systems where the Property is located.8-3在租赁期内,乙方将该房屋转让给他人承租或与他人承租的房屋进行交换,必须事 先征得甲方书面同意。转让或交换后,该房屋承租权的受让人或交换人应与甲方签订 租赁主体变更合同并继续履行本合同。During the lease term, Party B shall obtain the written consent from Party A before assigning the Property to a third party for sublease or exchange the Pro
34、perty subleased by a third party. After the assignment or exchange, the assignee of the Property or the party to the exchange shall sign the Con tract for the ame ndme ntof the lease and con ti nue to en force thisCon tract.8- 4在租赁期内,甲方如需出售该房屋,应提前三个月通知乙方。乙方在同等条件下有 优先购买权。若乙方无意购买该物业,本租赁合同继续生效。During t
35、he lease term, if Party A shall sell the Property, it shall no tify Party B 3 mon ths in adva nee. Party B shall have the priority to purchase un der the same con diti ons.九、解除本合同的条件Con diti ons for Termin at ing this Contract9- 1甲、乙双方同意在租赁期内,有下列情形之一的,本合同终止,双方互不承担责任:Party A and Party B have agreed t
36、hat duri ng the lease term, this Con tractshall be term in ated un der any of the follow ingcircumsta ncesand bothparties shall not be held resp on sible as a result thereof:(一)该房屋占用范围内的土地使用权依法提前收回的;The right to use of land withi n the scope of the Propertywas early resumed in accorda nee with the l
37、aws;(二)该房屋因社会公共利益被依法征用的;The Property was resumed for public in terests;(三)该房屋因城市建设需要被依法列入房屋拆迁许可范围的;The Property has bee n classified as premises to be demolished accordi ng to the law for the n eed of tow n pla nning;(四)该房屋毁损、灭失或者被鉴定为危险房屋的;Damages, fire hazards occurred to the Property or otherwise
38、bee n classified dan gerous premises;(五)甲方已告知乙方该房屋出租前已设定抵押,现被处分的。Pen alty as a result of the mortgage created over the Property as no tified to Party B by Party A before the lease;9- 2甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反合 同的一方,应向另一方按月租金的_2_倍支付违约金;给对方造成损失的,支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:Party A an
39、d Party B have agreed that one party may term in ate this Con tractby writte n no tice to the other party un der any of the follow ing circumsta nces.The party in breach shall pay to the other party a pen alty of2 times ofthe rent per mon th; if damages is caused to the other party and the pen alty
40、is not sufficient to offset the damages of the other party, the party in breach shall also compe nsate for the differe nee betwee n the pen alty and the damages caused:(一) 甲方未按时交付该房屋,经乙方催告后7日内仍未交付的;Party A fails to deliver up the Property accord in gly and rema in fail to deliver withi n7 days after
41、 dema nd give n by Party B;(二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交 付的房屋存在缺陷,危及乙方安全的。The Property delivered up by Party A falls short of the agreeme nt of this Con tract, caus ing failure to realize the purpose of the lease; or the Property delivered by Party A is defective and affects the safety of Pa
42、rty B;(三)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;Party B alters the use of the Property without the written consent of Party A, caus ing damages to the Property;(四)因乙方原因造成房屋主体结构损坏的;Damages caused to the main structure of the Property attributable to Party B;(五)乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;Party B subleases th
43、e Property, assig ns the Property to or excha nges the Property with the third party without consent;(六) 乙方逾期不支付租金累计超过壹 月的;Party B fails to pay rent for over 1mon ths;十、违约责任Liabilities for Breach of Con tract10- 1该房屋交付时存在缺陷的,甲方应自交付之日起的_日内进行修复,逾期不修复的,甲方同意减少租金并变更有关租金条款。For defects exist at the time of
44、 delivery of the property, Party A shall perform the repair work withi n days after the delivery, in the eve nt ofdelay and non-repair, Party A agrees to reduce the rent payable and alters the releva nt rental provisions.10- 2因甲方未告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失 的,甲方应负责赔偿。Party A shall be liable to c
45、ompe nsati on for loss in curred by Party B due to PartyA s failure in notifying Party B of the restriction of the Property under mortgage or assig nment of in terests before the lease of the Property.10-3租赁期间,甲方不及时履行本合同约定的维修、养护责任,致使房屋损坏,造成 乙方财产损失或人身伤害的,甲方应承担赔偿责任。During the lease term, if Party A fa
46、ils to perform the duties of maintenance and repair un der this Con tract, caus ing damages or losses to the Property an d/or pers onal in juries to Party B, Party A shall be liable to compe nsati on.10-4租赁期间,非本合同规定的情况,甲方擅自解除本合同,提前收回该房屋的,甲 方应按月租金的 倍向乙方支付违约金。若违约金不足抵付乙方损失的,甲方还应负责赔偿。During the lease te
47、rm, if Party A termi nates this Con tract and takes back the Property before the expirati on of the lease in any eve nt other tha n those stipulated in this Con tract, it shall pay to Party B a pen alty of _2 times of rent payable for the remai ning days of the term.Party A shall beliable for compen
48、sation if the penalty is not sufficient to offset the losses suffered by Party B.10-5乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者增设 附属设施的,甲方可以要求乙方恢复房屋原状(恢复房屋原状/赔偿损失)。Party B has renovated the Property or added facilities attached to the Property without obtaining the written consent of Party A or outside the s
49、cope of the written approval of Party A, Party A may require Party B to restore the Property to its orig inal state.10-6租赁期间,非本合同规定的情况,乙方中途擅自退租的,乙方应按月租金的2倍向甲方支付违约金。若违约金不足抵付甲方损失的,乙方还应负责赔偿。甲方可从 租赁保证金中抵扣。保证金不足抵扣的,不足部分则由乙方另行交付。During the lease term, except for circumsta nces stipulated in this Con tract
50、, if Party B withdraws from the lease without obtaining the approval of Party A. Party B shall pay a pen alty to Party A2 times the rent payable forthe remai ning days of the term.If the pen alty is n ot sufficie nt to offset theloss suffered by Party A, Party B shall be liable to compe nsati on.Par
51、ty Amay offset the amount from the deposit.If the deposit is not sufficie nt tooffset the amount, the outsta nding amount shall be paid by Party B.十一、其他条款Other Clauses11- 1租赁期间,甲方需抵押该房屋,应当书面告知乙方,并向乙方承诺房屋抵押 后当事人协议以折价、变卖方式处分该房屋前叁十日书面征询乙方购买该房屋的意见。During the lease term, if Party A shall require to mortg
52、age the Property, it shall notify Party B in writing and guarantee to Party B that after the mortgage of the Property, Party B s opinion as to the purchase of the Property would be consulted in writing 30 days before agreement on method of disposal of the Property is reached.11- 2本合同自双方签字/签字后即刻生效。生效
53、后的15日内,由甲方负责按规定向房屋所在地区、县房地产交易中心或农场系统受理处办理登记备案,领取房屋 租赁登记备案证明;本合同经登记备案后,凡变更、终止本合同的,由甲方(甲方/乙方)负责在本合同变更终止之日起的15日内,向原登记机构办理变更、终止登记备案手续。因甲方未办理房屋租赁登记备案或变更、终止登记备案的, 所引起的法律纠纷,由甲方承担一切责任。This Con tract shall take effect after sig ned by both parties.Withi n 15 daysof the sig ning of this Con tract, Party A sha

55、tract, Party Ashall be resp on sibleto register the modificati on or term in ati on withtheorigi nal registrati onoffice withi n 15 days of such modificati onortermination.Any legal disputes arising from the failure of Party A toregister theCertificateof Lease or to register the modification orterm
56、in ati on shall be bor ne by Party A.11-3本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条款及 附件均为本合同不可分割的一部分,本合同及其补充条款和附件内空格部分填写的文 字与铅印文字具有同等效力。Party A and Party B may through mutualconsultationenter into thesuppleme ntaryclauses on matters not stipulated in this Con tract.
