2、awf uln ess, fair ness, equality, free will,negotiated consensus and good faith by and between the foresaid Party A and Party B in accorda neewithLabor Law of Peoples Republic of China and other releva nt laws and regulatio ns of China.Article 1 Term of the Con tract:1. Party B shall fulfill his/her labor
6、 obligati ons accord ing to thejob contents and requireme nts.4.Article 4 Worki ng Hours, Rest and Vacati ons1. The Parties agree to determine the working hour pursuant to mode1 Sta ndard worki ng hour system.2 Worki ng hour system of comprehe nsive calculati on.3 Flexible worki ng hour system.2. Pa
7、rty A shall strictly abide by legal working time and have control of overtime, soas to ensure Party Bs rest and physical and mental health. In case Party A has to arrange overtime workfor Party B due to bus in ess requireme nt, it shall firstly n egotiate with and acquire the approval of the laborun
8、ion and Party B and shall arrange Party B to take compe nsatory leave afterwards or pay Party B forovertime work accord ing to law.3.Party A shall provide Party B with paid annu al leave in accorda nce with releva nt laws.Article 5 Labor Protecti on and Work ing Con diti ons1. Party A shall inform P
9、arty B of those jobs that may cause pote ntial occupati onal diseases and shallprovide safety and health educati on to Party B to avoid in dustrial accide nts and reduce occupati onalhazards.2. Party A must provide safe and healthy work ing con diti ons and n ecessary labor protection articleswhich
10、comply with regulations of the state. If Party B is to be engaged in work with occupati onal hazards,Party A shall provide a regular medical check and arrange Party B to con duct occupati onal health exam inati on before term in ati ng the Con tract.3. Party B shall strictly follow the safe operatio
11、n rules, and has the right to refuse to obey Party Asillegal comma nd or take forced risky works.4. Party A shall provide protecti on to Party B in accorda nee with releva nt state regulati ons on specialprotecti on for female worker and mi nors.5. Party A shall implement state provisions on medical
12、 treatment period of the employees sufferi ngfrom ill ness or non-work-related injuries.Article 6 Labor Remun erati onWage shall be paid by Party A to Party B at least once a month in monetary form and shall not bededucted or delayed without reas on.1. Party A promises to pay the wage on the day eve
13、ry mon th.2. The mon thly wage of probati on period is RMB .3. The Parties agree to determ ine the payme nt pursua nt to modes wage accord ing to its wage distributi on systemformulated in accorda nee with the law and Party Bper mon th.2 In case of comb ining basic wage with performa nee wage, Party
14、 Bs basic wage ideterm ined to per mon th. Thereafter Party A may cha nge the wage of Party B from timeto time based on the wage distribution system. Party A will provide a performanee bond in accordanee withParty Bs performanee, achievement and actual contribution.3 In case of piecework wages, Part
15、y A shall follow a scie ntific and reas on able wayto determ ine Party Bs work loddteThe ned work load shall be one that can be completed by more than 90labors at the same position in the unit within the statutory work ing hours. Party A shall pay wages to PartyB accord ing to the piece rate and wag
16、e quota agreed upon and Party B rformanpe.44. Party A may reas on ably raise Party Bs wage accord ing to the bus in ess efficie ncy,salary in crease guideli nes released by the local gover nment and guida nee wage levels.Party Bs wage growth shall be determ ined pursua nt to_ (collectivesalary n ego
17、tiati on system, or in ternal wage in creas ing mecha ni sm.Article 7 Social Welfare & Ben efits1. Both parties hereto shall atte nd social in sura nee and pay social in sura nee charges on time. Thepart that shall be paid by Party B according to law will be withheld from Party Bs wages and paid
18、 by PartyA.2. Party A shall make public various social in sura nee premiums paid for Party B.Party B shall have the right to inquire Party As payment of premiums and Party A shallprovide assista nee.1 Party A shall determine Party B3. I n case of occupati onal disease or in dustrial injury suffered
19、by Party B, Party Ashall be responsible for timely treatment of Party B or provide assistanee, apply to the labor and socialsecurity admi nistrative departme nt for in dustrial injury recog niti on within specified time period, gothrough working capability appraisal according to law and perform n ec
20、essary obligati ons for Party Bs recei ving of in dustrial injury medicaltreatme nt.4. Party B shall receive releva nt welfare and ben efits as stipulated by the stateaccord ing to law and Party A shall impleme nt accord in gly.Article 8 Terms for Negotiati onThe two parties, after full discussion a
21、nd consultation, agree to thefollowing_ terms.1. Where Party Bs job is related to Party Aseesee)nRBe:yAllmay enterinto con fide ntiality agreeme nt or non-competiti on agreeme nt with Party B.2. Where Party A provides special funding for Party Bs professional technicaltraining, it may conclude an ag
22、reement specifying a term of service with Party B. 3. PartyA shall, in accorda nce with state provisi ons on welfare, provide Party B ben efits as follows:_4. Other terms that shallbe agreed upon by both parties:_Article9 Settleme nt of Labor Disputes 1. The Con tract on ce con cluded in accorda nce
23、 with the law shall possesslegal binding force. The parties invo Ived must comprehe nsively fulfill and strictly carry out the obligationsof modification, rescission, termination, renewal or econo mic compe nsati on stipulated in the Con tract 2.Any labor dispute aris ing from or related to the perf
24、orma nee of this Con tract shall be settled through negotiati on. In case both parties are unwilling to settle the dispute through negotiation or no settlement canbe reached through n egotiati on, the case may be submitted to the labor dispute mediati on committee ofthe unit; in case the mediation f
25、ails, the case may be submitted for arbitration or legal action. The party whoapplies for arbitration shall submit written applicati on to the labor dispute arbitrati on committee with in sixtydays of the day on which the labor dispute happe ns. 3. Where Party A violates labor laws, regulati ons andrules impairing Party Bs legitimate rights, Party B shall have the right to report to the admi nistrativedepartme nt of labor security and releva nt departme nt. 6Article 10 Miscella neous 1.
