28、域内从事建设工程质量检测活动的检测机构和非检测机构，都应遵守本规程。1.3 建设工程质量检测除应执行本规程外，还应符合国家、行业及地方现行的有关标准、规范、规程及管理规定的要求。2 术语2.1 建设工程质量检测活动建设工程质量检测活动包括检测机构和非检测机构的工程质量检测活动。检测机构的质量检测活动是指：工程质量检测机构接受委托，依据国家有关法律、法规和工程建设强制性标准，对工程成品、半成品质量性能的抽样检测(鉴定)，对进入施工现场的建筑材料、构配件和设备的取样检测(鉴定)。非检测机构的工程质量检测活动是指：企业试验活动、监理单位的试验活动和监督机构的监督抽检活动。2.2 企业试验活动企业试验

29、活动是指建筑业企业试验室依据企业质量保证体系要求对本企业施工的入场原材料、设备、半成品的质量参数进行验证性试验以及对其施工或生产的工程半成品、成品进行检测的活动。2.3 监理单位的试验活动监理单位的试验活动是指工程项目监理机构在平行检验时利用一定的检测手段，在施工单位自行检验的基础上，按照一定的比例独立进行的检测活动。2.4 监督机构的监督抽检活动建设工程质量监督机构按照监督程序对工程材料和产成品的质量性能进行验证的抽查检测活动。2.5 检测试验能力评估活动检测试验能力评估活动是指由省检测行业协会组织实施，依照自愿原则，对申请评估的检测机构和非检测机构的检测试验能力进行评价确认的技术性活动。2

33、、构配件或检验项目中，按检验批抽取一定数量的样本，通过对样本的测试确定检验批质量的检测。2.8 检测合同检测机构与委托方之间签订的建设工程质量检测协议或检测委托书。2.9 检测任务书(单)检测机构向内部检测部门下达检测任务，提供检测工作所需信息的通知书。2.10 原始记录由检测活动产生能再现检测过程并记载检测活动所采集的数据和完成各类活动的证据。2.11 检测(鉴定)报告检测机构出具检测(鉴定)结果的书面报告。2.12 取样员具有相关检测取样知识，获得检测单位同意，承担检测试样取样、制作的人员。2.13 见证人由建设单位或工程监理单位中具有监理岗位证书或具备检测试验知识并经该工程质量检测单位同

34、意、见证现场检测试样的取样、制作、送样过程真实性合规性的技术人员。2.14 自动采集使用数据采集设备将检测数据自动记录并传输到检测软件进行数据处理的一系列过程。2.15 检测争议检测结果利害关系人对检测结果的争议。2.16 飞行检查飞行检查是指由建设行政主管部门或工程质量监督机构组织实施，对检测活动进行的不预先通知的检查活动，目的是了解检测活动的真实情况。2.17 能力验证能力验证是指由省级建设工程质量监督机构安排的目的在于检查检测单位检测能力保持情况和检测结果准确性、可比性的验证活动。2.18 检测人员在检测机构、企业试验室、监理单位的试验部门、监督机构中从事建设工程质量检测Building

45、rural与试验活动，经过有关培训并取得岗位证书的技术人员。2.19 检测单位指检测机构和建筑施工企业试验室。3 基本规定3.1 建设工程质量检测机构（以下简称检测机构）是具有独立法人资格的中介机构，其工商营业执照经营范围应包括有建设工程质量检测业务。3.2 企业试验室是企业中专门从事试验活动的部门，属于企业质量保证体系的组成部分。企业试验室的试验业务范围：本企业承揽的工程（或生产产品）中见证取样检测以外的检测内容。3.3 从事建设工程质量检测试验活动的建筑业企业和监理单位应进行检测能力评估，并在检测（试验）能力评估证书给定的能力范围内开展检测试验活动。3.4 检测机构在核准的资质范围以及在获

46、得的试验能力评估范围内出具的检测报告可作为工程竣工验收的依据；获得省检测行业协会试验能力评估证书的企业试验室在其能力范围内的试验报告可以作为工程竣工验收资料使用。3.5 见证取样检测的比例不得低于工程总检测量的30%，施工企业试验室承担的检测比例不得高于70%。当工程的检测业务全部由检测机构承担时，为保证检测结果具有比对性，在工程所在地有两家或多家检测机构时，一家检测机构承担的检测比例不应超过70%。3.6 检测业务的委托按照有利于检测结果公正性的原则进行，检测机构应与委托方签订检测合同，合同内容包括委托检测的内容、执行标准、责任义务和争议解决等。3.7 检测机构应执行密码管理制度，检测单位应

47、当单独建立不合格试验项目台账。不合格试验项目台账的格式见附录1 6 。3.8 检测机构应使用符合国家、省及有关规范标准要求的、能网上自动传输、适于监管的检测管理软件。检测项目应逐步推行数据自动采集系统，并按有关规定期限实施。3.9 检测机构应按季度向注册地建设工程质量监督站报送本机构上季度所承担的工程检测项目的基本情况（见附录1 15 ） ，按年向省建设工程质量监督机构报送机构自身建设情况（见附录1 7） ；3.10 检测机构完成检测业务后，应当及时出具检测报告。检测机构对出具的检测报告负有法律责任，检测报告必须实事求是，数据准确可靠，必须由检测人员、审核人员、报告授权签发人三名不同的人员签字
