15、购房款及相关税费等)造成房屋不能顺利选购、同开发商签定房屋买卖合同、过户等,甲方不承担责任,且不退还购房权转让费,给甲方所造成的其他经济损失均由乙方承担。六、其他约定条款1、乙方已承诺不得涉及甲方名义办理房屋产权相关的抵押贷款。2、若甲方单位可以办理更名手续而甲方不配合乙方办理,则视甲方违约。3、届时若必须以甲方名义付款,则乙方出资以甲方名义支付,甲方必须协助,由此所产生的一切费用由乙方负责。4、甲方将该房屋转让给乙方以后,与该房屋的相关证件资料都由乙方保管,与甲方无关。5、开发商向甲方交付房屋当日,甲方即告知乙方,并及时同乙方办理房屋交割手续。甲方向乙方交割房屋后,所发生的物业管理费、水电费

16、、卫生费等与房屋使用相关的费用及责任均由乙方承担。6、甲方向乙方交割房屋后,因自然灾害等不可抗拒因素导致乙方所购房屋受损的,与甲方无关,不得要求甲方任何赔偿。7、甲方保证上述购房权益转移到乙方名下之前,没有产权纠纷、债权、债务等问题,如由此给乙方造成的经济损失,甲方全部赔偿给乙方。8、甲方领取房屋产权证当日,甲方即告知乙方,并及时同乙方办理房屋过户手续。房屋办理产权转移过户手续所须交纳的所有相关税、费(含国家相关法规规定由甲方承担的税、费),均由乙方承担。9、甲乙双方现在此先声明:若一方在合同履行期间丧失履行能力,此一方由法定继承人或监护人继续履行本合同,直至本交易结束。10、甲乙双方现在此声

17、明:对国家和本市购房限购政策已经知晓 。11、若购房指标权力人与共有人或家庭成员在指标转让一事有争议的情况下,导致交易不能进行的,由签约人承担违约责任。12、若因不可抗力、国家政策变动、甲方单位因素导致交易失败,不视为双方违约,按本条解除协议时,甲方应退还乙方已付给甲方的相关款项但不支付利息。13、甲方承诺将该套房屋转让给乙方期间,甲方积极配合乙方办理该套房屋的一切相关手续。七、违约责任(一)协议经双方签字后生效,任何一方均应按约履行协议,否则,过错方或违约方给无过错方或守约方造成经济损失的,过错方或违约方必须向无过错方或守约方赔偿损失。(二)协议生效后,甲乙双方任何一方未能履行本协议及协议补

18、充条款部分或全部义务,均视为违约,协议签订当年内每次违约应向对方支付10万元违约金,从第二年起(自2013年1月1日起计)违约金基数每年增加5万元(即2013年每次违约应向对方支付15万元违约金,2014年每次违约应向对方支付20万元违约金,以此类推,直至产权过户完成)。(注:若因甲方个人造成不能过户则视为甲方违约,但因国家政策及甲方单位因素造成不能及时办理更名或过户手续,则不做违约处理) (三)一方出现违约,守约方可在要求对方承担违约责任的同时,提出继续履行协议或中止协议的意见。如继续履行协议,违约方支付违约金后双方继续履行;如中止协议,违约方支付违约金,甲方返还乙方支付的所有费用(含房屋购

19、置、配套、装修、家具等房屋使用投入各种费用,不含家电、食品等日常用品费用,资金按同期银行贷款利率计息),乙方不再拥有房屋所有权。八、支付保证。作为对合同各相关利害人各项权益的保护,甲方、乙方分别承诺:(1)严格履行合同约定的义务,如部分或全部义务未能履行,则按合同约定承担违约责任和赔偿责任。(2)同意将本人所有或支配的财产和资产作为资金安全保证,在履行合同义务或承担违约责任时,其他合同利害关系人可根据情况处置本人财产或资产,直至全部弥补他人损失及由此发生的各项费用。九、本协议未尽事宜,由甲乙双方协商解决,协商不成的,依法向该物业所在辖区人民法院提起诉讼。十、本协议共贰页,壹式两份,甲乙双方各执
