5、eCouncil of15 January2013ontheapprovalandmarketsurveillanceoftwo-orthree-wheelvehiclesandquadricyclessetsout generalrequirementsonthefunctionalsafetyandenvironmental performance of these vehicles and repeals 15 directives. The Commissionis empowered to adopt the specific technical requirements and t

6、est procedures throughdelegated acts.Thisdraftisthefirstdelegatedact,outofaforeseentotalofthree.Itsetsoutthespecific requirements and test procedures in the area of vehicle functional safety. Manyof these technical requirements and test procedures are carried over from the repealedDirectivesandadapt

7、ed,whennecessary,totechnicalprogress.Othersarenewlydevelopedinorderto reflectthenewsafetyprovisionsincludedinRegulationNo168/2013.Asfaraspossible,therequirementsarebased onormakedirectreferencetointernationalrequirementsadoptedundertheUNECE framework(Revised1958Agreement). This is in line with the C

8、ARS 21 recommendation to strengthen internationalregulatory harmonisation and represents a clear benefit for manufacturers.G/TBT/N/EU/115- 2 -7.Objectiveandrationale,includingthenatureofurgentproblemswhereapplicable:The term "L-category vehicles" covers a wide range of different vehicle ty

9、pes with two,threeorfour wheels,e.g.two-andthree-wheeledmopeds,two-andthree-wheeledmotorcycles,motorcycleswith side-carsandlight four-wheeledvehicles(quadricycles)such as on-road quads and quadri-mobiles.Type-approval requirements applying to new L category vehicles are currently set out inDirective

10、 2002/24/EC of the European Parliament and of the Council of 18 March 2002relatingtothetype-approvaloftwoorthree-wheelmotorvehicles(the"FrameworkDirective").Inaddition,aseriesofDirectivesreferredtointheFrameworkDirectivecontain detailed technical requirements relating to L-category vehicle

11、s.TheCommissionhasidentifiedthefollowingkeyconcernsasregardsthecurrentprovisionsforthe type-approvalofnewL-categoryvehiclesandtheseneedto beaddressed:- the complexity of the legal framework;-thelevelofemissionsandtheirincreaseasa proportionoftotalroadtransportemissions, which are decreasing overall;

12、- vehicle functional safety aspects related to type-approval requirements;- the lack of a legal framework for vehicles fitted with new technologies and;-theavailabilityontheinternalmarket,andregistrationof, certainimportedvehicles,systems,componentsorseparatetechnicalunitswhichdonot complywiththecur

13、renttype-approvalrequirementsregardingvehiclefunctionalsafetyand/or environmental protection.Thisproposalconsolidatescurrent type-approvalrequirementsregardingthefunctionalsafetyofL-categoryvehicles,updatingtheminline with technicalprogressandsimplifyingthemas muchaspossiblebyreferringtointernationa

14、lrequirementsinthisarea(e.g.UNECERegulations).Theobjectiveistoincreasethelevelof protectionL-category vehicle riders as vulnerable road users.8.
