安防工程合同(中英文对照)

1、安防工程建设合同甲方：XXXXXX 简称甲方乙方：YYYYYY 简称乙方合同号：依据?中华人民共和国合同法?和国家、行业部门现行的建设工程质量评定标准及设施验收标准的规定，经双方友好协商，签订本合同。第一条：工程合同1、 工程技术细节：依据合同附件中的工程材料明细和设计方案进行安装和施工。2、 工程范围及造价：乙方负责对甲方工程现场进行视频监控施工和安装，以适应甲方的要求，乙方须按照合同预算清单中的工程进行施工。工程预算为人民币： 伍万伍仟陆佰捌拾圆整￥55,680工程材料明细详见附件。3、 工程造价变更，如在施工期间任何一方对工程提出工艺变更要求，经双方协商并同意变更，可签署工程变更单，由此

2、造成的价格变动，按照变更单上的金额结算。第二条：工程进度所有工程分以下几个局部进行实施：1、 工程材料的采购 12天2、 综合布线施工 57天3、 设备的采购及安装调测 12天4、 工程完成时间：本工程必须在 2021年 月 日 之前完工。5、 如有特殊情况由甲乙双方协商解决。第三条：工程实施：1、 甲乙双方均应按照合同附件中的有关设计方案和时间安排施工。2、 甲方应指派专人到工程工程实施现场进行协调和监督，并就需要协商解决的问题与乙方联系,乙方施工人员必须支持并配合该人员的工作。3、 甲方负责联系厂区有关工程技术人员，就施工期间出现的楼宇应急问题进行处理。甲方应协助乙方办理有关施工手续。4、

3、 乙方应按合同规定的时间提供布线工程所需的材料和设备，并提供产品证明。5、 乙方应遵守甲方的各项管理规定，以及施工平安及防火等事项。乙方应制定施工队伍的施工平安措施及材料、工艺的正确标准，布线施工中出现的平安问题，由乙方自行负责。6、 为使工程得以顺利实施，双方如有需要改动的地方，达成一致后应以书面形式制成备忘录,作为本合同的补充条款，与合同同样有效。第四条：验收1、 乙方需严格按照工程方案精心施工，确保工程一次交验到达甲方要求及测试报告的参数要求。2、 验收时，工程应到达设计要求，即甲方可以立即投入使用。3、 验收时，乙方将以文本方式，向甲方提供布线统计、配置及竣工图、测试报告、布线分配表等

4、在内的书面文档，以作为付款的依据。4、 验收标准：参照中国工程建设标准化协会标准、建筑与建筑群综合布线系统工程施工及验收标准等，双方协商制定。5、 甲方确认验收合格后，签发工程验收合格书。第五条：付款1. 工程完工并验收合格后，甲方须在一个月内支付工程款90%，计人民币 伍万零壹佰壹拾贰圆整￥50,112。2. 预留工程款10%作为质保押金，工程完工后6个月付清,计人民币伍仟伍佰陆拾捌圆整￥5,568。第六条：违约责任1、 本合同签订后任何一方提出终止合同执行时，根据工程进度按工程总款项的10%30%赔偿对方的经济损失。但以下情况除外：a) 不可抗力b) 经双方协商解决达成一致2、 甲乙双方应

5、按照本合同所规定的时间表来组织安排施工与管理。甲方应在开工之前为乙方提供适宜的施工条件，乙方应在规定的时间内完成工程，假设由于乙方原因造成工期延误不能及时竣工，每延误一天，按工程总款项的0.1%赔偿甲方。但以下情况除外：a) 不可抗力b) 工程量变化和设计变更c) 一天内，非乙方原因停电造成停工，累计超过4小时d) 乙方提出书面的工期顺延请求而甲方两日内无故不予以答复的e) 合同中另行约定或双方代表经协商同意给予延期的其他情况3、 假设乙方施工达不到设计要求，或购置材料明显不能到达合同规定的质量等级的，更换材料的费用和由此造成的损失由乙方承当，造成的延期参照本合同第六条第2款执行。第七条：维护

6、及效劳1、 热线技术效劳：乙方应向甲方提供包括直线 、 、电子邮件等必须的通信联络方法，如出现任何问题和故障，先由乙方技术人员提供24小时热线效劳，假设无法解决，乙方须派技术人员2日内提供现场技术效劳，并保证故障的解决。2、 从验收之日起，乙方将对本工程所提供的视频产品提供整体1年的免费维护；产品方面，线缆提供3年质保，设备提供2年质保，如果在质保期内设备材料本身出现问题而影响使用，乙方负责免费及时更换。3、 工程验收合格后发现的问题，凡因施工原因造成的，乙方负责无偿修理；如因甲方使用或管理不当造成的系统设施损坏，乙方有偿提供相关配件及效劳。第八条：本合同一式二份，甲乙双方各持一份。自双方签字

12、ys2.4 Finish time: the project must be completed before2021-5-312.5 Any emergency should be solved by the mutual discussion of the Parties.3 Item implement3.1 Party A and Party B shall arrange the work according to the design plan and time relating to the appendix in the contract. Party A shall assi

13、gn a specified person in the support of the constructors of Party B to coordinate and supervise the implement of engineering item at the site and inform Party B the problem required to be solved .3.2 Party A shall instruct the relevant engineering technician to deal with the building emergencies dur

14、ing the construction and help Party B handle the relevant work procedures.3.3 According to the time stipulated in the contract, Party B shall provide the necessary material and equipment of cabling project and product certification.3.4 Party B shall comply with the regulations of Party A and other r

15、ules construction security and fire prevention and shall draw up the construction security measurements and the standard of material and technology. Any safety problem during the cabling construction is under Party Bs obligation3.5 For the sake of the successful implement of project, anything requir

16、ed to be changed by the mutual consent of the parties shall be made into written memorandum as the additional term of this contract which is as valid as contract itself.4 Acceptance4.1 When the project is checked first time, Party B shall make sure it meets the demands of the Party A and accord with

17、 the parameters of testing report.4.2 At the time when the project is checked, it shall meet the design specification, i.e. it can be used by Party A immediately.4.3 Party B shall provide Party A with written files in the form of text including cabling statistics and configuration, complete work cha

18、rt, testing report and cabling distribution table, which are considered as the basement of payment.4.4 The Parties referring to standards from China Association for Engineering Construction Standardization and construction and acceptance specification of generic cabling system for building and build

19、ing groups shall negotiate to make the acceptance standards.4.5 If the project is qualified, Party A shall issue the project acceptance certificate,5 Payment5.1 When the project is completed and proved to be qualified after the inspection, Party A should pay 90% of project price in a period of one m

20、onthRMB fifty thousand one hundred and twelve yuan￥50,112。5.2 10% of project costRMB: five thousand five hundred and sixty eight￥5,568as quality assurance deposit, which shall be fully paid after six months from the termination date of project.6 Responsibility for breach of contract6.1、One party who

21、 breach the contract after it was signed will pay for the other party 10% to 30% percent of total cost of the project according to on-going situation excluding the following cases:a) force majeureb) reach an agreement by two parties、 Both party A and party B should arrange and carry out the project

22、according to scheduled time. Party A should prepare proper constructing condition for party B before starting working and party B should finish work within stated time. Nevertheless, if party B could not finish project due to its own reason, it have to pay party A 0.1% of total cost for the project

23、per day excluding following cases: a) force majeureb) change of volume or design for the project c) power breaking off not due to party Bs reason for more than 4 hours in one dayd) party A does not reply party Bs written request for postponing working in two days without reasone) other cases shown i

24、n the contract or agreement achieved by two parties6.3、If works of party B could not reach requirement of design or materials could not reach quality requirements stated in the contract, party B should pay for cost for changing materials and loss due to this reason. Time for postponing will be arran

25、ged according to term 2 in clause 67.Hotline technical service: 1、 party B will provide party A contacting info. such as direct tel. no.，cell phone no.，email address. Any problems or faults, technical workers in party A will provide 24 hour hotline service. If it doesnt help, party B should send tec

26、hnical workers to provide technical service in spot in 2 days and ensure that the problem could be solved.2、Since checking and accepting day, party B will provide one-year free maintenance service for video product; as for other products, there will be three-year qualitative guarantee for circuitry and two-year qualitative g
