3、rthepurposeofpreventinginfectiousorparasiticdiseasesofanimals,diseases,insectpestsandweedsdangeroustoplants,andotherharmfulorganisms(hereinafterreferredto,forshort.asdiseases,insectpestsandharmfulorganisms)fromspreadingintooroutofthecountry,protectingtheproductionofagriculture,forestry,animalhusband

4、ryandfisheryaswellashumanhealth,andpromotingthedevelopmentofforeigneconomicrelationsandtrade.Article2Animalsandplants,theirproductsandotherquarantineobjects,containersandpackagingmaterialsusedforcarryinganimalsandplants,theirproductsorotherquarantineobjects,aswellasmeansoftransportfromanimalorplante

5、pidemicareasshall,onentryorexit,besubjecttoquarantineinspectioninaccordancewiththisLaw.Article3AnanimalandplantquarantinedepartmentshallbeinstitutedundertheStateCouncil(hereinafterreferredto,forshort,astheStateanimalandplantquarantinedepartment),whichshallconductaunifiedadministrationoftheentryandex

6、itanimalandplantquarantineinthewholecountry.PortanimalandplantquarantineofficessetupbytheStateanimalandplantquarantinedepartmentatportsopentotheoutsideworldandatplacesbusywithentryandexitanimalandplantquarantineshall,10inaccordancewiththisLaw,carryoutentryandexitanimalandplantquarantine.Thedepartmen

7、tinchargeofthequarantineofanimalproductsleavingthecountryfortradepurposesshallbedesignatedbytheStateCouncilasitdeemsappropriate.ThedepartmentofagricultureadministrationundertheStateCouncilshallbeinchargeoftheentryandexitanimalandplantquarantineinthewholecountry.Article4Aportanimalandplantquarantineo

8、fficemayexercisethefollowingfunctionsandpowerswhenperformingquarantineinspection:(1)embarkingonaship,avehicleoranairplanetoperformquarantineunderthisLaw;(2)enteringaseaport,anairport,arailwayorcoachstation,cessed,bredorcultivated,toperformquaranti

9、neinspectionandcollectsamplesaccordingtorelevantregulations;(3)enteringasiterelatingtoproductionorstorageaccordingtotheneedsofquarantine,tocarryoutepidemicmonitoringandinvestigationsorquarantinesupervisionandcontrol;(4)consulting,makingcopiesoforexcerptsfromoperationaldiaries,billsoflading,contracts

10、,invoicesorotherdocumentsrelatingtothequarantineobjects.Article 5 TheStateshallprohibitthefollowingobjectsfromenteringthecountry:(l)pathogenicmicro-organisms(includingseedculturesofbacteriaandviruses)ofanimalsandplants,insectpestsandotherharmfulorganisms;(2)relevantanimalsandplants,theirproductsando

11、therquarantineobjectsfromcountriesorregionswithprevalentepidemicanimalorplantdiseases;(3)animalcarcasses;and(4)soil.Whenaportanimalandplantquarantineofficediscoversanyobjectsprohibitedfromenteringthecountryasprescribedintheprecedingparagraph,suchobjectsshallbereturnedordestroyed.Whoever,becauseofspe

12、cialneedssuchasscientificresearch,importsanyobjectsprohibitedfromenteringthecountryasprescribedinthefirstparagraphofthisArticle,mustsubmitanapplicationinadvance,whichshallbesubjecttotheapprovalbytheStateanimalandplantquarantinedepartment.Thecataloguesofobjectsprohibitedfromenteringthecountryasprescr

13、ibedin(2)ofthefirstparagraphofthisArticleshallbeworkedoutandannouncedbythedepartmentofagricultureadministrationundertheStateCouncil.Article 6 Intheeventthataseriousanimalorplantepidemicoccursabroadandisliableto10spreadintothecountry,theStateCouncilshalladoptemergentpreventivemeasuresandmay,whenneces

14、sary,issueorderstoprohibitmeansoftransportfromanimalorplantepidemicareasfromenteringthecountryortoblockadetherelevantports;thelocalpeople'sgovernmentsinareasthreatenedbytheanimalorplantepidemicaswellastheportanimalandplantquarantineofficesconcernedshallimmediatelytakeemergencymeasures,and,atthes

15、ametime,reporttothepeople'sgovernmentsathigherlevelsandtheStateanimalandplantquarantinedepartment.Thedepartmentsofpostsandtelecommunicationsanddepartmentsoftransportationshallgiveprioritytotransmittingortransportingreportsconcerningseriousanimalorplantepidemicormaterialstobesentforquarantineinsp

16、ection.Article7TheStateanimalandplantquarantinedepartmentandportanimalandplantquarantineofficesshallpractiseaquarantinesupervisionsysteminrelationtotheproceduresintheproduction,processingandstorageofanimalsandplantsandtheirproductsforentryorexit.Article8Whenaportanimalandplantquarantineofficeiscarry

17、ingoutitstasksofquarantineinspectioninseaports,airports,railwayorcoachstations,orpostoffices,relevantdepartmentssuchastheCustoms,departmentsofcommunications,civilaviation,orrailways,andpostalservicesshallcoordinatetherewith.Article9Anyquarantinefunctionaryofananimalandplantquarantineorganmustbedevot

18、edtohisorherdutiesandenforcethelawimpartially.Nounitorindividualmayobstnictaquarantinefunctionaryofananimalandplantquarantineorganfromcarryingouthisorherdutiesaccordingtolaw.ChapterIIEntryQuarantineArticle10Whoeverimportsanimals,animalproducts,plantseeds,seedlingsorotherpropagatingmaterialsmustsubmi

19、tanapplicationinadvanceandgothroughtheformalitiesforexaminationandapprovalofquarantineinspection.Article11Whoeverimportsanimalsandplants,theirproductsorotherquarantineobjectsthroughtrade,scientificandtechnologicalcooperation,exchanges,donationsoraidshallspecifyinthecontractsoragreementstherequiremen

20、tsforquarantineinspectionprescribedbyChina*slawandthenecessityofquarantinecertificatesissuedbytheanimalandplantquarantinedepartmentunderthegovernmentoftheexportingcountryorregionbeingappendedtherewith.Article12Theownerorhisorheragentshallapplytotheportanimalandplantquarantineofficeattheportofentryfo

21、rquarantineinspectionoftheanimalsandplants,theirproductsorotherquarantineobjects,beforeorontheirentry,onthestrengthofdocumentssuchasthequarantinecertificatesissuedbytheexportingcountryorregionandthetradecontracts.Article13Onarrivalataportofameansoftransportforcarryinganimals,theportanimalandplantqua

22、rantineofficeshallforthepreventionofepidemicsadopton-the-spotpreventivemeasures10andconductdisinfectionofpersonsembarkingonordisembarkingfromthemeansoftransportorhavingcontactswiththeanimals,themeansoftransportforcanyingtheanimalsandthecontaminatedfields.Article14Importanimalsandplants,theirproducts

23、andotherquarantineobjectsshallbequarantinedattheportofentry;withoutconsentoftheportanimalandplantquarantineoffice,thesameshallnotbeunloadedfromthemeansoftransport.Theimportanimalsandplantsthatneedtobeplacedinisolationforquarantineinspectionshallbequarantinedinanisolationcourtdesignatedbytheportanima

24、landplantquarantineoffice.Byreasonoflimitedconditionsattheportofentry,theStateanimalandplantquarantinedepartmentmaydecidetohavetheanimalsandplants,theirproductsorotherquarantineobjectstransportedtoadesignatedplaceforquarantineinspection.Inthecourseoftransportation,loadingandunloading,theownerorhisor

25、heragentshalltakepreventivemeasuresagainstepidemics.Designatedplacesforstorage,processing,isolatedfeedingorplantingshallconformtotheprovisionsonanimalandplantquarantineandepidemicprevention.Article15Theimportanimalsandplants,theirproductsorotherquarantineobjectsthatpassthequarantineinspectionareallo

26、wedtoenterthecountry;theCustomsshall,afterverificatioiLreleasethesameonthestrengthofthequarantinecertificatesissued,orthestampsonthecustomsdeclarationformsaffixed,bytheportanimalandplantquarantineoffice.Inrespectoftheimportanimalsandplants,theirproductsorotherquarantineobjectsthatneedtobetransferred

27、awayfromacustomssuneillancezoneforquarantineinspection,theCustomsshall,afterverification,releasethesameonthestrengthoftheQuarantineTransferenceNoticeissuedbytheportanimalandplantquarantineoffice.Article16Inrespectoftheimportanimalsthatfailinthequarantineinspection,theportanimalandplantquarantineoffi

28、ceshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttodealwiththesaidanimalsineitherofthefollowingmanners:(1)theanimalsthatarefoundsufferingfromClassAinfectiousorparasiticdiseases,shall,togetherwithalltheotherin-contactanimals,bereturnedorslaughteredwiththeircarcassesdestroyed:or

29、(2)theanimalsthatarefoundsufferingfromClassBinfectiousorparasiticdiseasesshallbereturnedorslaughtered;andtheotherin-contactanimalsshallbeplacedinanisolationcamporanyotherdesignatedplaceforobservation.Inrespectofimportanimalproductsorotherquarantineobjectsthatfailinthequarantineinspection,theportanim

30、alandplantquarantineofficeshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttoconductsuchtreatmentsasdisinfectionanddisinfestation,returningordestruction.Theproductsorobjectsthatpassthequarantineinspectionafteratreatmentofdisinfectionanddisinfestationareallowedtoenterthecountry.A

31、rticle17Ondiscoveringthroughquarantineinspectionthatimportplants,plantproductsor10otherquarantineobjectsarecontaminatedwithdiseases,pestsorweedsdangeroustoplants,theportanimalandplantquarantineofficeshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttoconductsuchtreatmentsasdisinf

32、ectionanddisinfestation,returningordestruction.Thosethatpassthequarantineinspectionafteratreatmentofdisinfectionanddisinfestationarcallowedtoenterthecountry.Article18ThecataloguesoftheClassAandClassBinfectiousorparasiticdiseasesofanimalsspecifiedinArticle16,Paragraph1,Item1and2ofthisLawandthecatalog

33、uesofthediseases,pestsorweedsdangeroustoplantsspecifiedinArticle17ofthisLawshallbeworkedoutandannouncedbythedepartmentofagricultureadministrationundertheStateCouncil.Article19Ondiscoveringthroughquarantineinspectionthatimportanimalsandplants,theirproductsorotherquarantineobjectsarecontaminatedwithdi

34、seases,insectpestsorharmfulorganismswhicharenotcoveredbythecataloguesspecifiedinArticle18ofthisLawbutareextremelyharmfultoagriculture,forestry,animalhusbandryandfishery,theportanimalandplantquarantineofficeshall,inaccordancewithrelevantregulationsofthedepartmentofagricultureadministrationundertheSta

35、teCouncil,notifytheownerorhisorheragenttoconductsuchtreatmentsasdisinfectionanddisinfestation,returningordestruction.Thosethatpassthequarantineinspectionafteratreatmentofdisinfectionanddisinfestationareallowedtoenterthecountry.ChapterIIIExitQuarantineArticle20Theowner,orhisorheragent,ofexitanimalsan

36、dplants,theirproductsorotherquarantineobjectsshall,beforetheirexit,submitanapplicationforquarantineinspectiontotheportanimalandplantquarantineoffice.Theanimalsthatneedtobeplacedinisolationforquarantineinspectionbeforeexitshallbequarantinedinanisolationcourtdesignatedbytheportanimalandplantquarantine

37、office.Article21Exportanimalsandplants,theirproductsorotherquarantineobjectsshallbequarantinedbytheportanimalandplantquarantineoffice,andthosethatpassthequarantineinspectionorconformtothestandardsafteratreatmentofdisinfectionanddisinfestationareallowedtoleavethecountry.TheCustomsshall,afterverificat

38、ion,releasethesameonthestrengthofthequarantinecertificatesissued,orthestampsonthecustomsdeclarationformsaffixed,bytheportanimalandplantquarantineoffice.Thosethatfailinthequarantineinspectionandareunabletobetreatedbydisinfectionanddisinfestationwitheffectivemethodsshallnotbeallowedtoleavethecountry.A

39、rticle22Wheretheanimalsandplants,theirproductsorotherquarantineobjectsthatpassthequarantineinspectionareinvolvedinanyofthefollowingcircumstances,theownerorhisorheragentshallre-applyforquarantineinspection:(1)wheretheimportingcountryorregionischanged,andthechangedimportingcountryorregionhasdifferentr

40、equirementsforquarantineinspection;(2)wherethepackingsarechangedortheunpackedproductsorobjectsaresubsequentlypacked;(3)wherethestipulatedvalidperiodofquarantineisexceeded.ChapterIVTransitQuarantineArticle23WhoeverrequestsatransitofanimalsthroughtheChineseterritorymustobtaininadvanceandthroughconsult

41、ationtheconsentofChina'sStateanimalandplantquarantinedepartmentandthetransitmustbeconductedthroughthedesignatedportandroute.Themeansoftransport,containers,feedingstuffsandbeddingmaterialsfortheanimalsintransitmustallconformtoChina'sregulationsonanimalandplantquarantine.Article24Thetransitofa

42、nimalsandplants,theirproductsorotherquarantineobjectsrequirestheconsignorortheescorttosubmitattheportofentrythebillsofladingandthequarantinecertificatesissuedbytheanimalandplantquarantinedepartmentunderthegovernmentoftheexportingcountryorregiontotheportanimalandplantquarantineofficeforquarantineinsp

43、ection.Nofurtherquarantineinspectionisneededattheportofexit.Article25Thetransitanimalsthatpassthequarantineinspectionareallowedtopassthroughthecountry;andincaseanyinfectiousorparasiticdiseaseofanimalsspecifiedinthecataloguesasstipulatedinArticle18ofthisLawisdiscovered,theentireflockoftheanimalsshall

44、notbeallowedtotransit.Thetransitanimals*feedingstuffsthatarecontaminatedwithdiseases,insectpestsorharmfulorganismsshallbesubjectedtosuchtreatmentsasdisinfectionanddisinfestation,denialoftransitordestniction.Thecarcasses,excrements,beddingmaterialsandotherwastesofthetransitanimalsmustbedisposedofinac

45、cordancewiththeregulationsoftheanimalandplantquarantinedepartment,andmaynotbecastawaywithoutauthorization.Article26Theportanimalandplantquarantineofficeshallexaminethemeansoftransportandthepackings,inrespectofthetransitplants,animalandplantproductsorotherquarantineobjects,whichareallowedtotransitthr

46、oughthecountryiftheypassthequarantineinspection;incaseanydisease,insectpestorharmfulorganismspecifiedinthecataloguesasstipulatedinArticle18ofthisLawisdiscovered,itshallbesubjectedtoatreatmentofdisinfectionanddisinfestationordenialoftransit.Article27Animalsandplants,theirproductsorotherquarantineobje

47、cts,inthecourseoftheirtransit,maynotbeunpackedordischargedformthemeansoftransportwithouttheapprovaloftheanimalandplantquarantineorgan.Chapter VQuarantineofMaterialsCarriedbyPassengersorbyPost10Article28Whoeverintendstocarryorpostplantseeds,seedlingsorotherpropagatingmaterialsintothecountr)rmustsubmi

50、quarantineobjectswhicharenotincludedinthecataloguesspecifiedinArticle29ofthisLawshalldeclarethemtotheCustomsattheportofentryandacceptthequarantineinspectionbytheportanimalandplantquarantineoffice.Whoevercarriesanimalsintothecountrymustholdsuchpapersasquarantinecertificatesissuedbytheexportingcountry

51、orregion.Article31Theportanimalandplantquarantineofficeshall,inrespectoftheanimalsandplants,theirproductsorotherquarantineobjectsnotincludedinthecataloguesspecifiedinArticle29ofthisLaw,carryoutquarantineinspectionattheInternationalPostageExchangeBureau,onwhennecessary,takethesamebacktotheportanimala

52、ndplantquarantineofficeforquarantineinspection;andthesameshallnotbetransportedordeliveredwithoutundergoingquarantineinspection.Article32Animalsorplants,animalorplantproductsorotherquarantineobjectsthatenterthecountrybypostshallbereleasediftheypassthequarantineinspectionorconformtothestandardsafterth

53、etreatmentofdisinfectionanddisinfestation;thosethatfailinquarantineinspectionandareunabletobetreatedbydisinfectionanddisinfestationwitheffectivemethodsshallbereturnedordestroyed,andtheQuarantineTreatmentNoticeshallbeissued.Article33Theanimalsorplants,animalorplantproductsorotherquarantineobjectsthat

54、arecarriedorpostedoutofthecountryshallbequarantinedbytheportanimalandplantquarantineoffice,uponrequestbytheownerthereof.Chapter VIQuarantineofMeansofTransportArticle34Ships,airplanesortrainsfromtheanimalorplantepidemicareasshall,upontheirarrivalattheport,bequarantinedbytheportanimalandplantquarantin

56、ryshallbedisinfectedforepidemicpreventionbytheport10animalandplantquarantineoffice.Article36Theswillsandwastesofanimalorplantnatureonthemeansoftransportenteringorleavingthecountryrshallbedisposedofinaccordancewiththeregulationsoftheportanimalandplantquarantineofficeandmaynotbecastawaywithoutauthoriz

57、ation.Article37Themeansoftransportcarryingexportanimalsandplants,theirproductsorotherquarantineobjectsshallconformtotheregulationsonanimalandplantquarantineandepidemicprevention.Article38Theoldanddisusedshipsenteringthecountryfordisassemblingpurposesshallbequarantinedbytheportanimalandplantquarantin

58、eoffice.Intheeventthatdiseases,insectpestsorharmfulorganismsspecifiedinthecataloguesmentionedinArticle18ofthisLawarediscovered,thesaidshipsshallbesubjectedtoatreatmentofdisinfectionanddisinfestation.Chapter VIILegalResponsibilityArticle39Whoever,inviolationofthisLmitsanyofthefollowingactsshallbefine

59、dbytheportanimalandplantquarantineoffice:(l)failingtoapplyforquarantineinspectionorfailingtogothroughtheformalitiesforexaminationandapprovalofquarantineinspectioninaccordancewiththelaw;(2)unloadinganimalsorplants,animalorplantproductsorotherquarantineobjectsenteringthecountryfromthemeansoftransportortransportingordeliveringthesame,withoutpermissionoftheportanimalandplantquarantineoffice;(3)transferringordisposingof,wit
