文档根源为:从网络采集整理.word版本可编写.支持.产质量量保证保险条款ClausesofProductQualityBondInsurance总则GeneralProvisions第一条为促使产品生产者、销售者重视和提升产质量量，保护公司产品名誉，保护花费者的合法权益，特创办本保险。ClauseIThisinsuranceisspeciallysetuptopromoteproducersanddistributorstopayattentiontoandimproveproductquality,soastomaintainthereputationofproducts,protectthelegalrightsandinterestofconsumers.第二条凡经国产业质量量查验机构查验合格、赞同生产和销售的产品，生产和销售公司(以下称被保证人)都能够按本条款规定向本公司投保。ClauseIIAlltheproductsthathavebeenaccreditedandauthorizedbyProductQualityInspectionUnittobemanufacturedandfreelysoldonthemarket,producersaswellasdistributors,hereafterreferredtoasthewarrantee,canapplyforinsurancetoourcompany.保险责任InsuranceLiabilities第三条在保险限期内，被保证人对其当年生产销售的产品，依据《中华人民共和国产质量量法》。对由以下原由产生的，应由其担当的维修、改换、退货责任，本公司对被保证人负责补偿80%的损失，累计最高补偿金额在保险金额10%以内赔付，详细补偿限额在特别商定中列明。ClauseIIIIninsurancePeriod,foralltheliabilitiesforrepair,replacementandwithdrawaloftheproducts,producedandsoldbyandshouldbeassumedbythewarranteeaccordingtoLawonProductQuality,causedbyfollowingreasons,ourcompanywillpayfor80%ofthewarrantee'sloss,whilethetotalpremiumshouldnotpass10%oftheinsuredamount.ThespecificlimitsofindemnitywillbelistedintheSpecialAgreements.文档根源为:从网络采集整理.word版本可编写.支持.(一)不具备产品应该具备的使用性能而预先未作说明的；Article1.Donotpossesstheperformancestheproductsshouldbearandhavenotbeennarratedinadvance.(二)不切合在产品或许包装上注明采纳的产品标准的；Article2.Havenotreachedthestandardsindicatedontheproductsandpackaging.(三)不切合以产品说明、或实物样品等方式表示的质量状况；Article3.Fallshortofthequalitystatusindicatedbytheproductinstructionorthesample.(四)经本公司预先赞同，因为本条(一)至(三)款责任惹起的应由被保证人担当的合理的运杂费及其余相关花费。Article4.RationaltransportationandotherrelevantexpensesbroughtaboutaccordingtoArticle1to3ofthisClausethatshouldbeassumedbythewarrantee.第四条经本公司和被保证人特别商定，在被保证人因经营不善休业整改或法院宣布破产时，本公司才负责本条款第三条保险责任。ClauseIV.Accordingtothespecialagreementofourcompanyandthewarrantee,ourcompanywillundertaketheinsuranceliabilityofthethirdArticleonlywhenthewarranteeisinbadmanagementandstopoperationsforrectification,orsuspendedbythecourt.除外责任ExemptionofLiability第五条本公司对以下各款不负补偿责任：ClauseV.Ourcompanyisexemptedfromliabilityinfollowingarticles.(一)除本条款第三条规定的法律责任外依据合同或协议应由被保证人担当的其他责任；Article1.Otherliabilities,exceptforthelegalliabilitiesprescribedinClauseIII,shouldbeassumedbythewarranteeaccordingtocontractandagreement.(二)出厂时未经查验的产品或虽经查验属于不合格产品(包含次品、办理品、废品等)以及没法确立出厂日期或销售日期的产品；ArticleII.Productswithoutex-factoryinspection,productshavenotpassedtheinspection,includingtheinferior,disposedanddiscarded,aswellastheproductsboth文档根源为:从网络采集整理.word版本可编写.支持.thedateofshipmentandsaledatecannotbetraced.(三)用户和花费者(下称权益人)不依据产品使用说明书要求安装、使用或经权益人自行拆装、维修过的产品；ArticleIII.Productsthatusersandconsumers,hereafterreferredtoastheobligee,havenotinstalledorusedabidingbytheinstruction,andtheproductsthathavebeendismantledandfixedbytheobligeehimself.(四)出口到境外(包含港、澳、台地域)的产品；ArticleIV.Productsexportedoverseas,includingHongkong,MacaoandTaiwan.(五)产品造成使用者或其余人的人身损害和财富损失；ArticleV.Personalinjuryandpropertylosscausedbytheproducts.(六)产品的自然磨损，运输、仓储过程中产品的损失，销售公司自进货发票开出之日起，高出一年半以后销售的产品以及超出保质期所致的损失；ArticleVI.Wearlossandthelossintransportationandstorageoftheproducts,productssold1andanhalfyearaftertheincominginvoicedate,aswellasthelosscausedbyexcessingthedateofminimumdurability(七)违纪生产或销售的产品；ArticleVII.Productsillegallyproducedorsold.(八)被保证人不切合产品实质状况的产品宣传惹起的损失；ArticleVIII.Lossbroughtaboutbythewarrantee'spromotioninconsistentwiththeproducts.(九)被保证人因经营不善所致休业整改或法院宣布破产此后销售的产品；ArticleIX.Productssoldafterthewarranteeisinbadmanagementandstopoperationsforrectification,orsuspendedbythecourt.(十)其余不属于本保险责任范围内的损失。ArticleX.OtherlossesnotfallingwithintheScopeofCoverageofthePolicy.保险责任限期InsurancePeriod第六条自产品由权益人在保险合同限期内购进被保证产品之日12时起，到次年同日12时止，限期为1年。产品注明的安全使用期或无效期在保险责任限期内文档根源为:从网络采集整理.word版本可编写.支持.的，则以注明天期为停止日。ClauseVI.Insuranceperiodis1year,from12:00ofthedaywhentheobligeepurchasetheinsuredproductsininsuranceperiod,to12:00ofthesamedayofnextyear.保险金额与保险费InsuranceAmountandInsurancePremium第七条单件产品的保险金额按出厂销售价或商铺零售价确立。ClauseVII.Insuranceamountofsingleproductisdeterminedaccordingtofactorypriceorretailprice.第八条保险费按被保证产品当年的计划销售额和本公司费率规章的规定预收，期满时依据实质销售额进行调整。ClauseVIII.Insurancepremiumisreceivedbeforehandaccordingtotheplannedturnoveroftheinsuredproductsandthefeeclausesofourcompany,andwillbeadjustedaccordingtotheactualturnover.被保证人义务Liabilitiesofthewarrantee第九条在保险合同奏效日以前，缴纳保险费和商定的其余相关花费。ClauseIX.Paytheinsurancepremiumandotherstipulatedfeesbeforeinsurancecontractbecomeeffective.第十条仔细接受本公司对被保证产品的质量检查、监察，向本公司供给必需的生产、销售、质检及产品维修、改换、退货等方面的数据资料与帐册，对本公司的防灾防损建议对付诸实行。ClauseX.Modestlyacceptthequalityexaminationandinspectionbyourcompany,providenecessarydataandaccountbooksrelevantwithproduction,distribution,qualityinspectionandrepair,replacementandwithdrawaloftheproducts,aswellasactualizeourcompany'sadviceoncalamityandlossprevention.第十一条被保证人在销售产品时，产品或其包装的表记一定切合相关法例的规定，并应同时附有注明产品生产日期和保险时效的保险服务卡及产品使用说明书。ClauseXI.Whenthewarranteeselltheproducts,marksoftheproductsandits文档根源为:从网络采集整理.word版本可编写.支持.packagingmustconformrelevantlaws,andenclosedwithinsurancecardmarkedwithproductiondateandinsuranceperiodplusinstruction.第十二条被保证产品在技术标准或工艺标准上的改动应预先通知本公司。ClauseXII.Notifyourcompanyofanychangeoftechnologyandcraftstandardsoftheinsuredproducts.第十三条配合本公司办理赔案，并负责维修、改换被保证产品。ClauseXIII.Providecooperationindealingwithcompensationcasesandanswerforproductsrepairandreplacement.第十四条保险合同期满后不再续保时，被保证人应从本保险合同停止之日起停止使用保险凭据、保险标志，节余部分交由本公司办理。ClauseXIV.Whentheinsurancecontractterminateandisnotrenewedanylonger,thewarranteeshouldstopusingtheinsurancecertificateandmarks,andhandoverthelefttoourcompany.第十五条被保证人如不执行上述第九条至第十四条义务，本公司有权拒绝补偿，或许从书面通知之日起停止保险合同。ClauseXV.Ifthewarranteedonotfulfilltheabove-mentionedliabilitiesfromClauseIXtoXIV,ourcompanywillbeentitledtorefusecompensation,orterminatetheinsurancecontractfromthedayofwrittennotice.补偿办理Compensation第十六条被保证产品假如发生保险责任事故时，本公司按以下标准的80%予以补偿。ClauseXVI.Whenaccidentsofinsuranceliabilityaccidentsbefalltheinsuredproducts,ourcompanywillpay80%ofthefollowingstandards.(一)一般零零件、元器件无效后的修复花费；Article1.Repairexpensesofcommonpartsandcomponentsfailure.(二)因设计、制造等原由所致主要零零件、元器件无效，而改换该件的重置价值；Article2.Reinstatementvalueofthemainpartsandcomponentsbecauseofthefailurecausedbydesignandproduction.文档根源为:从网络采集整理.word版本可编写.支持.(三)产品发生改换、退货时，其单件产品的保险金额，假如改换产品的保险金额高于重置价值时，其补偿金额以不超出重置价值为限；Article3.Insuranceamountofsingleproductwhenreplacementandwithdrawal.Thereinstatementvalueofthereplacedproductsshouldnotexceedtheinsurancepremium.(四)零零件、元器件和整件产品的重置价值以生产公司的销售价钱为准，但不可以超出同类产品的当地市场价；Article4.Thereinstatementvalueofparts,componentsandcompleteproductshouldtakethesalepriceasthestandardanddonotexceedthemarketpriceofsimilarproducts.(五)经本公司预先赞同，因产品维修、改换、退货惹起的运杂费及其余相关的费用的实质发生数额，但不得超出该件产品的保险金额。Article5.Transportationandotherrelevantexpensesarousedbytherepair,replacementandwithdrawaloftheproducts,withtheapprovalbyourcompanybeforehand,shouldnotsurpasstheinsurancepremiumoftheproduct.第十七条对本保险范围内的补偿责任，本公司以为必需时能够以被保证人的名义代位履行应诉或向第三方提起诉讼。ClauseXVII.Asforthecompensationliabilitiesundertheinsurancecoverage,ourcompanyisentitledtoexertthesubrogationrighttoanswerthelawsuitandtolodgeacomplainttoathirdparty.第十八条被保证人或权益人向本公司提出索赔时，一定供给保险凭据、销售发票、维修花费凭据，及本公司以为必需的生产或销售原始记录、损失清单、质检判定等相关单证。ClauseXVIII.Whenregisteringclaims,thewarranteeandobligeemustprovidetheinsurancecertificate,salesinvoiceandmaintenancecostswarrant,plusthenecessaryoriginalproductionorsalesrecord,losslist,qualityappraisalandotherrelevantcertificates.第十九条本公司一般经过被保证人向权益人补偿，在以为有必需时也能够向权利人直接补偿。ClauseXIX.Generally,ourcompanypaytheobligeethroughthewarrantee,andpay文档根源为:从网络采集整理.word版本可编写.支持.directlywhennecessary.第二十条权益人在获取赔款时，应将向相关责任方的追偿权转让给本公司，并辅助本公司追偿。ClauseXX.Whenreceivingtheindemnity,theobligeeshouldhandovertherelevantrecoveryrighttoourcompanyandhelptorecovertheloss.第二十一条权益人从发生保险责任事故的当日起，2年以内不向本公司申请赔偿，不供给规定的各样单证，即视同自动放弃索赔
