洁,工程完工后负责清扫施工现场。4.6工程开工未移交甲方之前,负责对现场的一切设施和工程成品进展保护。工程工程及施工方式如需变更,双方应协商一致,双方签名确认,同时调整相关工程费用及工期(见装饰装修工程增减工程单)。6.1由甲方提供的材料、设备(详见甲方提供装饰装修材料明细表),应当符合设施要求,如因质量问题或规格差异造成工程损失的,由甲方负责。甲方应在材料运到施工现场前通知乙方,双方共同验收并办理交接手续;乙方验收后应负责妥善保管。6.2由乙方提供的材料、设备(详见乙方提供装饰装修材料明细表),乙方应在材料运到施工现场前通知甲方,并承受甲方检验。如质量不符合要求或规格有差异的,应制止使用;如已经使用对工程造成损失的由乙方负责。7.1对以下原因造成开工日期延误,经甲方确认,工期相应顺延;(1)工程量变化和设计变更;(2)不可抗力;(3)甲方同意工期顺延的其他情况。7.2因甲方未按约定完成其应负责的工作而影响工期的,工期顺延;因甲方提供的材料、设备质量不合格而影响工程质量的,返工费用由甲方承当,工期顺延。7.3甲方未按期支付工程款,合同工期相应顺延。7.4因乙方责任不能按期开工或无故中途停工而影响工期的,工期不顺延;因乙方原因造成工程质量存在问题的,返工费用由乙方承当,工期不顺延。8.1合同生效后,甲方按下规定中的约定直接向乙方支付工程款:第一次:签定本合同时,甲方支付乙方报价单确定的总金额(含工程款总额和增加工程金额)的%,即元。第二次:木工进场,甲方支付乙方报价单确定的总金额(含工程款总额和增加工程金额)的%,即元。第三次:扇灰油漆进场,甲方支付乙方报价单确定的总金额(含工程款总额和增加工程金额)的%,即元。第四次:工程完工及开工验收后,结算完毕,甲方甲方支付乙方报价单确定的总金额(含工程款总额和增加工程金额)的5%,即元。8.2工程验收合格后,乙方应向甲方提出工程结算,并将有关资料送交甲方。甲方接到资料后日内如未有异议,即视为同意,双方应填写工程结算单并签字,甲方应在签字时向乙方结算工程尾款。8.3工程款全部结清后,乙方应向甲方开具正式统一收据。甲方所支付的工程款,以乙方财务部开出并盖财务专用章收据为准。8.4本工程验收合格后,保修期为自双方签字之日起12月9.1以下甲方原因造成工期延误,损失由甲方负责,工期应当顺延:(1)不能提供水、电;(2)不能保证每天8小时以上工作时间(含加班);(3)不能按期提供自购材料、设备;(4)不能按期支付工程款影响正常施工的;(5)因甲方原因变更设计、增加施工工程;(6)同意工期顺延的其他情况。(7)逾期验收或无故怠于验收;(8)因甲方责任造成工期延误的其他情况。9.2对以下原因造成工期延误,工期不顺延:(1)因乙方责任不能按期开工或中途无故停工而影响工期的,工期不顺延;(2)因乙方原因造成工程质量存在问题的返工费用由乙方承当,工期不顺延。(3)乙方施工过程中违背平安操作标准造成人员伤害的,由乙方负责;(4)乙方施工造成甲方物品损坏,乙方应予以修复或赔偿;(5)乙方违背物业管理规定造成的损失,由乙方负责。(6)乙方原因,工程质量达不到双方约定的质量标准,乙方负责修理,工期不予顺延。9.3合同中的任何一方因未履行合同约定或履行不符合约定,受损失的均由责任方承当责任,并赔偿给对方造成的经济损失。9.4未办理验收手续,甲方提早使用或擅自动用工程成品而造成损失的,由甲方负责。9.5因一方原因,造成合同无法继续履行时,该方应及时通知对方,并办理合同终止手续,并由责任方赔偿对方相应的经济损失。9.6甲方未按期支付工程款的,每延误一天向对方支付违约金_______元。9.5由于乙方原因致使工期延误,每延误一天向对方支付违约金_______元。10.1乙方设计师完成的施工图,必须在商定的时间内会同甲方审图,经甲方确认签字后,乙方方可进展施工。10.2乙方必须严格按甲方认可的图纸进展施工(安装)。10.3施工过程中,甲方提出变更图纸、停顿施工或增减工程,应以书面形式通知乙方,列明停顿施工或增减工程的理由、工程部位、时间、材料等。乙方根据变更要求,尽快向甲方提交变更所采取的措施、增减的造价,因停工等原因造成的工期延误、材料耗损、费用损失等清单,并报告甲方。甲方收到报告后两天内做出签字答复或协商解决。10.4隐蔽工程验收前,由乙方通知甲方到现场验收,验收期为两天。甲方未按时验收的,乙方可自检后如实填写隐蔽记录,对乙方的自行验收结果,甲方应予以成认。10.5工程开工后,乙方应当通知甲方验收。甲方应在接到通知后天内验收,并办理验收移交手续。如甲方在上述规定时间内未能验收,应当及时书面通知乙方,另定验收日期,否那么视为甲方通过验收。如另定验收日期,甲方应成认开工日期,并承当乙方的看管费用和相关费用。10.6双方未办理验收手续,甲方不得入住,如甲方擅自入住视同验收合格,由此而造成的损失由甲方承当。《工程预算报价表》、《施工图》以及双方协商一致、签名确认的其他文件,作为合同附件,与合同具有同等法律效力。本合同在履行过程中发生的争议,由当事人双方协商解决;也可由东莞市装饰协会调解;协商或调解不成的,可依法向人民法院提起诉讼。13.1本合同如有未尽事宜,双方本着友好互利原那么协商解决,如协商后签定补充协议,补充协议与本合同有同等法律效力。13.2本合同签订后工程不得转包。13.3本合同一式_贰__份,双方各执__壹__份,合同自双方签名并加盖公章或合同专用章后正式生效,履行完毕后自行终止。13.4合同附件为本合同的组成局部,与本合同具有同等法律效力。甲方:____________(签字)乙方:东莞×××装饰工程(盖章)法定代理人:法定代理人:_____________委托代理人:_____________委托代理人:_____________地址:地址:××市××镇×××路×××::×××××××工程装修合同电子版篇六委托方〔甲方〕:____________承接方〔乙方〕:____________为明确甲乙双方在装修工程施工中的权利义务,根据国家____有关规定。经双方协商,签订本合同。以资双方共同遵守。第一条工程概况1、工程地址____________2、施工面积____________平方米3、施工内容〔详见合同附件一,《施工图》〕4、开工日期______年______月_______日5、交工日期______年______月_______日6、委托方式包工包料第二条工程价款工程总造价_____元〔¥:_____元〕工程预算书,〔详见合同附件二〕。《装修工程预算书》预算中单价做为决算单价,增加量按实际发生额结算。第三条质量要求1、使用材料品种、规格、名称,〔详见合同附件〔二〕工程预算书〕,其工程预算书中不包含洁具、灯具、软装饰品、造景植物、安装工程及撤除工程。2、工艺标准双方同意参照中华人民共和国国家标准《住宅装修工程施工标准》〔gb50327—20xx〕及装修协议。3、由乙方设计施工的二楼架设工程必须保证平安使用年限在___年以上,期间发生倾斜、材料断裂、塌陷等不平安现象,由乙方负责免费维修直至重新架设。4、阁楼架设工程在使用过程中一旦发生质量事故,造成人员伤亡、设施损坏等,由乙方负全责并处理善后事宜。5、阁楼架设工程必须具备与军公区综合楼同等抗震才能。6、施工过程中如存特殊施工工程和质量要求,双方应协商确认,增加费用,签订补充合同。7、甲方自购材料,设备其质量由甲方自负。8、施工过程中双方对施工质量发生争议,申请由有关部门对工程质量予以认证。假设经认证工程质量不符合合同约定的标准,认证过程支出的相关费用由乙方承当,经认证工程质量符合合同约定的标准,认证过程支出的相关费用由甲方承当。第四条材料供给1、乙方提供材料设备〔详见合同附件二,《工程预算书》〕,如不符合质量要求或有规格差异〔在允许偏向范围外〕,应制止使用,对工程造成损失由乙方负责。2、甲方提供材料、设备,应符合设计要求,并按时供给。如因甲方未按时提供或产品质量问题引起的误工或返工,其各项费用由甲方承当,同时甲方承当工期延误责任。材料经乙方验收后,由乙方负责保管,假设因乙方事物造成材料损坏由乙方负责赔偿。第五条价款支付1、合同签约时预付总造价50﹪,木工完成时再付总造价的45﹪,整体工程完工开工验收时交付5%。2、甲方在应付款日期未付款属违约行为,乙方有权停顿施工,验收合格未付清工程款时,工程不得交付使用。3、工程工程在施工过程中有增减变动时,双方需要补充合同。增减工程的价格,签订补充时一次付清。4、甲方未按合同规定期限预付工程款,那么逾期一天应按付工程款的1﹪支付违约金给乙方。第六条工程工期1、在正常施工情况下,乙方延误工期,按每天五十元支付违约金给甲方。如因甲方原因延误工期由甲方按每天五十元支付违约金给乙方。2、在施工过程中由于以下情况影响工期时不计误工,工期顺延:〔1〕增加工程量、设计变更或材料变更;〔2〕累计停水、停电二小时以上/每天;〔3〕甲方未按本合同第五条付款方式支付工程款;〔4〕甲方原因拖延造成误工;〔5〕不可抗力和因素;〔6〕甲方同意给予顺延的其它情况。第七条工程验收1、在施工过程中,乙方通知甲方分段验收。工程完工后,乙方组织甲方进展全面验收,双方办理工程结算和移交手续。2、乙方通知甲方进展工序验收或开工验收,甲方应在三天内组织验收,逾期视为甲方验收合格,如有问题甲方自行负责。甲方未经开工验收自行入住,视为验收合格,并承当违约责任。3、甲方因特殊原因不能如期验收,应用时通知乙方,另定日期。但甲方需成认工程的开工日期,并承当相应的看管费。4、验收时,甲方假设对个别装修质量小问题有异议时,双方因本着公平、合理解决问题的原那么互相协商,不能以此为由,拖延验收时间。第八条双方职责一、甲方1、提供原房屋平面、水电、煤气线路图,并向乙方现场交底。2、如需拆、改元件建筑构造或设备、管线,应向有关部门办理相关手续,并承当相关费用。3、免费提供施工期间的正常用水、用电。4、负责与物业管理部门做好协调工作,保证每天正常施工时间10小时〔含强烈声操作〕或负责协调施工队与邻里之间的关系。5、及时解决工期、质量等现场发生需要协商的有关事宜并负责工程开工验收。二、乙方1、严格执行平安施工操作标准、防火规定、施工标准及质量标准,按期保质完成工程。2、负责施工现场平安,因施工造成管道堵塞、渗漏水等事故需尽快修复并承当费用。第九条违约责任1、乙方如不能如约保证质量,造成返工,费用自付。2、假设甲方不按合同支付所应付的款项,超过约定三天时间的,乙方有权向甲方发出要求付款通知,甲方收到通知后仍不付款,乙方可以在发出通知的三天起停顿进场或施工,由此造成的工期拖延及损失均由甲方负责。超过约定支付15天,乙方有权单方面解除合同,甲方必须一次性赔偿乙方5000元人民币。经甲、乙双方确认扣除一万元赔偿款外上余的工程款,乙方必须在三天内退还给甲方。3、在施工过程中,未经对方同意,任何一方私自更改施工内容,所以引起的质量问题,责任方负责。4、工程验收合格三天内,甲方应向乙方决算并结清工程尾款,每逾期一天甲方应付50元看管费予乙方。在未付清工程款时如甲方擅自更换门锁或入住,视为违约。甲方须每天付100元违约金给乙方并承当其它违约责任。5、合同生效后,履行期满前,擅自解除合同的一方,给对方造成的损失应按时赔偿,并按合同价款的10﹪支付违约金。6、在一方要求解除合同另一方同意的情况下,造成对方经济损失的,按实际造成的.损失赔偿。第十条保修条款工程验收后装饰主体工程保修12个月。12个月保修期过后,保修费用由甲方负担。第十一条合同文本1、本合同正本两份,甲方一份、乙方一份。甲方:乙方:〔签名〕〔签名〕地址:地址:联络:联络:年月日年月日工程装修合同电子版篇七合同编号:_________发包方(以下简称甲方):_________委托代理人:_________单位:_________住所地址:_________联络:_________承包方(以下简称乙方):_________法定代表人:__
