HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,

HavingregardtoDirective(EU)2024/1275oftheEuropeanParliamentandoftheCouncilof24April2024ontheenergyperformanceofbuildings

,andinparticularArticle7(3)thereof,

Whereas:

(1)PursuanttoArticle7(2)ofDirective(EU)2024/1275,MemberStatesaretoensurethatthelife-cycleglobalwarmingpotential(GWP)iscalculatedanddisclosedintheenergyperformancecertificateofnewbuildingsinaccordancewithAnnexIIItothatDirective.MemberStatesmaydecidetoexcludefromtheobligationtocalculatethelife-cycleGWPthecategoriesofbuildingswhichtheyexcludefromtheobligationtohaveanenergyperformancecertificatepursuanttoArticle20(6)ofthatDirective.

(2)AharmonisedUnionframeworkforthenationalcalculationoflife-cycleGWPisnecessaryforthebuildingsectortopromotecomparabilityoflife-cyclegreenhousegasemissionsacrosstheUnion,therebyfacilitatingtheassessmentoftheclimateimpactofdifferentbuilding-relatedproductsandactivities.

(3)AUnionframeworkforthenationalcalculationoflife-cycleGWPshouldprovideacommonmethodologyandsetofrules,enablingMemberStatestocalculatelife-cyclegreenhousegasemissionsinaconsistentandtransparentmanner,withaviewtothedisclosureoftheresultsintheenergyperformancecertificateofthebuilding.Incombinationwiththedeclarationofthelife-cycleclimatechangeeffectsofconstructionproductsunderRegulations(EU)No305/2011

and(EU)2024/3110

oftheEuropeanParliamentandoftheCouncil(theapplicableregulationdependsontheconstructionproductinquestion),theUnionframeworksupportsthecreationofleadmarketsforlow-carbonproductswhichreducethewholelife-cycleemissionsofbuildings.ThelackofsuchaUnionframeworkmayleadtoinconsistenciesandunequaltreatmentofeconomicoperators,underminingtheeffectivenessandcoherenceofUnionclimatepolicies.

(4)Toensurealevelplayingfieldandfacilitatethetransitiontoaunifiedapproach,itisnecessarytolaydownauniformframeworkthatestablishescommonprinciplesforexistingnationaltoolsormethodsestablishedpriortotheadoptionofDirective(EU)2024/1275andtoolsormethodsthatwouldbedevelopedinthefuture.

(5)TheUnionframeworkshouldoffersomelevelofadaptability,allowingMemberStatestointegratetheirexistingofficialnationaltoolsormethodsintothenewunifiedapproach,whileensuringthattheoverallframeworkremainsconsistentandpromotesthecomparabilityofresultsacrosstheUnion.

(6)TheUnionframeworkforlife-cycleGWPassessmentshouldbebuiltuponinternationallyrecognisedstandardsandmethodologies,inparticularEN15978(EN15978:2011Sustainabilityofconstructionworks.Assessmentofenvironmentalperformanceofbuildings.Calculationmethod)andtakeintoaccountanysubsequentstandardrelatingtothesustainabilityofconstructionworksandthecalculationmethodfortheassessmentofenvironmentalperformanceofbuildings,whilepromotingcarbonstorageinoronbuildings,long-lastingconstructionandcirculareconomyinconstructionincludingthereuseandrecyclingofmaterialsanddesign-for-disassembly.TheUnionframeworkshouldalsoconsiderexistinginitiatives,includingLevel(s)commonEUframeworkforindicator1.2andofficialnationalframeworks,toensureahighlevelofenvironmentalprotectionandconsistencywithexistingnationaltoolsandmethodsandglobaleffortstoaddressclimatechange.

(7)TheUnionframeworkshouldestablishauniformscopeofbuildingelementsandtechnicalequipment,whichminimisesmarketbarriersbetweenMemberStatesandfacilitatestheunderstandingandcomparisonofresults,whilealsoenablingtheidentificationofsourcesofemission.Abalancedlevelofdetailintheuniformscopeofbuildingelementsandtechnicalequipmentisnecessarytoachieveaccurateandcomparableoutcomes,asexcessivegeneralityorvaryinglevelsofdetailcouldleadtoinconsistentapproachesandunfairperceptionsoftheenvironmentalimpactofdifferentprojectsandsolutions.

(8)Toeffectivelyreducewhole-life-cyclegreenhousegasemissions,life-cycleGWPshouldbecalculatedorestimatedalreadyatthedesignstage,beforethebuilding’sconstructionisstarted,whenchangestothebuildingdesigncanstillbemade.

(9)Theresultsdisclosedintheenergyperformancecertificateshouldreflecttheas-builtstage,toensurethattheactualgreenhousegasemissionsofthecompletedbuildingareaccuratelyaccountedfor.

(10)Toensureaccuracyandconsistencyinlife-cycleGWPcalculations,theusefulfloorareausedinthecalculationsshouldbeclearlydefined,therebyavoidingthepotentialforlow-impactareastoartificiallyreducethebuilding’soveralllife-cycleGWPresult.TheUnionframeworkshouldthereforerequiretransparencyonthefloorareasusedinthecalculationbyrequiringnationalrulestakingintoaccountinternationallyrecognisedstandards,whileallowingMemberStatessomeflexibilitytodefinetheusefulfloorareaatnationallevel.

(11)Toensuretheaccuracyandreliabilityofthelife-cycleGWPcalculation,aclearhierarchyoftheinputdatabasedontheirqualityandprecisionshouldbeestablished.Thelife-cycleGWPcalculationshouldprioritisetheuseofdataissuedunderrelevantUnionlegalacts,includingRegulation(EU)2024/3110,whichlaysdownharmonisedrulesforthemarketingofconstructionproducts.

(12)Intheoutermostregions,withinthemeaningofArticle349TFEU,MemberStatesmayconsidersimplifyingthebuilding’slife-cycleGWPcalculationbyallowinganextendeduseofdefaultdatainthoseregions,totakeintoaccountthepossibilityforexemptionrecognisedbyRegulation(EU)2024/3110applicabletoconstructionproductsplacedonthemarketintheoutermostregions.

(13)Thelife-cycleGWPofthebuildingdisclosedintheenergyperformancecertificateshouldbereportedinatransparentformat,showingresultsatleastforeachlife-cyclestage.Forotherpurposesincludingcontrolandverificationanddatacollectionforsettingandupdatinglimitvaluesatnationallevel,MemberStatesareencouragedtocollectmoredetailedinformationonabuilding’slife-cycleGWP.

ThisRegulationshallenterintoforceonthetwentiethdayfollowingthatofitspublicationintheOfficialJournaloftheEuropeanUnion.

ThisRegulationshallbebindinginitsentiretyanddirectlyapplicableintheMemberStates.

Calculationoflife-cycleGWPofnewbuildingspursuanttoArticle7(2)

1.GENERALFRAMEWORK

ThisannexsetsoutaUnionframeworkforthenationalcalculationoflife-cycleGWP,withaviewtothedisclosureoftheresultsintheenergyperformancecertificateofthebuildingpursuanttoArticle7(2).FortheverificationofcompliancewithalimitvaluepursuanttoArticle7(5),MemberStatesmaydecidetoleaveoutsomepartsoflife-cyclestagesandsomepartsofthescopeofbuildingcomponents,forexamplebyapplyingweightedcoefficientsassociatedwiththedateofemissionduringthebuilding’slifecycle.

Thelife-cycleGWPofnewbuildingsshallbecalculatedinaccordancewiththeminimumrequirementssetoutinthisAnnexandfollowingtherelevantpartsofthestandardEN15978(EN15978:2011Sustainabilityofconstructionworks.Assessmentofenvironmentalperformanceofbuildings.Calculationmethod)andtakingintoaccountanysubsequentstandardrelatingtothesustainabilityofconstructionworksandthecalculationmethodfortheassessmentofenvironmentalperformanceofbuildings.Thisdoesnotconstitutealegalcodificationofthisstandard.

Thelife-cycleGWPdisclosedintheenergyperformancecertificate(EPC)ofthebuildingshallreflecttheas-builtstage.

FordatatypesotherthandataavailableundertheConstructionProductsRegulationorunderecodesignandenergylabellinglegislation,MemberStatesareencouragedtolimitmarketfragmentationthroughtherecognitionofreliableandcompatibleavailabledataissuedinanyMemberState,includingproduct-specificdataandproject-specificdatacalculatedinaccordancewithEN15804orEN50693oracompatiblestandard.Inanyevent,MemberStatesshalltakethenecessarymeasurestoensureconsistencyandcompatibilitybetweendatawhencombiningthosedatafromdifferentsourcesandensurethatthefinalresultsforthelife-cycleGWParereliable.

4.USEFULFLOORAREA

Thelife-cycleGWPshallbeexpressedinunitsofkgCO2eq/m2ofusefulfloorarea.

MemberStatesshallsetouthowthedefinitionofusefulfloorareaistobeusedinpracticetocalculatethelife-cycleGWPofnewbuildings.Theusefulfloorareashallcorrespondtotheareaofthepartsofthebuildingthatarecoveredbythelife-cycleGWPcalculationandshallnotextendbeyondthebuildingenvelope.MemberStatesshalldescribeatnationalleveltheadoptedusefulfloorareaintermsofcomponentareas,asdefinedinaccordancewithInternationalPropertyMeasurementStandards(IPMS)

oranequivalentstandard,whichensurethetransparency,consistencyandcomparabilityoffloorareameasurements.

Thelife-cycleGWPshallbecalculatedanddisclosedintheEPCofthebuilding,inaccordancewithArticle19andAnnexV,orofthebuildingunitwhereapplicable.Ifrelevant,MemberStatesmaysetrulesforallocatingtheemissionsofbuildingcomponentssharedbymultiplebuildings.Thoserulesshallensurethatthelife-cycleGWPcalculationisfair,transparentandconsistentacrossdifferentbuildingsandprojects.

5.SCOPEOFLIFE-CYCLESTAGES

Thelife-cycleGWPshallbecalculatedforeachrequiredlife-cyclestage,assetoutinTable2.MemberStatesmaydecidetoexcludeanyoptionallife-cyclestagesfromthecalculation,assetoutinTable2.

Foreachlife-cyclestage,whentheinformationavailableatproductleveloffersmultiplescenarios,thecalculationatbuildinglevelshallbeasrepresentativeaspossibleofthebuildingprojectorbuilding.Whenreliableinformationisnotavailable,orasimplifiedcalculationisrelevant,MemberStatesmaydecidetoallowadefaultscenariotobeusedforthecalculation,basedontheworst-casescenarioprinciple.

MemberStatesmayadoptdefaultvaluesforanylife-cyclestagesorsub-life-cyclestagesinaccordancewiththerequirementsrelatingtodataforcalculationsetoutinSection3tofilldatagapsorwhenitisnecessarytosimplifythecalculation.
