4、 of education is funds. A reasonable and efficient financialinvestment system on higher education is the foundation of the healthy developmentof public higher education in our country. Since 1990s, our higher education hasdeveloped by leaps and bounds. Meanwhile, the central government has made lots

5、 ofreformation and exploration on financial system in higher education. Especially fromthe reform and opening up, the governments from the local to the central havegradually intensified efforts on financial investment in public higher education, whichplays an important role in the development of pub

6、lic higher education, but we shouldpoint out that comparing with countries which are more developed in highereducation, there are still some problems in financial investment in our highereducation, including public higher education, such as the lack of total financialinvestment, imbalanced financial

7、 investment, with the central and local governmentsfiscal transferring payment not being in place, education and financial investmentlegislation lagging behind. In view of this, it is undoubtedly of great significance forus to study financial investment in Chinese public higher education from theper

8、spective of researching public finance law, for building a healthy financialinvestment in public higher education legal system, promoting the healthydevelopment of public higher education. Higher education is a public goods, so it isthe governments responsibility to manage financial investment in pu

9、blic highereducation.In this paper, the author discusses the legal system on financial investment inChinese public higher education from three aspects. In the first part, the authorintroduces the legal system of financial investment in overseas higher education aswell as the enlightenment for us. By

10、 analyzing the system of the USA, the UK andJapan, the author summarizes several points of enlightenment; in the second part, theauthor analyzes the situation of the legal system on financial investment and existingproblems. Although the system has made a lot of achievements, there are still someII

11、problems, such as the lack of total investment, unreasonable allocation, imbalanceddevelopment of the system in different areas, the separation between routine power,financial power in higher education financial system, incompletes law supervisingsystem. In the third part, the author proposes severa

12、l advices of perfecting the legalsystem of our financial investment in higher education, including intensifying theinput for higher education, improving the financial system of collecting fund inmulti-channels, reforming the allocating mode of financial investment, perfecting thetransferring payment
