酒店公寓房租赁合同HOTELAPARTMENTTENANCYAGREEMENT一、出租人XX(以下简称“甲方”)LANDLORDSHANGHAITOWNYARDHOTELMANAGEMENTCO,LTDHEREINAFTERREFERREDTOASPARTYA二、承租人(以下简称“乙方”)TENANTHEREINAFTERREFERREDTOASPARTYB三、租赁范围及用途TENANCY甲方同意将其所有的位于市路号腾源九星公寓酒店_号房屋及设施在良好及可租赁的状态下租给乙方居住使用,出租房的面积共计约_平方米。PARTYAHEREBYAGREESTOLEASEITSPROPERTYLOCATEDATRM,TOWNYARDHOTELJNINESTAR【APARTMENT】,NO,ROADANDTHERELATEDFACILITIESINCLUDINGFURNITUREANDAPPLIANCESINGOODANDTENANTABLECONDITIONTOPARTYBFORRESIDENTIALUSETHESIZEOFTHELEASEDPROPERTYISAPPROXIMATELYM2四、租赁期TERMOFTENANCYA租赁期为_个月,自_年_月_日至_年_月_日。THEABOVEPROPERTYISHEREBYLEASEDFORATERMOFMONTHS,COMMENCINGONANDEXPIRINGONB租赁期满,甲方有权收回全部出租房屋,乙方应如期交还。乙方如需要续租,须在本合同期满日一个月前向甲方提出书面申请,再由双方另行协商续租事宜。ONEXPIRYOFTHETENANCY,PARTYAHASTHERIGHTTOTAKEBACKTHEENTIRELEASEDPROPERTYANDPARTYBSHALLDELIVERTHELEASEDPROPERTYTOPARTYAPROVIDEDALWAYSTHATPARTYBSHALLHAVETHEOPTIONTORENEWTHISAGREEMENTUPONGIVINGONEMONTHPRIORWRITTENNOTICETOPARTYABEFORETHEEXPIRATIONOFTHISAGREEMENT,TERMSANDCONDITIONSOFTHENEWAGREEMENTTOBEDISCUSSED五、租金RENTA双方确认租金为每月()人民币元,租金包括房费、服务费、管理费、上网费和一周两次的室内清洁。THERENTAGREEDTOBYBOTHPARTIESISRMBPERMONTHINCLUDINGRENTALFEE、MANAGEMENTFEEANDHOUSEKEEPINGTWICEAWEEKB乙方提前支付甲方每月的租金,应在()前汇至甲方指定的银行帐号,支付租金日期以乙方汇出日期为准。PARTYBHEREUNDERSHALLPAYEACHMONTH,SRENTBEFOREEACHTENANCYMONTH,BYTRANSFERRINGTHEAMOUNTOFSUCHRENTTOABANKACCOUNTDESIGNATEDBYPARTYATHEDATEOFTRANSFERSHALLBETHEDATEOFPAYMENTC如租金到期后七天仍未支付,乙方须按日加付租金05的滞纳金。如超过三十天未付则视为乙方自动退租,构成违约,甲方有权收回出租房屋,并追加乙方违约责任。IFTHERENTSHALLBEUNPAIDFORSEVEN7DAYSAFTERTHETERMSHALLBECOMEDUEANDPAYABLE,PARTYBSHALLBELIABLETOPAYALATEPENALTYTEEEQUALTO05OFTHERENTPERDAYIFTHERENTHASNOTBEENPAIDMORETHAN30DAYSAFTERTHEDUEDATE,PARTYBWILLBEDEEMEDTOHAVEAUTOMATICALLYTERMINATEDTHETENANCYRESULTINGINABREACHOFTHISAGREEMENTPARTYAWILLTHENBEENTITLEDTOTAKEBACKTHELEASEDPROPERTYANDHAVERECOURSEAGAINSTPARTYBFORBREACHOFCONTRACT六、保证金SECURITYDEPOSITA为确保出租房屋及其设施之安全与完好及租赁期内相关费用之如期结算,乙方应在签订本租赁合同后三天内,支付给甲方()个月租金额的租赁押金计()人民币元,作为乙方确保合同履行之保证金。TOENSURETHEWELFAREANDGOODCONDITIONOFTHELEASEDPROPERTYASWELLASTHEPROMPTPAYMENTANDSETTLEMENTOFALLRELATEDCHARGESDURINGTHETERMOFTHETENANCY,PARTYBAGREESTOPAYPARTYASECURITYDEPOSITWITHINTHREEDAYSAFTERSIGNINGOFTHISTENANCYAGREEMENTEQUALTOMONTH,SRENTINTHEAMOUNTOFRMBASSECURITYFORPARTYB,SPERFORMINGOFTHISAGREEMENTB除合同另有约定之外,甲方应于租赁期满或双方确认此合同提前终止之日且交房方迁空、清点当天保证金全额无息退还乙方。在甲方退还保证金之前,乙方有权保留房屋钥匙。UNLESSOTHERWISEPROVIDEDINTHISAGREEMENT,PARTYASHALLRETURNTOPARTYBTHEENTIRESECURITYDEPOSITWITHOUTINTERESTTHEREONUPONEXPIRATIONOFTHETENANCYOREARLIERTERMINATIONOFTHISAGREEMENTAGREEDBYBOTHPARTIESANDATTHETIMEWHENBOTHPARTIESHAVECONFIRMEDTHERETURNOFTHEPREMISESPARTYBHASTHERIGHTTORETAINTHEKEYSTOTHEPREMISESUNTILPARTYARETURNSTHESECURITYDEPOSITC甲方因乙方违反本合同的规定而受到损失,可在保证金中扣抵合理数目,不足部分乙方必须在接到甲方付款通知后十天内补足。PARTYAMAYDEDUCTAREASONABLEAMOUNTOFSECURITYDEPOSITTOWARDSPAYMENTOFANYACTUALDAMAGESPARTYASHALLHAVEINCURREDORSUFFEREDASARESULTOFPARTYB,SBREACHOFTHISAGREEMENTIFTHESECURITYDEPOSITISNOTSUFFICIENTTOCOVERSUCHAMOUNTS,PARTYBMUSTPAYTHEDEFICIENCYWITHIN10DAYSOFTHERECEIPTOFADEMANDFROMPARTYA七、其他费用OTHERCHARGESA乙方应承担租赁期内的()等杂费并按甲方提供的通知单如期缴纳。PARTYBISRESPONSIBLEFORPAYINGMISCELLANEOUSCHARGESONTIMEEVERYMONTH八、出租人的责任LANDLORD,SOBLIGATIONSA甲方须按时将出租房屋以良好状态交付乙方使用。PARTYASHALLDELIVERONSCHEDULETOPARTYBTHELEASEDPROPERTYFORPARTYB,SUSEB租赁期内甲方不得无故收回出租房屋。(除非本合同另有规定)PARTYASHALLNOTTAKEBACKTHELEASEDPROPERTY,WITHOUTCAUSEDURINGTHETERMOFTHETENANCYUNLESSOTHERWISESTIPULATEDINTHISAGREEMENTC房屋基本设施和结构(不包括乙方损坏的家私和器具)损坏时,甲方有修缮的责任并承担有关的费用,并对其作定期保修。PARTYAISRESPONSIBLEFORREPAIRINGANDMAINTAININGTHEBASICFACILITIESEXCLUDINGFURNITUREANDAPPLIANCESDAMAGEDBYPARTYB,THESTRUCTUREOFTHELEASEPROPERTYANDFORBEARINGALLCOSTSRELATEDTHERETOD如有租赁期内,租赁房屋发生所有权全部或部分转移、和其它影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同的所有条款。如乙方于本合同下的权益受此等所有权人或第三者所影响或损害,甲方须负责补偿乙方的所有损失、损害、支出及费用。IFDURINGTHETERMOFTHETENANCY,ALLORPARTOFTHELEASEDPROPERTYISTRANSFERREDORPARTYB,SRIGHTTOUSELEASEDPROPERTYISAFFECTED,PARTYASHALLENSURETHATTRANSFEREEORTHIRDPARTYHAVINGEFFECTONPARTYB,SRIGHTTOUSETHELEASEDPROPERTYWILLCONTINUETOABIDEBYTHETERMSOFTHISAGREEMENTPARTYASHALLALSOBELIABLETOKEEPPARTYBBEFULLYINDEMNIFIEDAGAINSTANYLOSSES,DAMAGES,COSTSANDEXPENSESIFANYOFPARTYB,SINTERESTSHEREINAREAFFECTEDORPREJUDICEDBYSUCHOWNERORTHIRDPARTY九、承租人的责任TENANT,SOBLIGATIONSA乙方应按合同的规定,按时支付租金,保证金及其它各项应付费用。PARTYBSHALLPROMPTLYPAYALLRENT,SECURITYDEPOSITANDOTHERCHARGESPAYABLEBYITINACCORDANCEWITHTHETERMSOFTHISAGREEMENTB乙方经甲方事先书面确认,可在承租用房内进行装修及添置设备。租赁期满必须恢复原状(正常损耗除外),并承担其费用,经甲方验收后归还甲方。PARTYBMAY,WITHTHEPRIORCONSENTOFPARTYA,RENOVATEANDINSTALLADDITIONALFACILITIESINTHELEASEDPROPERTYUPONEXPIRYOFTHETENANCY,THELEASEDPROPERTYSHALLBERETURNTOPARTYAINITSORIGINALCONDITIONSFAIRWEARANDTEAREXCEPTED,ANDALLEXPENSESARISINGTHEREFROMSHALLBEBORNBYPARTYBC乙方应爱护使用租赁的房屋,如因乙方的过失或过错致使房屋及设施受到损坏(正常损耗除外),乙方应负赔偿责任。PARTYBSHALLTREATTHELEASEDTHEPROPERTYWITHCAREIFASARESULTOFPARTYB,SNEGLIGENCEORMISCONDUCT,THELEASEDPROPERTYANDTHERELATEDFACILITIESSUFFERANYDAMAGEFAIRWEARANDTEAREXCEPTED,PARTYBSHALLBERESPONSIBLEFORCOMPENSATINGPARTYAFORSUCHDAMAGESD乙方应按本合同的约定合法使用租赁房屋,不得擅自改变使用性质,不应存放中华人民共和国法律下所禁止的危险品,如因此发生损害,乙方应承担全部责任。PARTYBSHALLUSETHELEASEDPROPERTYLEGALLYASAGREEDINTHISAGREEMENTANDMAYNOTCHANGESUCHUSEONITSOWNPARTYBSHALLNOTSTOREANYDANGEROUSITEMS,WHICHAREPROHIBITEDBYTHELAWSINTHEPEOPLE,SREPUBLICOFCHINAINTHELEASEDPROPERTYANDSHALLBEFULLYRESPONSIBLEFORANYDAMAGESORLOSSESASARESULTTHEREOFE未经甲方事先同意,乙方不得将承租的房屋转租或分租给其他的第三方,乙方本公司人员除外。WITHOUTPARTYA,SPRIORCONSENT,PARTYBMAYNOTASSIGNTHETENANCYORSUBLETTHELEASEDPROPERTYTOATHIRDPARTY,SAVEANDEXCEPTANYASSOCIATEDPERSONOFPARTYB十、违约处理、BREACHOFAGREEMENTA甲、乙任何一方如未按本合同的条款履行,构成违约,应承担相应的违约责任,双方同意违约方应赔偿对方直接损失(间接和结果性损失除外)。IFEITHERPARTYAORPARTYBFAILSTOPERFORMITSOBLIGATIONSHEREUNDER,ITSHALLCONSTITUTEABREACHOFTHISAGREEMENTANDTHEDEFAULTINGPARTYSHALLUNDERTAKETHELIABILITIESFORSUCHBREACHTHEPARTIESAGREETHATTHEPARTYINBREACHSHALLPAYTHEOTHERPARTYTHEDIRECTLOSSANDDAMAGEEXCLUDINGINDIRECTANDCONSEQUENTIALLOSSANDDAMAGESB乙方有下列行为之一的,甲方有权终止合同,收回出租房屋,并且保证金不予退还。PARTYASHALLHAVETHERIGHTTOTERMINATETHISAGREEMENT,REPOSSESSTHELEASEDPROPERTYANDFORFEITTHESECURITYDEPOSITIFPARTYBCOMMITSONEOFTHEFOLLOWING1)将承租的房屋擅自转租,但转租给乙方本公司人员除外;SUBLETSTHELEASEDPROPERTYTOANOTHERPERSONORENTITYEXCEPTASSOCIATEDPERSONOFPARTYB2)未经甲方同意将承租的房屋擅自拆改结构或改变用途的;或ALTERSTHESTRUCTUREOFLEASEDPROPERTYWITHOUTAUTHORIZATIONORUSESTHELEASEDPROPERTYOTHERTHANFORTHEPURPOSESTATEDHEREINOR3)无故拖欠租金及其它应付款超过三十天。FAILSTOPAYRENTWITHOUTANYREASONFORMORETHAN30DAYSAFTERTHEDUEDATE十一、不可抗力FORCEMAJEURE若由于不可抗力的自然灾害(包括但不限于火灾、洪水、地震、施工、战争、暴动、敌对等行为等)或其它非乙方过错所造成的对本物业的损毁,使其无法居住或使用本物业,乙方有权终止本组契约,甲方必须全数退还乙方所有保证金和当月余租期之相应租金及管理费。IFTHELEASEDPROPERTYISDESTROYED,DAMAGEDANDRENDEREDUNINHABITABLEOFUNUSABLEDUETOFORCEMAJEUREINCLUDE,BUTNOTLIMITEDTO,FIRES,FLOOD,EARTHQUAKES,ACCIDENTS,STRIKES,WARS,INSURRECTIONS,PUBLICENEMYETCORACTIONSTHATARENOTTHERESULTOFPARTYB,SFAULT,PARTYBSHALLHAVETHERIGHTTOTERMINATETHISAGREEMENTANDPRORATEDBALANCEOFALLRENTSANDMANAGEMENTFEESPAID,ASWELLASSECURITYDEPOSIT,SHALLBERETURNEDTOPARTYBWITHOUTANYSETOFFORDEDUCTIONS十二、适用法律APPLICABLELAW本合同的成立,其有效性,解释,签署和解决与其有关的一切纠纷均受中国法律的管辖并依据中国法律解释。THEFORMATIONOFTHISAGREEMENT,ITSVALIDITY,INTERPRETATION,EXECUTIONANDSETTLEMENTOFANYDISPUTESARISINGHEREUNDERSHALLBEGOVERNEDBYANDCONSTRUEDINACCORDANCEWITHTHELAWSOFTHEPEOPLE,SREPUBLICOFCHINA十三、争议的解决DISPUTERESOLUTION凡因执行本合同所产生的或与本合同有关的一切争议,双方应通过友好协商解决;协商不成应提交市仲裁委员会,按其仲裁规则和中华人民共和国仲裁法在市进行仲裁,仲裁裁决是终局的,对双方都具有约束力。INTHECASEOFDISPUTERARISINGOVERTHISAGREEMENTORANYMATTERSRELATEDHERETO,THEPARTIESSHALLNEGOTIATEINGOODFAITHTORESOLVESUCHDISPUTESIFSUCHNEGOTIATIONFAILS,THEPARTIESSHALLSUBMITTHEDISPUTETOARBITRATIONBYSHANGHAIARBITRATIONCOMMISSIONININACCORDANCEWITHITSARBITRATIONRULESTHEDECISIONOFTHEARBITRAGEBODYISFINALANDSHALLBEBINDINGONTHEPARTIESHERETO十四、其他OTHERS1本合同附件是本合同不可分割的组成部分,具有同等法律效力。THEATTACHMENTTOTHISAGREEMENTISANINSEPARABLEPARTOFTHISAGREEMENTANDISEQUALLYENFORCEABLE2本合同如有未尽事宜,由甲、乙双方洽谈解决。IFTHISAGREEMENTISUNCLEARWITHRESPECTTOCERTAINMATTERS,THETWOPARTIESSHALLDISCUSSTORESOLVESUCHAMBIGUITIES3本合同由中文和英文写成,两种文本具有同等效力。如果中英文发生差异,以中文为准。THISAGREEMENTISWRITTENBOTHINTHECHINESEANDENGLISHLANGUAGESINTHECASEOFDISCREPANCYOFTHETRANSLATION,THECHINATESTWILLPREVAIL4本合同自签字之日起生效。未经双方同意,不得任意终止或修改,若甲方单方面无适当理由终止本合同,则应付给乙方相当于二个月租赁押金的违约金及全额退还乙方二个月的租赁押金(本合同另有约定除外)。若乙方单方面无适当理由终止本合同,则乙方同意甲方没收二个月的租赁押金作为违约金(本合同另有约定除外)。本合同壹式贰份,甲、乙双方各执壹份。当中、英文有差异时,以中文为准。THISAGREEMENTSHALLBECOMEEFFECTIVEUPONTHESIGNINGTHEREOFBYTHEPARTIESHERETOSAVEANDEXCEPTASPROVIDEDINTHISAGREEMENT,THISAGREEMENTMAYNOTBETERMINATEDOFAMENDEDWITHOUTTHECONSENTOFBOTHPARTIESIFPARTYATERMINATETHISAGREEMENTUNILATERALLYANDWITHOUTANYREASON,THENPARTYASHALLPAYTHECOMPENSATIONTHATEQUALTOTWOMONTHSSECURITYDEPOSITANDFULLYREIMBURSETHETWOMONTHSRENTALDEPOSITTOPARTYBASWELLIFPARTYBTERMINATETHISAGREEMENTUNILATERALLYANDWITHOUTANY
