工程合同中施工设备和临时设施条款（中英文对照）施工设备和临时设施ConstructionEquipmentandTemporaryFacilities承包人提供的施工设备和临时设施ConstructionEquipmentandTemporaryFacilitiesProvidedbyContractor承包人应按合同进度计划的要求，及时配置施工设备和修建临时设施。进入施工场地的承包人设备需经监理人核查后才能投入使用。承包人更换合同约定的承包人设备的，应报监理人批准。Thecontractorshall,undertherequirementofprogressschedulehereof,effectwithoutdelayallocationofconstructionequipmentandbuildingtemporaryfacilities.Thecontractor’sequipmentwhichwillenterintotheworksiteshouldbecheckedandinspectedbythesupervisorbeforebeingputintouse.Replacementoftheequipmentwhichhasbeenagreedincontractshouldbeapprovedbythesupervisor.除专用合同条款另有约定外，承包人应自行承担修建临时设施的费用，需要临时占地的，应由发包人办理申请手续并承担相应费用。Unlessotherwisestipulatedinparticularconditionofthecontract,thecontractorshallbearthecostoftheconstructionoftemporaryfacilitiesonwhich,if,occupationofland,theemployershallgothroughtheformalitiesofapplicationandbearthecorrespondingcosts.发包人提供的施工设备和临时设施ConstructionEquipmentandTemporaryFacilitiesProvidedbyEmployer发包人提供的施工设备或临时设施在专用合同条款中约定。Constructionequipmentandtemporaryfacilitiesprovidedbytheemployershouldbestipulatedintheparticularterm.要求承包人增加或更换施工设备RequirementofContractor’sAddedorReplacedWorkEquipment承包人使用的施工设备不能满足合同进度计划和（或）质量要求时，监理人有权要求承包人增加或更换施工设备，承包人应及时增加或更换，由此增加的费用和（或）延误的工期由承包人承担。Providedthatiftheworkequipmentusingbythecontractorcannotsatisfytheprogressscheduleofcontractand/orthequalityrequirements,thesupervisorreserverighttorequirethecontractoraddorreplaceworkequipment,forwhichthecontractorshouldpromptlyincreaseorreplacethereof,theaddedcostand/ordelayedtermarisingtherefromwillbebornbythecontractor.材料与设备专用要求ParticularRequirementforMaterialandEquipment承包人运入施工现场的材料、工程设备、施工设备以及在施工场地建设的临时设施，包括备品备件、安装工具与资料，必须专用于工程。未经发包人批准，承包人不得运出施工现场或挪作他用；经发包人批准，承包人可以根据施工进度计划撤走闲置的施工设备和其他物品。Thematerials,equipmentofengineeringandexecution,whicharetransportedintothesitebythecontractor,andthetemporaryconstructionbuildingbythecontractor,includeinteraliaspareparts,thetoolsanddataforinstallationshouldbeexclusivelyusedinengineeringwork,withouttheapproveoftheemployer,shouldnotbetransportedoutofthesiteorusedforotherpurpose.Thecontractormay,throughtheapprovaloftheemployer,withdrawtheidleworkingequipmentandotherarticlespursuanttotheprogressschedule.承包人根据合同约定或监理人指示进行的现场材料试验，应由承包人提供试验场所、试验人员、试验设备以及其他必要的试验条件。监理人在必要时可以使用承包人提供的试验场所、试验设备以及其他试验条件，进行以工程质量检查为目的的材料复核试验，承包人应予以协助。Wherethecontractor,byvirtueoftheagreementhereoforthesupervisor’sinstruction,makethematerialtestonsite,theplace,personnel,deviceandothernecessaryconditionsforthetestshouldbeprovidedbythecontractor.Thesupervisormay,whennecessary,usetheplaces,equipmentandotherconditionsfortestwhichprovidedbythecontractor,tocarryoutthematerialreviewtestforthepurposeofqualityinspectionoftheproject,forwhichthecontractorshouldeffectassistancethereof.承包人应按专用合同条款的约定提供试验设备、取样装置、试验场所和试验条件，并向监理人提交相应进场计划表。Thecontractorshould,undertheagreementofparticularconditionhereof,providethetestequipment,samplingdevice,theplaceandconditionfortest,inadditiontoissuethescheduleofentrysite.承包人配置的试验设备要符合相应试验规程的要求并经过具有资质的检测单位检测，且在正式使用该试验设备前，需要经过监理人与承包人共同校定。Thecontractor'stestequipmentshallconformtotherequirementsoftherelevanttestproceduresandbecheckedbyaqualifiedtestingunit,andshallbejointlydeterminedbythesupervisorandthecontractorpriortotheofficialuseofthetestequipment.拟用于工程的生产设备和材料PlantandMaterialsintendedfortheWorks如果根据合同规定,承包商有权获得尚未运到现场的生产设备和材料的期中付款,承包商必须具备下列条件才有权得到:IftheContractorisentitled,undertheContract,toaninterimpaymentforPlantandMaterialswhicharenotyetontheSite,theContractorshallneverthelessnotbeentitledtosuchpaymentunless:相关生产设备和材料在工程所在国,并已按雇主的指示,标明是雇主的财产;或therelevantPlantandMaterialsareintheCountryandhavebeenmarkedastheEmployer’spropertyinaccordancewiththeEmployer’sinstructions;or承包商已向雇主提交保险的证据和经雇主批准的实体按批准的格式签发的、数额和币种与该项付款相同的银行保函.该保函可以用与第14.2款[预付款]中提到的格式相似的格式,并应做到在生产设备和材料已在现场妥善储存并做好防止损失、损害或变质的保护以前一直有效.(b)theContractorhasdelivered,totheEmployer,evidenceofinsuranceandabankguaranteeinaformandissuedbyanentityapprovedbytheEmployerinamountsandcurrenciesequaltosuchpayment.ThisguaranteemaybeinasimilarformtotheformreferredtoinSub-Clause14.2[AdvancePayment]andshallbevaliduntilthePlantandMaterialsareproperlystoredonSiteandprotectedagainstloss,damageordeterioration.对于附件AB和C中没有明确规定的设备、备用件、材料、服务或人员，但，根据通行的油田惯例，为了正常的陆地钻井施工，为了承包商钻机及设备的运行和维护，又需要这些设备、备用件、材料、服务或人员，承包商应自付费用提供这些项目。CONTRACTORshallalsoprovideatitsexpenseanyitemsofequipment,spareparts,supplies,services,orPersonnelwhicharenotmentionedinAppendices"A","B"or"C",butwhicharerequiredfortheoperationandmaintenanceofCONTRACTOR’SRigandequipmentfornormalonshoredrillingoperations,accordingtogoodoilfieldpractice.本工程项目中，设计人不得指定建筑材料、设备的生产厂或供货商。发包人需要设计人配合建筑材料、设备的加工订货时，所需费用由发包人承担。12.3IntheprojectsoftheContract,DesignershallnotappointmanufacturersorDesignersofconstructionmaterialsandequipment.WherethereisanecessitythatDesignershallcooperatewithEmployerinorderingtheprocessofconstructionmaterialsandequipment,therelevantchargeshallbepaidbyEmployer.由于设备制造原因试车达不到验收要求，由该设备采购一方负责重新购置或修理，乙方负责拆除和重新安装，费用由责任方承担。设备由乙方采购的，由乙方承担修理或重新购置、拆除及重新安装的费用，工期不予顺延；设备由甲方采购的，甲方承担上述各项追加合同价款，工期相应顺延。Incasethecommissioningisfailedduetothemanufactureofanyequipment,theprocuringpartyoftheequipmentshallberesponsibleforreprocurementorrepair,andPartyBshallberesponsibletoremoveandreinstallatthecostoftheresponsibleparty.IftheequipmentisprocuredbyPartyB,PartyBshallberesponsibleforalltheexpensesonrepair,reprocurement,removalandreinstallationwithoutchangingtheconstructionperiod;IftheequipmentisprocuredbyPartyA,PartyAshallberesponsibleforalltheexpensesasmentionedandextendtheconstructionperiodaccordingly.双方一致同意，如发包人为保证工程质量而指定承包人采购某一厂家的商品时，应由承包人具体与该厂家签订合同，在合同中明确发包人是所供应设备和材料的使用者，配合或监督供应商做好所供设备和材料的安装等工作。在签署此等合同之前，承包人应当将其提交发包人审阅并得到发包人的书面同意。承包人应当对供应商在此等合同项下的安装、质量、维修、售后服务、培训、技术协助等所有义务对发包人承担连带责任。BothPartiesagreethat,ifinordertoguaranteethequalityoftheProject,theEmployerdesignatestheContractortopurchasethegoodsofacertainmanufacturer,theContractorshallsignthepurchasecontractswiththemanufacturer,inwhichtheEmployershallbespecifiedastheuserofthesuppliedequipmentandmaterials,cooperateorsupervisethesuppliertocompletetheworkfortheequipmentandmaterialssuchasinstallationetc.Beforesuchcontractsaresigned,theContractorshallsubmitthemtotheEmployerforreviewandobtaintheEmployer’swrittenconsentonthem.TheContractorshallbejointlyliableforallthesupplier’sobligationsunderthosecontractsinrespectofinstallation,quality,repair,safe-salesservice,training,technicalassistanceetctotheEmployer.如主要设备需要替换，新公司股东应按其股份比例增加投资额，用以购买和安装替换设备。替换设备和部件的使用年限由国际上接受的会计原则确定，如使用年限超过转让期，替换费应由B和新公司按照超过转让期的年份比例和在转让期的年份比例分担。Incasethatmainequipmentshouldbereplaced，themembersofewCompanyshallagreetoincreasetheirinvestmentamountintheproportionoftheirsharetoNewCompanyfortheprocurementandinstallationofthatreplacingequipment.Costforreplacementpartsandequipmentofwhichdurableyear，determinedbytheinternationallyacceptedaccountingprinciple，exceedsTransferDate，shallbesharedbetweenBandNewCompanyinproportionoftheyearsbeyondTransferDatendtheyearsfallingwithinTransferDate.临时工程是指在工程实施、完成和修补其任何缺陷时需要或有关的所有各种临时工程，但承包人的设备除外。"Temporaryworks"meansalltemporaryworksofeverykind(otherthanContractor'sEquipment)requiredinorabouttheexecutionandcompletionoftheWorksandremedyingofanydefectstherein.工程设备是指预定构成或构成永久工程一部分的机械、仪器以及类似设备。"Plant"meansmachinery,apparatusandthelikeintendedtoformorformingpartofthePermanentWorks.承包商的设备是指在工程实施、完成及其缺陷修补过程中所需要的全部装置和任何性质的物品，但不包括预定构成或构成永久工程一部分的设备、材料或其它物品。"ContractorEquipment"meansallappliancesandthingsofwhatsoevernature(otherthanTemporaryWorks)requiredfortheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein,butdosenotincludePlant,materialsorotherthingsintendedtoformorformingpartofthePermanentWorks.由于所采购的货物的运行和维护费用是设备使用周期成本的一个主要部分，这些费用将根据投标资料表或技术规格中规定的标准进行评价。Sincetheoperatingandmaintenancecostsofthegoodsunderprocurementformamajorpartofthelifecyclecostoftheequipment,thesecostswillbeevaluatedinaccordancewiththecriteriaspecifiedintheBidDataSheetorintheTechnicalSpecifications.承包商根据各分标段的项目实施进度表，分别提供场地的地质勘探；工程的基本设计、设备采购、供货；厂房、设备基础、管网的施工；设备的安装、调试；人员培训；各主生产线的试车、试生产；投产；验收交付。TheContractorshallprovidethesiteg
