The Regulations on Safety Management and Supervision over Pressure Pipelines is hereby issued for the purposes of doing well the safety management and safety supervision over pressure pipelines, ensuring safe operation and protecting the personal safety and property safety of the people. Please earnestly implement these regulations. If you meet any problem in your execution, please timely advise the Occupational Safety, Hygiene and Boiler & Pressure Vessel Supervision Bureau of our Ministry.Key words:Pressure pipelinesSafetyManagement SupervisionRegulationsCopy to:The Ministry of Finance, the Supreme Peoples Procuratorate, the Supreme Peoples Court, the State Technology Supervision Bureau, the Legal Affairs Bureau of the State Council and the All-China Federation of Trade UnionOffice Department of the Ministry of LaborIssued on April 24, 1996Regulations on Safety Management and Supervision over Pressure PipelinesChapter 1GeneralArticle 1These regulations are formulated according to the Labor Law of the Peoples Republic of China and the stipulations of the relevant laws and codes, for the purposes of ensuring the safety operation of pressure pipelines and protecting the personal safety and property safety of the people.Article 2Pressure pipeline in these regulations refers to a special equipment which is widely used in the production/ life and may cause severer hazards, such as: fire, explosion and poisoning.Based on its services, pressure pipeline can be divided into industrial pipeline, utility pipeline and long-distance transfer pipeline.Article 3These regulations shall apply to the pipelines and their supporting facilities meeting one of the following conditions:1. Pipelines transferring the media with extreme hazard of toxicity as per GB5044 Hazard Rating of Occupational Contact Toxicant;2. Pipelines transferring the media with Grade 1 and Grade 2 of fire risk as per GB50160 Fire-proof Code for Petrochemical Enterprise Design and GBJ16 Fire-proof Code for Building Design;3. Pipelines transferring the media of gas (vapor) or liquefied gas with maximum working pressure 0.1 Mpa ( g, the same below);4. Pipelines transferring the flammable, explosive, toxic or corrosive media with the maximum working pressure 0.1 Mpa or the liquid with the maximum working temperature normal boiling point;5. The supporting facilities and safety protection devices of the pipelines stipulated in 1 4 of this article.Article 4These regulations shall not apply to the following pipelines:1. Pipelines of equipment proper;2. Pipelines in military equipment, traffic vehicles and nuclear facilities;3. Pipelines transferring non-toxic, nonflammable or non-corrosive gas, with the nominal diameter of the pipelines 150 mm and maximum working pressure 1.6 Mpa;4. Living fuel gas pipelines after the last valve before entering into household (residence building, court) and heat supply pipelines after heating substation ( excluding heating substation).Article 5The units in charge of design, manufacture, erection, use, inspection, repair and modification of pressure pipelines must implement these regulations.The competent departments of the units in charge of design, manufacture, erection, use, inspection, repair and modification of pressure pipelines shall be responsible for the safety management work of the pressure pipelines of the enterprises under them.Article 6The boiler & pressure vessel safety supervision authority under the Ministry of Labor shall be responsible for carrying out safety supervision over pressure pipelines of all the country.The boiler & pressure vessel safety supervision authority under the labor administrative department at the county level or above shall be responsible for carrying out safety supervision over pressure pipelines within its administrative area.Chapter 2 Safety ManagementArticle 7The relevant competent department shall perform the following duties:1. Implement laws and codes regarding safety as well as technical regulations and standards regarding pressure pipelines, establish and perfect safety management system for pressure pipeline within the department;2. Arrange the examination and approval of design for pressure pipeline project to be newly built, revamped or expanded, supervise and inspect construction quality and arrange completion acceptance according to the relevant stipulations;3. Prepare the annual plan and long-term planning for safety management of pressure pipelines within the department, arrange and assist the relevant units in checking serious hidden dangers on pressure pipelines, making safety assessment and remedy and eliminating hidden dangers so as to ensure safety;4. Timely report pressure pipeline accident and participate in or arrange accident investigation and handling according to the relevant stipulations;5. Arrange safety inspection, appraisal and check-up on pressure pipelines within the department, give commendation to the advanced units, sum up and exchange safety work experience regarding pressure pipelines;6. Arrange research and popularize advanced scientific and technical research achievements for safety of pressure pipelines and management methods for safety production;7. Carry out safety propaganda and education work for pressure pipelines and arrange training of safety management personnel for pressure pipeline;8. Perform the safety management work for other pressure pipelines they should be responsible for as per the relevant stipulations.Article 8The pressure pipeline users shall be responsible for the safety management work for pressure pipelines of the unit and perform the following duties:1. Implement laws and codes regarding safety as well as technical regulations and standards regarding pressure pipelines, establish and perfect safety management system for pressure pipeline within the unit;2. Specify the full time or part time professional technicians for the safety management work of pressure pipelines;3. The pressure pipelines and their safety facilities must conform to the relevant stipulations of the State;Have the right to refuse the completion acceptance of pressure pipelines and their safety facilities to be newly built, revamped or expanded, if they are not conformable to the relevant stipulations of the State;4. Establish technical file and register at the labor administrative department of the prefecture (city) where the enterprise is in or at the labor administrative department of the county authorized by the prefecture (city);5. Exercise the safety technology training of pressure pipeline operators and pressure pipeline inspectors;6. Formulate pressure pipeline regular inspection plan, arrange the regular calibration and maintenance work of auxiliary instruments and meters, safety protection facilities as well as measuring, adjusting and controlling devices;7. Timely exercise the corrective actions for the hidden perils of accident, major hidden perils of accident shall be reported in written form to the competent department at the provincial level or above and the labor administrative department at the provincial level or above;8. Establish the line inspection system for the pressure pipelines transferring the flammable, explosive or toxic media, prepare emergency measures and recovery scheme, establish recovery team and make routine demonstration as necessary;9. Timely and honestly report pressure pipeline accidents to the competent department and local labor administrative department according to the relevant stipulations, give assistance in making accident investigation and disposal, earnestly summarize the experiences and lessons so as to prevent the reoccurrence of accident;10. Perform the safety management work for other pressure pipelines they should be responsible for as per the relevant stipulations.Article 9The administrative personnel, inspectors and operators for pressure pipelines shall strictly follow laws, codes, technical regulations and standards regarding safety as well as enterprises safety production system.Chapter 3Safety SupervisionSection 1General StipulationsArticle 10Pressure pipeline design unit shall achieve the design qualification certificate issued by the relevant competent department at the provincial level or above and report to the labor administrative department at the provincial level or above for the record. Pressure pipeline design unit shall be responsible for the safety technology performance of the designed pressure pipeline.Article 11The manufacturing units for pipe, fitting, valve, flange, compensator and safety protection facility for pressure pipeline ( hereinafter referred to as manufacturing unit) shall apply for safety registration at the labor administrative department at the provincial level or above or at the labor administrative department of the prefecture (city) authorized by the provincial labor administrative department.The review work of safety registration shall be performed by the reviewing authority confirmed by the Ministry of Labor together with the relevant competent department at the same level.The manufacturing unit shall be responsible for the safety quality of its products and type approval test shall be made before manufacturing such products.The Ministry of Labor shall be responsible for the qualification examination and approval of type approval test unit and issue the type approval test unit qualification certificate.Article 12Pressure pipeline erection unit must have the pressure pipeline erection license issued by labor administrative department.The review work of qualification confirmation for pressure pipeline erection unit shall be performed by the reviewing authority confirmed by labor administrative department together with the relevant competent department.Pressure pipeline erection license shall be printed uniformly by the Ministry of Labor and issued respectively by the Ministry of Labor and provincial labor administrative department.Pressure pipeline erection unit shall be responsible for the safety quality of its erected and constructed pressure pipeline project.Article 13The pressure pipelines to be newly built, revamped or expanded shall be supervised and inspected, over its erection quality, by competent inspection unit; the pressure pipelines in service shall be periodically inspected by competent inspection unit.The qualification review of inspection unit shall be carried out as per the stipulations of Article 25 and Article 28 of these regulations.Article 14Pressure pipeline repairing and modifying unit shall possess certain conditions, when important modification is made to pressure pipeline, its technology and management level shall be conformable to the requirements of newly built pressure pipeline.Article 15The welders engaging in the welding of pressure pipeline and inspectors for non-destructive inspection must achieve the qualification certificate for special specialty operator issued by labor administrative department according to the relevant stipulations.Article 16Labor administrative department shall, as per these regulations, exercise safety supervision over the design, manufacturing, erection, use, inspection, repair and modification units of pressure pipeline and define the key points and mode of site safety supervision according to the actual conditions of the region. The preventive safety supervision over the pipelines with severer hazard shall be strengthened.Article 17Labor administrative department shall count, report and handle accident as per the relevant stipulations.Section 2Safety Supervision over Industrial PipelinesArticle 18Industrial pipeline shall be classified as per its hazard degree. The safety supervision shall be implemented as per its classification.Article 19If user designs industrial pipeline by itself, it shall get the consent of its provincial competent department and report to the provincial labor administrative department for the record.Article 20If user erects industrial pipeline by itself, it shall get the consent of its provincial competent department and report to the provincial labor administrative department for the record.Section 3Safety Supervision over Utility PipelinesArticle 21The construction of utility pipeline must conform to the requirements of city planning, fire-fighting and safety. Consent shall be achieved from the local labor administrative department when reviewing the route selection.Article 22The design review and completion acceptance of utility pipeline project shall be attended by the safety supervisors sent by the local labor administrative department.Article 23Any unit and individual person can not construct building, structure or stack articles on utility pipelines.When construction is made near urban fuel gas and heat supply pipelines, construction unit shall get the consent of the units managing and using them. Construction can start only after the corresponding protective actions agreed upon by the both parties have been taken.Section 4Safety Supervision overLong-distance Transfer PipelinesArticle 24The Ministry of Labor shall be responsible for the safety supervision over long-distance transfer pipelines. The Ministry of Labor shall perform training, examination of and issue certificate to the safety supervisors for long-distance transfer pipelines. They shall be responsible to the Ministry of Labor.Article 25The inspection units for long-distance transfer pipelines shall possess certain conditions. Their qualification review shall be made by the Ministry of Labor together with the relevant competent departments at the same level and inspection qualification certificate shall be issued by the Ministry of Labor.Article 26Before the erection construction of long-distance transfer pipelines to be newly built, revamped or expanded, the owner shall report to the Ministry of Labor for the record. The project completion acceptance shall be attended by the safety supervisors sent by the Ministry of Labor.Chapter 4Inspection UnitsArticle 27The inspection units for industrial and utility pipelines shall possess certain conditions and obtain corresponding qualification certificate according to the requirements of these regulations.Article 28The qualification of the inspection units for industrial and utility pipelines, affiliated to the relevant departments at the provincial level or above, shall be reviewed by the Ministry of Labor together with the relevant competent departments of the same level.The qualification of the inspection units for industrial and utility pipelines, affiliated to the relevant departments or enterprises under the provincial level, shall be reviewed by the labor administrative department of the provincial level.Inspection qualification certificate shall be printed uniformly by the Ministry of Labor and issued respectively by the Ministry of Labor and provincial labor administrative department.Article 29Pressure pipeline inspectors shall be examined under the arrangement of labor administrative department at the provincial level or above and obtain the corresponding qualification certificate.Article 30The inspection units and inspectors must be engaged in the inspection work within the allowable scope stipulated in the inspection units and inspectors qualification certificates.The inspection units shall be responsible for the correctness of inspection results presented by them.Article 31The inspection units undertaking erection supervision inspection and import & export inspection of pressure pipeline shall possess justice third party status.The inspection units and their personnel engaging in supervision inspection work can not be engaged in the design, manufacture, erection, repair and revamping work of pressure pipelines as well as the sale activities related.Article 32The inspection units and inspectors shall keep the commercial secret of the inspected units.Article 33The inspection units and inspectors shall accept the supervision, inspection and business direction of labor administrative department.Article 34The inspection units engaging in pipeline inspection shall collect inspection fee according to the relevant fee collection regulations.Chapter 5Penalty ProvisionsArticle 35Those who commit any one of the following acts shall be instructed to make correction and may be fined by the labor administrative department:1Pressure pipeline design units who, failing to go through the recording formalities, design pressure pipeline;2Manufacture units who, failing to go through the safety registration formalities, manufacture pipe, fitting, valve, flange, compensator and safety protection device for pressure pipelines;3 Erection unit who, failing to obtain pressure pipeline erection license, erect pressure pipelines;4 Those who put the pressure pipelines to be newly built, revamped and expanded into service by themselves before these pipelines are proved qualified through supervision inspection and completion acceptance;5 Users use pressure pipelines
