方:_签订日期:_年_月_日Employer:LegalRepresentative:Position:President:Address:Postcode:Employee:Name:Gender:Address:Nationality:IDCardNo:DateofBirth:EducationDegree:ThisContractissignedonamutualityvoluntarybasisbyandbetweenthefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeoplesRepublicofChina1TermoftheContract:Thetermofthiscontractisforyearsandshallcommenceon,andshallcontinueuntil,unlessearlierterminatedpursuanttothisContractTheEmployeeshallundergoaprobationaryperiodofmonths2JobDescription:TheEmployeragreestoemployMr/MsnameasjobtitleinDepartment,locatedinofficelocationandcity3RemunerationofLabouraThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofPRCItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjinbThesalaryoftheEmployeeisRMB$permonthintheprobationaryperiodandRMB$aftertheprobationaryperiodcIfthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations4WorkingHours&Rest&VocationaThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweekbTheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrulescTheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursadayHowever,thetotalextensioninamonthshallnotexceedthirty-sixhours5SocialSecurity&WelfareaTheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulationsbDuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofPRC6WorkingProtection&WorkingConditionsaTheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocessbTheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperationscTheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork7LabourDisciplineaTheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;bTheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployercTheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo2years8Termination,Modification,RenewandDischargeoftheContractaTherelevantclausesoftheContractmaybemodifiedbytheparties:iThespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;iiDuetotheforcemajeure,theContractcannotbeexecuted;iiiTherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContractbTheContractmaybeautomaticallyterminated:iThisContractisnotrenewedattheexpirationofthisContract;iiTheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iiiThedeathoftheEmployeeoccurs;ivTheforcemajeuretakesplace;vTheconditionsofterminationagreedintheContractbythepartiesarisecTheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;dTheContractmaybedischargedthroughconsultationbytheparties;eTheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:iTheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;iiTheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iiiTheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;ivTheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancevTheEmployeeisbeingchargedwithcriminaloffences:fTheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30thirtydaysinadvance:iTheEmployeefailsillorisinjuredtootherthanduetoworkandaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;iiTheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iiiThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstancesivTheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemploueeinlegalproceduregTheEmployeeshallnotbedismissed:iTheContracthasneitherexpirednorconformedto8d,8e,8f,8g;iiTheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,TianjiniiiTheEmployeeisillorinjuredotherthanduetoworkandiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;ivTheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriiiTheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContracthTheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30thirtydaysinadvanceHowever,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:iTheEmployeeisstillintheprobationaryperiod;iiTheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iiiTheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;ivTheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealthITheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8d,8h,jTheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8d,8f,8hi-8hivAdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8fi9BreachLiabilitiesaDuetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituationbDuetoeitherpartysfault,ifbreachingtheContracttodamagetheotherpartyThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRCcDuetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;cTheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcostThemethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMBwithinyearsintheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithinyearsintheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithinyearsintheCompanyiftheContractisterminatedbytheEmployeeathiscause;10LaborDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplyto
