Employment Contract of Employment ContractParty A: Address: TEL: Party B:Name: Address:TEL: Emergency contact: Name: Relationship: Address:TEL: This contract is signed on a mutuality voluntary basis by and between the following Employer and Employee in accordance with the Labor Law of Peoples Republic of China. 1. Employment Position and Termination Both parties agree that Party B is employed by Party A as an English foreign teacher for him or her to perform the following duties:1.1 Party B shall be employed as an English Teacher. Provide English education in the kindergarten. Party B shall perform such duties as are assigned to him or her from time to time (orally or in writing) by the management, and shall make and maintain such reports as the management may require. Party B shall diligently report to the management any and all information relevant to his or her employment. 1.2 Party B will use the teaching materials provided by Party A and will develop an appropriate teaching plan. The Foreign Teacher should apply this teaching plan to ensure the delivery of high-quality lessons. Make sure that the children obtain the highest education standard according to the curriculum established by Party A and given to Party B. 1.3 Have a good knowledge of the school program and of the curriculum so as being able to introduce it to whom may want to know about it (parents, potential students, ) .This contract is from _ _Y _M _D to _ Y _M _D 2. Job Description As an English foreign teacher, Party B agrees to:2.1 Party B will be required to work Monday to Friday five days a week. Party B works no more than 8 hours per day, no more than 40 hours per week, and Saturday and Sunday are set as the official weekly rest days. Party A may extend Party Bs working hours on the basis of mutual agreement, and Party B shall get corresponding deferred holidays or paid for the extended work hours in accordance with relevant laws and regulations. 2.2 Party B should do their teaching jobs based on the working schedule which is made by the management staff. Party B is required to puncture working card to record his/her working hours every day. Party B is not allowed to leave the school during working time except for lunch/dinner without the permission of Education Director. Certain amount of money will be deducted from Party Bs salary if Party B is late for work or leave early. If Party B is late for work, however, his/her salaries will be deducted as follows:4 minutes = RMB 205-9 minutes = RMB 3010- 30 minutes = RMB 5031 minutes + = RMB 701 hour+ or more =RMB 100 Teachers are also supposed to make up the classroom time missed by lateness.If Party B has been late accumulative total more than 30 minutes in one month, 20% of his/her monthly bonus will be deducted. 2.3 Party B agrees to follow the program decided by Party A. Only use the English language to communicate with the children. Introduce western education and culture to the teachers and the children. 2.4 Party B agrees to attend the meetings and to involve himself/herself with any extra-activity hosted by Party A. Attend the weekly English education meeting. Help Party A improve the Chinese teachers English at least one hour a week. Party B agrees to work on some weekends or holidays if asked by Party A. 2.5 Party B will maintain absolute confidentiality about Party As curriculum, teaching methods or any private information to people not involved with the school.2.6 Party B should take a health examination at a local public hospital before start working in the kindergarten. The health examination should include AIDS test and all fees should be paid by party B. The examination fee can be prepaid by Party A, and it gets deducted in Party Bs first month salary. 2.7 Party B agrees to follow the laws of the Peoples Republic of China and to behave properly. The foreign teachers should respect his / her colleagues and Chinese culture, vice versa. 2.8 Party B wont engage with any other company during the time period of this contract. Party B cannot engage in any part-time job without Party As consent. 3. Terms and Wages 3.1 In the case when there is a probation period (probation date starts at _and ends at _, during probation, Party B will get a basic salary of _RMB. After the probation period or in the case of no probation, Party A will provide Party B with a salary of _ RMB per month during the time period of this contract. During the contract period, if Party B performs well (show up for work on time and proactively provide good teaching quality) a monthly bonus of RMB will be given at the end of each semester along with the last month salary. 3.2 The above agreed salary is set and it cannot be changed or renegotiated for one semester or one year. If Party B and Party A fail to reach an agreement and Party B leave before the contract finish, Party A shall have the right to deduct the last payment and shall have the right to pursue economic compensation for losses.3.3 The winter and summer holidays are the same as the Chinese teachers. During the winter and summer holidays, Party A will provide Party B with a salary of _ RMB per month. When the holiday days are less than 30 days, then the salary will be counted by days (For example: RMB2000/30*17=RMB1133). Christmas day (December the 25th)is a paid holiday. 3.4 Party A shall pay salary to Party B before the 15th day of every month in the form of cash or bank-transfer. If the day of the month falls in the weekend or holiday, the payment can be delayed to the nearest weekday. Party A shall inform Party B and explain the detailed reason 3work days in advance in case Party A fails to pay the salary due to special reasons. 3.5 During the contract period, Party A will provide Party B free housing (including management fees), Party B will bear the cost and be responsible of the use of housing (such as water, electricity, gas, WIFI). During the working period in the kindergarten, the kindergarten provides three meals a day, but not during the winter and summer vacation. If the contract between the two parties is over, Party A will no longer provide free meals and housing for Party B. 3.6 The Employee shall notify, and seek approval for sick leave from the Director of Foreign Affair or his/her deputy immediately in the event of sickness. All sick leaves must be supported by a doctors certificate unless prior approval from the Director of Foreign Affair is obtained. With doctors certificate from a public hospital, Party B can have one paid sick day off per month. All the expense occurred due to Party Bs sickness should be all bared by Party B. 3.7 Private affairs leaves of Party B shall be approved by the Party A. Party B must inform Party A in advance and it must be confirmed by Party A. Days of absent wont be paid, and in Party B fail to get permission from Party A, Party A has right to deduct salary of days of absent (half day absent will be counted as 1 day absent, 1 day absent will be counted as 3 days absent). In the contract term, the private affairs leaves should not exceed 10 days. The continuous private affairs leaves should be no more than 3 day. 3.8 All of the above Party Bs salary and benefits shall be kept private. Party B cannot disclose any details to any other parties. If Party A comes to notice that Party B disclose these critical information to others, Party A has right to deduct the contract bonus from Party Bs paycheck at the end of the semester. Party A retains the legal responsibility to be held by Party B. 4. Visa 4.1 Party A will provide related documents for Party B to apply for a visa as soon as possible. In the mean time, Party B will try to get any long period visa he/she can. 4.3 After Party B had completed one semester contract with Party A and Party B extend his/her contract for another year, for visa fees: _4.4 If for any reasons Party B cant get a visa, Party B should not ask Party A for any damage fee. 5. Responsibilities for breaking the contract and/or dismissal 5.1 If one of both parties wishes to terminate the contract before the actual date, that party should give thirty day notice to the other party. Upon receiving this notice, arrangements shall be made to terminate the contract.5.2 Party A may immediately terminate the employment of Party B if Party B has done something critical (harming a student, breaking the law).If Party Bs performance is not satisfactory: 5.2.1 A discussion between both parties to see what can be done shall serve as first notice. 5.2.2 If no improvement is shown a written note shall serve as second notice. 5.2.3 If nothing is done by Party B, then Party A has the right to dismiss Party B without any further payment. This will serve as third notice. 5.2.4 If Party B breaks the contract, Party A has the right of dismissing Party B without prior notice or further payment of remaining wage.5.3 If Party B breaks the c
