（英语语言文学专业论文）试论英汉法律翻译原则.pdf

内容摘要 在日趋全球化的今天，随着人们法制意识的日益增强，法律文件的翻译在国 际交流与合作事务中的作用和意义日渐突显。尽管众多研究者已经投入法律语言 的研究，在法律翻译研究方面仍是比较薄弱。 本文借鉴功能语言学中的语域分析理论，试图通过对英汉法律语言特征的研 究来深入探讨英汉法律翻译的原则问题。基于法律语言的特点以及法律文本的功 能，笔者归纳出以下三点原则：精确性、专业性以及逻辑性。精确性原则不仅要 求译文忠实反映原文本信息，还特别针对法律文本的交际价值，提出了在原文本 信息与原作者意图有冲突的情况下，应遵循后者，以使译文合法化。鉴于法律文 本的格式会影响其法律效力。以及法律文体介于公文文体和技术文体之间的特殊 性，专业性原则要求译文必须符合法定形式，“文随其体”，在词汇和句法层面上 反映正式文体的整体要求。逻辑性原则要求通过表层结构的黏着及深层结构的连 贯来生成符合严格的语言及法律逻辑的译文。其间，笔者通过大量例证，揭示了 应引起译者充分注意的难点，并结合法律语域分析，提出一些建设性的意见。 本文仅是英汉法律翻译研究方面一点有益的尝试，希望能给以后的研究者一 点小小的启示。 关键词：法律翻译原则、语域分析、黏着、连贯 a b s t r a c t e x i s t i n
