.物业正式租赁合同Formal Tenancy Agreement出租方姓名/名称: (以下简称“甲方”)Landlord: (hereinafter referred to as Party A) 承租方姓名/名称: (以下简称“乙方”) Tenant: (hereinafter referred to as Party B) 甲、乙双方就甲方愿意出租,乙方自愿承租物业之事宜,经双方协商一致,同意签订本物业正式租赁合约。This Agreement is made by and between Party A and Party B in connection with rental of property whereby this agreed as follows: 1.租赁物业名称及地址: (以下简称“该物业”)1.Name & Address of Property to be Rented: (hereinafter referred to as the Property)2.用途: 该物业只供 使用。2. Usage: For use only.3.面积: 该物业建筑面积为 平方米。3. Area: building area of the Property is square meters.4租赁期限:由 年 月 日起至 年 月 日止。其中从 年 月 日到 年 月 日为固定期,从 年 月 日到 年 月 日为非固定期4. Term of Tenancy: from to inclusive. From is fixed term; from is flexible term.5.租金:租赁期租金/每月金额: 。乙方在收到甲方提供的税务发票后10个工作日内全额支付本月租金。5. Rent: /Month. Party B shall pay monthly rent within 10 working days after the Party B has received the current month Tax Invoice from Party A.6.付租方法:6. Method of Payment6.1日期:乙方需于租赁期限内每月 日之前支付,以实际居住天数支付租金。6.1 Date: Party B shall pay off the rent on or before the 1st day of each month. The rental is according to the date the Party B living.6.2方式:乙方须以现金/划帐方式支付。每 月为一期支付一次。6.2 Method: Party B shall pay off the rent by T/T or cash. month(s) as a term.7.管理费:按有关管理部门规定之金额及方法由甲方支付。7.Management Fee: Shall be paid by Party A according to the amount and payment method stipulated by the related management office.8.公用事业费:水、电、煤气、电话费、ADSL。8. Public Utility Fee: Water, electricity, gas, telephone, ADSL.8.1计收方法:水、电、煤气、电话费、ADSL由乙方每月按帐单支付。8.1 Payment Method: Shall be paid by Party B according to the amount of relevant bills。8.2 甲方需为乙方开通水、电、煤气、电话费、ADSL。8.2 Party A shall help Party B to make the Water, electricity, gas, telephone, ADSL in normal condition. 9.保证金/订金:9. Security Deposit:9.1于本合约签订后交房同时,乙方须以现金方式支付甲方保证金,共计金额人民币 整,甲方另立收据为凭。9.1After the signing of this Formal Tenancy Agreement and on the date of hand-over, Party B shall pay to Party A by cash security deposit that is . A separate receipt shall be issued by Party A.10.首期租金:10. Rent In Advance: 10.1于 年 月 日之前,乙方须以现金/划帐方式支付甲方首期租金,即租赁期内 年 月 日至 年 月 日的租金,共计金额 人民币 元整,甲方另立发票为凭。10.1 Before the date , Party B shall pay to Party A the rent in advance which covers Tenancy from to that is_ . A separate invoice shall be issued by Party A.11.交房日期:于 年 月 日或之前。11. Date of Hand-over: On or before 12.乙方之义务:12. Party Bs obligations:12.1租赁期间内,该物业内所有公用事业费,如水、电、煤气、电话费、ADSL均由乙方承担。12.1 To pay all public utility fees such as water, electricity, gas, telephone, ADSL related to the Property exclusively during the Term of Tenancy. 12.2乙方须按上述规定交付承租保证金于甲方12.2 To pay the aforesaid security deposit to Party A.12.3乙方同意按上述规定每月按时支付租金等,如乙方逾期不付,须缴纳滞纳金甲方,滞纳金每日按月租金百分之零点五(0.5%)计收,逾期超过十五天的,则视作乙方自动退租,甲方有权收回该物业,乙方应按本租约第12.9条赔偿甲方损失。12.3 To pay the said rent in of on time and in the aforesaid manner without any deduction whatsoever. In case payment delayed, Party B shall pay a fine to Party A for delaying payment which equals to 0.5 percent of monthly rental per day, and if such default has not been cured by Party B within 15 days of notice there of from Party A. Party B shall be regarded as terminating the Tenancy and Party A shall have the right to claim losses pursuant to Article 12.9 hereunder.12.4乙方承租物业须按规定用途使用,不可用于不合法用途。12.4 To use the Property as per usage stipulated herein only and not to use the Property for any illegal purpose.12.5未经甲方书面同意,乙方不得擅自将物业转租给第三方,或与第三方合租、分租,但甲方不得不合理地拒绝乙方该等请求。12.5 Not to sublease or part with the possession of the Property without written consent of Party A and such consent however but to be unreasonably withheld.12.6乙方不得在该物业内,收藏政府违禁之物品,举凡军械.火药.硫磺.汽油.及挥发性之化工原料,或对物业有损害的有爆炸之危险的物品,均不得陈放该物业内外任何地方,并应对违反地方法规的任何行为承担责任。12.6 Not to store arms, ammunition or unlawful goods, gun-powder, saltpeter, kerosene or any explosive or combustible substance of any damage of the said property, and to be answerable and responsible for any consequence of any violation of local regulations.12.7在租赁期间内,乙方须正确使用该物业内甲方所提供之家具、装置及设备,保持其良好,在租赁期间内,乙方不做任何装修。物业之一切设备如因乙方疏忽而导致的损失,乙方须负责维修或赔偿,若物业内之设备在正常使用过程中自然损坏,甲方须负责及时修复。12.7 To duly use the furniture, fixtures and equipments inside the Property provided by Party A and keep them in good and tenantable condition and Party B will not decorate the house throughout the tenancy. In the case any damage due to Party B, Party B shall be responsible, otherwise, Party A shall be responsible for repairing on time.12.8租期内,乙方不得提前退租,如乙方提前退租,甲方有权扣除乙方之保证金作为赔偿,除此之外,甲方不得要求乙方赔偿由乙方退租引起任何其他直接或间接损失。12.8 Not to terminate the tenancy during the Term of l Tenancy, otherwise Party A shall have right to forfeit Party Bs security deposit as the compensation of loss Party A may suffer. Besides the security deposit, Party A shall not claim any other losses directly or indirectly incurred from such early termination.12.9租约期满,乙方如延长租约,须在租约期满 个月前以书面通知甲方。经双方协商同意,乙方可以新订租金继续租用该物业。12.9 To notify Party A in writing not less than month before the expiration of the Term of Tenancy if Party B wish to extend the tenancy. The tenancy may be extended upon terms and conditions agreed by both parties.12.10乙方须全面遵守有关物业管理公约,履行公约所规定的各项义务,承担违反公约所产生的责任。12.10 To perform and observe the reasonable Covenants of the related Property Management and be fully responsible and liable for breach thereof.13.甲方之义务13. Party As Obligations:13.1租赁期内,甲方不得无故终止合约,否则甲方需双倍返还乙方保证金做赔偿。13.1 Not to terminate the tenancy during the Term of Formal Tenancy, otherwise Party A shall refund to Party B the security fund at same time with two months as compensation.13.2甲方须负责该物业各种结构,包括但不限于屋顶、天花板、墙壁等结构以及各种内外部管线等之维修并承担维修费用。13.2 To keep and be responsible for repairing all structure the Property including but not limited to the roof, ceiling, main structure which includes walls of the Property, internal and external pipelines for electricity and water at its own cost.13.3在本租约签定及甲方收到乙方保证金后,甲方按照合约之附件(标的物业内家私与设备清单)提供配备家私与电器设备。13.3 To furnish the Property according to the Exhibit of the Formal Tenancy Agreement, the Furniture, Fixtures & Equipment List, after the execution of this agreement and after Party A receives the security deposit from Party B.14.如由于出现不可抗力的情况,包括但不限于地震、风暴、洪水等自然灾袭击,而使该物业内任何设施不能正常运行,或水、电、煤气、冷暖气供应中断时,甲乙双方概不负责。如果由于不可抗力无法按本租约条款履行,受不可抗力影响的一方有权解除租约,并不负任何赔偿义务,保证金及租金余额应退还乙方。14. In the case the Property or any part thereof or any facilities thereof shall at any time during the Term of Tenancy be destroyed, damaged or cannot work, or in the case the supply of water, electricity, gas, air conditioning or central heating is cut off due to the force major including but not limited to earthquake, storm, flood and etc, both parties shall be discharged of liabilities for losses due to force major. In case of failure in performance of this agreement upon agreed conditions, the affected party by force major is entitled to terminate the tenancy without any compensation and the security deposit and the balance of all rents shall be returned to Party B.15.如有任何本租约下的通知,应经书面通知至各方上述之地址。15. Any notice under this Agreement shall be in writing and shall be sent to the address of the parties above.16.本租约之附件,包括甲、乙双方身份证件,甲方产权证,家私清单均为不可分割的组成部分。16. The attachments, including: Party As ID card and property rights papers of the Property, Party Bs passport, Furniture, Fixtures & Equipment List are integral parts of this Agreement and are equally enforceable.17.本租约适用中华人民共和国法律,自甲乙双方签字后,双方均应遵守本租约规定的各项条款。任何由本租约引起或与之有关纠纷,双方不能完满解决,将依照中华人民共和国有关法律,提交中国国际经济贸易仲裁委员会上海分会根据届时有效之仲裁规则在上海通过仲裁解决。17.
