新闻英语与法律英语文体的对比研究 中文摘要 新闻英语和法律英语是英语的两种特殊语域，具有区别于文学语言和其他实 用文体的显著特点。语言学家们认为文体学的任务不是列举若干文体的名目，而 是观察和描述若干主要文体的语言特点，亦即它们各自的语音，词汇，句法与篇 章的特点。普通英语的词和词组，句式和篇章是根据它们的普通意义来解释的， 而法律英语和新闻英语有其特有的文体特点。自1 9 6 3 年美国律师大卫美林科 夫的著作法律语言问世以来，英语国家研究法律语言的人从文体学的角度对 法律语体的各个层面包括词汇、句法、修辞、版面格式、语篇结构等进行了深入 细致的分析。而新闻英语也是吸引了不少学者对其句法结构、词汇特点和篇章结 构进行了分析。 本篇论文从词汇、语法和篇章三大方面将法律英语和新闻英语的文体进行了 对比，从中总结出两种文体的不同，并浅析了产生这些不同的原因。通过对比本 文发现法律英语和新闻英语文体特点的不同主要取决于两者不同的社会功能。法 律英语在社会中的特殊作用要求法律英语正式、准确、保守，要避免模糊和歧义。 对于正式和准确的过度追求使得法律英语显得复杂、累赘，甚至是枯燥乏味。而 新闻英语的特殊社会功能则要求新闻英语的语言简明、易懂，能够让大众在短时 间内掌握新闻报道者所要传播的消息。法律英语和新闻英语的这些文体特点在其 词汇、句法及篇章组织上都有所体现。 在词汇方面，法律英语与新闻英语存在的主要区别是法律英语倾向于采用古 词和长词，而新闻英语则倾向于采用新词和简短词汇。 在句法方面，法律英语的句子普遍采用长旬。法律英语严谨、准确的特点要 求其所要表达的意思必须完整，这一点也使得法律英语的句子较长。为了能够使 意思准确无误地表达出来，后修饰词也得到普遍应用，从而成为法律英语在句法 方面的又一特点。与法律英语不同，新闻英语普遍采用短句、省略旬和使用前修 饰词来达到新闻英语简明易懂的特点。 在语篇方面，本文主要从主述位方面来分析。在从句中，法律英语与新闻英 语采用较多的单项主位，但是单项主位和复项主位在法律英语中所占的比例差距 奠j 、作者分析在分析商务法时发现，在商务法中复项主位的使用频率高于单项 主位。而新闻英语中的单项主位使用频率远高于复项主位的使用频率，单项主位 与复项主位所占的比例差距达到7 5 。 通过分析，作者得出结论以上法律英语和新闻英语在文体方面的差别主要是 由两者的社会功能和社会要求决定的。 法律语言存在多种类型，其中法律文件中的法律文本是法律语言中最具权威 性，最正式，最规范和对语境依赖性最小的一种。因此本文在研究法律英语的文 体时尽可能选择法律文本作为语料。为了使对比更精确一些，新闻英语的语料也 尽可能选择对法律事件的报道。 本文的目的在于使学习者能够更好地了解法律英语和新闻英语的文体特点， 能够在恰当的场合，比如翻译和写作时分别使用它们。 本文花费了大量的时间来研究证实文中所涉及的法律英语和新闻英语的文 体特点，并将两者进行比较，相信这篇文章将对法律英语文体和新闻英语文体的 对比研究有一定的理论和实践意义。同时，由于调查资料范围的局限性，比如说 法律文本和新闻语料的时间跨度、法律的其他类型的文本是否具有类似的文体特
