精选资料房产租赁合同 APARTMENT LEASE CONTRACT 合同编号 / CONTRACT NO.:CD 甲方(出租方)/ Landlord (Party A): 身份证号码 / ID No.: 乙方(承租方)/ Tenant (Party B): 身份证号(或护照号)/ ID / Passport No: 丙方(中介方)/ Intermediary: 根据中华人民共和国合同法等法律、法规的规定,甲、乙双方经友好协商,本着平等互利的原则,通过丙方提供信息就出租及承租房屋的相关事宜达成如下合意: According to The Law of Peoples Republic of China and the provisions of the relevant laws and regulations, and on an equal and voluntary basis, Party A and Party B agree to sign this lease contract in order to make clear the rights and obligations of both sides as follows: 一、租赁标的基本情况: The basic information of the apartment: 1.1 房屋位置 房屋套型 ,建筑面积 平方米,结构框架 ,楼层 层,该房屋 已 / 未 设定抵押。 The location of the contract apartment is: ,with bedrooms, bathrooms, with square meters, in the _ floor, with / without the condition of mortgage. 1.2 该房屋 产权证号/购房合同备案号 监证 权证号 The property ownership certificate No. / the house purchase contract No.: 监证 权证号 1.3 该房屋用途: 住宅 。乙方保证,在租赁期间内未征得甲方书面同意以及按规定经有关部门审核批准前,不擅自改变房屋的用途。 The use of the contracted apartment: _residence usage . Party B, wishes to renew the lease after the expiration of rent, Party B has privilege and priority under same condition as others and shall give 30 days in advance notice to party A, before the expiry of the lease.,Both parties can reach an agreement with the new rent.三、租金及支付方式: The rent and payment option: 3.1 租金标准:人民币 ¥ 元( 月 (大写: ), The rent is ¥ RMB per month 3.2 支付类型: ,乙方应每次提前 天支付甲方下一季租金,(租金支付时间表详见附件) .Payment method : , party B shall pay days in advance every quarter to party A.( payment dates is attached as Appendix ) 3.3 租金支付方式:乙方以银行转帐或者银行转账方式的形式支付甲方租金。(银行帐号:详见附件3 ) The way of the payment: Party B shall pay the rent to Party A by bank transfer or cash bank account details is attached as Attachment 3 ) 3.4 甲方收取租金及房屋租赁保证金后,应向乙方开具收条。 Party A should make the invoice for the rent and deposit.4、 房屋租赁保证金: The deposit of the contracted apartment:4.1 乙方应向甲方支付房屋租赁保证金,具体金额为人民币:¥ 元(大写: )。 Party B should pay ¥ _RMB as deposit to Party A. 4.2 租赁期满或合同解除后,乙方付清所有该承受的费用及租金,且物屋内设施设备无人为损坏,甲方将全额退还乙方押金。 Until Lease expiration or termination of the contract , Party B should pay off all usage fees and rent , and make sure that facilities, equipments and furniture within the apartment has no damage,Party A will refund Party B the deposit. 5、 其他费用: Some other fees: 租赁期内,使用该房屋所产生的费用,包括水、电、气、通讯、设备、物业管理费用由乙方承担。During the lease period, Party B should pay the fees for water, electricity, gas, and communication expense, facility expense, and the community property management fee.6、 房屋的交付及返还: Handover and return the apartment: 6.1 交付 :甲方应于 年 月 日前将房屋按约定条件交付给乙方,并签署附件二物业交接单,签字后视为交付完成。 Handover: Party A shall handover the apartment to Party B before according to the contracted condition, and both parties sign theProperty Handover List, attachment 1,2,as completion of the Handover. 6.2 返还:租赁期满或合同解除后,乙方应返还该房屋及其附属设施。甲乙双方验收后认可在附属件二物业交割单上签字盖章。甲乙双方应结清各自应承担的费用。 Return: Party B should return the apartment and all the contracted items to Party A after the contract expires or invalid, and shall clear and pay off all the related fees 6.3 乙方添置的新物可由其自行收回,而对于乙方装饰、装修的部分,具体处理办法为:双方协商处理 Party B can take away the new items it bought. About the decoration made by Party B, the way to deal with is _both parties will reach an agreement 6.4 返还后对于该房屋内乙方未经甲方同意遗留的物品,甲方有权自行处理。 After Party B returns the contracted apartment to Party A, Party A has the right to manage the stuff left by Party B without Party Bs permission.7、 房屋使用要求和维修责任: The requirements of the usage and repair responsibilities: 7.1 租赁期内,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复。甲方应在接到乙方通知后的 7 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。 During the lease period, Party B should inform Party A in time if the contracted apartment of the contracted items are broken. Party A should fix them within _7_ days after Party B informs him. Party B can fix them for Party A if Party A doesnt fix them in time, and Party A is in charge of the repair fee. 7.2 租赁期内,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修,或甲方可代为维修,费用由乙方承担。 During the lease period, Party B should take good care of the contracted apartment and items with proper use. If the contracted apartment or the contracted items are broken because of the improper way Party B uses, Party B should fix them., Party A can fix them and Party B is in charge of the repair fees. 7.3 除本合同附件(一)外,乙方另需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定应向有关部门办理审批的,则还由 甲方委托乙方 报有关部门批准后,方可进行。乙方增设的附属设施和设备及其维修责任于甲、乙双方另行书面约定。Apart from the contracted items ( seen on the attachment 1), Party B should have the permission from Party A if Party B wants to re-decorate or add some new items. And also Party _B_ should have the permission from relevant department if necessary. Party A and Party B can reach an agreement about the repair responsibility of the new items Party B buys.8、 转租,及所有权变动: Sub-lease , ownership changes: 8.1 除甲乙双方另有约定以外,乙方不可在租赁期内将该房屋部分或全部转租给他人。 Unless Party A and Party B have an agreement,Party B is not allowed to re-rent or sublet part or full of the apartment to the others. 8.2 租赁期内甲方出售该房屋的,甲方应当提前30 日书面通知乙方,乙方在同等条件下享有优先于第三人购买的权利(此项甲方不用支付违约金)。 During the lease period,if Party A sells the apartment, Party A should inform Party B by writing _30_ days in advance. Meanwhile, Party B has priority to buy the apartment over others(this item without payment of liquidated damages)9、 合同的解除: The conditions to invalid the contract: 9.1 经甲乙双方协商一致,可以解除本合同。 The contract can be invalided if both Party A and Party B can reach an agreement. 9.2 有下列情形之一的,本合同终止,甲乙双方互不承担违约责任: Both the Party A and Party B are free from penalty responsibility of ending the contract if its because of the following reasons:9.2.1 该房屋因城市建设需要被依法列入房屋拆迁范围的。The contracted apartment is chosen to rear down and relocation required by City Construction needs.9.2.2 因地震、火灾等不可抗力致使房屋毁损、灭失或造成其他损失的。 The contracted apartment is damaged by the natural reasons, such as earthquake, fire etc.9.2.3 在本合同非固定期限内(详见2.1条),双方如需解约均需提前30天通知对方 In the non-fixed term contract( see 2.1),both Party A and Party B are required for cancellation 30 days in advance notice to the other. 9.3 甲方有下列情形之一的,乙方有权单方面解除合同: The Party B can invalid the contract with the reasons as following:9.3.1 未按约定时间交付该房屋达 日的。 Party A doesnt handover the contracted apartment in time until _ days late. 9.3.2 交付的房屋不符合合同约定严重影响乙方使用的。The contracted apartment is not matched with the contract and Party B couldnt live with it. 9.3.3 不承担约定的维修义务致使乙方无法正常使用该房屋的。Party A doesnt fulfill the required repair obligation and Party B couldnt use the contracted apartment properly. 9.3.4 交付的房屋危及乙方安全。The contracted apartment is dangerous for Party B.9.4乙方有下列情形之一的,甲方有权单方解除合同,收回该房屋:Party A has the right to invalid the contract and take back the apartment if: 9.4.1 不支付或者不按照约定支付租金达 日的和/或欠缴各项费用达人民币 元的。Party B doesnt pay rent or doesnt pay in time until _ days later, or Party Bowns the required fees more than _ _ RMB.9.4.2 擅自改变该房屋用途的和/或擅自拆改变动或损坏房屋主体结构的和/或擅自将该房屋转租给第三人的。Party B changes the usage or breaks structure of the contracted apartment or re-rents the apartment without Party As permission.9.4.3 利用该房屋从事违法活动的。Party B uses the contracted apartment to do illegal activities. 10、 违约责任: Responsibility of breaking the contract:10.1 甲方有本合同第九条第9.3款约定的情形之一的,应按月租金的 100 %向乙方支付违约金。Party A will pay _100_ % of the rent to Party B if he breaks one of the rules mentioned in number 9.3 in the contract.10.2 租赁期内,甲方需提前收回该房屋的,应提前 30 日通知乙方,将已收取的租金余额退还乙方并按月租金的 100 %支付违约金。During the lease period, if Party A wants to take back the contracted apartment in advance, he should inform Party B _30_days in advance and give back the rest of the rent Party B has paid and also give 100_ % of the rent to Party B as compensation. 10.3 乙方有本合同第九条第9.4款约定的情形之一的,应按月租金的 100 %向甲方支付违约金。If Party B breaks one of the rules mentioned by number 9.4 in the contract, he should pay _100_ % of the rent as compensation.10.4 租赁期内,乙方需要提前退租的,应提前 30 日通知甲方,并按月租金的 100 %支付违约金。甲方退还剩余租金及押金During the lease period, if Party B needs to return the contracted apartment in advance, then Party B should inform Party A _30_ days in advance and pay _100_ % of the rent to Party A as compensation ,Party A will refund Party B the rest of the rent which Party B has paid as advance payment. 10111101010.4 and all payment after the termnation date subject to 30 daysrefund Party B the doposit and all non consumed a10.5 甲方未按约定时间交付该房屋或则乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约定时间返还房屋的,应按 标准支付违约金。If Party A doesnt hand over the apartment as due time, or Party B doesnt pay the rent on time ( not reaching the condition to invalid the contract), either party should pay as compensation. 11、 经纪服务费用 Intermediary fees:11.1 甲方应在本合同签订时向丙方支付居间服务费人民币 元(大写: )Party A will pay RMB as commission to the intermediary whiling signing the contract.11.2 乙方应在本合同签订时向丙方支付居间服务费人民币 元(大写: )Party B will pay _ RMB as commission to the intermediary while signing the contract.11.3 本合同签订后,如果甲方和/或乙方原因导致本合同不能履行或提前解除的,丙方已收取的居间服务费不予退还。If the contract is not applied or invalided because of Party A or Party B after signing the contract, the intermediary will not give back the commission.11.4 由于丙方已经为甲乙双方提供居间服务促成合同签订并尽到自己如实告知的义务,故无论基于何种原因甲乙双方不能依本合同之条款完成本次租赁交易,导致丙方未能收取居间服务费的,则丙方有权要求违约一方依据月租金的 100 %支付违约金,以弥补丙方居间服务费的损失。As the intermediary has fulfill the obligation of agency service honestly, no matter what happened to cause the contract to invalid because of Party A or Party B and the intermediary failed to get the commission, the intermediary has the right to the one who breaks the contract for 100 % of the rent as compensation to make up the loss.11.5 在房屋租赁期间,丙方应积极提供相应的后续服务如甲乙双方需要帮助,以及如出现房屋租赁及相关事务纠纷,丙方应积极配合,协助予以解决。During the leasing period, Party C shall actively provide after-sales services when Party A and Party B needs help, for leasing related disputes and problems, Party C shall cooperate actively and facilitate to resolve.12、 争议处理: Dealing with the problems: 本合同在履行中如发生争议,各方应协商解决。协商不能解决的,各方同意按以下第 2 种方式解决纠纷。 If there is any problem while fulfilling the obligation in the contract, both Parties should try to reach an agreement. If they couldnt reach an agreement, they agree to deal with the problem by _the second 1.提交 成都 仲裁委员会仲裁Arbitration 2、依法向房屋所在地的人民法院提起诉讼。Court Lawsuit13、 本合同经甲、乙、丙三方签字即生效,本合同壹式叁份,甲、乙、丙三方各执壹份,具有同等法律效力。本合同生效后,双方对合同内容的变更或补充应采取书面形式,作为本合同的附件。附件与本合同具有同等的法律效力。This contract has been prepared in triplicate. Party A, Party B and the intermediary must each keep a copy. All three copies have the same legal effect. After the contract is in effect, Party A and Party B can add some issues as an attachment.
