Appendix OInfection Control Matrix71 4WCE 600700 Rev 4 Page 3 of 71 1 PURPOSE 1 1This global engineering specification defines the minimum requirements for practices and procedures to be complied with by construction contractors working for Xxxx 2 SCOPE 2 1This specification applies to all construction projects in which Xxxx participates in a variety of capacities throughout the world 2 2This specification applies to all contractors as well as the subcontractors that they employ to perform specific activities on the project site 2 3Home Rule The requirements of this construction safety procedure will be modified by the specific safety rules and procedures of individual operating plants that will be described in 600 710 and shall be used in conjunction with this specification 2 4This specification shall supplement all national provincial or local codes and external standards in force within the country where this specification is being applied Examples of some standards are indicated in paragraphs 3 2 through 3 5 If there is a conflict between this specification and the applicable code or standard the Xxxx representative shall be notified immediately for resolution 2 5Failure of this specification to reference specific national provincial or local regulations does not excuse the contractor and its subcontractors or their employees from following those regulations that might be applicable to the scope of work being performed by the contractor 3 RELATED DOCUMENTS Note Unless otherwise specified reference to related documents shall mean the latest revision in CERCLA 3 7Various Chemical Manufacturers Suppliers Material Safety Data Sheets MSDS 4 DEFINITIONS 4 1Xxxx Representative as used herein shall mean the designated person of Xxxx in charge of the work at the site or elsewhere who through knowledge experience and training will act on behalf of the company to ensure that the standards and specifications are adhered to when the contractor performs various duties or tasks This person can be an employee of Xxxx a subsidiary of Xxxx an owner see paragraph 4 13 or a designee of a joint venture partner who will be assigned on a project basis 4 2Approval Unless otherwise specified approval in this specification means approval in writing 4 3Cases with days away are incidents that result in an occupational injury or illness that would prevent the employee from working on the next calendar day following the incident 4 4Certification is a statement attesting authoritatively that a specified standard or condition has been met 4 5Competent person means one who is capable of identifying existing and predictable hazards in surroundings or working conditions that are unsanitary hazardous or dangerous to employees and who has authorization to take prompt corrective measures to eliminate them 4 6Construction project is any new construction work at a new facility or as an extension or modification to an existing facility Generally it is industrial or commercial in nature and applies to all sizes of projects It does not apply to plant maintenance work although requirements might be similar 4 7Contractor is an external individual or company who performs work for Xxxx under specific contractual terms supplying goods and services The use of the word contractor in this procedure covers contractors and their subcontractors 4 8First aid is treatment for a minor injury that does not require medical or surgical procedures These injuries can be treated locally at the site or by a medical physician but without complex procedures 4 9Governmental requirements include local provincial and national codes regulations and ordinances 4 10Jobsite is defined to include any work site inside or outside battery limits of facility laydown areas related parking area owners premises and transportation routes within the facility 4WCE 600700 Rev 4 Page 5 of 71 4 11Near miss is an incident or potential situation that could have caused personal injury This may include incidents that had no injury but had the potential for causing serious injury as well as minor accidents where the injury that resulted to an employee required first aid treatment but the potential for more severe injury existed This differs from an unsafe condition in that in a near miss an incident actually occurred 4 12Occupational injury illness are known injuries or illnesses to non employees that involve our products facilities or employees which would be considered an Xxxx recordable and or a Worker s Compensation case if the injured person was an employee 4 13Owner can be Xxxx a joint venture partner a subsidiary of Xxxx or a customer contracted with Xxxx The owner will be defined in the project specific documentation 4 14Property damage is an accident where property damage resulted 4 15Qualified means one that has the training experience or instruction to be deemed competent and has demonstrated the ability to perform all assigned duties and do so in a safe manner When required the individual has met the appropriate license certification or authorization requirements This individual has received formal training by an accredited body in accordance with national provincial or local regulations applicable in the location 4 16Job Safety Analysis JSA is a technique used to identify document and mitigate hazards and potential hazards associated with a specific task or job function Primarily used as a communication tool for all individuals involved with the task The JSA is generated and communicated prior to the beginning of the work See Appendix K 4 17Accident Cause and Effect is a method used to identify the root cause or causes of an incident Xxxx has adopted the Accident Cause and Effect method for evaluating lost day work cases recordables and serious near misses 4 18Accident Predictive Technique is a leading indicator tool used to identify document and mitigate workplace hazards and potential hazards including both conditions and behaviors See Appendix C 5 GENERAL 5 1Xxxx requires the very highest standards of safety on its construction sites Contractors must ensure that their management commitment planning resourcing quality systems training and execution in the field strive for the highest standards and continual improvement 5 2This specification addresses conditions of work and the manner in which Xxxx expects work on its premises to proceed Its intent is to establish a reasonable minimally acceptable level of safety for all personnel located at Xxxx facilities during the construction period If any unforeseen considerations or problems arise they shall be resolved by mutual agreement recognizing that personnel safety is of paramount importance 5 3The contractor shall ensure strict compliance with these construction safety procedures as well as with all applicable national provincial and local regulations The most stringent of the applicable governmental regulations or this specification shall apply if there is a conflict 5 4Xxxx requires the contractor s senior management to make a personal commitment to the standard of safety on the project and to sign and send on company letterhead a Safety Commitment Letter to the site where it will be posted An example of which is attached as Appendix E 5 5Xxxx also requires the contractor s site management team and supervisors to sign their own personal letter of commitment to the safety of the job site that will be posted at the jobsite An example of which is attached as Appendix F 4WCE 600700 Rev 4 Page 6 of 71 5 6The contractor acknowledges its duty to furnish each of its employees employment and places of employment free from recognized hazards and unsafe conditions causing or likely to cause death or serious physical or material harm The contractor agrees to comply with all safety and health standards promulgated under the national provincial and local regulations as amended The contractor acknowledges that the sole responsibility for the safety of contractor s employees and for compliance with the national provincial and local regulations regarding such employees rests with contractor 5 7During the performance of its work the contractor its employees subcontractors agents and invitees shall strictly comply with all safety fire health and other applicable rules and regulations of owner and Xxxx The contractor shall familiarize itself and each of its employees subcontractors agents and invitees with such rules and regulations If any of them violate any such rules and or regulations the contractor shall cause such persons to be dismissed permanently from the project The owner and Xxxx reserve the sole right to determine if such act or failure to act constitutes a violation or deviation of any such rules and regulations 5 8The contractor expressly agrees to review its safety and health program for the work with Xxxx before beginning any work and during the performance of the work The contractor shall be able to demonstrate to Xxxx during the performance of the work that it is fully complying with all applicable laws rules and regulations The contractor agrees to indemnify and hold harmless the owner and Xxxx from any expense claim penalty or resulting fines directly or indirectly from the contractor s failure to comply with the aforementioned safety and health standards The contractor further understands and agrees that any violation of applicable safety and health laws rules or regulations shall be sufficient cause for termination by Xxxx or the owner pursuant to the General Conditions for Construction Agreements 5 9The contractor shall at its own expense cooperate with Xxxx and the owner in all reasonable safety precautions in connection with the project The contractor shall comply with all requirements of Xxxx the owner or any governmental authority having an interest in the work concerning the secrecy of any part or aspect of the work or of the project The contractor shall not permit any person to enter upon the premises of Xxxx or the owner at the site of the work or elsewhere except according to the safety and security requirements of Xxxx the owner or such governmental authority having an interest in the work 5 10The contractor agrees to indemnify and hold harmless owner and Xxxx from prohibiting any contractor s or subcontractor s employees agents or invitees from entering onto the project site if in the sole opinion of Xxxx such employee agent or invitee fails to comply with the above mentioned safety and health laws rules and regulations 5 11In jurisdictions where permitted by law the contractor is required to have an alcohol and substance abuse policy This policy shall require testing of all contractor employees as well as of any subcontractors employed by the contractor The requirements are detailed in Appendix J of this specification 5 12Safety Performance Enhancement 5 12 1With the assistance of the Xxxx representative and in jurisdictions where permitted by law the contractor shall develop and propose a safety recognition and incentive plan that is to be used at the construction site to aid in promoting safety awareness The contractor is encouraged to use a program that is already in place or develop a new program that is specific for this project 5 12 2Elements to consider are Monetary incentives based on results Near miss and hazard recognition reporting Safety slogans and signs Luncheons and miscellaneous gifts based on performance Housekeeping 4WCE 600700 Rev 4 Page 7 of 71 5 12 3Financial responsibility will be negotiated at time of contract award 5 13Contractor Safety Supervisor 5 13 1The contractor shall provide a qualified and competent safety supervisor who shall maintain job site safety during all phases of the contractor s onsite work A resume of the safety supervisor listing their work experience and safety record for each of the last three years shall be submitted with the bid for Xxxx representative approval 5 13 2The contractor must include a separate safety supervisor when more than 20 workers including subcontractors are working on site When the workforce increases the contractor shall add additional field safety professional s in accordance with national provincial and local standards In cases where this is not defined by regulations the contractor shall add a second safety supervisor when there are more than 50 workers on site 5 13 3If the contractor will have 20 or fewer workers including the contractor s subcontractors the contractor with Xxxx approval shall designate a person who will perform all of the required safety responsibilities and duties to be the primary safety contact or person Determination if a separate safety supervisor is required when the contractor has 20 or less workers on site will be based on type of work assessed risks contractor s past safety performance on Xxxx projects contractor s safety program and contractor s safety statistics 5 13 4The minimum qualifications and duties for the Contractor Safety Supervisor are outlined in Appendix N Contractor Site Safety Supervisor Job Description 6 MOBILIZATION PHASE 6 1Before starting any work the Xxxx representative shall review the safety specifications via a kickoff meeting with the construction contractor s and their subcontractors at the job site to ensure that all parties understand the safety rules and regulations applicable to that job site 6 2Before starting any construction project the Xxxx and contractor representatives shall perform a site safety assessment identifying any unsafe conditions or potential hazards and take the necessary steps to correct or minimize the unsafe condition hazard The contractor shall document the safety audit or assessment and issue it to contractor management and the Xxxx representative 6 2 1Items to be considered might be items such as customer processes traffic flow routes into and out of the jobsite temporary structure or trailer sitting fabrication areas equipment storage or laydown areas overhead power lines and obstructions neighboring facilities underground utilities emergency response emergency evacuation and assembly locations work permit procedures and operating vent locations Items from the Site Risk Assessment shall be included 6 3Each contractor shall develop new ideas and approaches to promote safety awareness at the site 6 4All contractor personnel must receive necessary training and testing before performing any work on site This training
