法律英语中古体副词的构成 含义及翻译 倪清泉 谢金荣 西南政法大学 外语学院 重庆401120 摘要 法律英语是一种英语言语变体 属于专门用途英语之一 具有自身独有的特点 法律英语中的there under等古体词具有以下特点 一是这些古体词是由here there where加常用介词构成的复合词 二是here 主要 指代 本 文件 文书 合同 协定等 即法律文件本身 there 虽然有时也可表示 本 文件 在这个意义上 here 与 there 的区别主要体现在话语者的心理距离上 但通常多指代前面提到的单词和词组 where 常指代前面所说的 整个句子或词组等 三是此类词语语义重点在here there where 复合词的第二部分 因为这部分都是常用介 词 词义比较明确 具体 四是here there 类复合词一般为副词 而where 类复合词既可作副词 也可作从属连 具有自身 独有的特点 如句子冗长 句式复杂 逻辑缜密 信息繁多 用词讲究等 Mellinkoff 2 将法律英语用词特点归纳为9种情况 如频繁使用法律专业术语 专业行话 正式用词 极端精确表达词 法语词 拉丁词和古英语词或中古英语 词等 其中 在法律文本中以古英语词或中古英语词汇的使用较为常见 古英 语词或中古英语词汇中又以thereunder等副词的使用尤为突出 古英语与古 汉语一样 古奥 庄严 语体正式 言简意赅 可以避免不必要的重复 行文准确 经济 简洁 使简洁性和正式性融为一体 可谓一石二鸟 3 我们在教学中发现 学生之所以畏惧法律英语 主要原因之一便是感到像 thereunder等古体词晦涩难懂 理解困难 翻译更加棘手 为帮助学生和法律工 作者解决上述问题 宋雷 傅伟良 王青 马庆林 张乐平等对thereunder等英 语古旧词在法律英语中的使用进行过研究 但他们只是在论述法律英语一般 94 性特点时对其一带而过 并未进行深入讨论 鉴于 此 本文拟对thereunder等古英语副词的构成 含 义及翻译做进一步探讨 以帮助法律英语学习者 和法律工作者解决在阅读和使用法律英语时遇到 的实际问题 一 古体副词的使用理据 法律英语偏爱thereunder等古体副词是由其 自身特点所决定的 首先 法律英语自身具有保 守性和惰性 法典讲究传承与稳定 由于英国或 英联邦国家主要采用遵循先例原则 判例法 法官审理案件都要以过去相关案件为参考或依 据 因此法官在制作法律文书时 为了避免因改 变原有词语而产生歧义 大量的古体词就原封不 动地保留下来 4 其次 法律英语具有神秘性和权 威性 法律英语追求古朴 用词考究 句法复杂 晦涩难懂 就连英语国家的非法律专业人士也认 为它们古怪 陌生 畏惧地称其为 外语 因为 法律仅掌握在少数社会精英的手里 这些精英分 子受过良好的高等教育并接受过严格的法律知 识训练和筛选 他们故弄玄虚 咬文嚼字 以显示 自己与众不同的才华和学识以及其高贵 权威地 位 从而达到操纵社会和维护自身利益的目的 再其次 法律英语具有庄重性和简洁性 法律语 言不同于普通语言 本身要求简明扼要 言简意 赅 严肃庄重 以显示其神圣性 权威性和严谨 性 英语古体词 特别是古体副词 虽然显得呆 板 晦涩 但它们内涵丰富 有时一个词相当于现 代英语的几个词或一个句子 甚至一个段落 一 个文件 因此 在法律英语文本中运用古体词 特 别是古体副词 可以有效地体现法律英语的上述 特点 二 古体副词的构成及功能 法律英语中 thereunder等古体副词有四十多 个 如hereafter hereat hereby herein hereinafter hereinbefore hereof hereon hereto heretofore ereu nder hereunto hereupon herewith thereafter thereat thereby therefore therefor therefrom therein there inafter thereinbefore thereunder thereof therethro ugh thereto theretofore thereon thereout thereover thereupon thereunto therewith whereas whereafter whereat whereby wherein wherefore wherefrom whereof whereon wherethrough whereto whereupon wherewith 不过 常见的仅有十几个 如hereafter hereby herein hereof hereto hereof thereafter thereby thereof whereby whereof等 从上述古体副词不难看出 第一 这些词可以 简单地分为三类 here 类 there 类及where 类 第 二 这些词大部分由here there及where 单介词 构成 部分则由here there 双介词构成 单介词归 纳起来主要有after as at by fore from in of through over out to under upon unto with 双介 词有in after in before to fore after at by in of on to upon及with通常为here there 和where 三类词共用 即这些介词均可放在here there 和 where 后构成复合副词或从句连词 inafter inbe fore tofore under unto只能放在here there 之后 构 成 复 合 副 词 fore from through则 只 能 放 在 there 和where 后构成复合副词或从句连词 第 三 here 类和there 类为副词 作状语 表示时间 地点 方式和条件等 where 类为副词或连接词 作状语 引起状语从句或定语从句 三 古体副词的含义及翻译 上述古体副词或连接词看上去十分复杂 但 只要弄清其结构并根据具体法律文本语境 理解 其含义并进行翻译并不困难 总的来说 here 通 常指 this document 可译为 本 文件 文书 合 同 协定等 有时可译为 为此 在此 等 there 为 that those 有时指 该文 有时指代前 面提到的单词和词组 where 可理解为 which 翻 译视具体语境而定 然后 在此基础上根据后面介 词的本义进行理解和翻译 例如 hereby可以理 解为 by this document thereby可理解为 by that by those 可译为 据此 特此 兹 因此 whereby可以理解为 by which 可译为 凭 按照 等 以下将对here there where 类古体复合词 副词逐一进行分析和翻译 1 hereafter thereafter
