中文提要 长期以来，美国一直在国内外鼓吹自己的新闻自由机制。从最初的革命信仰 “人人生而平等”到其宪法信条“人人生而具有不可剥夺的生命权、自由权和追 求幸福的权利”，从理论上讲，美国具有相对宽松的社会环境和政治环境以确保“出 版自由”的存在。然而在现实中，报业中的“新闻是事实”原则还远未得到实现。 来自于报业内部、政府及各社会团体的制约使报纸根本无法不受限制地对事实进 行客观报道。报业中存在的或多或少的政治倾向性，注定了报纸不可能对重大政 治事件进行不偏不倚的公正报道。此外，政府软硬兼施的策略也扼住了报业讲事 实的喉舌。与此同时，几乎每一种报纸都有其所从属的大企业，这样在对这些企 业进行报道时，报纸肯定会采用对自己母公司有利的报道，即使牺牲事实也在所 不惜。最后，一些社会团体组织，如绿色环保组织、同性恋联合会、全国妇女联 合会等等也会对报业在报道与其组织相关的领域时施加影响。所有这一些强加在 报业上的沉重负担，使得报业中的出版自由理论和客观报道原则成为流于形式的 空洞口号。 同时我们也应认识到，这些制约机制在一定程度上也起到了限制报业滥用报 道权、保护受报道团体和个人利益的作用。从这一点来说，这些机制具有积极的 影响。更重要的是，美国报业中的制约机制会对我们中国的报业带来许多有益的 启示，这有利于我们在改革开放的大趋势下，尽快规范我国的媒体市场，从而对 媒体报道进行有效的管理。总之，对于美国报业中的“言论自由”理论，我们应 该用批判的观点全面分析和看待，只有这样，我们才能在借鉴美国报业制约机制 的基础上，坚持自己的路线策略并尽快完善中国报业的制约机制，使报业更快、更 强、更有效地为社会主义现代化建设和改革开放发挥宣传和监督的作用。 关键词：制约机制；出版自由；冲突；妥协 a
