manual shall be applicable to all the employees in Lightning optoelectronic technology SZ Co LTD company 4 员工聘用政策员工聘用政策 Employee recruitment policy 4 1职级制度 Job grade system XX 职级制度共有 9 个级别 具体如下 Lightening has 9 grades in the job grade system which are as follows 90 级 高级管理层 90 grade Senior management 80 级 80 grade 70 级 管理层 专家 70 grade Management experts 60 级 60 grade 50 级 50 grade 40 级 主管层 专业人士 40 grade Supervisor professionals 30 级 30 grade 20 级 基层管理人员 技工 文员 20 grade Junior management technicians and staffs 10 级 普通员工 10 grade Normal Worker 4 2工作时间 Working time 标准工作时间 即每天工作 8 小时 每周工作 40 小时 如下 The standard working time 8 hours per day and 40 hours per week is as follows 星期一至星期五作息时间 8 Work and rest time from Monday to Friday 直接生产人员 早班 上午 8 00 12 00 下午 13 30 17 30 Morning 8 00 12 00 具体则按公司发布的时间执行 In case of special circumstances the company will make special arrangement based on actual demand and the details of which shall be implemented according to the timetable issued by the company 公司对某些特定岗位实行不定时工作制 经劳动部门批准且受限于中华人民共和国适用法律法规的规定 该等员工的工作时间安排可不同于上述标准工作时间 The company will implement flexible working hour system on certain special positions as approved by the labor department and the applicable law and regulation of the People s Republic of China the working hours arrangement of such employees may differ from the foresaid standard working hours 4 3 合同期及试用期 Contract period and probation period 员工在上班的第一天办妥一切报到手续后 由人力资源部门代表公司与其签订劳动合同 除非法律 另有规定 所有的合同均为固定期限合同 合同期限一般为 3 年 也可以由公司和员工自行约定其 他期限 After employees settle all the report to duty procedures on the first day of working the human resource department will sign labor contract with them on behalf of the company Unless otherwise regulated by law all the contracts shall be fixed term contracts The period of contract is normally 3 years or other periods agreed between the company and the employees 劳动合同到期时 经公司和员工协商一致 可续签合同 When labor contracts expires it may be renewed after the company and employees reach an agreement through negotiation 任何首次受雇于公司的员工都应在其劳动合同期限开始之日起的不超过 3 个月期间为试用期 直接 工人试用期可为 2 个月 试用期结束后 除非公司认为员工不符合录用条件 员工将继续为公司工 作 Any employee employed by the company shall have a probation period no more than 3 months after the beginning date of his her labor contract Direct labor probation period can be 2 months After the probation period expires unless the company believes that the employee doesn t meet the recruitment condition the employee will continue to work for the company 公司在试用期内或结束之时可对员工的工作表现进行评估 员工不符合录用条件的情况包括但不限 于 During or after the probation period the company may evaluate the work performance of employees The circumstances that employees don t meet recruitment conditions include but not limited to 9 员工提供或要求第三方为其提供虚假的个人信息或文件或与雇佣有关其他信息或文件 Employees provide or require any third party to provide false personal information or document or other information or document relating to employment 员工未能通过公司所指定的医院的健康体检 Employees fail to pass the health examination at the hospital designated by the company 员工对其前雇主负有未了结的债务 且公司认为该等债务可能会对员工在公司的工作带来不利 的影响 Employees have unsettled debt with former employer and the company believes that such debt will bring negative influence to the employees work in the company 员工对其前雇主负有竞业限制义务 Employees have competitive restriction obligation to their former employers 员工不能胜任公司的工作任务 Employees are not capable of work tasks in the company 员工未能通过公司的工作表现评估 Employees fail to pass the work performance assessment in the company 员工的身体条件不符合其工作岗位的岗位要求 例如特殊岗位的要求 Employees physical conditions don t meet the position requirements of their work positions such as requirements for special positions 4 4 培训 升职和调动 Training promotion and transfer 根据员工的能力和工作表现 公司将自行决定向适合的员工提供平等的培训及升职机会 公司有权 要求接受公司出资的专项或专业技术培训的员工与公司签订一份服务期协议 Based on the ability and work performance of employees the company will decide at its discretion to provide proper employees with the equal training and promoting opportunities The company will be entitled to signing a service period agreement with the employees accepting the specific or professional training paid by the company 根据业务需要 公司可将员工调往 XX 的其他岗位或其他关联公司工作 Based on business demand the company may transfer employees to other positions or other affiliated companies of Lightning 如果员工希望调动工作 应向其直接主管提出书面申请 直接主管将协同人力资源部共同考虑员工 的申请 如果公司认为员工所申请的调动不具有可行性 则该等申请将不会被批准 其直接主管或 人力资源部应尽量在合理的时间内将此结果告知员工 If employees wish to transfer work they shall submit written application to their direct director who will assist the human resource department in considering the employees applications If the company believes that the transfer applied by employees are is not feasible then such applications won t be approved their direct directors or human resource department shall inform such employees about the result in reasonably short period 4 5 劳动关系的终止和解除 Termination and cancellation of labor relation 10 4 5 1有下列情形之一的 在中国法律允许的情况下 公司可立即单方解除劳动合同 For any of the following circumstances the company may unilaterally cancel the labor contract allowed by Chinese law 员工在试用期内被证明不符合录用条件 包括但不限于本手册第 4 3 部分所列的条件 Employees are proven to be not meeting the recruitment conditions during probation period including but not limited to the conditions listed in article 4 3 of this manual 员工严重违反了公司的规章制度 包括但不限于本手册 该等行为的实例如下所列 但下述 实例并非意在穷尽所有的可能 Employees have seriously violated the company s regulations and systems including but not limited to this manual Such behaviors have examples are listed as followed but which examples are not exhausting all the possibilities 偷窃公司或其他员工的产品 财物 如金钱 产品 原材料 工具等 Steel product property such as money product raw material tool etc of the company or other employees 欺诈行为 包括但不限于 Fraudulent conduct including but not limited to 欺骗公司和 或同事 伪造文件或记录 如申请病假的医院证明 身份证 学历及 专业资格证明及其他个人信息 Cheat on the company and or colleagues by forging documents or records such as hospital certificate for applying sick leave ID certificate diploma professional qualification certificate and other individual information 贪污公司财物 如利用假发票 Embezzling of company property such as using fake invoice 伪造数据 报表或材料 如假销售纪录 假签名等 或 Forge data statement or material such as false sales record false signature or 未经允许私取公司财产 礼品及礼券等 Take company property gift or gift certificate without permission 在非吸烟区吸烟 可能或已经导致危险后果或污染产品 材料 Smoke in non smoking area which may or already cause dangerous consequence or contaminate products materials 故意破坏公司或其他员工财产 Purposefully damage the properties of the company or other employees 在公司内外无理取闹 聚众闹事 打架斗殴 影响办公室秩序 工作秩序和社会秩序 Make trouble out of nothing gather a crowd and make disturbances have group fighting affect office order work order and social order inside or outside the company 口头或书面 直接或间接威胁 骚扰 辱骂其他同事或对其他同事进行人身攻击 或以任 11 何形式干扰他人工作 Directly or indirectly threat harass or insult other colleagues in oral or written form or make personal attack on other colleagues or disturb the others work in any form 向非意图接收信息的第三人泄漏公司的业务 策略 销售量等机密信息 Disclose the company s operation strategy sales volume and other confidential information to any third party without intention to receive information 发表有损公司 产品或雇员形象的言论 或做出有损公司形象的其他行为 Express any speech that damage the image of the company products or employees or make other conduct that damage the company s image 违反公司相关规定 接受任何与公司有业务关系的机构 含潜在客户 或人士之礼品或金 钱及其它任何形式的个人资助 Violate the concerned regulation by accepting gift money and any other form of personal gain from any institution including potential customer or individuals having business relation with the company 违反公司的相关规定 定义及链接见本手册第 4 8 部分 包括但不限于 Violate the concerned regulation for definition and links please refer to article 4 8 of this manual including but not limited to 单独或与其他公司或个人一起从事贿赂或其他腐败的行为 或 Independently or collide with other company or individual to engage in bribery or other corruption activities or 未经公司事先批准 为其他实体或个人工作 Work for other entity or individual without permission from the company in advance 违反公司制度和程序 定义及链接见本手册第 4 9 部分 包括但不限于纪律规范 的任 何规定 Violate the concerned system and procedure in the company for definition and links please refer to article 4 9 of this manual including but not limited to any regulation in the discipline code 受到公司顾客或客户的投诉 且使得公司遭受经济上和声誉上的损失 Receive complaint from company customer or client and cause the company to subject to economic or reputational loss 违反公司相关 保密协议 如适用 Violate the concerned Confidentiality Agreement of the company if applicable 未经许可或超越授权范围以公司的名义对外签署文件或使用公司印鉴 Sign contract or use company seal in name of the company without permission or beyond the scope of authorization 未向公司事先披露并取得公司的书面许可 参与实施任何与公司的利益相冲突或可能会冲 突的行为 在下列情况下 员工的个人利益与公司的利益相冲突 或可能冲突 或可被理 解为相冲突 12 Engage in any behavior that may conflict with the company interest or may cause conflict without disclosing to the company and obtain written permission from the company in advance Under the following circumstances the employees personal interest and the company s interest have conflict or may have conflict or can be interpreted as having conflict 与其他实体或个人建立雇佣关系或事实雇佣关系 Establish employment relation or substantial employment relation with other entity or individual 向公司的竞争对手 由公司认定 提供服务或以其他方式提供协助 Provide competitor of the company determined by the company with service or provide assistance in other form 违反公司经营原则 未向公司申报并获批准 向任何实体 包括公司的潜在客户 或个人赠送或收受该等实体或个人赠送的礼品 现金或任何其他的有价物品或好 处 Violate the general operation principle by giving or accepting any gift cash or any other valuable item or gain to or from any entity including potential customer of the company or individual or 直接或间接从与公司进行交易的实体或个人处享有个人利益 Directly or indirectly have personal interest from any entity or individual that having transaction with the company 违反任何法律法规并因此而承担刑事 行政或民事责任 Violate any law and regulation and assume criminal administrative or civil responsibility as a consequence 任何其他经公司认定损害公司利益的的行为 Any other behavior recognized by the company as harming the company s interest 员工严重失职 营私舞弊 给公司造成重大损失的 Employees have severe negligence or malpractice and cause serious loss to the company 重大损失 不仅包括超过人民币 5 000 元的经济损失 也包括其他无法以经济价值衡量的损 失 如对公司形象或声誉的损害 Serious loss includes not only the economic loss over RMB 5 000 but also other loss that can t be measured by economic value such as damage to company image or reputation 相关法律法规所规定的公司可立即单方解除劳动合同的其他情形 Other circumstances regulated by the concerned law and regulation that the company may unilaterally cancel the labor contract 4 5 2有下列情形之一的 公司提前三十日以书面形式通知员工或者额外支付员工一个月工资后 可单 方解除劳动合同 For any of the following circumstances the company may unilaterally cancel the labor contract by noticing the employees in writing form thirty days in advance or pay the employees one moth of pay 员工患病或者非因工负伤 在规定的医疗期满后不能从事原工作 也不能从事由公司另行安 13 排的工作的 Due to sickness or non work related injury after the regulated medical treatment period expires if employee is unable to engage in the original work and unable to engage other work arranged by the company 员工不能胜任工作 经过培训或者调整工作岗位 仍不能胜任工作的 是否不能胜任可根据 工作绩效评估的结论或其他结果加以决定 Employees are not capable of work tasks and still unable to work after training or adjustment of work position whether capable of working shall be determined based on the work performance assessment conclusion or other results 劳动合同订立时所依据的客观情况发生重大变化 致使劳动合同无法履行 经公司与员工协 商 未能就变更劳动合同内容达成协议的 如发生并购 撤资或公司迁址 The objective reality based on which the labor contract is formed has material change which makes the original labor contract unable to be fulfilled an
