请假与休假管理规定 8 / 8Management Provision about leave and vacation目的 Purpose将本公司有关请假与休假规定事项予以制度化、标准化;This documents target is to institutionalize and standardize the companys provisions about leaves and vacation.1. 适用范围 Applicable scope本规定适用于公司全体在职员工的请假、休假管理;This provision applies to leaves and vacation management of all staff in-service.2. 职责 Responsibilities3.1 人力资源部负责本办法的制定、修改、废止的起草工作;HR Dept. is responsible for drafting the provisions formulation, modification and abolition;3.2 总经理(或其代理人)负责本办法的制定、修改、废止的批准工作;CEO (or his agent ) is responsible for approving the provisions formulation, modification and abolition;3.3 人力资源部为本规定的管理部门;HR Dept. is the management department of this provision;3.5 除非公司另有规定,由财务部兼管人力资源部工作;Unless otherwise specified, finance dept. shall also bear job responsibility of HR dept.3. 管理规定 Management provisions4.1 休假/请假类别 Category of Vacation/Leaves休假/请假分为法定节假日、法定带薪休假、病假、工伤假、婚假、孕检假、产假、哺乳假及护理假、丧假、事假、总经理关怀假等几类; The vacation/leaves are classified as follows: statutory holidays, statutory paid vacation, statutory sick leaves, work related injury leaves, marriage leaves, pregnancy-test leaves, maternity Leaves, nursing Leaves, paternity Leaves, bereavement leaves, private affair leaves and caring day from CEO;4.2 各类休假管理;All kinds of vacation management4.2.1 法定节假日 Statutory Holidays全体员工每年享受以下带薪法定休假日: staff enjoys the following statutory holidays:元旦New Years day1天1 Day国际劳动节Labor Day1天1 Day春节Spring Festival3天3 Days端午节Dragon-Boat Festival1天1 Day清明节 Tomb-sweeping Day1天1 Day国庆节National Day3天3 Days中秋节 Mid-Autumn Festival1天1 Day妇女节 Womens Day0.5天0.5 Day4.2.2带薪年假 Annual Leaves4.2.2.1 员工每年可以享受的休假天数(N),依据员工的累积工作年限来计算。具体如下:Employees are entitled annual leaves (N) as follows which is calculated according to staffs accumulated work experience: 累计工作年限不满十年,可享有每年5个工作日;For people who work less than 10 years, he/she is entitled 5 working days as annual leaves each year; 累计工作年限满十年不满二十年,可享有每年10个工作日;For people who work over 10 year however less than 20 years, he/she is entitled 10 working days as annual leaves each year; 累计工作年限满二十年以上,可享有每年15个工作日。For people who work over 20 years , he/she is entitled 15 working days as annual leaves.4.2.2.2 年假享有资格: Eligibility for annual leaves: 新员工的年假将按其雇佣合同开始之日作为起算点,但须在试用期满后才开始使用。新员工累计工作年限不满一年,在奥特发公司工作每满一个月,可享有N/12个工作日年假New Employees can take their annual leaves accrued from hire date but only after the probation. If new employees work experience are less than one year, he/she is entitled N/12 working day as annual leave based on the months he/she works for ASWX. 经部门负责人批准,在奥特发服务满一年的员工可申请预支年假,但当年预支上限不得超过3个工作日。当年预支的年假在次年冲减。如果员工离职,预支的年假将从工资中按当年日工资扣除。Employees who worked for ASWX over 1 year can apply the next years annual leaves in advance however no exceeding 3 working days. The annual leaves that were used in advance will be written down in the following year. If employees left company, the annual leaves that were used in advance will be deducted relevant daily salary from the payroll in the leaving month. 年假的使用应首先服从部门和公司的安排。The application of annual leaves shall be approved, subject to department and company arrangements.4.2.3 病假 Statutory Sick Leaves4.2.3.1 员工申请病假依本人意愿可优先使用抵冲年假及调休。员工必须提供公司认可的或指定的正规医疗机构(市二级以上医院)以上出据的病历卡和病假证明。 Employees who apply for statutory sick leaves can offset annual leaves and compensation leaves based on personal willingness. Employees shall provide relevant sickness certificate issued by company designated hospital (Band 1 or above). 4.2.3.2 病假期间的工作按国家相关法律法规处理。 The task during the sick leaves will be handled in accordance with relevant laws and regulations.4.2.3.3 病假工资根据员工累计工作年限按以下标准计算:The salary during this period will be calculated as per accumulated working years:4.2.3.3.1 员工因疾病或非因工负伤连续休假3个月或3个月以内的:If the Employee is on leave due to illness or non-work related injury in three consecutive months or less:条件Working Years*待遇标准Salary during Sick Leaves*2年以内 within two year本人工资60%60% of the personal salary24年以内 Two to four years本人工资70%70% of the personal salary46年以内Four to six years 本人工资80%80% of the personal salary68年以内Six to eight years本人工资90% 90% of the personal salary8年以上Above eight years本人工资100% 100% of the personal salary*累计工作年限:指员工在ASWX及其他单位工龄的总和。*Working Years: accumulated working years at ASWX and other companies*本人工资 = 标准工资的70%*personal salary = 70% standard salary4.2.3.3.2 员工因疾病或非因工负伤连续休假超过3个月不超过9个月的:If the Employee is on leave due to illness or non-work related injury more than three consecutive months but not more than nine consecutive months:条件Working Years*待遇标准Salary during Sick Leaves*1年以内 within one year本人工资40%40% of the personal salary13年以内 one to three years本人工资50%50% of the personal salary3年以上more than three years 本人工资60%60% of the personal salary*累计工作年限:指员工在ASWX及其他单位工龄的总和。*Working Years: accumulated working years at ASWX and other companies*本人工资 = 标准工资的70%*personal salary = 70% standard salary4.2.3.3.3 员工因疾病或非因工负伤连续休假超过9个月不超过12个月的:If the Employee is on leave due to illness or non-work related injury more than nine consecutive months but not more than twelve consecutive months:条件Working Years*待遇标准Salary during Sick Leaves*1年以内 within one year本人工资30%30% of the personal salary13年以内 one to three years本人工资40%40% of the personal salary3年以上more than three years 本人工资50%50% of the personal salary*累计工作年限:指员工在ASWX及其他单位工龄的总和。*Working Years: accumulated working years at ASWX and other companies*本人工资 = 标准工资的70%*personal salary = 70% standard salary4.2.3.3.4 员工因疾病或非因工负伤连续休假超过12个月的:无锡最低工资的80%。If the Employee is on leave due to illness or non-work related injury more than twelve consecutive months: 80% of the minimum wage in Wuxi.4.2.3.3.5 病假工资不得低于法律、法规规定的最低标准(现行:无锡市最低工资的80%)。The salary during the sick leaves should not be less than the minimum legal standards (now: 80% of the minimum wage in Wuxi).4.2.3.3.6 公司按法律规定解除劳动合同的权利不受以上条款影响。The company has independent of the upper clause the right to terminate the contract according to the law.4.2.3.4 如存在欺诈申请,公司有权利立即解除与该员工的劳动合同而不给予任何经济补偿。If theres any fraud application, the company has the right to terminate the labor contract immediately without giving any financial compensation.4.2.4 婚假 Marriage Leaves按国家相关规定,员工达到相关法定结婚年龄,可享受3个工作日的婚假。符合晚婚条件的员工(男:25周岁,女:23周岁),享有10个工作日的带薪婚假。员工试用期后方可申请婚假并需要提供结婚证明,且应在结婚证颁发的一年内休完。 Employees who reached legal age for marriage are entitled 3 working days as marriage leaves. Employees who reached age for late marriage (men: 25 years old, women: 23 years old) are entitled 10 working days as marriage leaves. Marriage leaves can be taken within 1 year starting from the date of the marriage certificate was issued. Employees can only apply marriage leaves after the probation period.4.2.5孕检假、产假、哺乳假 及护理假Pregnancy-test leaves, Maternity Leaves, Nursing Leaves and Paternity Leaves4.2.5.1 孕检假: 女性员工,合法结婚并已领取当地计划生育委员会出具的准生证后,可享受孕检假,具体如下所示:Maternity: Female employees who are legally married can enjoy the following maternity after getting Zhunshengzheng issued by local family planning committee:怀孕期 Pregnancy Period孕检频率 Frequency of Pregnancy Test 可享受的孕检假Attainable Pregnancy-test leaves不满 5个月 less than five months-不享受 None满5个月但不满 7个月 over five months but less than seven months每月1 次 once per month0.5天 Half a day满7个月但不满 9个月 over seven months but less than nine months每2 周1 次 once per two weeks0.5天 Half a day满9个月 over nine months每周1 次 once per week0.5天 Half a day4.2.5.2 员工必须至少提前一个工作日申请孕检假;The employees must apply pregnancy-test leaves at least one workday in advance.4.2.5.3 符合计划生育的女员工,按有关规定享有国家生育保险,及3个月(包括产假期间所可能跨及的节假日)的带薪产假。难产的,增加产假15天。多胞胎生育的,每多生育一个,增加产假15天,晚育增加30天等。如当地另有规定的,按当地规定执行。 Female employees are entitled 3 calendar months (including all weekends and public holidays) maternity leaves in accordance with relevant state policy and regulations. If she got dystocia, the employee will have additional 15 days maternity leave. If she had multiple births, the employee will have additional 15 days maternity leave for each additional birth. If she was in late birth, the employee will have additional 30 days maternity leave. If theres a special requirement from local authority, please process accordingly.4.2.5.4 有不满一周岁婴儿的女职工,公司在其正常劳动时间内给予每天两次哺乳(含人工喂养)时间,每次30分钟。多胞胎的,每位每次均有30分钟。劳动日内的哺乳时间可以累计为整个工作日,一次性使用,但不得以现金发放给职工。 If a female employee has a baby under one year old, she is entitled 30 minutes breast-feeding time, twice a working day. For multiple babies, each baby deserves 30 minutes breast-feeding each time. The breast-feeding time in working days can be accumulated and used together but cannot be transferred to cash and paid to employees.4.2.5.5 男员工在妻子分娩期间,享有5天带薪护理假。如当地另有规定的,按当地规定执行。 Male employees are entitled 5 working days paternity leave during the period when his wife is giving birth to a baby. If theres a special requirement from local authority, please process accordingly.4.2.6 丧假 Bereavement Leaves直系亲属(配偶、父母、子女)过世,员工享有3个工作日的带薪丧假。其他旁系亲属过世,可享有1个工作日的带薪丧假。丧假在外地料理的,根据路程给予1-3天的路程假。 Employees are entitled 3 working days bereavement leaves when their direct relatives (spouse, parents, children) died and 1 working day bereavement leave when their other collateral relatives died. Employees may have 1-3 days off according to the distance if the funeral is other city.4.2.7 工伤假 Work Related Injury Leaves4.2.8.1 员工因工负伤,医生证明需要休息者算为工伤假。工伤期间的工资按国家相关法律规定处理。 Work Related Injury Leave is the leave employees take due to their work related injuries with the doctors certificate. The salary during the work related injury leaves will be calculated in accordance with relevant laws and regulations.4.2.8.2 员工发生工伤遵医嘱休工105天(含)以上的,当年不享有年终奖,特殊情况例外;遵医嘱休工休工105天(不含)以下的,根据公司相关政策和绩效评估结果决定是否享有年终奖。 Employees who were work related injured take 105 days (inclusive) leaves as per doctors suggestions, are not entitled with the annual bonus, except for special cases; who were work related injured take less than 105 days (exclusive) leaves as per doctors suggestions, will be evaluated their performance according to relevant company policies and company will decide if they will have the annual bonus or not.4.2.8 事假(无薪假) Private Affair Leaves公司不鼓励员工请事假。员工如需请事假,必须按照请假流程进行申请并经上级批准。使用事假宜先使用冲抵年假和调休。事假期间,公司不支付工资。事假未经批准,擅离岗者作旷工处理。 Employees apply for private affair leaves and obtain approvals in accordance with relevant company policies and procedures. Employees shall offset annual leaves or compensation leaves for private affair leaves. Private affair leaves are not paid. People who do not get approval and leaves will be considered absenteeism. 4.3 请假审批程序Leave Application and Approval procedures 4.3.1 所有请假必须填写休假申请单,注明请假种类、日期和时间,并务必按照下表讲述的审批权限向相应级别的上级提前申请,经批准后并报人力资源部签字备案后方可执行。未事先申请,或未获得部门经理批准,或未向人力资源部备案者,其缺勤事实将作同等时间旷工处理。 Each leave application shall be supported by leave Application Form which is clearly notifying type of leaves, dates, duration, and is signed approval according to the below form. All leave application shall be applied in advance with relevant approval and filing in HR Dept. Only approved leave applications are valid. Those leaves that are not applied in advance or get approved or filing in HR Dept. will be considered absence.4.3.2 员工休假或调休后须如期回到岗位工作,若因故无法如期回到岗位,则必须以书面形式(包括邮件、Email、传真或手机短信)申请延期,经批准后方为有效,否则延期要求将被视作未曾提出或提出无效。未经有效批准的缺勤将以旷工处理。 Employees shall report to work on time after the leaves. People who are not able to go back work as scheduled shall apply for leave extension in written forms (incl. mails, emails, fax, or messages) and get relevant approval. Only approved extension is valid. No application for the extension or no approval for the extension will be considered no valid and an absence.4.4 审批Approval:4.4.1 审批权限Authorized approval levels:请假天数Number of leave days批准人Approval Level备案Filing部门经理Dept. Manager总经理CEO人力资源部HR Dept.1-2个工作日以内(含2日) 1-2 Working days3-5个工作日以内(含5日) 3-5 Working days5个工作日以上Over 5 Working days*请假的最小单位为半天Employees can apply half day leave the least.*部门经理可指定代表在其不在时代为行使审批权限。Department Manager can appoint representative for his absence.4.4.2 员工
