(Hereinafter referred to as “The company”) to ensure ongoing compliance between inspections. Minimum Age (Regulation 1.1)最低年龄 （规则1.1） 1.1 The company will only recruit seafarers, including petty seafarers，who are above the age of 18. 公司仅招募年龄在18周岁及以上的海员，包括实习生。1.2 To ensure compliance, the company will verify the seafarers age prior to joining the ship by inspecting their seaman books or identifications, and keep a latest crew list.为确保符合年龄要求，公司将在海员上船前检查他们的海员证或身份证件以验证年龄，并保持最新船员名单。2. Medical Certification (Regulation 1.2)体检证书 （规则1.2）2.1 Every seafarer employed on board the ship will be in possession of a valid medical fitness certificate attesting that he is medically fit to perform the duties he is to carry out.受雇于公司船舶的每个海员均持有一份有效的健康证书，以证明其身体状况适于履行赋予的职责。2.2 The nature of medical examination and certificate will comply with the standards of medical fitness for seafarers in accordance with the STCW Convention 1978, as amended from time to time.体检和证书符合修订的1978 年STCW 公约制定的对海员健康标准的规定。2.3 Prior to working on the ship, every seafarer will hold a valid medical certificate issued by a duly qualified medical practitioner licensed at the place of examination and/or recognized by the competent authority at the place of examination, attesting that the seafarer is medically fit to perform the duties that they are to carry out at sea 每位海员在上船前均应持有由具有正规资质的持证医生或检查地相关主管机关认可的从业人员签发的有效的体检证书，以证明该海员身体健康适合其将在海上履行的职责。2.4 The Seafarers have the rights to have a further examination as stipulated in Standard A1.2.5 of the Convention. A seafarer that has been refused a certificate may also apply to the competent authority for a medical review.海员有权根据本公约标准A1.2.5 中的规定要求进行进一步检查。遭到拒绝发证的海员同样可以向监管机构申请健康复查。2.5 Each medical fitness certificate states in particular that the scopes of health conditions of the seafarer as stipulated in Standard A1.2.6 of the Convention. Its contents are in both Chinese and English.每份体检证书均已说明公约标准A1.2.6 规定的海员健康状况范围。2.6 All medical certificates issued by a competent person recognized by the CHINA MSA should be written in Chinese with English translation. Valid period of medical certificates is not longer than 2 years. 所有体检证书通过中国海事局认可资质的人员以中文签发，其内容包括英文译本，体检证书有效期最长两年。2.7 Prior to joining the ship, the Crew Personnel Director will check and confirm medical fitness certificate for concerned seafarer, to ensure its compliance with the STCW Convention 1978, as amended船员上船前，船员人事主管检查确认船员体检证书，以确保符合修订的STCW78公约的要求。2.8 The seafarer should carry medical certificate with him and hand over the certificate to the master or authorized person on the date of joining the ship. The master or authorized person shall check the annotation and expiry date of the certificate, and register the expiry date onto a log and send a copy to Crew Personnel Director. 体检证书由船员本人随身携带上船，上船后立即交给船长或其指定的人员保管，船长或其指定的人员须审核船员的体检证书内的签发批注及有效期，并将本船船员的体检证书有效期汇总造册，同时抄送船员人事主管。2.9 If the master suspects the authenticity of the certificate or the qualification of medical institute， the master should inform the Crew Personnel Director to carry out investigation immediately, the Crew Personnel Director should inform the result to the master without delay.如船长对船员体检证书或签发机构资质存疑时，应立即通知船员人事主管进行查询，船员人事主管应将结果及时通知船长。2.10 The master, or authorized person, shall check the expiry date of the medical certificate every month. If the period of validity of a medical certificate is approaching, the master shall contact the local agent to arrange the seafarers to conduct medical examination at a qualified medical institute without delay, and report to the Crew Personnel Director accordingly.船长或其指定的人员须每月对本船船员的体检证书的有效期进行检查，对即将到期船员,应及时与港口代理联系安排船员到合格医疗卫生机构进行体检并上报船员人事主管。2.11 In normal practices, the company will not allow a seafarer to work on the ship with a medical certificate that has expired.正常情况下，公司不允许在船工作的海员的体检证书过期。 2.12 In urgent cases, a seafarer without a valid medical fitness certificate is urgently needed to work on the ship, the company will apply to MSA to allow the seafarer to work without a valid medical fitness certificate until the next port of call where the seafarer can obtain a medical fitness certificate from a qualified medical practitioner, but not exceeding the period of 3 months and the seafarer concerned is in possession of an expired medical fitness certificate of recent date. Those urgent cases include:在紧急情况下，需要未持有有效体检证书的海员在船工作时，公司将向中国MSA 申请允许该海员工作至可以从合格的医师那里取得一份体检证书的下一停靠港，但时限不超过3个月，且该海员持有最近过期的体检证。这些紧急情况包括：2.12.1 A medical fitness certificate expires in the course of a voyage, 在航行途中体检证书过期。2.12.2 There is no any possible chance or environment to arrange seafarer concerned to carry out a new medical certification examination 没有机会和条件安排相关海员进行新的体检。 2.12.3 There is no anther available seafarer with adequate periods of medical certificate to fit the position onboard 船上持合格体检证书的船员没有人能替代该海员位置。 2.12.4 The position must be fitted to ensure the ship seaworthiness before departure 该海员的职务涉及船舶适航问题。 2.12.5 A new medical certificate shall be obtained at the next port of call from a qualified medical practitioner licensed or recognized by the competent authority。新的体检证书必须在下一港口才能够从具有正规资质或经主管当局认可的医生处获得。3. Qualifications of Seafarers (Regulation 1.3)海员资格 (规则 1.3）3.1 The seafarers will not work on board the ship unless they are certified as competent to perform their duties as required by the STCW Convention, as amended from time to time.除非海员证明根据经修订的STCW 公约的要求适任于履行其职责，否则不得在船舶上工作。3.2 The seafarers will not be permitted to work on board the ship unless they have successfully completed the trainings required by the Section A-VI/1 of the Code of the STCW Convention, as amended from time to time.除非海员已经成功完成了经修订的STCW 公约规则第A-VI/1 节要求的培训，否则不得准许其在船舶上工作。3.3 The company ensures that seafarers employed are qualified to meet the requirements of PRC and international regulations.公司确保雇佣的海员资格满足中国政府和国际规定的要求。3.4. The Crew Personnel Director is responsible for establishing the certificate archives for every seafarer, and applying, updating, reapplying for seafarers certificates, as well as registering and inputting the information into Crew management system. 船员人事主管负责为每个船员建立证件档案，负责办理船员证书的申办、更换、补办及证书获取后的建档和证书信息的输入。3.5 The Crew Personnel Director will review the seafarers certificates prior to joining the ship, to ensure the certificates and visas are compliance with the requirements of their duties, as well as the requirements of the Flag State and destined port authority.船员人事主管负责对即将安排上船船员的证书审核，确保所派船员的证书及签证与船舶岗位、船旗国及驶往港口国要求相符一致。 3.6 The master is responsible for verifying、maintaining seafarers certificates and the records of seafarers identity document. The master shall notify the Crew Personnel Director to renew the seafarers certificate 2 months before the expiry of the certificate.船长负责对本船船员的证书验收、保管和船员服务簿的记载。在船员证书到期前二个月通知船员人事主管进行办理。4. Seafarers Employment Agreements (Regulation 2.1)船员就业协议 （规则 2.1）4.1 The terms and conditions for employment of a seafarer will be set out or referred to in a clear written legally enforceable agreement and are consistent with the standards set out in the Code. 船员就业条款和条件在一项明确的法律上可执行的书面协议中加以规定或提及并与守则中规定的标准一致。4.2 All seafarers employed for working on board the ship will have a crew agreement signed by both the seafarer and the company or a representative of the company providing them with decent working and living conditions on board the ship as required by the Convention.受雇工作于船舶上的所有船员持有一份由船员和公司或公司的代表双方签署的船员就业协议，为其提供公约所要求的体面的船上工作和生活条件。4.3 The company will provide seafarers signing a crew agreement an opportunity to examine and seek advice on the agreement before signing, as well as such other facilities as are necessary to ensure that they have freely entered into an agreement with a sufficient understanding of their rights and responsibilities.签署船员就业协议前公司向船员提供对协议进行审查和征询意见的机会，还为船员提供其它必要的便利确保其在充分理解了其权利和义务后自由达成协议。4.4 The company and seafarer concerned with the agreement will each have a signed original of the crew agreement.公司和相关船员各持有一份经签字的船员就业协议的原件。4.5 The company provides seafarers, including the ships master, clear information to the conditions of seafarers employment, and such information, including a copy of the crew agreement will beprovided or available for authorized officers for review, including those authorities in ports to be visited.公司向包括船长在内的船员提供关于船员就业条件的明确信息，并且这些信息，包括一份船员就业协议的副本，还应能够供主管当局的官员，包括船舶所挂靠港口的官员查验。4.6 The company will provide each seafarer a seafarers identity document containing a record of their employment on board the ship. The document contains sufficient information, with a translation in English, to facilitate the acquisition of further work or to satisfy the sea-service requirements for upgrading or promotion.公司提供给船员一份载有其船上就业记录的船员服务簿。该文件包含足够的信息并有英译文，以便于未来就业或满足升级或升迁所需的海上资历要求。4.7 The seafarer s identity document will not contain any statement as to the quality of the seafarers work or as to their wages. 船员服务簿不包含关于船员工作的质量和其工资的陈述。4.8 The crew agreement will contain the items required by Standard A2.1.4 of the Convention.船员就业协议包含公约标准A2.1.4 中的各项要求。4.9 The minimum notice period to be given by the seafarers and the company for the early termination of a crew agreement will not be shorter than seven days.船员和公司提前终止船员就业协议所发出预先通知的最短期限不得少于七天。4.10 The company will allow seafarers to terminate the crew agreement at shorter notice or without notice without penalty for compassionate or other urgent reason.公司允许船员出于值得同情的原因或其他紧急原因提前较短时间通知或不通知就终止就业协议，而不受惩罚。5. 使用任何有许可证的或经发证或管理的私营招募和安置服务机构（规则1.4）Use of any licensed or certified or regulated private recruitment and placement service (Regulation 1.4) 5.1 公司建立实施员工招聘考核和培训程序,公司所聘用的海员均通过直接招募方式获得。The company establishes and implements Assessment and training procedure for employee recruitment, The seafarers employed are recruited directly by the company.5.2 公司根据国家相关法规，通过保险或适当的等效措施建立保护机制，赔偿由于本公司未能履行对海员的义务、而给海员造成的经济损失。In accordance with the relevant laws and regulations of the Government, the company shall compensate the seafarers economic losses through insurance or other suitable equivalent measures when the company failed to perform its obligations to seafarers.5.3 下列费用由公司承担：中华人民共和国体检证书、海员证和护照及其他类似的旅行证件、海员适任证书。The following costs shall be borne by seafarers：medical certificate of P.R.C, seafarers book and passport or other similar personal travel documents、national seafarers competency certificates for designated position on board.6. Hours of work or rest (Regulation 2.3)工作或休息时间 （规则 2.3）6.1 The company is implementing the normal working hours standard for seafarers on the basis of an eight-hour day with 2 days of rest per week and rest on public holidays.公司实施正常的海员工作时间标准，以每天工作8小时、每周休息2天和公共节假日休息为依据。6.2 The company will provide every position of seafarers on board the ship with the minimum number of hours of rest which shall not be less than : 公司为船舶上的每个船员提供的最短休息时间不少于：(a) ten hours in any 24-hour period; and在任何24小时时段内10小时；以及(b) 77 hours in any seven-day period. 在任何7 天时间内77 小时。This minimum number of hours of rest will apply to all seafarers on board. 该最低休息时间适用于船上的所有船员。Hours of rest means time outside hours of works; this term does not include short breaks. 休息时间指的是工作时间以外的时间，不包括短暂的休息。6.3 The hours of rest may be divided into no more than two periods, one of which shall be at least six hours in length, and the interval between consecutive periods of rest shall not exceed 14 hours.休息时间最多可将分为两段，其中一段至少要有6小时，且相连的两段休息时间的间隔不得超过14 小时5.4 The emergency drills will be arranged in a manner that minimizes the disturbance of rest periods and does not induce fatigue. The seafarers will be given adequate compensatory rest period if normal period of rest is disturbed by call-outs to work. The seafarers concerned will be given sufficient rest.应急演习船须以对休息时间的影响最小和不会造成疲劳的方式安排。如果船员因被招去工作而打扰了正常的休息时间，则给予充分的补休。相关船员给予充足的休息时间。6.5 A table for the shipboard working arrangement will be posted on board. The table will cover every position and contains at least :船舶上须张贴一份船上工作安排表。该表格应至少包括每一岗位的下列内容：(a) the schedule of service at sea and service in port; and在海上和在港口的工作时间表；和(b) the minimum hours of rest. This table, in the working language of the ship and in English, will be placed in an easily accessible place.该表格应使用船上的工作语言和英文，张贴在容易接近的地点。6.6 Records of seafarers daily hours of rest, in the working language of the ship and in English as are developed in accordance with “IMO/ILO Guidelines for the Development of Tables of Seafarers Shipboard Working Arrangements and Formats of Records of Seafarers Hours of Work or Hours of Rest” as amended from time to time, are maintained to allow monitoring of compliance with provisions under the above paragraphs 6.2 to 6.5. The seafarers will be given a copy of the records pertaining to them which is endorsed by the master, or a person authorized by the master, and by the seafarers.保持使用船上的工作语言和英文，根据经修订的“IMO/ILO 船员船上工作安排表和船员工作时间或休息时间记录格式制订指南”制订船员每天的休息时间记录，以便于监督是否遵守上述6.2 到6.5 中的条款。海员得到一份由船长或船长授权人员以及船员本人签字认可的有关其本人记录的副本。6.7 The master has the right to require a seafarer to perform any hours of work necessary for the immediate safety of the ship, person on board or cargo, or for the purpose of giving assistance to other ships or persons in distress at sea. Accordingly, the master may suspend the schedule of hours of rest and require a seafarer to perform any hours of work necessary until the normal situation has been restored. As soon as practicable after the normal situation has beenrestored, any seafarers who have performed work in a scheduled rest period shall be provided with an adequate period of rest by the master.船长有权出于船舶、船上人员或货物的紧急安全需要，或出于帮助海上遇险的其它船舶或人员的目的而要求船员在任何时间进行工作。为此，船长可中止休息时间安排，要求船员在任何时间从事必要工作，直至情况恢复正常。一旦情况恢复正常，船长应尽快地确保所有在计划安排的休息时间内从事工作的船员获得充足的休息时间7. Manning levels for the ship (Regulation 2.7)船舶配员水平（规则 2.7）7.1 The company will ensure that the ship is manned by seafarers that is adequate, in terms of size and qualifications, to ensure the safety and security of the ship and its personnel, under all operating conditions, in accordance with the minimum safe manning certificate (MSM Certificate) issued by China MSA.公司将保证船舶根据MSA 签发的最低安全配员证书（MSM 证书），从数量和资格角度配备充足的船员，确保在各种操作情况下船舶及其人员的安全和保安。7.2 A sufficient number of seafarers will be employed on board by the company to ensure that the ship is operated safely, efficiently and with due regard to safety, protection of the marine environment and security under all conditions taking into account about seafarer fatigue and the particular nature and conditions of the voyage公司雇佣足够的船员上船工作，以确保船舶营运安全高效、促进海洋环境保护和各种情况下的保安以及对船员的疲劳程度和航次特殊要求的考虑。7.3 The master and officers shall evaluate the fatigue of seafarers regularly, where fatigue exists, the master shall report to the company, and take corrective actions immediately.船长和高级船员应经常评估船员的疲劳状况,如发现问题，应向公司报告，并及时纠正。8. Accommodation (Regulation 3.1)起居舱室（规则 3.1）8.1 The ship constructed before the Convention came into effect, is compliance with the requirements of Regulation 2008 and got the accommodation certificate.本船建造于公约生效之前，符合2008法规要求，取得舱室证明。8.2.The seafarers accommodation has been checked for compliance with the related requirements of the Maritime Labour Convention, 2006 for exiting vessel.船员起居舱室经检查符合2006年海事劳工公约中有关现有船舶的要求。8.3The seafarers accommodation includes sleeping room, office, toilet, mess room, galley, conference room, hospital accommodation, recreation room, smoking room, washhouse, drying room, dressing room and other public living spaces.船员起居舱室包括卧室、办公室、盥洗室、餐厅、厨房、会议室、医务室、娱乐室、吸烟室、洗衣房、烘衣间、更衣室以及其它生活区公共场所。8.4The company has taken into sufficient consideration of floor area, floor height, sound insulation, heat insulation, shock absorption, natural light and artificial light of accommodation, indoor furniture and other factors being beneficial to seafarers health and convenience, and maintain 24-hours well ventilation, comfortable temperature and humidity, adequate lighting (including emergency lighting), running cool and hot water, sanitary facilities available, and provide tidy beddings and sanitary products at no cost to the seafarers.公司已充分考虑到船员起居舱室的面积、层高、隔音、隔热、减震、自然采光和人工照明、室内家具以及其它有益于船员身心健康和生活便利的因素，并24小时不间断地保持良好的通风、舒适的室温和湿度、充足的照明（包括应急照明）、生活冷热水供应和排放、卫生设施的正常使用，免费提供清洁卧具和卫生用品。8.5.The master or authorized person is responsible for carrying out inspections of seafarers accommodation at least once a week, and enter the result into “Accommodation and Recreational Facilities Checklist at monthly intervals, to ensure the condition of seafarers accommodation is clean and decent.船员起居舱室维护管理情况由船长或其指定人员负责监督检查，每月至少检查一次，检查结果记录在起居舱室和娱乐设施检查清单，以确保船员起居舱室的干净和体面地适宜居住。8.6 For any defects found during inspection, the master shall report the defects to the company and take corrective actions immediately, the company will provide necessary technical and financial support, to ensure the defects to be rectified timely.检查中如发现缺陷，船长应及时报告公司前采取纠正措施，公司根据船舶要求提供必要的技术和物质支持，以确保缺陷得到及时整改。9.
