房屋租赁合同 (经纪机构居间成交版) 北京市房屋租赁合同Premises Lease Contract OfBeijing(经纪机构居间成交版)(broker transactionversion)出租人(甲方)证件类型及编号Lessor(Party A):ID Type&No.:承租人(乙方)证件类型及编号Lessee(Party B):ID Type&No.:依据中华人民共和国合同法及有关法律、法规的规定,甲方与乙方在在平等、自愿的基础上,就房屋租赁的有关事宜达成协议如下In aordancewith the Contract Lawof thePeoples Republicof Chinaand anyother relevantlaws,policies andregulations,Party A and Party B,and on the basisof equalityand freewill,conclude andreach theterms andconditions asfollows withrespect to the house lease-related matters:第一条房屋基本情况Clause1Basic Situationof the Premise(一)房屋坐落于,建筑面积平方米。 1.The Premise is locatedat_District(County),Beijing.Its grossarea is_square meters.(二)房屋权属状况甲方持有(?房屋所有权证/公有住房租赁合同/房屋买卖合同/其他房屋)证明文件编号或其他房屋证明名称及编号,房屋所有权人(公有住房承租人、购房人)姓名或名称,房屋(是/?否)已设定了抵。 2.Ownership of the Premise:No.of(?House OwnershipCertificate/Public HousingLeaseContract/House SaleContract/other housesource certificates)in Party As possession:_;or titleor No.of othercertificates evidencingthe housesource_;name ortitle ofhouse owner(public housinglessee,purchaser):_;the premise(has/?has not)been putunder mortgage.第二条房屋租赁情况及登记备案Clause2Lease andRegistration of the Premise(一)租赁用途.如租赁用途为居住的,居住人数为人,最多不超过人。 1.Lease Purpose:_;if forresidential purpose:the numberof personsliving in the Premise is_,or_to themaximum.(二)如租赁用途为居住的,甲方应自与乙方订立本合同之日起七日内,到房屋所在地的社区来京人员和出租房屋服务站办理房屋出租登记手续。 对多人居住的出租房屋,乙方应将居住人员情况告知甲方,甲方应当建立居住人员登记簿,并按规定报送服务站。 本合同变更或者终止的,甲方应自合同变更或者终止之日起五日内,到房屋所在地的社区来京人员和出租房屋服务站办理登记变更、注销手续。 在本合同有效期内,居住人员发生变更的,乙方应当自变更之日起二日内告知服务站,办理变更登记手续。 2.If the Premise isrent forresidential purpose,Party A shall,within7days afterconclusion of the Contractwith Party B,handle house lease registrationformalities withthe munitymigrant workersand houselease servicestation at the Premises place.If therere morethan oneliving in the Premise,Party B shall notifyParty Aof theinformation thereof,and Party A shallset uprelated registryand furnishto thesaid servicestation.Any modificationor termination of the Contract shall,within5days thereafter,be renewedor deregisteredby Party A withthe munitymigrant workersand leasedhouse servicestation at the Premises place.Any changeto anypeople living inthe Premise withinthe validityof the Contract shallwithin2days thereafterbe reportedby Party B tosuch stationfor renewal.居住人员中有外地来京人员的,甲方应提供相关证明,督促和协助乙方到当地公安派出所办理暂住证;居住人员中有境外人员的,(?甲方/乙方)应自订立本合同之时起24小时内到当地公安派出所办理住宿登记手续。 If theres anymigrant workeramong those livinginthe Premise,Party Ashall providerelated certificate,and urgeand helpParty Bacquire temporaryresidence permitfrom the local public security bureau;if theres anyforeigner amongthoselivinginthe Premise,?Party A/Party B shall handleresidence registrationformalities withthelocalpublicsecuritybureau within24h afterthe Contractis concluded.租赁用途为非居住的,甲方应自订立房屋租赁合同之日起30日内,到房屋所在地的房屋行政管理部门办理房屋租赁合同备案手续。 If the Premiseisrent fornon-residential purpose,Party Ashall handlehouseleasecontract registrationformalities withthe houseadministrative managementauthority at the Premises placewithin30days afterthe Contractis concluded.第三条租赁期限Clause3Lease Term(一)房屋租赁期自年月日至年月日,共计年。 甲方应于年月日前将房屋按约定条件交付给乙方。 房屋交割清单(见附件一)经甲乙双方交验签字盖章并移交房门钥匙及后视为交付完成。 1.The lease term of the Premiseis_year/years and_month/months mencingon_and expiringon_.Party Ashall deliverthe Premise to Party B aording to thespecified conditionsbefore_(date).The deliveryshall befinished afterthe DeliveryList(Appendix1)has beenexamined,signed andstamped by Party A and Party B,and keys_have beenhanded over.(二)租赁期满或合同解除后,甲方有权收回房屋,乙方应按照原状返还房屋及其附属物品、设备设施。 甲乙双方应对房屋和附属物品、设备设施及水电使用等情况进行验收,结清各自应当承担的费用。 2.Upon expiryor cancellationof the Contract,Party Ahas theright totake the Premise back,and Party B shallreturn the Premise and its attachedfittings,facilities andequipment instatus quoto Party A.Party Aand Party B shallcheck the Premise andits attachedfittings,facilities andequipment,as wellwater and electricity consumptionsituations,and shouldertheir respectiveexpenses.乙方继续承租的,应提前日向甲方和乙方提出(书面/?口头)续租要求,协商一致后双方重新签订房屋租赁合同(经纪机构成交版)。 If Party B desiresto continuerent of the Premiseupon expiryof the Contract,Party Bshall submitits requestto Party Aand Party Cin writing/?orally_days in advance,and subsequentlythree partiesshall signa newhouseleasecontract(broker transactionversion)upon mutualnegotiation,and Party Ashall pay intermediationservice feeto PartyC aordingto therenewal period.第四条租金及押金Clause4Rent andDeposit(一)租金标准及支付方式元(月/季/半年/?年),租金总计人民币元整(?)。 1.The rentfor the premises shall be RMB:_Yuan/(month/quarter/half year/?year).Total Rent:¥_.支付方式(现金/转帐支票/?银行汇款),各期租金支付日期为:,.Payment Mode:(in cash/by transfercheque/?by bankdraft);第五条其他相关费用的承担方式Clause5Bearing ofOther RelatedExpenses租赁期内的下列费用中,由甲方承担,由乙方承担 (1)水费 (2)电费 (3)电话费 (4)电视收视费-歌华有线 (5)供暖费 (6)燃气费 (7)物业管理费 (8)房屋租赁税费 (9)上网费 (10)车位费 (11)室内设施维修费 (12)卫星电视收视费 (13)费用。 Among the following expensesincurred inthe leaseterm,shall beassumed byParty A,and (1) (2) (3) (4) (6) (9) (10) (12)shall beatthecost ofParty B: (1)water fee; (2)electricity fee; (3)telephone; (4)cable TVfee; (5)heating fee; (6)gas fee; (7)property management fee; (8)rent tax; (9)inter fee; (10)parking fee; (11)indoor facilitiesrepair fee; (12)satellite fee (13)fee第六条房屋维护及维修Clause6Repair andMaintenance of the Premise(一)甲方应保证出租房屋的建筑结构和设备设施符合建筑、消防、治安、卫生等方面的安全条件,不得危及人身安全;乙方保证遵守国家、北京市的法律法规规定以及房屋所在小区的物业管理规约。 1.Party Aguarantee thearchitectural structure、facilities andequipmentof thePremise areup to the safetyrequirements onconstruction,fire prevention,security andsanitation,and wouldnot harmphysical integrity;Party Bguarantee toobserve thelaws andrules of the Stateand BeijingMunicipality,as wellas theproperty managementregulations of the residentialquarter wherethePremiseis locatedat.(二)租赁期内,甲乙双方应共同保障该房屋及其附属物品、设备设施处于适用和安全的状态2.During the leaseterm,Party Aand Party Bshallmaintain thePremise andits attachedfittings,facilities andequipment inuseable andsafe condition. 1、对于该房屋及其附属物品、设备设施因自然属性或合理使用而导致的损耗,乙方应及时通知甲方修复。 甲方应在接到乙方通知后的日内进行维修。 逾期不维修的,乙方可代为维修,费用由甲方承担。 因维修房屋影响乙方使用的,应相应减少租金或延长租赁期限。 (1)Party Ashall repair or remedyany defectstherein causedby naturalattribute orreasonable usewithin_days afterbeing notifiedbyParty B,or otherwiseParty Bshall beentitled torepair or remedy thedefects atParty As cost.If thePremiseisnot tenantableduring theperiod ofrepair orremedy,the rentfor theperiod shall be deducted,or the lease periodshall beextended aordingly. 2、因乙方保管不当或不合理使用,致使该房屋及其附属物品、设备设施发生损坏或故障的,乙方应负责维修或承担赔偿责任。 (2)If theres anydefect thereinofthepremise andits attachedfittings,facilities andequipmen dueto Party Bs improperstorage,or unreasonableuse,Party Bshall beresponsible for the repairorremedyof suchdefect,or shallgive correspondingpensations.第七条转租Clause77Sublet除甲乙双方另有约定以外,乙方需事先征得甲方书面同意,方可在租赁期内将房屋部分或全部转租给他人,并就受转租人的行为向甲方承担责任。 Unless otherwisestipulated byParty Aand Party B,without Party As priorwritten consent,Party Bshall notsublet thePremise inwhole orpart to any third party duringtheleaseterm;and Party Bshallbe liableto Party A forany actor behaviorofthethirdparty.第八条合同解除Clause88Cancellation ofContract(一)经甲乙双方协商一致,可以解除本合同。 1.The Contractmay be terminated if Party AandParty B mutuallyagree toafter consultations.(二)因不可抗力导致本合同无法继续履行的,本合同自行解除。 2.The Contractshall automaticallybeterminatedif itcannot befulfilled ina continuousmanner forforce majeurereason.(三)甲方有下列情形之一的,乙方有权单方解除合同3.In any ofthe following circumstances,Party Bis entitledto terminatedthe Contractunilaterally: 1、迟延交付房屋达日的。 2、交付的房屋严重不符合合同约定或影响乙方安全、健康的。 3、不承担约定的维修义务,致使乙方无法正常使用房屋的。 4、。 (1)Party Adelays deliveryofthePremise for_day/days; (2)Party As Premisefalls shortoftherequirements stated herein oris inthe statethat mayharm Party Bs physicalintegrity andhealth; (3)Party A fails to fulfill repairand maintenance obligations asspecified herein,resulting ininability ofParty Bto usethePremiseinanormal way. (4)_.(四)乙方有下列情形之一的,甲方有权单方解除合同,收回房屋4.In any ofthefollowing circumstances,PartyAis entitledto terminatedthe Contractunilaterally andtake thePremise back: 1、不按照约定支付租金达日的。 2、欠缴各项费用达元的。 3、擅自改变房屋用途的。 4、擅自拆改变动或损坏房屋主体结构的。 5、保管不当或不合理使用导致附属物品、设备设施损坏并拒不赔偿的。 6、利用房屋从事违法活动、损害公共利益或者妨碍他人正常工作、生活的。 7、擅自将房屋转租给第三人的。 8、。 (1)Party Bdelays paymentof rentfor_day/days; (2)PartyB fails to pay duefees atspecified time,and suchfee amountsto_Yuan; (3)PartyBchanges theusage ofthePremise without approval; (4)PartyBchanges ordamages themain structureofthePremisewithoutapproval; (5)PartyB fails toproperly orreasonably usethe attachedfittings,facilities andequipment ofthePremiseand refusesto givepensations; (6)PartyBconducts illegalactivities inthePremisethat mayundertake illicitactivity、harm thepublic interests (7)PartyBsublets thePremisetoany thirdparty withoutapproval (8).(五)其他法定的合同解除情形。 5.other situationsthat maylead totermination oftheContractaordingtolaws.第九条违约责任Clause99Default Liabilities(一)甲方有第八条第三款约定的情形之一的,应按月租金的%向乙方支付违约金;乙方有第八条第四款约定的情形之一的,应按月租金的%向甲方支付违约金,甲方并可要求乙方将房屋恢复原状或赔偿相应损失。 1.Where PartyA mitsanyofthefollowingcircumstances as set forthin Clause8.3hereof,PartyA shallpay%of monthlyrent toPartyBas penalty;should PartyB mitsanyofthefollowingcircumstances asset forthin Clause8.4hereof,PartyBshallpay%of monthlyrent toPartyBas penalty,and tothis effect,PartyAmay requestPartyBto restorethePremiseto itsoriginal statueor pensateforthecorresponding loss.(二)租赁期内,甲方需提前收回该房屋的,或乙方需提前退租的,应提前日通知对方,并按月租金的%支付违约金,甲方还应退还相应的租金。 2.Where duringtheleaseterm PartyA findsit necessaryto earlytake thePremise backor PartyB intendsto earlyend theContract,anotice shallbe givento theother partydays beforedoing so,and apenalty at%of monthlyrent shallbe paid,but asfor PartyA,besides doingtheforegoing,PartyAshall furtherrefundcorresponding rent.(三)因甲方未按约定履行维修义务造成乙方人身、财产损失的,甲方应承担赔偿责任。 3.PartyAshall assumepensation responsibilityifPartyB suffersphysical injuryand/or financialloss resultedfrom PartyAs failuretofulfillrepairormaintenanceobligationsassetforth herein.(四)甲方未按约定时间交付该房屋或者乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约定时间返还房屋的,每日应按标准支付违约金。 4.Where PartyAfailsto deliverthePremiseatthespecified time,or PartyBfailstopayrent asstatedhereinbut suchfailure doesnot satisfyconditions forterminationoftheContract,or PartyBfailsto givethePremiseback toPartyAatthespecified time,penalty shallbe paidat ratefor eachday delayed.第十条合同争议的解决办法Clause10Settlement ofContract Dispute本合同项下发生的争议,由双方当事人协商解决;协商不成的,依法向有管辖权的人民法院起诉,或按照另行达成的仲裁条款或仲裁协议申请仲裁。 Any disputeor discrepancyarising fromtheContractshallbesettled byTWO partieshereto uponconsultation;if noagreement canbe reached,proceeding may be initiatedtothepeoples courtof jurisdiction,or applicationmaybemade forarbitral awardunder arbitrationrules orcovenants separatelyspecified.第十一条其他约定事项Clause11Other Provisions本租约自签字之日起生效,租约文本连同附件一式二份,双方方各执一份,中英文具有同等法律效力,当两种文本发生歧义时,以中文文本为准.The Agreementshall einto effectonthesigning date;TWO willbe TWOcounterparts ofthe contractthe attachments,and onefor eachparty.Both Chinesetext andEnglish text shallberegarded asthe same legal effect.In caseof discrepancy,the Chinesetextshallprevail.本合同生效后,各方对合同内容的变更或补充应采取书面形式,作为本合同的附件。 附件与本合同具有同等的法律效力。 Any modificationor supplementtoanycontent oftheContractupon effectivenesshereof shallbe inwriting,and shallbe appendixtotheContract.Appendices shallhave thesamelegaleffect astheContract.出租人承租人Signature ofLessor(PartyA)Signature ofLessee(PartyB)委托代理人委托代理人Authorized AgentAuthorized Agent身份证或护照号身份证或护照号ID orpassport NO.ID orpassport NOContact InformationQualification CertificateNo.签约日期:年月日Date ofexecution:附件一Appendix1房屋附属设施、设备清单List ofAttached Facilitiesand Equipment家用电器家具Household ApplianceFurniture名称品牌及规格数量名称品牌及规格数量Item Brand&Specification QuantityItem Brand&Specification Quantity电视机床TV Bed电冰箱沙发Refrigerator Sofa洗衣机餐桌Washing ahineDining Table空调茶几Air-Conditioner CoffeeTable热水器衣柜Water HeaterWardrobe微波炉床头柜Microwave OvenBed-stand DVD机电视柜DVD MachineTV Cabi电饭煲椅子Rice CookerChair吸尘器写字台Vacuum Cl
