becausestatesdidnotfeelcompelledtogranttheprivilegeexceptasacourtesy Suchcourtesycanbeseenasakindofanticipatoryreciprocityinwhichstatesdountootherstatesastheywouldhopetobetreatedinturn Comityisthusunderstoodasaninformalprinciplethatnationswillextendcertaincourtesiestoothernations particularlybyrecognizingthevalidityandeffectoftheirexecutive legislative andjudicialacts TheGermanGovernmentmaintainsthatthecontestedprohibitionofimportationisjustifiedongroundsrelatingtotheprotectionofhealthwithinthemeaningofArticle36oftheTreatybecauseitisnecessarytoensureasufficientintakeofcertainessentialnutrientscontainedinmeat especiallyproteins Itmustbepointedoutatoncethatthatargumentiscontradictedbyinformationwhichappearsinreportsonnutrition 1 21 publishedin1980and1984bytheGermanGovernmentitself aMemberStatemaynotinvokepublichealthgroundsinordertoprohibittheimportationofaproductbyarguingthatitsnutritionalvalueislowerthananotherproductalreadyavailableonthemarketinquestion sinceitisplainthatthechoiceoffoodstuffsavailableto 1 21 consumersintheCommunityissuchthatthemerefactthatanimportedproducthasalowernutritionalvaluedoesnotposearealthreattohumanhealth ItfollowsfromtheforegoingthatthecontestedprohibitionofimportationmaynotbejustifiedongroundsrelatingtotheprotectionofhealthwithinthemeaningofArticle36oftheTreaty 1 21
