The names of the parties 合同双方的名称2. The name and nationality of the ship 船舶的名称和国籍 （注释：nationaliy:国籍，国家）3. Its bale or grain capacity 船舶包装或散装的容积。 （注释：bale or grain capacity : 包装或散装容积。）4. Description of the goods to be loaded 对货物装载的描述。 （注释： description 描述，形容）5. Port of loading and discharge 装货港和卸货港的规定。6. Time for loading and discharge 装货和卸货的时间。7. Payment of freight 运费的支付。8. Demurrage 滞期货的规定 （注释：demurrage 滞期货）9. Typically example is Gencon form which is general charter parties designed to be used in trades where no specific form exists.注释：standard： 标准的 form：形式，格式 typically： 代表性地，作为特色的 Gencon form： “金康”格式（全称“统一杂货租船合同（Uniform General Charter）.是一个不分杂货和航线，适用范围比较广泛的航次租船合同的标准格式。） design ：计划，打算，设计 exists： 存在课文意思：航次租船合同有多种标准格式可供使用。最具代表性的是“金康”格式，它是最普遍使用的租船合同，可用于没有特殊形式存在的贸易当中。二Time Chartering 定期租船 （考试重点）2-1 课文：The time chartering means that the shipowner provides a designated manned ship to the charterer, and the charterer employs the ship for a specific period against payment of hire .（定期租船的定义，了解一下）注释：time chartering： 定期租船 designated ： 指定的，派定的， manned：有人驾驶的，有人操纵的（在这里是指“配备船员”） charterer： 承租人，租船者 employ：雇用 period：期限，时限 hire： 租金，工钱课文意思：定期租船者是指船舶所有人提供给承租人一艘特定的配备船员的船舶，由承租人使用一定期限并交付租金。2-2 课文： The hire is payable in advance for a month or other period . If the hire is not paid promptly the shipowner may be entitled to cannel the charter .注释：payable：应付的，可付的 in advance：提前，预先 promptly：敏捷地，迅速地 be entitled to： 有权（做）， 有的资格 cannel： 取消课文意思：租金应提前一个月或其他期限支付，如果没有及时迅速地支付佣金，船舶所有人有权取消此次租凭。2-3 课文：Under a time charter the crew is employed by the shipowner, who is also responsible for the nautical operation and maintenance of the vessel, and supervision of the cargo.注释：crew ：全体人员（工作）队，在这里引申为“船员” nautical ： 船员的，船舶的，航海的（nautical operation ：航行操作） maintenance ：维护，保持 supervision：监督，管理 课文意思：定期租船条件下，由船舶所有人雇船员，并且负责航行操作和船舶的维修和货物的监督。2-4 课文：The charter is liable for costs directly connected with the use of the vessel ,for example ,bunker costs and port charges and pays for the loading and discharging.注释：is liable for： 对应负责任 directly ： 直接的 connected ：相关联的课文意思：承租人负责与船舶使用有直接相关联的费用，比如燃油费，港口费以及支付装载和卸载费用。2-5 课文：The liability for the cargo may be determined in different ways and may rest with the shipowner or with the charterer or may be divided between them in one way or another.注释：liability：责任，义务 determined ：规定，确定 different：不同的 rest with：取决于，在于 ，由负责课文意思：对于货物（风险）的责任划分可能有不同方式来决定，可能由船舶所有人负责或者由承租人负责或者也可能双方之间以一种或者其他方式来划分。2-6 课文：When giving orders to vessel the charterer must keep within the trading limits prescribed by the contract . with respect to geographical areas as well as cargoes to be carried .注释：giving 给予 order 订单 keep 保持trading limits 航区限制 prescribe 规定，指示 with respect to 关于，至于geographical 地理学的，地理的as well as也课文意思：当给船舶下了一票货后，承租人就地理区域和所载货物都要保持在合同规定的航区限制之内。2-7课文：There are also some standard forms of time charter party used in the time chartering business.定期租船合同也有几种标准格式。主要的两种格式：1. NYPE form 土产格式全称“纽约土产交易所定期租船合同”（The New York Produce Exchange Time Charter）,是美国纽约的土产交易所指定的定期租船合同的标准格式。By far the largest number of time chartering are fixed on the basis of the NYPE Charter Party. 到目前为止大量的定期租船都是以土产格式作为合同样本的基础。2.BALTIME form “波尔的姆”全称“波尔的姆统一定期租船合同” 是波罗的海国际航运协会指定的定期租船合同标准格式。二、 TCT (Trip Chartering 航次期租) 3-1 课文：Trip chartering means that the charterer emplys vessel on a time charter basis for single or round-trip voyagrs.(航次期租定义，了解一下)注释：Trip chartering ：航次课文意思：航次期租是指承租人以定期租船为基础租用船舶一个或来回航次。3-2 课文：A trip-chartering is similar to voyages chartering with regard to the fact that the intention of the parties is to empoly the vessel for one or two voyages .注释：is similar to：与相似 fact ：事实，实际，实情 intention ：意图，目的课文意思：航次期租就当事人的目的实际上与航次租船是相似的，租用船舶一个或者来回航次。3-3 课文：There the roles and responsibilities of charterer and shiponwner are identical to those assumed for time charter. 注释：role 角色 任务 be identical to 与一致，与相同 assume 表现呈现课文意思：承租人和船舶所有人在航次期租中担负的角色和责任与定期租船是一致的。Bareboat Chartering 光船租船四、 reboat Chartering 光船租船 （考试重点）4-1课文：The bareboat chartering ordinarily means that the vessel is put at the disposal of the charterer for a long period employment without any crew.(光船租船的定义，了解一下)注释：bareboat chartering 光船租船 ordinarily 普通 平常disposal 处理 处置 安排 配置课文意思：光船租船通常是指将未配备船员的船舶提供给承租人使用较长时间的租船方式。4-2 The charterer thus will take over almost over almost all of the shipowners functions.This means that the charterer will have the commercial as well as the technical responsibility for the vessel and will pay for maintenance,crew costs and insurance,etc. 注释：thus 因此 这样 如此 take over 接管 接受 （这里引申为负责）functions 职责 作用 commercial 商业的 贸易的technical 技术的 技术上的 responsibility 责任 职责课文意思：因此承租人将负责几乎所有船舶所有人的职责。这意味着承租人必须承担贸易商的职责，也同样要负责船舶方面技术上的职责，支付船舶的维修费用，船员的工资和保险等等。4-3课文：Bareboat chartering is less common than other types of chartering.课文意思：光船租船与其他租船方式相比较少使用。4-3 It is sometime employed in connect with the financial arrangements for purchase of the vessel on installment terms.注释：sometime 在某一时后，曾经 in connect with 与有关，连同financial arrangements 财务安排 installment terms. 分期付款条件课文意思：光船租购与财务安排有关，实际上相当于分期付款购买船舶。4-4 The bareboat charter hen serves as a hire/purchase contract,by which the shipowner/seller retains formal ownership and thereby security in the vessel until the full purchase price is paid.注释：serves as 作为 hire/purchase contract 租购合同retain 保持保留formal 正式的 形式的 ownership 所有权 物主身份 thereby 因此 因而课文意思：光船租船可以作为租购合同，船舶所有人或出售方在收到全部付款前对船舶拥有正式所有权。 4-5 课文 There is only one standard form of bareboat charter paty used to any great extent and that is the BATRECON form designed by BIMCO.注释：extent 范围 程度 区域 BATRECON form “贝尔康”格式 BIMCO 波罗的海的海国际航运协会绘制的“贝尔康”格式。五、Contract of Affreightment (COA) 包运合同 （考试重点）5-1课文：Contract of Affreightment ordinarily means that the shipowner promises to satisfy the charterers need for transport capacity over a certain period of time, often one year or several years.(包运租船的定义，了解一下)注释：Contract of Affreightment 包运合同 promise to 承诺做satisfy 满足 使满意transport capacity 运输能力课文意思：包运租船是指船东在一定期限内，通常一年或几年，向承租人提供一定运力，满足其运输能力的需要。 5-2 课文：The kinds of goods,as well as the period of time for the contract,is ordinarily clearly defined.注释：defined 定义 详细说明 规定 限定课文意思：通常都会明确地规定合同货物的种类和合同的期限。5-3 The quantity of the goods to be carried may be precisely fixed or refers to yearly production.注释：precisely 明确的 准确的fix 规定 确定refer to 查阅 提及 谈到课文意思：明确的规定运载货物的数量，或者参考年运载货物量。5-4 课文：The timeable for the individal vouages is commonly approximate，so that the shipnebts shall be fairly or evenly spread.注释：timeable 时间表individal 单独的 个别的approximately 近似的 接近的fairly 公正的 公平
