中文翻译国务院办公厅关于解决企业拖欠农民工工资问题在一些地区接连发生因企业特别是建设领域企业拖欠农民工工资引发的群体性事件，严重影响社会稳定。党中央、国务院对此高度重视，要求各地区、各有关部门和单位加大工作力度，切实解决企业拖欠农民工工资问题。经国务院批准，现紧急通知如下： 一、各地区、各有关部门要进一步统一思想认识，从维护社会稳定大局的高度，把解决企业拖欠农民工工资问题作为当前一项重要而紧迫的任务抓紧抓细，确保各项措施落到实处。按照属地管理、分级负责、谁主管谁负责的原则，进一步明确地方各级人民政府和有关部门的责任，省级人民政府负总责。人力资源社会保障部门要加强对解决企业拖欠农民工工资问题的组织协调和督促检查，加大劳动保障监察执法和劳动争议调处力度。住房城乡建设、发展改革、监察、财政等部门和工会要按照职责分工，积极做好解决建设领域拖欠工程款及企业拖欠农民工工资相关工作。 二、深入开展农民工工资支付情况专项检查，切实维护农民工的合法权益。地方各级人民政府要在普遍检查的基础上，集中力量重点解决建设领域企业拖欠农民工工资问题。要抓紧组织对本行政区域内所有在建工程项目支付农民工工资情况逐一排查，发现拖欠工资问题或欠薪苗头及时督促企业妥善解决；对反映投诉的建设领域工资历史拖欠问题，也要认真加以解决。要加强行政司法联动，加大对欠薪逃匿行为的防范、打击力度。对因拖欠工资问题引发的劳动争议，要开辟争议处理“绿色通道”，对符合立案条件的当即立案，快速调处，力争在春节前办结；对符合裁决先予执行的拖欠工资案件，可以根据劳动者的申请裁决先予执行。 三、督促企业落实清偿被拖欠农民工工资的主体责任。各类企业都应依法按时足额支付农民工工资，不得拖欠或克扣。建设工程承包企业追回的拖欠工程款应当优先用于支付被拖欠的农民工工资。因建设单位或工程总承包企业未按合同约定与建设工程承包企业结清工程款，致使建设工程承包企业拖欠农民工工资的，由建设单位或工程总承包企业先行垫付被拖欠的农民工工资。因工程总承包企业违反规定发包、分包给不具备用工主体资格的组织或个人，由工程总承包企业承担清偿被拖欠的农民工工资责任。 四、加大力度解决建设领域拖欠工程款问题。对于政府投资的工程项目已拖欠的工程款，要由本级政府限期予以清偿；涉及拖欠农民工工资的，先行垫付被拖欠的工资。对于房地产开发等项目已拖欠的工程款，要督促建设单位限期还款；涉及拖欠农民工工资的，先行垫付被拖欠的工资；对不具备还款能力的项目，可采取资产变现等措施筹措还款资金。政府有关部门要及时准确地向人民法院提供建设单位拖欠工程款的信息，帮助建筑业企业通过法律途径解决拖欠工程款问题。对已通过诉讼程序进入执行阶段的拖欠工程款，要配合支持人民法院加大执行力度。对因建设单位破产等特殊原因，致使拖欠工程款成为“死账”的，由有关部门和当地人民政府妥善解决。 五、加快完善预防和解决拖欠农民工工资工作的长效机制。地方各级人民政府及有关部门要抓紧完善企业工资支付的法规和政策，建立健全企业劳动保障守法诚信制度、工资支付监控制度，完善工资保证金制度，强化劳动保障监察执法，切实保障农民工工资按月足额支付。要进一步规范建设工程分包行为，加强建设项目资金管理，从源头上防止发生拖欠工程款导致拖欠农民工工资问题。地方政府未能解决政府投资工程项目拖欠工程款问题的，除极特殊的项目外，一律不再批准其新建政府投资工程项目。对有拖欠工程款问题的房地产开发企业，一律不得批准其新开发建设项目和为其办理用地手续。对存在拖欠农民工工资问题的建筑业企业，要依法对其市场准入、招投标资格和新开工项目施工许可等进行限制，并予以相应处罚。 六、地方各级人民政府要进一步健全应急工作机制，完善应急预案，及时妥善处置因拖欠农民工工资问题引发的群体性事件，坚决防止事态蔓延扩大。对于拖欠时间长、涉及数额大、一时无法解决的拖欠工资，要通过动用应急周转金等资金渠道先行垫付部分工资，或给予被拖欠工资的农民工必要的生活救助，帮助其解决生活困难。同时，要加强舆论引导，做好疏导工作，引导农民工用理性合法的手段维护自身权益。 各省（区、市）人民政府要在春节前组织开展专项督查，人力资源社会保障部会同解决企业工资拖欠问题部际联席会议成员单位进行重点督查。对监管责任不落实、工作不到位以及政府投资工程项目拖欠工程款导致拖欠工资问题引发严重群体性事件的，要对直接责任人员和有关领导实行责任追究。外文原著State Council on migrant workers to solve the problem of wage arrears In some areas due to a spate of corporate enterprises, especially construction of fields wage arrears for migrant rural workers caused mass incidents, serious impact on social stability.
