Definitions定义For the purpose of this Manual and unless provided otherwise in particular provisions, the term: 除非具体条款另行规定，就本手册而言：a) Competent Authority means the minister, government department or other authority having power to issue and enforce regulations, orders or other instructions having the force of law in respect of the subject matter of the provision concerned;“主管当局”一词系指有权就公约规定的事项颁布和实施具有法律效力的条例、命令或其他指令的部长、政府部门或其他当局；b) Declaration Of Maritime Labour Compliance means integrated documents for the implementation of requirements of the Convention and regulations of the flag state on board ship;“海事劳工符合声明”一词系指船舶实施公约要求和船旗国规定的综合性的文件；c) Maritime Labour Certificate means certificate issued to a ship by the competent authority, or by a recognized organization duly authorized for this purpose, after implementation of inspection of maritime labor condition of ship, with validity that shall not exceed five (5) years;“海事劳工证书”一词系指海事劳工证书：指船旗国主管当局或授权的认可组织经对船舶实施海事劳工条件检查后签发的证书，证书有效期不得超过5 年。；d) Requirements of the Convention refers to the requirements in the Articles, Regulations and Code of MLC2006“公约要求”指2006 年海事劳工公约的正文条款、规则以及守则A 部分的要求。 e) Seafarer means any person who is employed or engaged or works in any capacity on board a ship under Company management“海员”一词系指本公司管理船舶上以任何职务受雇或从业或工作的任何人员；f) SeafarersEmployment Agreement includes both a contract of employment and articles of agreement signed by Seafarer and the Company;“海员就业协议”一词系指海员和本公司签署的就业合同和协议条款；g) The Collective Bargaining Agreement means the agreement made between the Hong Kong Unions on behalf of Seafarer and the Company, and sets out the standards terms and the conditions applicable to all seafarers serving on any vessel entitled Hong Kong flag managed by Company.“海员集体协议” 系指香港海员工会代表海员和本公司签署的协议，该协议列明的条款适用于公司管理的悬挂香港旗船舶的海员h) Seafarer Recruitment And Placement Service means any person, company, institution, agency or other organization, in the public or the private sector, which is engaged in recruiting seafarers on behalf of Company or placing seafarers with Company;“海员招募和安置服务机构”一词系指公共或私营部门中从事代表公司招募海员或与船东安排海员上船的任何个人、公司、团体、部门或其他机构；i) Maritime Labor Condition means that seafarer has a right to fair terms of employment, to decent working and living conditions on board ship and to health protection, medical care, welfare measures and other forms of social protection.“海事劳工条件” 系指公约要求的海员有权获得的公平就业条件；体面的船上工作和生活条件；符合安全标准的工作场所和健康保护、医疗、福利、社会保障等诸方面的条件。j) Accommodation means provision of spaces of living and recreation for seafarers, including seafarer sleeping room, mess room, sanitary accommodation and recreational facilities etc.“起居舱室”系指船上提供给海员居住和娱乐的处所，包括海员卧室、餐厅、卫生间、医务室和娱乐室等。k) Shipowner means Maple Leaf Shipping Co.,Ltd, who has assumed the responsibility for the operation of the ship from the owner and who, on assuming such responsibility, has agreed to take over the duties and responsibilities imposed on shipowners in accordance with this Convention, “船东”一词系指台州市椒江枫叶海运有限公司（以下简称“公司”），其承担了船舶经营责任并在承担这种责任时已同意接受船东根据本公约所承担的职责和责任2. Abbreviations缩写： a) ILO International Labor Organization；ILO 国际劳工组织；b) IMO International Maritime Organization；IMO 国际海事组织； c) MLC, 2006 Maritime Labor Convention, 2006MLC,2006 2006年海事劳工公约；d) MLC Maritime Labor Certificate；MLC 海事劳工证书；e) DMLC- Declaration of Maritime Labor Compliance, DMLC 海事劳工符合声明f) STCW Convention International Convention on Standards of Training, Certification and Watch-keeping for Seafarers, 1978, as amended STCW公约 1978年海员培训、发证和值班标准国际公约及其修正案.g) CBA Collective Bargaining Agreement 集体谈判协议3. Language语言The English and Chinese versions of this manual are provided. The employment, engagement or work on board of any person under the age of 18 shall be prohibited.禁止任何18岁以下的人员受雇、受聘或到船上工作2. Verification证件核实a) Prior to employment, engagement or work on board, seafarer should present his or her identification document to Marine Personnel Department，issued by Competent Authority, confirming his or her age， the following document include but not limit to:受雇，受聘或到船工作前，海员应向船员部出示由主管当局签发的证明文件，以证实自己的年龄。这些文件包括但不限于:i. Seamans Passport海员证ii. Seafarers Identity Document服务簿b) Marine Personnel Department check the certificate to determine whether the basic information, such as Date of birth, Name, etc. are consistent with other document produced by seafarer, where certificate forged or altered, the seafarer should not be employed. 船员部对上船海员持有的证书进行核对，核对其与其他证书的基本信息是否一致，这些信息包括海员出生日期，姓名等。如有伪造,涂改的情况，不予录用。c) Master should check seafarer sign-on against valid identification documents to ascertain if the holder of certificate is him/her。 When the documents not being in conformity with the holder physical attributes， or forged document， master should inform shipowner as soon as possible so as to take appropriate measures by shipowner船长对到船工作海员的证件进行核对,确认证件持有者是否本人，如果发现与本人体貌特征情况不符或伪造证件时，立即报告公司以便公司采取相应的措施3. Document Keeping文件记录a) Marine Personnel Department keep the Scanning soft-copy of above-mentioned Certificate of Seafarer。船员部保留海员上述证件电子版扫描件。b) Marine Personnel Department keeps the sign on/sign off record when seafarer changes.安排海员上船下船时，船员部保留受雇，受聘或到船工作海员的上下船动态记录c) Master update the crew list immediate after crew change，date of birth of each seafarer is noted against his/her name on the crew list.海员更换后，船长立即对海员名单进行更新，每一海员的出生日期应在海员名单中的姓名旁标注. d) Master or officer acting on his or her behalf (“competent officer”) verify the crew list at proper interval and record the date of such verification.船长或代表船长的高级海员（“主管高级海员”）定期核查海员名单，并记录核查的日期e) Master should keep employment records of seafarer, include the sign-off seafarer, these records include but not limit to the following:船长应保持海员受雇在船的记录，包括已经下船海员的受雇记录，这些记录包括但不限于：i. Crew List of Hong Kong Flag State香港船旗国海员名单Relative Record相关记录：Marine Personnel Department船员部：1. Sign On / Sign Off Record上下船动态记录2. Scanning Soft-Copy of Seamans Passport海员证电子版扫描件Vessel船舶1. Prior to employment on board Seafarers should be in possession of a valid medical certificate and Vaccination/ Prophylaxis Certificate attesting that they are medically fit to perform the duties they are to carry out at sea.海员上船工作前应持有有效的体检证书和预防接种证书，证明其健康状况适合其将在海上履行的职责。2. Verification 证书核查a) Marine Personnel Department should focus on the following：船员部应重点关注：i. Marine Personnel Department check the medical certificate and Vaccination/ Prophylaxis Certificate to determine whether the basic information, such as Date of birth, Name, etc. are consistent with other document produced by seafarer, where certificate forged, altered, the seafarer should not be employed. 船员部对上船海员持有的体检证书和预防接种证书进行核对，核对其与其他证书的基本信息是否一致，这些信息包括海员出生日期，姓名等。如有伪造,涂改的情况，不予录用。ii. General comment on the medical certificate generated by medical practitioner to determine whether a potential employee is fit for duty.体检证书上体检医生给出的结论，确定未来雇员的健康状况是否足以胜任其工作iii. Validity data证书的有效期iv. A English version must be provided / attached必须提供英文版本。v. The medical certificate shall comply with the Requirements issued by the Competency Authority specifying the standards of medical fitness for seafarer in accordance with the STCW Convention 1978, as amended from time to time. 体检证书要符合主管当局根据修订的1978 年STCW 公约制定的对海员健康标准的规定vi. The medical certificate shall be issued by a duly qualified medical practitioner or, in the case of a certificate solely concerning eyesight, by a person recognized by the competent authority as qualified to issue such a certificate.体检证书应由有正规资格的医师签发，或者，对于只涉及视力的证书而言，由经主管当局认可的具备签发证书资格的人员签发。b) Master should check seafarer sign-on against medical certificate and Vaccination/ Prophylaxis Certificate to ascertain if the holder of certificate is fit for his/her duty。When the documents forged or altered, master should inform shipowner as soon as possible so as to take appropriate measures by shipowner.船长对到船工作海员的体检证书和预防接种证书进行核对,确认证件持有者适任，如果发现证书涂改或者伪造时，立即报告公司以便公司采取相应的措施3. Document Care证书保管a) If the medical certificate is verified to be true，valid and fit for duty on board, Marine Personnel Department scan the Medical Certificate and Vaccination/Prophylaxis Certificate and keep the soft-copy船员部检查体检证书真实有效能够适任船上工作后，对体检证书和预防接种证书进行扫描，并保留电子版的扫描件b) Marine Personnel Department registers and files the Medical Certificate and Vaccination /Prophylaxis Certificate in List of crew certificate.船员部对体检证书和接种证书的有效期在海员证书清单中登记归档.c) When the medical certificate or Vaccination / Prophylaxis Certificate of the seafarer employed on board become due， master should inform the shipowner to make necessary arrangement in advance.海员在船服务期间，如果体检证书或预防接种证书到期，船长应提前通知公司进行必要的安排d) Master should update the List of Document immediate after crew change/certificate replacement and reserve the records海员更换/证书换新后，船长立即对证书清单进行更新, 船长应保留该证书清单e) If the period of validity of a certificate expires in the course of a voyage, the certificate shall continue in force until the next port of call where the seafarer can obtain a medical certificate from a qualified medical practitioner, provided that the period shall not exceed three months.如果在航行途中证书到期，该证书应继续有效至该海员能够从合格医师那里取得体检证书的下一停靠港，条件是这段时间不超过3个月。4. Each medical fitness certificate shall state in particular that the scopes of health conditions of the seafarer as stipulated in Standard A1.2.6 of the Convention.每份体检证书应当特别说明公约标准A1.2.6 规定的海员健康状况范围。5. A medical fitness certificate issued shall specify the period, commencing with the date of the medical examination, for which the certificate shall remain valid, subject to the following maximum periods :体检证书应明确证书的有效期，从进行体检之日起，至下述最长期限为止：a) in respect of a seafarer under 18 years of age, 1 year;对于18 周岁以下的海员，1 年；i. in respect of a seafarer 18 years of age and under 55 years of age, 2 years; 18 周岁以上55 周岁以下的海员，2 年；ii. in respect of a seafarer 55 years of age and over, 1 year;55 岁及以上的海员，1 年；iii. in respect of a seafarer serving or intending to serve2 on bulk3chemical carriers, 1 year正在或将在散装化学品船上3 服务2 的海员，1 年；b) Colour vision test is valid for no more than 6 years. 色觉视力测试的有效期最多为6 年。6. In urgent cases, a seafarer may be permit to work without a valid medical certificate until the next port of call where the seafarer can obtain a medical certificate from a qualified medical practitioner, provided that:在紧急情况下，可以允许没有有效体检证书的海员工作直至该海员可以从合格的医师那里取得一份体检证书的下一停靠港。条件是：a) Obtain the approval of competent authority,获得主管当局的批准b) the period of such permission does not exceed three months; and所允许的期间不超过3个月；并且c) The seafarer concerned is in possession of an expired medical certificate of recent date.该海员持有最近过期的体检证书。7. Seafarers that have been refused a certificate or have had a limitation imposed on their ability to work, in particular with respect to time, field of work or trading area, shall be given the opportunity to serve on board when he/she pass the further examination.对于被拒绝发证的海员，或在其工作能力方面，特别是关于时间、工作内容或航行区域方面被施加了限制的海员，如果复检通过，应提供其就业的机会Relative Record相关记录：Marine Personnel Department船员部：1.
