各类型基金规模 表六：私募基金收益情况一览三、国证券投资基金业存在的主要问题 通过这近半个月的调查，我们小组发现证券投资基金市场存在以下几方面问题：（一）我国证券市场波动过大 从1996年以来，我国证券市场的规模在不断壮大，市场内生力量不断增强，各项制度也在不断完善，使得市场在纵向上具有一定的可比性。但由于外部环境以及市场自身的一些原因，市场波动性非但没有削弱，反而有所增强。（二）我国证劵投资基金治理问题1、基金托管人监管的软弱性。在我国现实的实践中，基金管理人通常都是基金的发起人，其在实质上有权决定基金托管人的选聘。这就导致了托管人实际上受制于基金管理入，所以名义上的双向监督在实际操作中异化管理人对托管人的单向监督。同时，基金托管业务目前已成为商业银行一项新的表外业务和利润增长点，如果托管人为了基金持有入的利益，面对基金管理入进行监督，就会损害基金管理人的利益，最终损害自身的利益。2、基金管理人偏离基金持有人利益。证券投资基金的持有入和管理人之间是一种委托代理关系，委托人追求投资收益的最大化，代理人追求代理收入的大化、社会名声、业内地位等，两者的目标函数不完全一致，当基金持有人利益和基金公司控股股东利益发生冲突，基金管理公司往往选择服务于控股股东的利益，从而损害了基金投资者的利益。3、基金经理变动过多。截止2011年12月22日，2011年基金经理变动达到惊人的378次，4月份单月变动数量高达40次。其中，工银瑞信雄踞变动榜首，旗下基金经理变动次数达到24次，涉及13只基金；而建信18次变动涉及10只基金，紧随其后。多达11家基金公司基金经理人事变动超过10次。仅有少数基金公司今年人员相对稳定。（三）法律法规不健全，市场监管不力我国的证券投资基金的法律建设明显滞后于基金业的发展。尽管我国已经有了证券法、证券投资基金法、信托法等法律规章制度，但是未建立起以证券投资基金法为核心、各类部门规章和规范性文件相配套的较为完善的基金监管法律法规体系。与国外相比，我国的基金立法缺乏必要的延续性，相关法律法规的可操作性较差。随着我国基金业的快速发展，政府对基金业事无巨细的直接监管无疑是效率低下的。我国目前的基金业自律机构是中国证券业协会，对基金监管的专业性不强，而且缺少对违规进行处罚的权威。四、促进我国证券投资基金业健康发展的对策研究 以下是我们小组从五个方面对基金行业健康发展的对策建议：（一）完善基金治理结构1、真正发挥独立董事制度的作用。参照美国共同基金独立董事制度，我国当前的独立董事制度中应完善两个方面的内容：一是进一步增加独立董事的人数比例，争取达到23的水平，独立董事必须占有董事会多数席位，以便更好地控制基金的运作；二是明确独立董事的任职资格。2、引入独立的受托委员会，履行契约的监护权。由于我国基金持有人的分散，导致对管理人的日常监督成本过高，或者由于外部性的存在根本就无人有动力去监督，于是在契约形成时，加入一个集中代表持有人履行监督职能的角色，并让其享受相应的剩余索取权，是符合成本收益原则的。在我国现有的契约型基金架构下，可以借鉴澳洲模式，引入独立的受托委员会来担任，实现这一第三方监督职能。（二）加强基金托管人的监督工作1、建立竞争性的基金托管人市场。我国目前基金托管人选择范围过于狭窄，准入门槛太高，可以考虑放松对基金托管人的资本金要求，让更多的银行、投资信托公司以及其他符合条件的金融机构也具有获得托管人资格的机会。同时，对基金托管人在专业人员、技术力量以及内控制度方面做出较为严格的规定。2、加强政府监管部门或行业自律组织对基金托管人的监督作用。法律应该规定基金管理人违规操作时，基金托管人应承担连带责任，并使其在新的基金托管市场竞争中处于不利地位，使基金托管人从经济利益的角度考虑，不会甘冒失去未来托管费收入的危险。同时，应建立基金托管人自律组织，提高整个基金托管人行业的监督水平和职业道德水准。（三）我国推进基金公司治理改革激励相容的监管探索引入业绩报酬，且在评价基金业绩时引入风险指标。引入声誉机制。声誉机制是一种动态激励。在存在声誉机制的情况下，基金激励方案中原本存在的一些问题自然而然就会消失。它形成了基金管理人出于长期利益的考虑以约束短期利益冲动的自发机制，它是基金管理人的自我激励，而且付出的成本也是最低的。（四）推动证券投资基金法的修订，适应行业进一步发展的需求伴随着我国金融改革的激变，此时的基金产业从内部结构到外部环境都已经发生了很大变化。基金新产品和新业务的不断涌现。为了适应基金行业外部生存环境的变化，避免基金法成为基金产业进一步发展的约束，应当对当前基金法中的部分内容进行适当的修改、补充和完善。（五）大力宣传价值投资和战略投资基金作为专业的投资机构，从社会募集资金来进行证券市场投资，其投资策略和投资行为都和基金持有人的成熟分不开的。特别是开放式基金，如果投资者缺乏理性的话,遇到股市出现波动时，便纷纷赎回，肯定会影响基金的投资策略。因此培养理性的投资者至关重要，要加大价值投资和战略投资理念的宣传，与基金形成战略合作关系，既能稳定基金规模，也能监督基金的投资行为，从而保证证券投资基金的良好发展。一是制作提供影片，一是为影片制作提供服务的以影视城为主的辅助产品。电影发行放映行业：电影发行服务，主要是以电影院为依托，通过一系列中间环节，把电影制作企业与普通消费者联系起来 。construction of party communist network, mobile, Al, where XX channels, taught the XX Party app platform and learning such as distance education platform.
