1、租赁合同LEASE CONTRACT出租方:(以下简称甲方):Lessor (here in after referred toas PartyA)承租方:(以下简称乙方):Tenan t (here in after referred toas PartyB)甲、乙双方经过友好协商一致订立本合同,以资共同遵守。Party A and Party B ,having had friendly discussion,hereby agree to enter into the following con tract to be abided by both parties.一、房屋地址:甲方将其

6、-mentioned earnest money will translate into automatically.五、租金1数额:双方议定租金为每月 元整,乙方以形式支付给甲方。汇率按支付当日中国人民银行公布之外汇官方牌价中间价计。2、 租金调整约定:。3、支付方式:租金按 个月为壹期支付,第一期租金于 年月日以前付清,以后每期租金于 的日前缴纳,先付后住(若乙方以划帐形式支付租金,则汇出日为支付日,汇费由汇出方承担),甲方收到租金后应予以书面签收。4、如乙方逾期支付租金,则须支付每天相当于月租金百分之一的滞纳金;若逾期且在经甲方正式通知后仍未付租金总计超过拾个工作日,则视为乙方自动退租,

Party B shall pay the ren tal before itmoves into the house.(If Party B pays the rental in the form of remittanee, the d

9、ate of remitting shall be day of rental payment. The remittance fee shall be borne by the remitter.) Party A should sig n a written receipt after each payme nt of ren tal is received.4、 If Party B delays suchrental payment, the interest would be imposed on overdue account at adaily rate of 1%of mont

After formal informing by Party A, if Party B still delays in the excess of ten work ing days, it shall deemed as automatically quitt ing tenancy, which shall con stitute of con tract.六、保证金1、 为确保房屋及其附属设施之安全与完好及租赁内相关费用之如期结算,乙方同意于_年月日之前支付给甲方 元整。作为乙方确保合同之保证金。甲方在收到保证金后应予以书面签收。2、除合同另有约定之外,甲方应于租

11、赁关系消除且乙方迁空、点清、并付清所有应付费用 后,当天将保证金全额无息退还乙方。3、因乙方违反本合同的规定,而产生的违约金、损害赔偿以及应付租金及相关费用,甲方 可在保证金扣抵,不足部分乙方必须在接到甲方付款通知后十天内补足。Deposit of Security:1、To ensure that the house and its accessory facilities are safe and in good condition and thatacco unts of releva nt fees are settled on schedule duri ng the term of

12、 lease, Party B agrees to pay to Party A before(month)(day)(year) as a deposit ofsecurity for fulfilli ng to Con tract. After receivi ng the deposit ,Party A should sig n a writte n receipt.2、Uni ess otherwise agreed upon. Party A should retur n to Party B the full amount of deposit ofsecurity inter

13、est free on the day lease is dissolved and Party B has vacated the house ,left everythi ng in the house in tact and paid up all expe nses due.4、Any pen alty for breach of con tract, compe nsati on for damage and ren tal and other releva nt fees payable aris ing from Party B violati on of the provisi

14、 ons of the Con tract may be made up for by Party B within ten days of the receipt of the no tice of payme nt issued by Party A.七、其他费用1、乙方应承担租赁期内的水费、电费、煤气费、通讯费和其他由乙方实际使用而产生的费 用,并按单如期缴纳。2、地租、房产税、租赁所得税、房屋维修费、物业管理费等原由甲方支付的费用,仍由甲 方承担。Other Fee:1、Party B should bear the water, electricity, gas and commun

15、ication fees and all other fees incurred by Party B in actual use and pay the bills on schedule during the term of lease.2、The land rent, house tax, income tax and house maintenance fee, management fees that were originally payable by Party A shall continue to be paid by Party A.八、甲方的义务:1、甲方须按时将房屋及附

16、属设施交付乙方使用。2、房屋设施如因质量原因,自然损耗或灾害而受到损坏时,甲方有修缮的责任并承担有关 的费用。3、甲方应确保所出租的房屋享有出租的权利,如在租赁期内,该房屋发生所有权全部或部 分的转移、设定他项物权或其他影响乙方权益的事情时,甲方应保证所有权人,他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款,反之如乙方权益因此而遭受损害,甲方应负赔偿责任。Obligatio ns of Party A:1、Party A shall turn over the house and accessory facilities (see the appendix for detail)

17、 on schedule to Party B for use.2、Party A shall be resp on sible for repairi ng any damage of the house due to poor quality, n atural tear and wear or calamities and bear the expe nses thereof.3、Party A should ensure that the house let out is entitled, to the lease. If all or part of the ownership o

18、f the house is transferred, other rights item are settled, or any other happening affects the rights and interests of Party B during the leasehold, Party A should guarantee that the owner, person to the rights item or any other third party that affects the rights and interestof Party B continue to a

19、bide by all the articles of the Con tract. Otherwise, Party A shall be liable for compe nsat ing to loss to the rights and in terests suffered by Party Btherefrom.九、乙方的义务:1、乙方应按合同的规定,按时支付租金、保证金及其他各项应付费用。2、乙方经甲方同意,可在承租用房内进行装修及添置设备。租赁期满后,乙方可将添置的 可拆动的动产部分自行拆运,并保证不影响房屋的完好及正常使用。3、未经甲方同意,乙方不得将承租的房屋转租或分租,并

20、爱护使用租赁的房屋。如因乙方 的过失或过错致使房屋及设施受到损坏,乙方应负赔偿责任。4、 乙方应按本合同的约定合法使用租赁房屋,不得擅自改变使用性质,不应存放危险物品,如因此发生损害,乙方应承担全部责任。Obligati ons of Party B:1、Party B should pay the rental, deposit of security and other fees payable on schedule accord ing to the provisi ons of the con tract.2、 Party B may, upon approval by Party

21、A , fit up the ren ted house and add equipme nt there in during the leasehold. Upon expiration of the leased hold, Party B may remove the added part of property that is removable, but it must en sure that the house is in good con diti on for no rmal use.3、 Party B must not transfer the lease of the

22、house it has rented or sublet it without the approval by Party A. Party B should take good care of the house ren ted. Party B shall be liable for compensating for any damage caused to the house and facilities due to Party B fault or misuse.4、 Party B should use the ren ted house lawfully accord ing

23、to the provisi ons of the Con tract. It must to not change the nature of the use of the house without authorization. No hazardous materials and goods shall be allowed to be kept in the house. If any damage is attributable to such use, Party B shall fully liable.十、合同终止及解除的规定:1、乙方在租赁期满后,乙方有优先承租权,如需续租,

24、应提前两个月通知对方,由双方另 行协商续租事宜。2、 租赁期满后,乙方应在 天内将承租的房屋交还甲方,如有留置的任何物品,在未 取得甲方谅解之下,均视为放弃,任凭甲方处置,乙方决无异议。3、本合同一经双方签字后立即生效,未经双方同意,不得任意终止,如有未尽事宜,甲、 乙双方可另行协商。Termin ati on and Dissoluti on of the Con tract:1、If Party B intends to renew the leased hold upon its expiration, it should notify Party A of such inten ti

Then, the two parties shall discuss matter over the ren ewal of leasehold.2、Upon the expiration of the leasehold, Party B should turn the rented house back to Party Awith indays. Any bel ongings left beh ind in the house shall, without obta iningprevious understanding of Pa

26、rty A, be deemed as things given up by Party B and shall be disposed of by Party A at its discretion, to which Party B shall raise no objection.3、This con tract shall go into effect the mome nt it is sig ned by both parties. It must not be termi nated at will without the approval of both parties. An

27、ything n ot covered in the Con tract shall be discussed separately by Party A and Party B.十一、违约处理:1、甲乙任何一方如未按合同的条款履行,导致中途终止合同,并且过错方在未征得对方谅解的情况下,则视为违约,双方同意违约金为 元整。若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。3、凡在执行本合同或与本合同有关的事情时双方发生争议,应首先友好协商,协商不成, 可向有管辖权的人民法院提起诉讼。Handing of Breach of Con tact:1、If failure of ei

28、ther Party A or Party B to fulfil the articles of the Con tract before its expirati on, the Party at fault shall be deemed as violati ng the Con tract without obta ining the un dersta nding of the other Party. The two parties agree that the pen alty for breach of con tract shall be n case such penalty is not sufticient to make up for the loss suffered bythe faultless party. The party that has violated the Con tract shall pay additi onal compe nsati on.3、Any dispu
