The Engin eers staff shall in clude suitably qualified

5、 engin eersa nd other pro fessi on als who are comp ete nt to carry out these duties. The Engin eer shall have no authority to ame nd the Con tract. Engin eer The Engin eer may exercisethe authority attributable to the Engin eer as sp ecified i n or n ecessarilyto be imp lied from the Con tract. If

6、the Engin eer is required to obtai n the appro val of the Empio yer before exercis ing a sp ecified authority, the requireme nts shall be as stated in the P articular Con diti ons. The Empio yer shall promp tly inform the Con tractorof any cha nge to the authority attributed to the Engin eer. Howeve

7、r, whenever the Engineerexercises a specifiediuthority for which the Empioyers appro val is required, the n (for the purpo ses ofhe Con tract) the Empio yer shall be deemed to have give n appro val. Exce pt as otherwise stated in these Con diti ons: (a) whe never carry ing out duties or exercis in g

8、authority, sp ecified in or imp lied by the Con tract, the Engin eer shall be deemed to act for the Empio yer; (b) the Engineer has no authority to relieve either Party of any duties, obligations or respon sibilities un der the Con tract; and (c) any app roval, check, certificate, consent, exam in a

9、ti on, i nsp ecti on, in structi on, no tice, prop osal, request, test, or similar act by the Engin eer (i ncludi ng abse ncdsisappro val) shall not relieve the Con tractor from any respon sibility he has un der the Con tract, i ncludi ng respon sibility for errors, omissi ons, discre pan cies and n

(d) Any act by the Engin eer in res ponse to a Con tractors request exce pt otherwise exp ressly sp ecified shall be no tified in writi ng to the Con tractor withi n 28 daysroce ipt. Notwithsta nding the obligati on, as set out above, to obta in appro val, if, i n the opiniontoe Engineer, an emergency occurs affecting the safety ofe or of the Works or of adjoining prop erty, he may,without relievi ng the Con tractor of any

14、 of his duties and respon sibility un der the Con tract, in struct the Con tractor to execute all such work or to do all such things as may, in the opinion of the Engineer, be necessaryto abate or reduce the risk. The Con tractor shall forthwith comply, des pite the abse nee ofappro val of the Empio

15、 yer, with any such instruction of the Engineer. The Engineer shall determine an addition to the Con tract Price, in res pect ofsuch in structi on, in accorda nee with Clause 13 and shall no tify the Con tractor accord in gly, with a copy to the Empio yer. 讲义 Employer 2.2 Permits, Licences or Approv
