13、.国际贸易惯例只有在一定条件下，才 产生法律约束力，具有强制性； 国际贸易惯例 n国际贸易惯例的性质 n通过国内立法，将国际贸易惯例引入国内法中，或 者在国内法明文规定适用国际惯例。如：我国 民法通则规定：“中华人民共和国法律和中华人民 共和国缔结或者参加的国际条约没有规定的，可以适 用国际惯例。” n通过国际立法，将国际贸易惯例引入公约或条约中 。 n通过合同，在合同中直接引用某一国际贸易惯例。 n司法实践中引用国际贸易惯例。 n默示适用国际贸易惯例。 国际贸易惯例 n国际贸易惯例的作用 na.如果双方都同意采用某种惯例来约束该项交 易，并在合同中做出明确规定时，那么这项约 定的惯例就具有了
