Public Holidays 法定假日The employees shall enjoy the following public holidays as stipulated by law. 员工将根据法律规定享受以下的法定假日。(1) New Years Day (One day on January 1st)(2) Spring Festival (First three days of the 1st month of Chinese lunar year)(3) Womens Day (On March 8th, the female employe
2、es may enjoy a half-day holiday)(4) Tomb-sweeping day (One day on Qingming of the Chinese Lunar Calendar)(5) International Labor Day (One day on May 1st)(6) Dragon Boat Festival (One day on Duanwu of the Chinese Lunar Calendar)(7) Middle Autumn Festival (One day on Zhongqiu of the Chinese Lunar Cale
3、ndar)(8) National Day (Three days from October 1st through 3rd)(9) Other public holidays as to the laws and regulations(1)元旦(一月一日,共一天)(2)春节(农历的初一至初三,共三天)(3)国际妇女节(3月8日女性员工可享受半天公休)(4)清明节(农历清明一天)(5)国际劳动节(五月一日,共一天)(6)端午节(农历端午一天)(7)中秋节(农历中秋一天)(8)国庆节(十月一日至三日,共三天)(9)法律、法规规定的其它休假节日B. Annual Leave 年假Exclusiv
4、e of official Public Holidays in force in the Peoples Republic of China, Employee is eligible for an annual paid leave of certain working days (reffer to labor contract, offer letter etc.) wich including the statutory annual leave and the company warefare annual leave.除了国家法律规定的相关公共假日外,员工还享受一定天数带薪年假(
5、具体天数参考公司与员工签订的劳动合同或录用通知等相关文件),其中包括法律规定根据员工个人工龄确定的年假以及公司额外给予的福利年假。i Annual Leave Calculation年休假计算方法The number of days paid annual leave shall be calculated each and every calendar year. An employee, whose employment has been less than one (1) full year at the last day of a calendar year, shall be ent
6、itled to his/her annual leave calculated according to the ratio of the accumulated months of his/her employment divided by 12 months. On calculating the number of days in this way, the decimal part shall be treated with rounding-off method, namely, the decimal part shall be neglected if it is less t
7、han 0.5, a half-day leave shall be granted if its equal to 0.5 and one-day leave shall be granted if its greater than 0.5.带薪年休假的天数计算以公历年度为阶段划分,截止到公历年最后一日未满一年的员工,可享受带薪年假的天数依据其已工作的月数按比例计算。依此计算休假天数时,对于小数部分采用“四舍五入”的计算方法,即: 小数部分少于 0.5的忽略不计,小数部分等于0.5的按半天计,小数部分大于0.5的按一天计。ii Validity of Annual Leave年假的有效期An
8、nual leave cannot be pre-taken. That is, an employee is entitled to the days of annual leave in prorate the number of months he/she has worked for the Company.年假不可提前预支,即在计算可休年假天数时,有效的计算基数截止到上一月月底。The annual leave of the current calendar year may be postponed till March 31st of the following year. Th
9、at is to say, the annual leaves of 20014 must be used up before March 31st, 2015 year. Untaken company welfare annual leave will be automatically waived on 1st April of next calendar year.本公历年度的年假可延迟到下一公历年的3月31日,如2014年的年休假,必须在2015年3月31日前休完。未使用的公司福利年假将视为自动放弃。iii Special case for extension of validity
10、 of annual leave申请假期延长年假有效期的特批情况Special case: if, due to companys business needs, an employee is unable to take his/her paid annual leave before the expiry date, the employee concerned should raise an application, with his/her department head to provide the necessary explanations. Upon approval by a
11、nd filing by HR Department, the said annual leave may be extended till June 30th of the following calendar year. The application for extension of the unused annual leave should be raised before January 31st of the following calendar year and submitted for approvals by both the department head and GM
12、 of IDB China. Once approved, the original application form shall be kept be the HR Department, while the employee concerned may hold a photocopy thereof.特批情况:如由于公司业务原因,致使员工无法在有效期限内使用其带薪休假,应由员工提出申请并由其部门经理给予说明,经艾瑞氏中国区总经理批准并报备人力资源部后,可将其该部分休假有效期延长至下一公历年的6月30日。延长年假有效期的申请应在下一个公历年的1月31日之前提出并交部门经理和艾瑞氏中国区总经
13、理准。 经批复后,申请单原件由人力资源部保存,员工可保留复印件。iv Application for Annual Leave年假的申请Application for annual leave must be made in advance. Half-day is the minimum unit in which the leaves are granted. For any annual leave of less than two (2) days, an application should be raised at least one day in advance; for any
14、 annual leave of longer than two days, an application should be raised at least two weeks in advance. All of the annual leave applications must be verified by the department head, and filed by the HR Department.年假必须提前申请。半天为最小请假单位,一次二天及以下的年假申请应至少提前一天提出,一次二天以上的年假申请应至少提前两周提出,所有年假申请均需经部门经理核准,并报备人力资源部。Em
15、ployees are encouraged to take all annual leave entitlement. They are advised to plan their annual leave in advance. Employees shall plan their annual leave taking into consideration the sales and production high seasons. A planning shall be done together with the employees manager each year in orde
16、r to let the company fulfill its commitments towards our customers.公司鼓励员工享受年假,员工应该提前计划休假,员工在做年假计划时应考虑销售、生产旺季等因素,并与部门经理一起商量,做好临时交接工作,以保障公司实现对客户的承诺。Employees can check with HR Department for any query on the vacation days and the valid period of their annual leave.如员工对其年假天数及有效期有疑问或有不清楚之处,请向人力资源部咨询。Emp
17、loyees who leave the company within one year, in accordance with the relevant laws and regulations, all annual leave taken before will be deducted from his/her last pay as leaves of absence.员工若在公司服务未满一年离职,按照国家法律相关规定其已经使用的 年假将按事假进行结算。C. Sick Leave and Term of Medical Treatment病假及医疗期The employees enti
18、tled non-cumulative 5 days fully-paid sick leave per calendar year on the basis of one full year service with the Company. 员工在公司服务满一年,即享有一年5天的全薪病假(不可累计)。Employees who leave the company within one year, all sick leave taken before will be deducted from his/her last pay as leaves of absence.员工若在公司服务未满
19、一年离职,其已经使用的病假将按事假进行结算。In the event an employee has to stop working for either medical treatment or rest due to sickness and/or injury which is incurred by any other reasons than his/her work, the employee shall be granted a medical treatment period in accordance with the laws and regulations.员工患病或非因
20、工负伤需停止工作治病休息时,按照相关法律法规享受医疗期。Upon falling sick, an employee must notify his/her department manager through telephone or any other means of communications, before the start of regular working hours, or otherwise no later than 15 minutes thereafter, in the first day of his/her absence. Meanwhile, he/sh
21、e should indicate when he/she can get recovered and come back to work. And the employee should present a certificate issued by the designated medical institute to the Company for the full period of his/her absence on the first day when he/she is back to work. Otherwise, he/she will not be entitled t
22、o the medical treatment period or any corresponding welfare treatment. Additionally, he/she may even be treated as absent without leave.员工患病,必须在缺席第一天上班前或不迟于上班开始时间后的15分钟内,以电话或其它方式通知其部门经理,同时告知何时可恢复上班,并于病假后上班第一天向公司提交定点医疗机构出具的病假证明。否则不能享受医疗期及医疗期待遇,且被视为未经批准的旷工。In the event that the sick leave has lasted f
23、or over one (1) month, the employee concerned must provide the Company with the sick leave certificates twice per month. The Company reserves the right to demand the employee to go through a physical examination at a Company-designated hospital如果员工所请的病假连续超过一(1)个月,该员工必须向公司提供一个月两次的病假证明,同时公司将保留要求其由公司指定
24、医院检查身体状况的权利。Employees salary calculation during the sick leave period shall be processed in accordance with local laws and regulations.员工病假期间工资计算按照法律法规规定的执行。D. Maternity Leave产假For the purposes of ensuring the female employees labor safety and interest, upon confirmed pregnancy, the female employee
25、concerned shall have the obligation to immediately notify the HR Department. The female employees who meet the States family planning policies shall be granted the maternity leave, baby-feeding leave and the other leaves as an encouragement in compliance with the family planning policies as stipulat
26、ed. The durations of such leaves as well as welfare treatments related thereto shall be handled as per the relevant regulations promulgated by the labor administrative authorities. For those female employees who do not meet the family planning policies, their leaves shall be treated as sick leaves.为
27、保障女员工的劳动安全和利益,女员工一经确认怀孕,有义务立即通知人力资源部,符合国家计划生育政策的女性员工按规定享有产假,哺乳假及其他计划生育奖励假。假期的期限和福利待遇按劳动部门相关规定执行,不符合国家计划生育政策的女性员工,请假按病假处理。The pregnant employee who intends to take maternity leave shall give notice to the HR Department and Department Head, specifying the expected date of confinement and the date of c
28、ommencement of maternity leave. A medical certificate by a qualified Medical Practitioner certifying her pregnant must be given.怀孕员工若想要休产假需书面通知部门领导和人事部门,写明预产期和产假开始的时间,且必须附上有效的医院证明。E. Paternity Leave男性员工陪产假All male employees who have been employed under a fulltime contract, within one (1) week follow
29、ing his spouses delivery, which must be in compliance with the family planning policies, are entitled to three (3) consecutive days of paternity leave. A medical certificate specifying the expected date of confinement of the mother must be provided.所有签订全职雇佣合同的男性员工在配偶分娩(应符合计划生育政策)后一周内享受三(3)天的陪产假。陪产假需
30、一次申请,一次性休完。员工需提供注明母亲预产期的医疗证明。F. Other Special Leaves其它带薪假期 A minimum of 5 days notice is required for the following paid leaves, except for unforeseen events such as death of a relative.以下的带薪假期申请需至少提前五天提出书面申请,除非是因不可预见的事件:如亲属的去世。i) Marital Leave: An employee, if getting married and the relevant offic
31、ial registration procedure are made in accordance to the Marriage Law, is entitled to three days wedding leave. If an employee meets the conditions of Late Marital Leave specified by the government, namely: the first time, getting married at the age of 25 and older (for male) or at the age of 23 and
32、 older (for female) (calculated by the registration date on marriage certificate), then he/she is entitled to ten consecutive days of Marital Leave. Marital Leave should be applied for and used up within half a year following the ratification of marriage certificate. When applying for Marital Leave,
33、 the employee shall present his/her marriage certificate to the Company. The Marital Leave as well as the corresponding salary treatment shall be handled in accordance with the stipulations set forth by the labor administrative authorities.婚假:员工结婚,并按国家婚姻法履行正式登记手续,可享受三天的婚假。如果员工结婚时(以结婚证书上批准日期为准)符合国家规定
34、的晚婚条件,即初婚,男二十五周岁及以上,女二十三周岁及以上初婚的,则可享受连续十天的婚假。婚假应在结婚证书批准日期开始的半年之内申请并一次性休完。申请婚假的员工应当凭结婚证书向公司申请。假期及工资待遇按劳动部门相关规定执行。ii) Condolence Leave: An employee shall be entitled to condolence leave in the event of the following circumstances:丧假:正式员工在下列情形下,可以享受丧假:Death of an employees immediate family (i.e. Parent
35、s, spouse, children, brothers, sisters, and parents in-law): 3 working days.Death of an employees immediate family as grandparents and grandparents in-law: 1 working day.员工的直系亲属去世(例如:父母,配偶,子女,兄弟,姐妹以及配偶的父母):三个工作日。员工的祖父母及员工配偶的祖父母去世:一个工作日。Condolence leave cannot be kept (entirely or partially) for futu
36、re use. Salary treatment during condolence leave shall be handled in accordance with the stipulations set forth by the labor administrative authorities.丧假需一次申请,一次休完。丧假期间的工资待遇按照劳动部门相关规定执行。H Overtime Leave补偿假期In general, the Company does not encourage overtime. In the event an employee is required to
37、work overtime to perform his/her own work, an Overtime Working Application Form must be filled in, which shall be verified and confirmed with signature by the department manager in advance and delivered to the HR Department. Otherwise any unauthorized overtime work shall not be recognized howsoever.
38、原则上,公司不鼓励员工加班。如果,员工确实需要通过加班来完成工作,他必须填写“加班申请表”,经得部门领导的预先批准,并交人力资源部备案。否则,任何未经批准的加班都将得不到公司的承认。According to the relevant laws and legal regulations, in the event the employees work overtime on their regular work days or off-duty days, the Company should first try to arrange for compensation leave.
